00:01:45.020 Thanks to the flood of so-called workers' rights legislation and case law over the past generation,
00:01:50.220 there are three words that are now music to the ears of every useless employee in the country.
00:01:55.320 Hostile work environment.
00:01:57.000 A claim for a hostile work environment isn't hard to put together, but it can result in millions of dollars in damages, often enough to destroy an entire company.
00:02:05.740 And for that reason, hostile work environment claims have become the weapon of choice for both workers who are really bad at their jobs,
00:02:11.920 as well as workers who actively want to sabotage their employers.
00:02:16.220 The underlying idea behind a hostile work environment claim is that instead of having to show any single concrete injury,
00:02:22.940 plaintiffs can simply point to a series of minor incidents that occurred over time.
00:02:27.340 And each of these incidents in isolation may mean absolutely nothing.
00:02:30.440 It could be a harmless joke that causes no mental distress whatsoever.
00:02:33.840 But in a hostile work environment claim, plaintiffs are allowed to add up all of those little incidents together
00:02:39.360 and then make the case that offensive conduct in general was so pervasive in their workplace that they couldn't be expected to perform their jobs.
00:02:46.980 The exploring popularity of these claims has become a major tool of left-wing lawfare.
00:02:52.340 And now it's having a noticeable effect on pretty much every major corporation in the country.
00:02:56.960 It's slowing productivity. It's making everything more dull and uninteresting.
00:03:01.420 Companies that actually try to innovate and excel are especially vulnerable.
00:03:05.740 So you may have seen that eight former SpaceX employees are now suing Elon Musk in Los Angeles,
00:03:11.080 alleging, among other things, that he operates a hostile work environment in violation of the Fair Employment and Housing Act.
00:03:17.180 These are the same former SpaceX employees who, back in 2022, helped distribute an open letter
00:03:21.460 that publicly called Elon Musk's behavior embarrassing.
00:03:23.900 And they were fired, unsurprisingly, because attacking your boss in public generally doesn't go over well.
00:03:29.440 But the employees, predictably, are back with a lawsuit against Elon Musk and SpaceX
00:03:33.960 that every major mainstream outlet from the Wall Street Journal to Axios is hyping as a really serious piece of litigation.
00:03:40.800 Here's CNN, for example, interviewing one of the eight plaintiffs in the case.

00:03:45.980 Paige Holland Thielen is one of the plaintiffs in this case, and she joins me now.
00:03:51.940 Paige, thank you so much for joining me this evening.
00:03:54.640 I do want to go through each of these allegations one by one because they are, frankly, extraordinary.
00:04:01.140 One is that people are evaluated on bra size.
00:04:04.940 What's happening?
00:04:05.940 Can you elaborate?
00:04:06.460 There was a very popular tweet from a little while ago where Elon claimed that he was starting a university
00:04:18.320 with what he considered humorous acronym.
00:04:23.920 And I won't go into what that is, but that got very popular and got repeated all over the workplace.
00:04:32.540 And one of the follow-up tweets was that D's get degrees, which was a joke about breast size due to the acronym of the fake college.
00:04:43.700 So things like that were widely shared on all internal chat channels and talked about in meetings.
00:04:49.800 So it turns out that, according to this plaintiff, Elon Musk evaluates employees based on their bra size.
00:04:58.560 Pretty serious claim.
00:04:59.680 I mean, you know, it sounds pretty outlandish, actually.
00:05:02.960 So you'd hope she'd have some proof to back it up.
00:05:06.820 But instead of providing any real evidence for this claim, the employee points to a tweet that Musk sent out to his 180 million followers.
00:05:13.660 And instead of just not reading the tweet or unfollowing Musk on Twitter, she apparently couldn't avoid seeing this horrible tweet.
00:05:21.540 And conveniently, she says that she simply can't repeat the tweet on air.
00:05:24.660 It's just too shocking, apparently.
00:05:26.340 Too upsetting.
00:05:27.460 Now, if you read the complaint, though, you'll find the tweet she's talking about.
00:05:31.140 So here it is.
00:05:33.220 I'm going to read it to you.
00:05:35.260 It's very traumatizing.
00:05:36.600 But this is what he tweeted.
00:05:38.200 Quote, should I make the Texas Institute of Technology and Science real?
00:05:42.060 No, it would, of course, have advanced social studies, too.
00:05:45.760 Close quote.
00:05:47.740 That's it.
00:05:48.620 That's the tweet.
00:05:49.520 So this is what's known as a joke.
00:05:52.800 And millions of people who saw the tweet immediately understood that it's a joke.
00:05:56.420 The acronyms for Texas Institute of Technology and Science and advanced social studies would be TITS and ASS, respectively.
00:06:05.180 So that's the punchline.
00:06:07.180 And in a follow-up tweet, the complaint says that Musk wrote,
00:06:11.140 D's would get degrees at his fictional university.
00:06:15.620 Now, from those two tweets, we're supposed to conclude that Musk and SpaceX evaluate employees based on their bra size.
00:06:23.720 It's a joke about D's getting degrees at a fictional university that he posted on Twitter.
00:06:28.500 Now, what we learned from the tweet, if anything, is that Musk maybe needs to hone his material a bit if he wants to pursue a career in stand-up comedy.
00:06:37.560 But we don't learn that he runs a hostile work environment.
00:06:40.020 And we certainly don't learn that Musk conducts performance reviews that involve ranking employees by their bra size.
00:06:47.260 That's just a thing that is not happening at all.
00:06:50.280 This is the kind of frivolous complaint that now confronts SpaceX, a $200 billion company that is objectively doing more to make humanity a space-faring civilization than any other organization on the planet, including NASA.
00:07:03.280 A woman and her colleagues didn't like a joke that Musk made on the Internet about a fake university.
00:07:08.780 And the corporate press is promoting this aggressively as a major scandal.
00:07:13.920 Forget about how SpaceX landed a 400-foot-tall reusable rocket for the first time in human history.
00:07:19.060 Never mind the fact that SpaceX could use that technology to land on Mars in the near future.
00:07:24.500 Like, they are very probably going to do something that has never been done.
00:07:30.980 They are on their way to achieving potentially the greatest accomplishment in the history of mankind.
00:07:39.960 Don't focus on that.
00:07:41.060 Focus instead on this particular joke.
00:07:43.700 A joke which, again, has nothing to do with Elon Musk evaluating employees by their bra size,
00:07:47.920 which was the original accusation.
00:07:50.520 So I pulled up the full complaint to see if I was missing anything here.
00:07:54.060 There's a whole section devoted to the grievous injuries that fired SpaceX employee Rebecca Clark allegedly suffered.
00:08:00.220 Here's the part about evaluating women based on their bra size.
00:08:02.880 Quote, Clark attended the Falcon meeting with Vice President John Edwards and HR Representative Janet Fernandez.
00:08:09.060 She observed that Mr. Edwards acted in an angry and aggressive manner in response to employees' concerns about the hostile work environment.
00:08:16.120 Clark pushed Mr. Edwards to clarify whether Elon's tweet, indicating that a woman is valued based upon the size of her breasts, was the view of SpaceX.
00:08:25.400 Edwards ultimately repeated words to the effect of SpaceX is Elon and Elon is SpaceX.
00:08:31.220 Simmons nodded his head in agreement with Edwards and repeated some of the things Edwards said, such as,
00:08:37.660 the mission to Mars is the most important thing and there's no time to focus on these issues at work.
00:08:43.200 Can you imagine?
00:08:44.040 He said going to Mars is more important than like a boob pun that Elon Musk tweeted.
00:08:51.180 Where are this guy's priorities?
00:08:52.680 I mean, come on.
00:08:53.980 In other words, this woman was so offended by Elon's joke that she concluded that a woman is valued based on the size of her breasts at SpaceX.
00:09:00.540 That's the leap that she made in her own words.
00:09:05.140 And when the higher-ups told her to knock it off because they want to focus on important things like launching rockets to Mars,
00:09:11.180 she, of course, became even more offended and added that to the lawsuit as well.
00:09:15.360 The rest of this complaint from these former employees is full of allegations like this.
00:09:19.440 Actually, it only gets worse, actually.
00:09:21.080 It reads like a parody of a lawsuit.
00:09:22.940 It's almost as if they intended to catalog Musk's greatest hits on Twitter and then some lawyer got a hold of the document and pretended to be outraged by it.
00:09:30.500 So here's one of the allegations that's supposed to convince us that this workplace is extremely hostile.
00:09:35.520 So hostile that these women couldn't get any work done.
00:09:37.920 They were so traumatized by all of it.
00:09:39.860 The complaint states that Elon Musk is guilty of, quote,
00:09:44.280 mocking Bill Gates by creating a meme of him with a pregnant-looking belly,
00:09:48.840 accompanied by the text, in case you need to lose a b**** fast.
00:09:53.040 So that's right.
00:09:54.260 Elon Musk, on his public Twitter account, made fun of Bill Gates, a billionaire who does not work at SpaceX.
00:09:58.340 It's a joke that millions of people thought was funny based on their documented reactions on the Internet.
00:10:04.580 And it is pretty funny.
00:10:06.560 And this is supposedly evidence that Musk created a hostile work environment at SpaceX
00:10:10.680 and presumably every other workplace on the planet where this tweet was ever viewed.
00:10:14.600 In case you missed Musk's tweet, it's from April 2022.

00:10:19.700 So that's Bill Gates on the left.
00:10:22.020 If you need to know who's the emoji and who's Bill Gates, he's on the left.
00:10:26.540 And on the right, it's an emoji that Apple rolled out to depict a pregnant man.
00:10:31.460 So I'll explain the joke here just in case any former SpaceX employees are watching,
00:10:37.160 looking slack jaw to your screens, wondering what could possibly be amusing about this meme.
00:10:41.560 You see, back in 2022, both Bill Gates and the Apple emoji were being widely mocked.
00:10:45.820 Bill Gates wanted to tell the whole world how to live their lives in order to be healthy,
00:10:49.220 but he's substantially overweight.
00:10:51.480 Meanwhile, Apple styles itself as a tech brand for intelligent, science-conscious consumers,
00:10:55.660 but they're pushing the idea that men can get pregnant.
00:10:57.960 Elon Musk posted a meme combining these two absurd situations in order to maximize the humor.
00:11:02.680 It's supposed to be funny.
00:11:04.800 This is how jokes work on this planet that we call Earth.
00:11:09.580 Now, it's a minor aside, but also note that contrary to what the complaint says,
00:11:13.180 nowhere in his tweet did Musk suggest that he personally created that meme as opposed to simply sharing it.
00:11:17.820 Nor is it clear why they're saying in the complaint that Gates' belly is pregnant-looking.
00:11:21.440 I mean, isn't that offensive to pregnant-looking women employed by SpaceX?
00:11:27.280 They're being compared to an overweight, unkempt photo of Bill Gates.
00:11:31.660 That's an outrage.
00:11:33.180 Maybe someone should sue these employees.
00:11:35.200 By complaining about Bill Gates and the pregnant man emoji,
00:11:37.540 they're clearly creating a hostile work environment for birthing folks.
00:11:43.040 But that lawsuit won't happen, and it's not a great mystery as to why it won't happen.
00:11:46.500 Musk committed the sin of permitting freedom of speech on the Internet,
00:11:49.620 so he's the target.
00:11:51.560 It seems that everybody from the DOJ to disgruntled SpaceX employees now
00:11:55.480 want to bring him down by any means necessary.
00:11:58.060 What's more interesting about this case, though,
00:12:00.080 is that it highlights the increased use of lawfare to enforce woke left-wing gender ideology.
00:12:05.840 Gender ideology is so unscientific and so arbitrary that it can't withstand any form of scrutiny whatsoever.
00:12:10.960 It certainly can't withstand mockery.
00:12:12.580 Proponents of gender ideology understand that very well.
00:12:14.920 So in order to ensure that this incoherent ideology survives,
00:12:18.240 they know that it's vital to enact blasphemy laws, essentially.
00:12:22.580 Parody and criticism aren't allowed.
00:12:24.800 That's pretty much what they're doing here.
00:12:26.780 Read further in the complaint, and that becomes very obvious.
00:12:28.840 For instance, here's another allegation in the complaint.
00:12:31.440 According to the complaint, he, quote,
00:12:32.620 quote, tweeted,
00:12:34.320 pronouns suck.
00:12:36.900 Now, the tweet could be more specific.
00:12:40.080 In fact, pronouns don't suck.
00:12:41.900 Pronouns didn't do anything wrong.
00:12:44.140 Like, let's not blame this on the pronouns.
00:12:45.900 What sucks is the idea that people get to choose their own pronouns.
00:12:50.060 It's like the pronouns themselves are,
00:12:51.720 there's nothing wrong with them.
00:12:53.040 It's how they're being used.
00:12:54.660 And that's obviously what Elon Musk was referring to.
00:12:57.140 Now, if a pronoun wants to sue him for slander,
00:13:00.940 maybe it would have a case.
00:13:02.180 But an employee citing it in a lawsuit is a joke.
00:13:04.760 It's an unintentional joke,
00:13:05.960 unlike the jokes that they're suing over.
00:13:08.240 In fact, not only does this complaint
00:13:09.580 seem to seek to ban criticism or mockery of gender ideology,
00:13:13.400 it also seeks to outlaw criticism or mockery of the tactics
00:13:16.100 that these zealots are using to enforce their ideology.
00:13:19.120 Quoting again from the complaint against Musk,

00:13:22.080 in response to news about a sexual harassment charge against him,
00:13:24.720 Musk posted,
00:13:25.200 finally we get to use Elongate as a scandal name.
00:13:29.000 It's kind of perfect.
00:13:31.380 Now, you can practically see these former SpaceX employees
00:13:33.700 with their arms crossed in their lawyer's office,
00:13:36.800 explaining how offended they were by all this.
00:13:39.400 Not only was Musk making jokes that they didn't like,
00:13:41.260 he was also mocking their attempts to slander him.
00:13:43.760 How dare he?
00:13:45.640 Indeed, Musk was even mocking some of their favorite buzzwords,
00:13:48.580 and they can't stand that.
00:13:50.420 That's why the lawsuit also faults Musk for posting this meme.
00:13:53.360 This is another meme cited in a lawsuit.
00:13:58.900 It reads,
00:14:00.700 ladies, mansplaining is short for man explaining.
00:14:05.120 You see, the joke is that he's mansplaining the definition of mansplaining.
00:14:08.680 And this apparently contributes to a hostile work environment somehow,
00:14:12.600 which forces me to mansplain to the people filing the lawsuit that making fun of mansplaining
00:14:18.180 does not make your work environment hostile.
00:14:21.860 But the lawsuit doesn't stop there.
00:14:23.320 It also faults Musk for thinking that Monty Python is funny.
00:14:26.140 Quoting again, Musk posted a photo from Monty Python with the subtitle, Biggest Dickous.
00:14:32.900 Yes, he posted a photo from a Monty Python movie.
00:14:35.100 That's not allowed anymore.
00:14:36.120 Quoting the life of Brian creates a hostile work environment.
00:14:39.280 So this is obviously a demented lawsuit.
00:14:41.240 It's a complete waste of time.
00:14:42.300 And I'm not cherry picking here.
00:14:43.300 The whole thing is this bad.
00:14:44.400 For example, here are some allegations by former employee Claire Mallon.
00:14:48.480 See if you can spot the problem here.
00:14:49.940 Quote,
00:14:50.080 So, Mallon also faced gender discrimination at work.
00:14:54.240 In her 2018 performance evaluation, her manager criticized her for being too coarse-slash-straightforward.
00:15:00.440 In her 2019 evaluation, Mallon was told to absorb feedback cheerfully.
00:15:05.560 This was a double standard applied to Mallon because of her gender,
00:15:08.880 as Ms. Mallon never observed men criticize for being straightforward
00:15:12.060 or for not taking feedback cheerfully enough.
00:15:14.960 In other words, this woman received negative feedback
00:15:20.240 and she didn't personally see men being criticized in the same way.
00:15:25.240 Therefore, it must never have happened.
00:15:26.920 Because obviously, nothing ever happens at SpaceX unless Claire Mallon sees it herself.
00:15:32.600 Now, you might point out that performance reviews are conducted privately,
00:15:35.960 so Mallon couldn't possibly have any idea what anyone else has ever been told in their review.
00:15:42.340 But if you say that, you're mansplaining,
00:15:46.020 and now you have victimized poor Ms. Mellon a second time.
00:15:49.440 Another ex-employee, Paige Holland-Thielen, who we heard from earlier,
00:15:52.640 makes the same non-argument.
00:15:53.960 According to the complaint, Holland-Thielen, quote,
00:15:56.120 expressed frustration about being routinely assigned rotations on a support or operations team
00:16:00.240 within ground software instead of development roles.
00:16:02.960 Lead Kyle Hussford gave her the feedback that she was too aggressive.
00:16:06.400 This was a double standard because of Holland-Thielen's gender.
00:16:09.900 She never observed men being criticized for being too aggressive.
00:16:15.020 Again, if she didn't see it, it didn't happen.
00:16:17.660 That's the idea.
00:16:18.920 No man has ever been criticized for aggressiveness.

00:16:34.560 Now, I'll admit that I'm not a lawyer, nor am I up-to-date on the finer points of California labor laws,
00:16:39.940 but after reading this complaint, I can make a few determinations with a fair degree of confidence.
00:16:43.800 First of all, hostile work environment claims are completely out of control.
00:16:47.620 The law that permits these kinds of claims obviously needs to be reworked or abolished.
00:16:51.920 It's simply too easy to collect a bunch of jokes together and claim to be offended by them
00:16:55.380 and then file a multi-million dollar lawsuit, especially in a left-wing jurisdiction like Los Angeles.
00:17:00.440 Humor is not illegal in this country.
00:17:02.100 Criticizing pronouns and trans ideology is not illegal either.
00:17:05.380 But through lawsuits like this, humor and other normal workplace interactions are effectively being outlawed.
00:17:10.500 On its website, the Equal Opportunity Employment Commission explicitly states that
00:17:13.920 offensive jokes can indeed constitute violations of the law.
00:17:17.580 So whenever Biden's administration is out of office, some changes need to be made there
00:17:21.160 because this has obviously gone too far.
00:17:23.020 However, that's why we've seen this form of lawfare repeatedly in recent years.
00:17:27.040 Just a few years ago, or rather just a year ago, there was that lawsuit filed by a Fox producer,
00:17:32.440 Abby Grossberg, against Tucker Carlson in Fox News.
00:17:35.040 Grossberg's complaint was full of jokes that she heard in the office, which she claimed that she found offensive.
00:17:40.900 From Grossberg's interviews on left-wing cable news channels,
00:17:43.780 it's apparent that one gag in particular that really bothered her was the pictures of Nancy Pelosi
00:17:50.340 that she says were plastered around the office.
00:17:53.020 Watch.
00:17:55.440 I show up first day of work, and I know that this is a popular one.
00:17:59.980 It's been widely publicized.
00:18:01.340 There are literally pictures like this big of Nancy Pelosi in a bathing suit in Europe,
00:18:07.960 plastered all over.
00:18:09.820 There was even one on my computer screen for the temporary computer I had to use,
00:18:13.660 and I had to take it down.
00:18:15.660 Now, the picture of Pelosi that she's mortally offended by happens to be all over the Internet.

00:19:25.120 But none of that matters because Grossberg says she was bothered by it.
00:19:28.160 And add that to a zillion other similar complaints,
00:19:30.120 and you get a hostile work environment and a settlement worth millions of dollars.
00:19:34.520 And as a side note, you may have noticed that it seems so often to be women who are behind these complaints.
00:19:41.020 SpaceX is trying to go to Mars, and Elon has to deal with a bunch of women crying
00:19:44.660 because their feelings were hurt by a tweet.
00:19:47.360 A bunch of women saying, I didn't find that funny.
00:19:49.740 That's not funny.
00:19:52.000 And the funny thing is that these women are ostensibly doing this
00:19:54.900 in order to defend the rights of women in the workplace.
00:19:57.100 But all they've really succeeded in doing is reinforcing every negative stereotype of women in the workplace.
00:20:02.680 Like, if you want to make it so that nobody wants to hire women or work with them,
00:20:06.340 this is how you do it with stuff like this.
00:20:08.180 Your every single negative stereotype is reinforced by a woman who's everyone else is trying to get their job done.

00:20:19.900 The best thing you can do if you want to help the rights of women in the workplace
00:20:22.400 is just like move on with your life and stop being offended by everything.
00:20:26.520 Anyway, these kinds of complaints are becoming more common in part because the media always pretends to take them seriously,

00:20:32.740 Take, for example, the complaint about a toxic work environment at Jimmy Fallon's show.
00:20:36.040 So this complaint hasn't materialized into a lawsuit, at least not yet,
00:20:39.080 but it was still present, presented by media outlets as evidence that Jimmy Fallon's workplace is hostile and oppressive.

00:25:43.640 Eric and Gina, the Fort Bend County District Clerk just made those charging documents for Thoreau Patel available to the public.
00:25:51.100 More than 20 pages that we have spent the last hour sifting through, and the allegations are alarming.

00:25:58.820 Back in October, the DA's office received a request from Precinct 3 Commissioner Andy Meyer to look into who was behind several social media posts directed at his opponent, which is Patel.
00:26:10.800 This came after Patel sent out a press release with a collage of supposed racist social media posts that he claimed were directed at him.
00:26:20.160 Meyer told investigators he recognized one of the accounts behind the comments as Antonio Scallywag.
00:26:25.720 The documents then further detailed how they linked that account back to Patel, including getting a subpoena from Facebook and Google.
00:26:34.880 From there, they were able to obtain account and payment information matching Patel's credit card number, address, phone number, and other personal data.
00:26:44.480 Patel now faces a third-degree felony of online impersonation and Class A misdemeanor for misrepresentation of identity.
00:26:52.560 The DA's office tells us this is the first time that they've charged someone with that specific election-related misdemeanor.

00:54:30.920 L.A. City Councilmembers Hugo Soto-Martinez and Nithya Rahman were on hand today to help remove the signs.
00:54:43.180 They say the no cruising and no U-turn signs were put up in the 1990s to prevent people in the gay community from meeting up with other gay people.
00:54:53.240 I was also surprised that these U-turn signs were still up.
00:54:59.180 And at first, you know, they seem a little, oh, okay, it's just a no U-turn sign.
00:55:03.460 But when you learn the history of it and you realize that these were used to profile gay people, it's so important that we have these removed.
00:55:11.940 The L.A. City Councilmembers say the signs were put up after the gay community began to grow and because there was a gay bar in that area.
00:55:19.860 So there you have it.
00:55:20.800 A crowd of people came together to remove no U-turn signs because no U-turn signs are homophobic.

00:55:30.120 No U-turn signs are bigoted against the gay community.
00:55:33.000 And topping it all off, the city council member who led this rally goes by the name, again, not making it up, goes by the name Maybe A Girl.
00:55:41.100 Council member Maybe A Girl is leading the charge and finally sparking the long-needed conversation about the homophobic legacy of traffic enforcement.

00:55:53.360 And if we're looking for anti-gay implications and traffic signs, why start with U-turns?
00:55:58.080 Some people have speculated there might be some homophobia in, for instance, exit-only signs.

00:58:12.940 and explain why it's actually a monument to homophobia.
00:58:15.480 And in spite of their extensive knowledge of these utterly pointless subjects,

00:58:23.140 According to the explanation we just heard, if you didn't fall asleep in the middle of it,
00:58:27.220 what you take from that is that they put the signs up in order to stop gay cruising in the 90s.
00:58:32.060 Gay cruising, as we saw in the newspaper clip that was briefly flashed on the screen,
00:58:36.480 means that gay men were going out and looking for other men to have sex with in public.
00:58:41.380 The news article mentioned two men caught having sex in a stairwell.
00:58:44.000 So, if the no U-turn signs were connected to the effort to stop this kind of public lewdness,
00:58:50.860 it must be because it was somehow effective in preventing gay men from cruising around on the street looking for sex.
00:58:57.360 So, if these signs had anything to do with the gay community, quote-unquote,
00:59:00.420 quote, and that's a big if, it's because they were behaving inappropriately in public,
00:59:06.040 and the sign somehow helped to get that problem under control.
