00:03:26.140 And let's talk about this trial in New York to begin with against the President of the United States.

00:03:35.380 Every legal mind I'm aware of who is in any way a leading professor, a leading attorney,
00:03:44.040 has said that this is a mockery, what is happening in this New York, this Manhattan courtroom.

00:03:51.540 Yeah, it's, Lou, you know that I used to practice law in the New York court system.
00:03:56.140 So I'm familiar with the procedures and the operations of it.
00:04:00.920 The idea that Alvin Bragg, the Soros-backed attorney, District Attorney Alan Bragg,
00:04:07.780 would bring, you know, three dozen felony charges against Trump when, you know,
00:04:15.180 if you sort of look honestly at the facts, you know, what could he have brought?
00:04:20.240 Well, maybe a misdemeanor charge or two, you know, for business records.
00:04:24.400 But, you know, even the state was not at all harmed by that.
00:04:28.400 You know, these are like jaywalking charges that, you know, that a legitimate attorney could have brought.
00:04:34.220 But instead, you know, 37 felony indictments.
00:04:38.760 This is just bizarre.
00:04:40.280 And, of course, it's well documented now that the judge is also a politician,
00:04:45.160 a politicized figure who's given money to Joe Biden and his daughter makes money.

00:04:52.880 It really is damaging to our entire system of government that one of the most important branches of our system,
00:05:02.940 our judicial system, has been so corrupted.
00:05:07.060 Well, you know, the question then becomes, why is it that no one in the New York appellate courts,
00:05:14.040 no one in the Supreme Court of the New York,
00:05:18.580 the judiciary has not come down like a ton of bricks on Alvin Bragg and Judge Merchant.
00:05:27.160 Because what is interesting here is the American people right now, by a vast majority, know and say that this is all politically motivated.
00:05:38.820 And what we're watching is the dismantling, as far as I'm concerned, of the integrity, the trust in the New York judiciary.
00:05:50.020 New York looks like a bunch of rubes, fools, and charlatans as well.
00:05:56.260 This is the most rigged judiciary, in my opinion now, outside of the D.C. federal courts that we've witnessed so far.

00:06:06.380 The left is always so good at using the rules that the rest of us live by and turning those rules against us.
00:06:16.360 So, you know, when can a party appeal?
00:06:20.940 Well, it depends on the issue.
00:06:22.120 But basically, procedural motions, you know, of the sort you're describing, have to wait until after trial is over, you know, under the law.
00:06:30.200 And so the president is really caught in a tough predicament.
00:06:35.760 It's a predicament created by the left, obviously for political purposes.
00:06:39.660 You know, in the end, you know, a small number of Manhattan voters showed up at the polls to elect Alvin Bragg, this radicalized prosecutor.
00:06:49.140 In some respects, this sits on the shoulders of all those New Yorkers who allowed this guy to get put in office.
00:06:57.220 You know, a radicalized Marxist kind of person who's going to use the power of the police state to attack his political opponents.
00:07:02.640 And when will anyone in the judiciary, the state of New York, the state of Georgia, perhaps the Supreme Court, when will they intercede?

00:07:17.320 Because, as you say, the rules of procedure call for, you know, someone to be hanging by a rope after the fact, and instead of cutting down that rope.
00:07:32.780 This is absolutely, on its face, barbaric, what we're witnessing.
00:07:37.800 And for there to be a procedural, some sort of, suddenly we're worshiping at the book of procedure, rather than, you know, the Bible, you name it, the Ten Commandments.

00:08:00.380 And in New York, there is no room for decency.
00:08:02.860 Well, you've just hit on a thread I was going to go down.
00:08:06.660 When you mentioned the Ten Commandments, our First Amendment is comprised of five elements, one of which is freedom of the press, another is freedom of speech.
00:08:15.380 Freedom of speech was recognized as a God-given right and enshrined in our Constitution, recognizing that right is inherent to us as human beings.
00:08:26.280 Freedom of the press, you know, there was no belief that that was a God-given right.
00:08:31.240 Instead, it was a practical understanding that the press has a role in our system of government to hold the powerful accountable, whether the powerful are incumbents in government or the powerful are university presidents.
00:08:45.060 So ordinarily, the press would be doing its job.
00:08:48.920 When there's some radicalized prosecutor, the press would be putting a spotlight on that radical prosecutor, putting pressure on that radical prosecutor.
00:08:56.380 And those prosecutors would then back off, knowing if they persisted, they could be impeached, lose their jobs, come under ethics charges.
00:09:05.200 But our media, ABC, NBC, CBS, NPR, Washington Post, New York Times, et cetera, they have not only defended Alvin Bragg, they've declared him a hero.
00:09:16.660 You know, where's the media in all of this?
00:09:20.160 Because, look, in the end, the media has decided that Donald Trump must not be reelected.
00:09:26.720 And they are using this same system for their political aims and goals.
00:09:31.300 And that's all well and good.
00:09:33.200 But the reality is we come back to the court system and to the prosecutorial system in the state of New York.

00:09:45.580 It's one thing for them to be I always get a kick out of the quaint expressions.

00:09:55.220 We don't have a justice system right now.

00:10:06.320 And no one is taking leadership, taking responsibility to intercede, to stop the political persecution of a president that is now in its ninth year, whether it be from the FBI, the Department of Justice, the intelligence communities, whether it be state jurisdictions, whether it be local jurisdictions.

00:12:25.720 Dan, you were part of the transition team for Donald Trump in 2017, 2016, and 17.
00:12:37.740 Give us your sense of just where things went off the rails, if I can put it in somewhat.
00:12:46.020 I don't think it's hyperbolic.
00:12:47.480 I mean, it went off the rails.
00:12:48.400 We had Chris Christie, the governor of New Jersey, leading the transition, who was a rhino.
00:12:54.160 And I mean, and suddenly, you know, he's in, you know, he's in absolute apposition to the guy he's supposed to be helping.
00:13:04.280 That is, President Donald Trump.
00:13:07.880 That moment was the basis for a lot of mistakes that followed through in the administration.
00:13:14.900 That is, the selection of people who were not appropriate for the roles they took and who actually were fighting this president.
00:13:21.460 Yeah, you know, some of the assets that the president brought, President Trump brought to the table is that he didn't know how Washington worked.
00:13:29.860 And he was willing to break glass and, you know, knock down doors to get his stuff done.
00:13:34.640 But that was also his weakness, not knowing the town, not knowing how things operated, who to trust.
00:13:42.040 Yeah, I was on transition.
00:13:43.500 I was, you know, I oversaw the appointments to several agencies initially.
00:13:49.860 When I say appointments, the selection of candidates during transition, that all, of course, shifted to the White House as soon as President Trump was sworn into office.
00:13:58.780 But one, I had a couple really important rules that I gave the leadership of the transition team.
00:14:05.720 Number one, do not keep any Obama holdovers.
00:14:10.020 And I cautioned them, you're going to be told that there are some people who are mission critical.
00:14:14.140 And until their replacements can be formally nominated and confirmed by the Senate, you've got to keep them.
00:14:20.480 And I implore them, under no uncertain terms, can you keep any of these people?
00:14:26.980 Find career bureaucrats to make as acting.
00:14:31.360 And that was my first rule.
00:14:33.780 And, you know, those folks didn't understand that.
00:14:37.140 And they kept Obama's deputy attorney general in place.
00:14:41.840 And, of course, she then orchestrated the whole Russia hoax thing.
00:14:45.580 My second rule was, whoever you select attorney general.

00:14:50.860 She was Obama's deputy attorney general.
00:14:52.820 And she was in that acting role for about two weeks, long enough to work her magic to create the impression that Donald Trump and the incoming attorney general had broken the law, working with Russians in advance and all that nonsense.
00:15:09.520 It's also, to me, interesting that there was so much confusion within the president's team, whether it be Jeff Sessions, whether it be Chris Christie, you name it, the people who were seemingly there for him and who then just as seemingly looked to be in just absolute counterpoint to him.
00:15:38.600 Do you see any sign that things are much, much better this time as we approach Election Day?
00:15:46.540 Look, Donald Trump made a lot of mistakes early on in his administration with regard to the selection of people for senior roles.
00:15:54.420 And he's learned a lot.
00:15:58.000 And so I think that if he's reelected, he's going to do a better job selecting people early on for those roles.
00:16:05.100 And do you know whether or not and I don't know this and I guess, you know, I know the president fairly well.
00:16:12.580 We're friends, but I I don't really know what preparations he's making for the the White House that I believe he will take back.
00:16:24.760 And the country better pray he takes it back.
00:16:29.540 But I don't know how much thoughts right now is going to an energy going to because of the campaign, naturally, to how he's going to staff out that that second term.
00:16:41.680 Do you have any idea?
00:16:45.160 Well, I would hope that Donald Trump himself is spending zero time thinking about people to to serve in his administration.
00:16:53.240 He needs to focus on staffing up the people and working with groups, think tanks, you know,
00:17:03.380 whomever it may be to really have some significant work done for the transition before there's a transition.
00:17:11.260 Yeah. So there are two groups that are really focused on this right now.
00:17:14.740 The Heritage Foundation is leading a coalition effort with lots of conservative groups.
00:17:20.800 And and I think that's that's an unprecedented effort in the past.
00:17:25.900 Some of these organizations have come up with stacks of resumes, but those stacks have not been helpful largely.
00:17:32.200 The Heritage Foundation and others are working much more diligently and carefully and strategically to do that.
00:17:38.380 But then there's also the think tank that's connected to Donald Trump that's comprised mostly of of sort of the loyal members of his administration.
00:17:48.000 So both of these efforts should put the president in good stead if he were to get reelected.
00:17:53.020 One hopes.
00:17:54.380 And the Heritage, you know, working with him for famously for his list of justices for the Supreme Court.
00:18:04.200 I mean, all I think of is now Amy Coney Barrett and what a disappointment she is and what she turned out to be.
00:18:13.160 It is really breathtaking to see, if you will, a big miss like that and a miss that we can't afford, frankly, to make again.
00:18:25.280 Yeah. It's really hard to screen these intellectuals who are right of center judges because it's, you know, look, they're super smart.
00:18:38.060 And, you know, I've I've you know, I used to practice law.
00:18:42.620 I was not one of these brainiac, super smart lawyers, and I'm kind of proud of that.
00:18:47.480 I've only known a couple of these super smart lawyers who actually have political savvy at all.
00:18:54.540 And so much of these hot button issues require not just an academic reading of the law and the text, but also an understanding of real implications to society.
00:19:06.160 And that's where so many of these fuzzy headed brainiacs just go wrong.
00:19:10.320 I love the way you called them super smart and brainiacs, because scholars of the of the group, I guess the only one I would consider, frankly, a scholar is Gorsuch, frankly, of the three that he brought in, Kavanaugh and Barrett.
00:19:33.200 But, you know, smart, but super smart. I'm not so sure.
00:19:37.320 And savvy. I know I know that she is not in Kavanaugh has been just been just worked over.
00:19:45.880 I mean, the man has been it's just awful the way he's been treated by the left.
00:19:52.660 And and and one can't imagine them not being to some margin intimidated by the mobs that Schumer sent over to to rattle them and to intimidate them.

00:21:54.220 This is a country that is watching the media fail.
00:21:57.480 It's watching, and by the way, when I say fail, I mean it fails the American people.
00:22:03.920 It's succeeding by its own measures, certainly the corporate measures in this country.
00:22:09.260 We see corporations, Facebook, as you and the Media Research Center have chronicled.
00:22:15.600 I mean, overwhelming interventions in the elections in this country since 2020.
00:22:23.840 It's difficult for me to imagine why it's not clear as vivid and stark what a threat corporate power is in this country and what has been and how that power has been used, particularly against Donald Trump, for crying out loud, against our political system.
00:22:45.820 Yeah, Lou, I'll just say that you're the first person to sort of open my eyes about the threat of corporate America, big corporations.
00:22:56.680 For so long, the idea of for-profit corporations, conservatives saw that as corporations' allies, as good things.
00:23:07.340 And it used to be that these corporate CEOs usually were kind of right of center and pro-freedom, and that's no longer the case.
00:23:14.560 And so now these big corporations are controlled by the left, and those resources are being used to attack the idea of America, the very founding principles of our democracy.
00:23:27.000 And the worst among all of them, of course, are the big tech platforms.
00:23:32.100 A few weeks ago, we released our big Google study showing how Google swayed anywhere from 6 to 8 million votes and interfered in our elections 41 times in really dramatic and significant ways.
00:23:44.560 Including burying all the Republican presidential campaign websites, except for Will Hurd, who, you know, never broke 1% of the polls.
00:23:52.960 And now we've just released our latest big tech study on Facebook, showing how it has interfered in elections 39 times in recent years, especially in 2020.
00:24:05.060 And to think that so many people in the country, and of course, most of them are on the left, they're Marxists, they're leftists, far left.
00:24:19.380 For them not to understand this is really being hidebound to an ideology and sacrificing their reason, their powers of comprehension and perception.

00:25:15.740 My goodness, Joe Biden and his administration just a month ago in the Supreme Court was arguing that the government and big tech both have First Amendment free speech rights to censor Americans who disagree with the president.

00:25:34.440 Joe Biden's argument is that government has the right to control our speech.
00:25:39.440 Yes, and he's not kidding, as the saying goes.
00:25:43.300 He is absolutely asserting that.
00:25:46.120 And the new head of NPR, saying that when asked about the First Amendment, this is the woman taking over NPR, tax funded leftist outlet that it is, saying, you know, it gets kind of tricky with that First Amendment.
00:26:03.860 And it's supposed to get tricky.
00:26:06.060 It's actually supposed to get tricky like a stone wall around each citizen.
00:26:15.040 And instead, it gets tricky.
00:26:17.740 And you can tell that she was, I mean, we're talking about globalists, elitists, who think somehow they have a God-given right to tell the rest of us exactly what to do, irrespective of our system of government, irrespective of our Constitution.

00:26:38.020 And by the way, they've got some idiots completely convinced of that.
00:26:41.920 And they are the people who are the martyrs to D-E-I-C-R-T-E-S-G and the nonsense of systemic.
00:26:52.480 If you use the word systemic as an adjective, I've noticed for racism, systemic racism, it buys you at least a 40 percent greater percentage of absolutely credulous fools.

00:27:13.160 Your thoughts about right now, media and what can be done to resurrect even whatever it would take to actually resurrect an objective, active, passionate, patriotic press.

00:27:43.080 And, Lou, I say this as you were talking, I was trying to think, is this accurate?

00:27:48.720 There's no journalist in the last 30, 40 years who has been more responsible for filling his or her role under the Constitution than you.
00:27:59.680 I was in the Bush administration for eight years and, oh, you would just go after us in the Bush administration.

00:28:08.300 But then you did the same thing in the Obama administration.
00:28:11.000 And you did the same thing during the Trump administration.

00:28:16.600 And, Dan, just for the audience's benefit, I got blackballed by the Republican Bush administration.

00:28:28.620 I got fired by CNN, a liberal network.

00:28:40.240 So, you know, if I could appoint you czar of the media and say, OK, media, get back to doing your jobs.

00:28:55.480 The role of journalism is, in fact, constitutionally, I don't want to say mandated,
00:29:03.080 but there's a constitutional responsibility of the media to hold the powerful accountable.

00:29:11.800 Today, the great bulk of media are cheerleaders and advocates for left-wing government.
00:29:19.900 And, of course, there are plenty of conservative outlets that do the cheering of the right.
00:29:24.680 And we've always had media that's partisan from the start of our nation's founding.
00:29:29.920 But it's always been sort of balanced, equal, equal on the left, equal on the right,
00:29:34.380 with plenty of journalists just doing straight journalism.
00:29:38.040 And today, you know, I can think of like three journalists who do what you do.
00:29:44.420 And one of them just got fired by CBS for doing her job.
