Special Counsel Jack Smith may have no authority to act as Special Counsel. Former Attorney General Ed Meese and others say Merrick Garland unlawfully appointed Smith and didn t have the authority to do so. That Congress created no such office. That s only Congress can create federal offices such as special counsel, and has not done so. And if they had, the President would be required to appoint them, not an Attorney General, and his appointment would require confirmation by the Senate.
