00:45:51.340 It's never happened in our history.
00:45:52.700 When Richard Nixon was removed, he resigned under pressure.
00:45:56.620 He would have been impeached.
00:45:57.840 But as soon as he resigned, they let him alone.
00:46:00.200 They didn't go after him.
00:46:01.700 The Constitution says the purpose of impeachment is to remove somebody.
00:46:05.560 He's out of office.
00:46:06.760 There's nothing left to do.
00:46:08.100 It doesn't say you can impeach him to disqualify him for the future.
00:46:12.100 It says if you remove him, you can then add disqualification.
00:46:17.360 But you can't just impeach somebody to disqualify him.
00:46:20.760 If they could, they could impeach you and me.

00:46:40.900 So once you're an ordinary citizen, you get tried only in the courts, not in the Senate.
00:46:45.780 So it's clearly unconstitutional.
00:46:48.000 So it's never been done, even with non-presidents in the past.
00:46:52.040 One case back in 1876, and they had a divided vote.
00:46:58.360 It was the former secretary of war who resigned on the eve of his impeachment.
00:47:03.340 And they had a close vote.
00:47:04.640 And they said, yes, they did have jurisdiction.
00:47:06.060 And then they voted to acquit him on the ground that they didn't have jurisdiction.
00:47:09.480 So it's not really a precedent either way.
00:47:12.880 But even if there were a precedent, it would just be wrong.
00:47:15.580 The Constitution doesn't permit it.
00:47:16.940 So does the president, switching topics to the Capitol break-in, does the president have any legal responsibility for this?
00:47:27.360 Let me tell you why not.
00:47:28.820 So there were thousands and thousands of people listening to his speech.
00:47:32.560 From that group, only a relatively small number went to the Capitol.
00:47:36.520 They all went legally, initially, protesting in front of the Capitol is perfectly legitimate.
00:47:41.400 From the group that was there legally, an even smaller group went inside.
00:47:45.960 They committed a crime.
00:47:47.580 Among those people, an even smaller group destroyed property.
00:47:50.880 And an even smaller group engaged in violence against people.
00:47:54.760 So to say that the president directly caused what went on inside just ignores the facts, ignores the facts.
00:48:04.480 I have been, I started warning when Donald, I mean, sorry, when George W. Bush was in office, be very careful about domestic terror and the Patriot Act and how it can be used by one side or another to claim its enemies are domestic terrorists.

00:48:28.880 Is anything going to stop this madness?
00:48:31.260 Well, let me tell you, I got a call from a friend of mine in Israel who was so insulted that people used the word terrorism to describe what happened in the Capitol.

00:48:43.400 It's going to a school in Malut and murdering 34 children in cold blood.
00:48:48.060 It's blowing up an airplane.
00:48:49.460 It's blowing up a bus.
00:48:51.040 It's designed just to kill civilians.
00:48:53.820 That's what terrorism is.
00:48:55.340 This was not terrorism.
00:48:56.900 This was not insubordination.
00:48:58.280 This was not a resolution.
00:48:59.660 This was not an insurrection.
00:49:01.760 This was a violent riot.
00:49:04.180 And the people who did it should be punished.
00:49:05.660 But let's not elevate it above what it actually was.

00:49:32.400 Well, there's some on the left, too.

00:49:52.620 But terrorism has a particular meaning.
00:49:55.400 It's designed to kill civilians, to target civilians, in order to bring about a change in government policies.

00:50:08.080 Tragically, they died, along with police officers.
00:50:10.620 But it was not an act of deliberate domestic terrorism.
00:50:15.500 There may have been among the group some domestic terrorists, some people who are part of a terrorist organization.

00:50:25.240 But remember, the president used two words, peacefully, patriotically.

00:50:32.980 When he says that, he obviously was appalled when the people committed the crimes they committed.

00:51:00.420 And they're talking now about the fairness doctrine to get rid of people like me, who they say are inciting violence and domestic terrorism.

00:51:12.240 And we are already seeing companies and everything else starting to back away, saying, it's just too dangerous of a situation.

00:51:22.340 Well, it's just like McCarthyism.

00:51:25.220 But the people in power said to private citizens, don't have any association with anybody who's red, pink, anybody who we accuse and think is not a core American.

00:51:39.080 They established television restrictions, movie restrictions, blacklists.

00:51:47.300 We're seeing it now on university campuses where they're trying to rescind the degrees of students who they don't like because they were associated with the Trump administration.
00:51:58.260 They're trying to rescind my emeritus professorship, which I earned for 50 years of teaching because I defended the president on the floor of the Senate, which was a great privilege for me to do as a constitutional lawyer.
00:52:11.100 And there's no stopping them unless we stop them now, because they're our future leaders.

00:52:22.720 I use the word fight back.
00:52:25.000 People will say, well, he must be asserting violence.
00:52:28.320 Fight back is a metaphor.
00:52:29.720 It just means that we have to resist and we have to answer in the marketplace of ideas.
00:52:36.280 I fight back by writing articles and by doing our shows like this and expressing my points of view.
00:52:41.860 But we can't just take it sitting down.
00:52:43.640 We can't just accept a new McCarthyism and a new form of censorship.
