00:01:22.460 you with us. Good news out of D.C. this week. President Trump's election interference case
00:01:27.240 in Washington, D.C. postponed indefinitely. The Marxist Dems planning to persecute Trump
00:01:34.420 and interfere with the 2024 election just isn't working out quite like they figure. It seems
00:01:40.620 almost every Biden administration employee is a regurgitated, recycled Marxist who previously
00:01:47.000 worked either in the Obama White House or the DNC. Good old John Podesta will take over for departing
00:01:53.200 climate czar John Kerry. One Marxist fills in for another Marxist. Our first guest today is
00:01:59.500 investigative reporter Julie Kelly. And Julie, great to have you back with us and congratulations on
00:02:04.860 all of your great reporting. It's good to talk with you. Apparently, these Marxists are sticking
00:02:10.060 together in our judiciary. Maybe they'll go down together. What do you think? Right. So this is the
00:02:16.560 appeal of Judge Chutkin's broad gag order that she imposed against the president and his legal team
00:02:23.320 and others. She imposed that in August of last year. So, of course, Trump's team appealed that.
00:02:29.400 Uh, it went to, um, the, uh, three, uh, three judge panel, the appellate court and the appellate panel,
00:02:38.440 of course. Now I will say they did strip away quite a bit of Judge Chutkin's gag order. I was actually
00:02:45.460 surprised. They did tell her to remove special counsel, Jack Smith, um, from being criticized by the
00:02:53.560 president saying he's a public servant. He's a public figure and he is subjected. He,
00:02:58.400 to public criticism of his work. So they did gut her gag order quite a bit, but overall they upheld it.
00:03:07.000 This was the three judge panel. And then what happens, Lou, is then the Trump's team,
00:03:13.520 the appellate can go back and ask for the entire DC circuit court to hear the arguments against the gag
00:03:21.340 order. And that's what was denied. So that's really just the next step in the process before,
00:03:28.400 Trump's lawyers then can file cert before the Supreme court and have them take up the issue.
00:03:34.960 So it's more of a procedural issue. I'll tell you, Lou, the DC circuit court is packed with Obama
00:03:40.660 appointees really wouldn't have mattered if what they call the N bonk, the full court would have heard
00:03:46.540 this. They're going to uphold Judge Chutkin's order, uh, the framework of it anyway, just as this
00:03:52.360 panel did. So not a huge loss, but it does enable Trump's team now to go to the Supreme court.
00:03:58.840 Well, at least, at least there is a, something of a Pyrrhic victory in that, uh, he can still lambaste,
00:04:05.420 uh, the junkyard Jackal, Jack Smith, the special counsel, uh, that has to hearten him secretly,
00:04:13.100 if not, uh, uh, publicly, uh, I would think he would feel that way. Uh, where does it,
00:04:19.100 do you really think it goes to the Supreme court? Do they take the case?
00:04:23.200 You know what, Lou? I don't know. The Supreme court, um, is being inundated as you know,
00:04:30.100 with Trump cases, 2024 election cases,
00:04:33.840 and other matters dealing with the DOJ's prosecution of January 6th. So they already
00:04:39.940 have quite a few issues on their docket. We know that, um, next month they will hear the,
00:04:46.760 uh, the lawsuit seeking to overturn the Colorado Supreme court ruling that removed Trump from the
00:04:53.080 ballot. We also know that the Supreme court has accepted, um, hearing the appeal of the 1512 C2
00:05:02.080 obstruction of an official proceeding felony. That's been charged slapped against more than 300,
00:05:06.440 January 6th defendants and represents half of Jack Smith's four count indictment against Trump in
00:05:12.040 Washington. Those oral arguments are expected to be scheduled for either March or April. Um,
00:05:19.360 there are other things. We certainly know the presidential immunity appeal, um, that was heard
00:05:26.200 by three judge panel on January 9th, uh, where we are fully expecting that to end up at the Supreme
00:05:33.360 court as well. So will they grant cert in this gag order, um, to, to consider this? I don't know. I
00:05:41.220 mean, the Supreme, they can't really, I guess they could take up everything. Will they know because
00:05:45.960 they're a political body as we know. So they may just let it stand. I'm not even a hundred percent
00:05:51.540 convinced Trump's lawyers will take this to the Supreme court because in its current form, yes,
00:05:57.220 it's unfair, but it is, uh, workable in terms of criticizing Jack Smith, criticizing the DOJ,
00:06:05.080 um, criticizing the judge. So there are limitations, but nothing that's overly, um, I think restraining.
00:06:13.760 So what is he, uh, left with in terms of, uh, uh, being prohibited from speaking? Uh, it's a,
00:06:22.700 it, the gag order, it seemed to me was motivated primarily by Chutkin and, uh, Jack Smith wanting
00:06:28.460 to preserve their, their sensitive little selves from the tongue lashing of Donald Trump.
00:06:35.020 That's true. And that is why it was sort of amusing to see the, uh, three judge panel. I believe,
00:06:42.340 and I'm writing on something now, I think they were all Democrats actually. Um, and these two of
00:06:47.800 them were Democrats who expressed skepticism at the breadth, at the, at the scope of judge Chutkin's
00:06:54.880 gag order. And as I said, gutted major parts of it. So he is able to speak, but keep in mind, Lou,
00:07:01.980 you know, all of the proceedings for the January 6th trial in Washington right now are on hold
00:07:08.480 until they can settle the presidential immunity question. Um, so this March 4th trial date is,
00:07:17.800 pretty much off the books and judge Chutkin kind of admitted that recently. Um, so it seems like
00:07:23.900 the gag order issue, again, I don't know what team Trump is going to do, but we can see what Donald
00:07:28.720 Trump's, uh, you know, speeches, uh, he's not feeling too constrained. Um, so I think the gag order
00:07:35.960 is less, less of a concern to them now that the appellate panel weighed in. And as I said, changed a
00:07:42.840 lot of what judge Chutkin originally ordered. You know, speaking of, uh, gag orders and gag orders
00:07:49.640 that don't work anger on in the New York state court, judge anger on losing control of his court
00:07:57.420 as, uh, final arguments of, uh, are unfolding, uh, Donald Trump taking over the courtroom as he's
00:08:06.220 defying the judge's direct order. Uh, he goes after everyone in the room. He does it, uh, intelligently.
00:08:13.820 He does it, uh, firmly. Uh, and it was just remarkable to see, uh, Donald Trump take over
00:08:21.000 that courtroom and the judge, the judge have no control and had no way in the world in which to
00:08:27.180 deal with it because every word that, that, that, uh, in my opinion, president Trump uttered
00:08:32.140 was absolutely true. Uh, that's just, that was just a remarkable performance. And I would think
00:08:37.500 that would scare the Dickens out of federal judges. Well, look, I think overall Lou, the American
00:08:44.700 people, especially people on the right, uh, are fully aware of the corruption of the department of
00:08:51.540 justice and what they are capable and willing to do to not just take down Trump, his associates like
00:08:57.740 Steve Bannon and Peter Navarro, who were convicted of contempt of Congress and now 1200 plus Trump
00:09:03.760 supporters, mostly Trump supporters who have been raided, arrested, um, charged and, you know,
00:09:11.240 taken plea deals or convicted by a DC jury for January 6th. But I think more broadly, Lou, people
00:09:17.860 are waking up to this crisis we have in the judiciary and these activist judges, whether it's someone like
00:09:25.260 Tanya Chutkin, who is the Obama appointee or anger on, or some of these other judges that we can't trust
00:09:34.780 the judiciary to protect the rights of defendants, especially if his last name is Donald Trump
00:09:40.860 or tied to Donald Trump, um, and protect the defendants rights and, and reign in and out of control
00:09:50.300 DOJ or state prosecutors to make sure that they are enforcing the laws equally. That is the job of a
00:10:01.760 judge. And I think just overall, this has been a big wake up call for those on the right who still,
00:10:08.360 you know, maybe think that the DOJ and these state prosecutors and these judges are acting the way
00:10:16.960 that we expect them to. And that just isn't the case. And so this is just another institutional
00:10:23.480 crisis in America due to the politicization of, uh, of these institutions and the judiciary in
00:10:31.360 particular. We're talking with the great investigative reporter, Julie Kelly, uh, at a real clear
00:10:38.780 investigations, uh, and you, uh, you read her all over and you hear about her here on the, uh,

00:12:01.040 I was, it was remarkable that they did not have arguments beforehand, uh, that they did not, uh,
00:12:06.540 hand down opinions, uh, with their ruling, uh, five, four decision. Uh, it's stunning because of the
00:12:13.080 magnitude of what they did inciting, uh, with basically the most corrupt presidential, uh,
00:12:18.560 regime in American history against, uh, a, uh, a robust, uh, and, uh, and resolute state government,
00:12:27.600 particularly in the person of, uh, uh, governor Greg Abbott, your, your thoughts on what, what
00:12:33.880 motivated the Supreme court in doing this. So Lou, I have to say, I haven't followed this closely.
00:12:41.360 I did see the headlines. My understanding is that there's more to come on this lawsuit. Um, but I
00:12:48.480 think it speaks to the frustration, uh, that the right feels, especially the MAGA base that we can't
00:12:54.360 depend on the Supreme court. Certainly not these judges who everyone fought so hard for, including
00:13:01.040 Amy Coney Barrett to get seated on the Supreme court, only to be disappointed once again, by their
00:13:07.840 decisions. And this goes back to, of course, their failure to address any of the election lawsuits
00:13:14.300 filed in 2020 or 2021. Um, they just don't seem to have the courage to take on these big fights
00:13:22.240 that we need them to, and be the stop gap for this lawless regime that is really putting our
00:13:30.040 country in jeopardy. So, you know, I, I think that it's just one more example of the right being
00:13:37.100 disappointed in these judicial picks. And it's certainly understandable. Yeah. I, I, I think my
00:13:44.340 first thought was, was that I was going to be, I thought I would be disappointed, but I didn't think
00:13:50.480 it would be on anything near this measure. Uh, and so now I'm just outraged. Uh, I am angry. I am
00:13:56.540 furious with the Supreme court because it has become a joke like every other, uh, part of our,
00:14:02.220 our government, uh, right now, as it stands with that five, four decision, the Supreme court has now
00:14:07.620 aligned itself with the Biden regime, the corrupt justice department, uh, the corrupt FBI, the corrupt,
00:14:15.000 uh, intelligence community. Uh, I can't find anywhere to turn to, to any agency within any
00:14:21.400 department that isn't run by Marxist Dems. Uh, they cited in this decision straightforwardly,
00:14:27.420 uh, uh, with the Mexican drug cartels that are killing a hundred thousand, at least a hundred
00:14:32.840 thousand Americans a year without consequence, without response from the United States. Uh, this is a court
00:14:39.040 that is now, it appears, uh, absolutely a tool, uh, the Marxist Dems. Well, let's hope that they
00:14:49.540 changed, changed course a little bit as these legal matters related to Trump and January 6th and the
00:14:55.880 2024 election end up on their docket. Um, we really need the Supreme court to reverse how the DOJ has been
00:15:05.720 using 1512 C to obstruction of an official proceeding, the post Enron felony. Um, they really
00:15:11.900 need to reverse that and give the DOJ and all these federal judges a well-deserved over do smackdown
00:15:20.600 for the weaponization of that evidence tampering law that has turned peaceful protesters into convicted
00:15:27.420 lifetime felons. So we need them to demonstrate some courage on that. We of course need them to
00:15:33.400 demonstrate courage on this Colorado Supreme court issue that will be before them next month and
00:15:40.360 other things, other matters, especially presidential immunity from criminal prosecution. This will be
00:15:45.720 a landmark Supreme court decision, just like the decision by Obama appointee, judge Chudkin arguing
00:15:53.720 that a president's acts in office can be subject to criminal prosecution. That's a first.
00:16:00.120 So the Supreme court will have to weigh in on that as well.
00:16:03.400 We will need more courage from them. So let's, let's hope that they demonstrate that because
00:16:11.320 these are going to be permanent decisions with a permanent lasting impact on the country.
00:16:19.320 Not the very least of which is, will we continue now start the spiral where presidents prosecute
00:16:28.520 their predecessors try to throw them in jail on bogus charges, just like we see in banana republics.
00:16:34.920 Is that the future for this country? That will be a decision made by the Supreme court.
00:16:41.000 Unfortunately, it's, it's our present reality. Uh, this is all contemporaneous. We are watching a,
00:16:47.960 a corrupt federal government. Uh, there is no question whatsoever about who controls the government in
00:16:54.600 every quarter. And that is the Marxist Dems who control the Democrat party and the deep state.
00:17:00.920 Do I wish that they would grant complete immunity to a sitting president? I don't see any other
00:17:07.720 intelligent answer to the question. Do we want a president not to be immune to prosecution? I think
00:17:14.520 the answer is absolutely yes. Uh, we're, we're watching a court system as you said, and I think
00:17:20.200 it's fascinating because I hadn't really thought about it the way you expressed it. This court system,
00:17:25.480 the federal court system is inundated, but the DC court system is inundated with all sorts of actions
00:17:34.120 from plaintiffs and prosecutors, uh, seeking some sort of resolution that all stems from the, the
00:17:42.120 anarchy of the 2020 presidential election. Uh, I, but to think that they're the ones who are burdened
00:17:50.120 while the president United States has to alternate between going to a campaign rally, uh, going to a,
00:17:56.520 victory rally in New Hampshire, then a New York court, then a Georgia court. Uh, I mean, it's just,
00:18:02.920 it's inexplicable that we are demanding this and permitting this, uh, interference by the justice
00:18:08.920 department and this administration, the Biden administration in the 2024 election. And right
00:18:14.040 now they're getting away with it. Well, they certainly are. And Lou, look, the federal courts
00:18:20.040 in Washington have already drastically changed how we have handled traditionally say executive privilege.
00:18:28.360 Judge Chutkin and the appellate court judges have basically eliminated executive privilege
00:18:35.160 protections for a former president. Joe Biden did it. He was the first to refuse to confer executive
00:18:42.040 privilege to his predecessor. The first president in history, the courts have upheld that forcing
00:18:48.120 Donald Trump to turn over his records to the January 6th select committee, forcing him to turn them
00:18:54.360 over. Of course, to special counsel, Jack Smith, uh, the chief judge of the district court,
00:19:00.760 Beryl Howell, another Obama appointee, took the extraordinary step of piercing attorney-client
00:19:07.800 privilege between a former president and his lawyer, forcing Evan, Evan Corcoran to turn over personal
00:19:16.280 and privilege records to Jack Smith about his communications with Donald Trump in the classified
00:19:21.800 documents case. Um, and furthermore, even more egregiously, Beryl Howell allowed Jack Smith
00:19:29.960 to circumvent the normal process for executive privilege, um, forcing Twitter, issuing a search
00:19:38.120 warrant, forcing Twitter to turn over all of Donald Trump's Twitter records, including DMs and other
00:19:45.320 private, what would be privilege records, forced Twitter to turn those over to Jack Smith and added
00:19:52.120 a non-disclosure order preventing Twitter from telling Donald Trump about it. So these are radical
00:19:59.800 changes that have already been made by this court system that people are not paying attention to, but
00:20:06.200 will have dire consequences, uh, certainly for the, for the next president, um, you know,
00:20:14.040 and certainly for, for Donald Trump right now. Coming up next, the border siege continues under the

00:20:47.640 buy this administration's nonsense? Well, it seems like a few people up in the hill are buying it,
00:20:52.760 but Tom Holman's not going to buy it. I did it for 30 years. Look, five, the numbers right now,
00:20:58.120 between five or 6,000 days. And what they're going to do, they're still going to get seven,
00:21:01.960 eight, 9,000 days. They just increase those that bring to a port of entry that they don't count
00:21:06.920 as an illegal entry, right? Right. So the only deal out there that makes sense to me is HR2.
00:21:13.080 Yeah. For the house bill. And, uh, and I agree, but you know, that's not going to happen because
00:21:17.800 it actually does something to secure the border. Uh, and the left is never going to go with that.

00:21:42.920 but he missed some theology lessons. I'm guaranteeing you. And he missed a lot of integrity lessons.
00:21:49.160 He's out trying to sell amnesty to people. Uh, it's just the ignorance of Mitch McConnell and
00:21:56.280 these guys in that Senate, but, uh, Langford trying to sell this to the house.

00:22:51.960 shut it down, shut it down. We can't get HR2. At what point is it enough to shut it down? When we
00:22:57.640 got over 300 people at the terrorist watch this on the southern border, we got 112,000 dead American
00:23:03.240 fentanyl, we got 1700 dead migrants in U.S. soil, we got a 600 percent increase in child and female
00:23:09.560 sex trafficking across the border. When is it time to shut it down?
00:23:13.880 You couldn't be more right. And Mitch McConnell instead is talking about
00:23:20.280 amnesty. He's pushing it to push Langford out. Langford is such a tool. I cannot get over him
00:23:27.000 being this stupid individually. I knew that he was a rhino, but a stupid rhino allowing himself to have
00:23:33.800 this blazing to cross his forehead that he's a traitor to both the Republican Party and the country.
00:23:39.320 It's outrageous what we're seeing. I don't know where this goes, but I do know this,
00:23:46.440 that we're looking at two articles of impeachment revealed today for Mayorkas in the House.

00:24:27.800 then. He knows how we stopped it. So now as a secretary, what is he doing? He's not holding
00:24:32.440 him. He's not detaining. They're not seeing the judge. And ICE isn't even looking for him. They're
00:24:36.760 not looking to remove him. He's doing the complete opposite of what he knows worked in 2014, 2015.
00:24:43.000 What do you think? I tell everybody, in my judgment, the Biden administration went to
00:24:53.880 enforce the border security effectively and then really turned over the border to the
00:25:01.560 Mexican drug cartels. They are in control, in my opinion, on both sides of that border,
00:25:08.440 all 2,000 miles of it. What do you think? I think I agree that the Mexican criminal cartels
00:25:16.600 have operational control over our southern border. They decide what comes in, who comes in,
00:25:22.760 where it comes in, and when it comes in. And that's just not my opinion based on three things.
00:25:28.040 You talk to most chief patrol agents who are brave enough to speak out. Those are the same thing.
00:25:32.520 Matter of fact, one chief patrol agent used a term with me, broken arrow. He says,
00:25:36.280 Tom, I can't contain what's coming across. I may be catching 10%. So yeah, the criminal cartels,
00:25:41.560 they have operational control over our southern border, and this administration handed it to them.
00:25:45.640 You know, no one celebrated this election when the cartels, because based on Joe Biden's promises
00:25:50.360 during the campaign, they knew they were back in business.
00:25:53.560 Yeah, it's just so ugly. And the gutless wonders that we have in both the Senate and the House,
00:26:00.920 frankly. But those four border states, Greg Abbott stands up and absolutely tells the Biden
00:26:08.520 administration to go to hell. He's going to pursue the Article 4 invasion clause. He's going to defend
00:26:14.120 the state of Texas. I think the man is a hero of our times to do this. Twenty-five states agree with
00:26:21.080 him. Ten are sending their National Guardsmen down to help him to help the state of Texas defend the
00:26:27.320 border. Your thoughts?
00:26:28.920 One hundred percent behind Greg Abbott. He should be the Secretary of Homeland Security. He's done more
00:26:34.840 security this border than anybody in this administration. Every ounce of cocaine, I mean,
00:26:39.320 every ounce of fentanyl or other drugs that troopers seize are less overdose deaths in the United States.

00:26:50.760 bent and we fingerprint and make sure they're not terrorists. I said, Greg Abbott has done more to

00:27:00.920 southern border. I stand behind him a hundred percent. I tell him, go for it. Don't back down.

00:29:53.400 of that idea? This is by design. Like I said, Alejandro Mayorkas knows how we closed the border down before.

00:30:39.400 courthouses, Antifa, Black Lives Matter. And guess what? Miraculously, it all stopped in the fall
00:30:48.920 and like it never happened going into election day. And I think you're right. We're going to see the
00:30:54.840 same thing in Mexico on the border. I'm going to, you know, I, I, unfortunately, I really think
00:31:03.480 that the national news media would resolve this if they had the guts to report what was really going
00:31:09.000 on. This time, it's pretty clear. Everybody knows that Biden is corrupt. 70% of the people
00:31:14.920 in this country know he's corrupt. And when they think about all of the money that the Biden family
00:31:21.480 got from Ukraine, from various other Eastern European hellholes, if you will, and from China

00:32:26.760 the Democrats still pushed that most of the fentanyl is smuggled in the United States by U.S. citizens
00:32:31.400 through the port of entry. That is a bunch of hogwash. I did this for three decades. The criminal
00:32:35.560 cartels in Mexico are going to use a rather least resistance. Matter of fact, last month,
00:32:39.960 in several different sectors, hold every single uniform off the line to process. You don't think
00:32:46.120 the criminal cartels had a field day with that? Even the Democrats on the Hill are supporting this
00:32:51.720 nonsense that U.S. citizens are smuggling the fentanyl in the United States. It's just ridiculous.
00:32:57.160 Well, they're ridiculous. They're evil. They're violent. They're corrupt. And they are everywhere in
00:33:03.080 this country right now, or every state, as you well know. And as we said, they own the border.

00:33:21.800 in terms of the impeachment of Alejandro Mayorkas. Do you think they'll be successful?

00:33:31.880 Republicans in the House that are smiling right now. Sex trafficking is up 600 percent.
00:33:38.440 Kimball cartels are making billions of dollars. Kimball cartels now operate in over 40 countries.
00:33:42.680 They're in every major city of the United States. And the terrorist threat. He knows they've arrested

00:33:53.320 For Trump, we have 11 and four. For those actions alone, if they don't impeach them,
