00:01:16.400 American Wade, appointed to uphold the rule and the value of our American laws. Turns out,

00:01:25.380 haven't exactly been doing that. Now, John Roberts, of course, one of them

00:01:28.480 we've all known about. Andy Coney Barrett, I think, is the one who managed to fool everybody.

00:01:37.200 And the big case, I guess we'll start off talking about today, is the birthright citizenship.

00:01:41.660 I want to bring a clip up that President Trump, just a few months ago, he didn't seem too optimistic that they were going to rule in favor of truth, justice in the American way.

00:03:14.140 Birthright citizenship, which is one that we've all been waiting on. I mean, we've sat here and

00:03:18.920 we've watched for years as presidents have used and abused this case, as migrants have come in 0.61

00:03:27.080 and used and abused this case. This one should have been a layup for the Supreme Court. This 0.91

00:03:31.780 should have been perhaps the easiest one yet but they didn't take it that way so this case was

00:03:38.940 president trump's executive order that was limiting birthright citizenship for children

00:03:42.900 born in the u.s to parents who are unlawfully present or only temporarily here and violates

00:03:50.480 citizens clause of the 14th amendment children born in u.s soil to such parents are subject

00:03:55.920 to jurisdiction of the United States and citizens at birth

00:03:59.120 while rejecting the executive order's broad new exceptions

00:04:05.000 in a 6-3 ruling striking down that executive order.

00:04:12.760 None other than Chief Justice John Roberts wrote the opinion,

00:04:20.860 Same human being who wrote, of course, the opinion on Obamacare and allowed that to stay.

00:04:29.140 Now, joining with him were Justices Sotham Anur, Justices Kagan, Jackson, and, of course, Amy Coney Barrett, forming the six-vote result.

00:07:50.940 This is his separate dissent.

00:07:52.120 He said the court's interpretation also has national security implications.

00:07:56.700 Suppose that a person's only connection to this country is that he was born here to a

00:08:01.000 mother who was present just long enough to give birth and then quickly return to her

00:08:05.240 native country.

00:08:06.360 Suppose that country is a strategic adversary or enemy of the United States.

00:08:11.500 Suppose the child never visited the United States while growing up and was inculcated with hatred of this country.

00:08:17.700 According to this court, now, that person is a citizen of the United States.

00:08:22.100 He can enter and leave the country as he pleases. He can travel the world on a United States passport.

00:08:27.780 Even if he plots to harm this country, he cannot be deprived of his status as a citizen, at least under current precedent.

00:08:34.420 He goes on to say that this this decision today also provides a powerful incentive to enter or remain in this country illegally.

00:08:43.860 He goes on to say, in my judgment, the court has made a mistake that will seriously affect the country's future.

00:08:49.200 So some very pointed dissents here from those who raised these very big concerns during the arguments and their real world scenarios, which are not a fantasy.

00:09:00.520 They're not a movie. I mean, these things that can actually happen now under this ruling that you have today from the majority.

00:10:59.420 up in the Congress through legislation with the support of the president that now is determined

00:11:04.920 during this process. No long unwieldy constitutional amendment is necessary. Congress should start

00:11:11.620 today to work on ending the expensive and unfair

00:11:14.920 to our country birthright citizenship. They will have my complete and total

00:11:19.500 support, President Donald J. Trump. Now, that's promising news.

00:11:23.760 The only problem is, is what can be done in Congress can also be undone

00:11:27.720 by Congress. Now, I just want to go back to

00:11:31.040 Justice Thomas and Gorsuch agreeing

00:11:34.840 in their own dissent together, arguing that the majority's

00:11:39.960 historical account inaccurate and that the clauses require more to be produced.

00:11:45.800 So Gorsuch and Thomas, Thomas always one of the good guys.

00:11:51.500 Gorsuch has erred on the side of good Alito, another one who's been such a force.

00:11:58.640 And the day that he and Thomas decide to retire,

00:12:02.100 I think is going to be a really horrible day for the court.

00:12:05.620 I think we all hope those people could live for another hundred years to try to save this country as much as they could.

00:12:14.660 Now, Kavanaugh and his little weak descending argument noted Congress could potentially legislate exceptions.

00:14:49.040 Rand Paul this afternoon expressing his strong, strong disappointment after the Supreme Court decided to uphold birthright citizenship.

00:15:00.400 And instead of sitting on his hands, Rand Paul has already filed an amendment to fully end birthright citizenship for those who are in this country illegally. 0.92

00:17:40.340 how to hide their pregnancies

00:17:42.060 from immigration authorities.

00:18:12.340 Was sentenced to 27 months imprisonment

00:18:15.280 For aspiring to commit health care

00:18:17.380 And wire fraud in connection

00:18:18.660 with birth tourism scheme that Eskal operated in New York.

00:18:24.840 This man and his co-conspirators advertised a birth tourism scheme

00:18:28.600 on two Turkish-language social media pages.

00:18:32.200 As part of the scheme, Eskal and his co-conspirators instructed women

00:18:35.240 to conceal their pregnancies from immigration authorities.

00:18:39.060 In addition to the prison term, Eskal was ordered to pay restitution

00:18:44.200 the amount of over a million dollars and forfeit the amount of nearly $400,000 that was made.

00:18:52.380 These are just two examples, folks, and happens probably each and every day in this country.

00:18:59.040 So moving past the third case that they give, they move on to say the Department of Justice

00:19:03.260 will investigate and hold accountable those who engage in this unlawful conduct,

00:19:08.660 as well as those who solicit and sell criminal services to others.

00:19:12.500 They say they're directing all U.S. attorneys and criminal divisions to work with the Department of Homeland Security to prioritize investigations and prosecutions of tourism birth schemes.

00:21:42.480 and closely drawn scrutiny to prevent circumvention

00:26:20.420 Next, after the first Monday in November as Election Day, provided that elections for federal office must be held on that date, noting that the electorate must be in accordance with the federal day statute makes it a choice on Election Day, not Election Week, not Election Month, not Election Season.

00:26:38.240 If the ballots received after election are added to the set of ballots that dictate the election outcome, the electorate choice does not occur on election day, and the federal election day statutes are violated.

00:26:55.120 The acceptance of these late-arriving ballots effectively postpones the date on which the electorate choice is made, and the federal law precudes that postponement.
