00:02:32.360 conservative. Establishment brings to mind something like an actual cabal or cartel of Republicans
00:02:38.440 meeting in secret smoky rooms, hatching dastardly plans. I think the actual reality of the
00:02:43.860 establishment conservative so-called does not involve cabals or secret rooms, certainly not smoky
00:02:49.600 secret rooms. There's less of a conspiracy and more of a, of a mutual instinct to shrink away from
00:02:56.320 serious ideological fights and to protect one's reputation by acting and speaking in a way that
00:03:02.860 will not offend the sorts of people that these sorts of people want to be admired by. All of that said,
00:03:09.440 I will, I will use establishment conservatives today. Just, just for lack of a better term may
00:03:13.520 not be the best description, but it is succinct at any rate. So we'll use it. And so I can report
00:03:18.520 that establishment conservatives seem to finally be getting on the same page in the week, in the wake
00:03:24.780 of justice Ginsburg's death. They've, they've tried desperately to think of a way to take these
00:03:29.880 winning cards we've been dealt and lose the hand anyway. And that's what they're very good at doing.
00:03:34.660 They all, it seems have come up with the same plan. So here's Jonah Goldberg in the LA times.
00:03:40.420 I'll read a little bit of this. He says towards the end of his piece, he says,
00:03:44.500 what some now dismiss as politics and posturing are actually important considerations that honor the
00:03:50.660 conservative distinction between can and should and fall under such antiquated notions as statesmanship,
00:03:56.080 prudence, legitimacy, consistency, and precedent. These concepts put maintaining the long-term health
00:04:01.560 of our institutions above the demands of the moment. Take Senator Lindsey Graham, who promised
00:04:06.580 in 2016 that if an opening were to come up in the last year of president Trump's term,
00:04:11.180 a nominee would not be considered until after the election. By going back on that promise in such
00:04:15.220 spectacular fashion, he's not merely debasing himself. He's also teaching people that nothing
00:04:20.540 politicians say matters. By the way, is there, is there anyone over the age of 12 who needs to be
00:04:25.780 taught that lesson? Really? You mean politicians will lie? I had no idea. Scandalized. Anyway,
00:04:34.080 he continues, moreover, merely on the level of real politic, abandoning all considerations other
00:04:38.520 than what you can get away with amounts to preemptive disarmament for the wars to come.
00:04:43.380 The pernicious logic of apocalyptic politics works on the assumption that the long-term doesn't matter,
00:04:48.500 but the long-term always becomes now eventually. This is why the Senate could use some posturing in
00:04:53.260 politics right now. Republicans have the ability to replace Ginsburg before the election or
00:04:57.040 immediately after in a lame duck session. That is a huge bargaining chip. And given that the GOP's
00:05:02.120 majority is so slim, it's a chip that can be traded even by even a handful of Republican senators.
00:05:07.360 So here's the deal that he proposes. A few Republicans could agree to postpone the process
00:05:11.760 until after the election in exchange for a few Democrats agreeing never to vote for a court-packing
00:05:17.880 scheme. This would give voters some buy-in for whatever happens next. Okay. Did you get that?
00:05:27.060 The plan here is for Republicans to choose not to vote on a justice, as long as Democrats pinky
00:05:34.140 promise, really pinky promise, okay, like super serious, to never pack the court in the future.
00:05:40.440 David French in Time agrees. He says, what can be done? An increasing number of center-right legal
00:05:47.800 scholars, including the American Enterprise Institute's Adam White and George Mason Law School,
00:05:52.900 Professor Ilya Soman, are proposing a variant of an approach best summed up as make them keep their
00:06:00.020 word. It goes something like this. First, Trump makes his pick. Second, the Senate applies the Schumer
00:06:05.340 principle and gives the nominee a hearing. This will have the benefit of giving the American people a more
00:06:09.420 complete picture of the qualifications and philosophy of the nominee, and thus the stakes of the
00:06:13.440 presidential election. Third, then, the Senate then applies the Graham-Rubio-Cruz rule and does not vote
00:06:21.540 before the election. If Trump wins, they then vote on the nominee. Now, there have been other articles in
00:06:28.660 Reason, the Bulwark, others have echoed this same plan. Republicans declined to confirm a nominee,
00:06:37.660 which, you know, confirming a nominee would potentially flip the court in favor of constitutionalism
00:06:42.340 in the process, save millions of lives, declined to do that and returned the Democrats' promise with
00:06:46.820 all their heart and souls to never pack the court. Now, the problems with this plan are, I think,
00:06:51.740 obvious, but let's discuss them anyway. First of all, we should emphasize this again. There is
00:06:57.800 absolutely no reason whatsoever to not confirm Trump's picks, okay? This is not even a problem that
00:07:04.900 we need to be thinking about. There is nothing whatsoever strange or outrageous or controversial
00:07:09.960 about a duly elected president putting forth a judicial nominee and duly elected senators confirming
00:07:15.260 or not confirming that nominee. This is what they were elected to do. There is no reason not to do it.
00:07:23.420 French and Goldberg and the others, they go on and on about principle and how somehow, in some way,
00:07:29.460 it violates principle for the president and the Senate to perform their constitutional duties.
00:07:35.100 This is nonsense. It is abject nonsense. The only thing it potentially violates is what some of them
00:07:41.880 said in 2016. Well, so what? Who cares? Some Republicans made a bad argument for not holding a
00:07:48.360 vote for Garland. They said that, you know, they shouldn't do it because there's an election coming up.
00:07:53.640 That was a bad argument. That was a dumb argument. They should have said they aren't going to vote
00:07:57.980 because they refuse to allow another activist on the court and they have the constitutional authority
00:08:02.700 to prevent it, and so they will. And they also, and they could have pointed out, they also have
00:08:06.840 the mandate from their constituents demanding that they prevent it. That's what they should have said.
00:08:12.340 Instead, they made a bad, stupid argument. Are they now, because of principle, required to live by
00:08:17.920 that bad argument forever? If you do the right thing, but you justify it with faulty reasoning,
00:08:23.340 are you now required to live by that faulty reasoning for the rest of your natural life?
00:08:28.140 If I save a kitten from getting run over and someone asks me why I saved it and I say,
00:08:32.700 well, because it's Tuesday, does that mean that from then on I must allow kittens to be run over
00:08:37.640 on Wednesday and Thursday? Or should I just continue saving the kittens even if my initial reasoning for
00:08:43.360 doing it must be adjusted or abandoned? Now, that was a weird analogy, granted, but I think it works.
00:08:49.280 Even if it doesn't work, it just demonstrates my point about faulty reasoning.
00:08:52.040 Second point, we cannot make a deal like this with Democrats because it relies on Democrats keeping
00:08:59.500 their word. Not just their word, but future Democrat politicians have to honor the word of previous
00:09:05.540 ones. The thing is, I wouldn't trust Democrats to honor their word, period, but I wouldn't even expect
00:09:11.180 them to honor the word of some other Democrats from years ago. I couldn't even blame them for breaking
00:09:16.380 that word. I just, I can't believe that men like French and Goldberg really think that a plan like
00:09:21.940 this is feasible or plausible or coherent. It's like if a guy has taken 10 hostages and he's
00:09:28.160 demanding $10 million and a plane ride out of the country. So you give him the $10 million and the
00:09:32.940 plane and you tell him to take the hostages with him. But when he gets wherever he's going, he has
00:09:36.860 to promise to let them go. Yeah, that's not a deal. That's not a negotiation. That's not a compromise.
00:09:42.440 That's just simply giving the other side everything they could ever want. And in this case,
00:09:47.860 it would be like doing it when the hostage taker has no gun and no bomb. You have all the ammo.
00:09:54.040 You hold all the cards. They can't even say, and yet you still give them everything you want.
00:09:58.080 This is what passes for principle among some on the right. It is so weak and limp and pathetic that
00:10:04.040 I can almost feel my testosterone levels dropping as I read some of these pieces. Now, here's what we
00:10:10.420 must understand about Democrats, okay? They say that conservatives are racist, fascist Nazis in league
00:10:18.700 with the Klan. And they say that conservatives want to control women and remove their autonomy and
00:10:24.720 enslave them like the Handmaid's Tale. And the thing is, they really believe it, or at least they act as
00:10:31.260 if they do. And what that means is that they're going to do everything in their power and tell any lie
00:10:37.160 they need to tell in order to stop those oppressive, woman-enslaving, neo-Nazi savages.
00:10:43.680 That's why the Kavanaugh hearings went the way they did. They could act to destroy this man,
00:10:49.020 destroy his family, slander him, defame him, ruin him. And they could feel entirely justified and
00:10:53.880 noble every step of the way. After all, they're up against Nazis, remember? Wouldn't you accuse a Nazi
00:10:59.460 of gang rape if that's what you needed to do in order to stop him from seizing power? Of course,
00:11:05.000 the difference is that Republicans aren't actually Nazis. So that's all a bunch of hysterical bulls**t.
00:11:12.800 On the other hand, Democrats are actually infanticidal radicals who believe that it's
00:11:20.000 morally acceptable to dismember a fully developed infant and throw the pieces into a dumpster.
00:11:25.920 That is the truth. They really believe that. That is their real-life position. And they want a court
00:11:33.180 that reflects it and shares it and advances it. What that means is that the ruthlessness they show
00:11:38.580 when it comes to the Supreme Court or anything else is not morally justified because the basis for it
00:11:43.980 is false and their actual objectives are evil. But for Republicans, it is morally justified to do
00:11:49.760 whatever must be done within the bounds of the law to stop them. The basis for our actions is not false.
00:11:55.300 It is really true. That is what we're up against. And you are not a principled conservative unless you
00:12:02.040 are willing to look into that darkness, confront it, acknowledge it, and fight it with all you have.
00:12:10.740 Let's go to our five headlines.
00:12:12.060 You know, I'm a big believer in reading. I think it's really important to read books,
00:12:22.280 to set aside time to read, to learn. You know, that's been my point about, you know, things like
00:12:28.100 going to college. And the thing is, whether you go to college or not, whatever you do for your
00:12:33.020 education, if you don't continue learning every day of your life, even after you graduate,
00:12:38.540 then, you know, a few years after college, you're going to be just as dumb as anybody else.
00:12:45.800 Learning is something that has to happen every single day. We have to continue to learn.
00:12:49.380 If you get out of school, no matter how much time you spend in school, if you get out and then just
00:12:53.180 stop learning from then on, it was all a waste of time because you're going to forget everything.

00:14:30.340 Didn't really come across my desk. I just like to phrase it that way. That Mitt Romney has announced
00:14:36.260 that he will vote, that he's in favor of voting on a nominee before the election. I guess there are
00:14:43.880 people who are surprised by that. They thought that, you know, would Romney be one of the squishes
00:14:48.840 who said we should wait till after the election? I'm not surprised by it at all, actually, because you
00:14:54.560 have to understand Mitt Romney is a senator from Utah. He represents Utah. And if you know anything
00:15:00.560 about Utah, the voters in Utah, extremely socially conservative, they are not going to tolerate the
00:15:06.440 guy who represents them standing in the way of potentially flipping the court in favor of pro-life
00:15:11.220 and conservatism. That was just not going to happen. So Romney really has no choice,
00:15:16.000 which is a credit to the voters in Utah. But we still have a long way to go because right now the
00:15:23.960 votes are lined up, but Democrats have barely even begun to launch their assault on Trump's nominee,
00:15:31.420 who hasn't even been officially named yet. And so we'll see. Right now they've got whatever,
00:15:36.060 53 votes. We'll see if all those Republicans hold the line. I think Romney will, no matter what,
00:15:44.020 because like I said, I don't think he has a choice. His, his, his, his base, his voters in Utah won't
00:15:48.680 tolerate other, other senators like Susan Collins. We'll see. Okay. Just to give you an idea, we move
00:15:56.100 on to number one here, just to give you an idea of how bad the bias is in media. Here's a conversation
00:16:01.720 between Don Lemon and Chris Cuomo last night, where Cuomo is the sane and rational one in the dialogue.
00:16:10.700 Listen, if the Democrats were in control of the Senate right now and Trump was president and he
00:16:16.500 wanted to nominate a justice, what do you think they'd say? Well, I think they do the same thing
00:16:20.060 they did in 2016. They, they do it. That's what they did. That's my point. That's why nobody cares
00:16:25.380 what the Democrats are saying. No, no, no, no, no. I think they do exactly what they did in 2016.
00:16:29.360 You can say what you want about Democrats. Democrats usually wet the bed. They're not as strategic.
00:16:33.740 You think they give Trump a justice after what happened with Merrick Garland? I think if they,
00:16:38.540 if yes, I think they do abide by, well, it's different because it's different because Democrats
00:16:45.420 did not make the promise. So you keep comparing things that aren't equal. Democrats did not make
00:16:49.860 the same promise in 2016. It wasn't a promise. Democrats are on the other side. They said,
00:16:53.480 it wasn't a promise. It was a BS rationale to explain what they were doing to deprive him of power.
00:16:58.560 Semantics. They didn't allow the, the, the, his nominee to go through. They wouldn't even have a
00:17:03.200 hearing. They said, we're not going to do it. So that wasn't Democrats doing that. That was
00:17:07.180 Republicans doing it. And if you come on this side, I don't know what Democrats would do.
00:17:11.340 Democrats back in 2016. It would not mean that they were being hypocritical if they did it.
00:17:15.360 Okay. So you see, uh, he, the dude really claimed there that Democrats, if they were in control,
00:17:19.240 would allow Trump's nominee to go through. They would cooperate with Trump and play fair.
00:17:23.740 Lemon says that's, that's, that's what we're getting. So we're just, we're just pretending that they,
00:17:27.320 that they didn't try to stop a Trump nominee by accusing him of serial gang rape. By the way,
00:17:33.080 Republicans stopped an Obama nominee by not holding a vote, which is an authority and power
00:17:38.880 they had legally. Democrats stopped or tried to stop a Republican nominee by orchestrating a smear
00:17:45.660 campaign and accusing him of being a, the ringleader of a gang of teenage rapists. Okay. One of those
00:17:51.660 methods is an assault on the rule of law and norms and decency. The other is not. And, uh, you know,
00:17:59.160 I'll let you guess which is which later in the same conversation to make matters worse. Cuomo had
00:18:04.420 to explain the constitution to Don Lemon. He, Cuomo had to become the constitutional scholar in the
00:18:11.360 conversation. Watch. No matter what happens, everybody sticks. We're going to have to blow
00:18:15.500 up the entire system. And you know what we're going to have to do? I don't know. You know what we're
00:18:18.880 going to have to do? You just got to honestly, from what your closing argument is, you're going to
00:18:23.760 have to get rid of the electoral college because the people, I don't see it because the minority in
00:18:28.560 this country decides who the judges are and they decide who the president is. Is that fair?
00:18:32.120 A constitutional amendment to do that. And if Democrats, if Joe Biden wins, Democrats can sack
00:18:37.380 the courts and they can do that amendment and they can get it passed. Well, you need two thirds vote
00:18:42.080 in the Congress and three quarters of the state legislature. They may be able to do that. Maybe.
00:18:46.180 Yeah. It's pretty clear from that conversation there that Don Lemon really thought that just by
00:18:51.420 taking what, if, if, if Democrats had just a simple majority in the Senate, they could amend the
00:18:56.520 constitution. That's all it would require. Uh, a profoundly stupid individual is
00:19:01.980 Don Lemon. Um, and also a partisan dishonest hack on top of it. That's, that's, that's tough break
00:19:07.820 when you're, you know, stupid as well as incredibly dishonest, which is why for me, it's like, I,
00:19:14.360 that's why I figure I know I'm stupid. So I might as well try to be honest. Like I got to have
00:19:17.920 something going for me at least. Let's go to number two. Uh, Alan DeGeneres was back on the air
00:19:22.600 yesterday and her opening monologue, she addressed all of the accusations that, uh, have been circling
00:19:28.020 around out there that she's a monstrous sociopath who mistreats everybody around her.
00:19:32.400 And here she is addressing it. As you may have heard this summer, there were allegations of a
00:19:37.780 toxic work environment at our show. And then there was an investigation. I learned that things
00:19:43.020 happened here that never should have happened. I take that very seriously. And I want to say,
00:19:47.320 I am so sorry to the people who were affected. I know that I'm in a position of privilege and power.
00:19:53.040 And I realized that with that comes responsibility. And I take responsibility for what happens at my

00:20:09.820 We have had a lot of conversations over the last few weeks about the show,
00:20:13.720 our workplace and what we want for the future. We have made the necessary changes. And today

00:20:25.460 I, I felt like she was just taking whatever BS spiel she gave to the staff during the staff meeting,
00:20:31.500 you know, when they first got together and repeating it here. Also the whole idea that
00:20:36.140 she found out about bad things that happened is obviously bogus because the whole controversy
00:20:42.260 and scandal was that she was the one doing the bad thing. So she's claiming that she,
00:20:46.540 she found out about the things that she herself was allegedly doing. Now you could always say,
00:20:51.120 of course, that you don't believe all these stories about Ellen DeGeneres. And, um, I fully agree that
00:20:56.460 false accusations do happen, but there is a certain point, right? Where, you know, I mean,
00:21:02.900 dozens of people who, who have worked with you and have been around you are all saying the same
00:21:09.500 things about you and telling the same kinds of stories. There's a point where there's no plausible
00:21:15.140 reason to disbelieve it. And then what's also conspicuous is that all these people coming out,
00:21:20.340 some on the record, some off the record saying Elle DeGeneres is just an absolute sociopath and is
00:21:24.300 horrible to everybody. And all of that, uh, like you can't even look her in the eyes when she walks down
00:21:28.340 the hallway, that kind of thing. There's really, there was really nobody, very, very few people
00:21:33.660 coming out in defense of her and saying, no, you know what? This is crazy. She's a wonderful person.
00:21:38.120 Very few people saying that. And that's, that really, you know, that's, that's an indication
00:21:42.400 that there's an issue when everyone who's ever been around you agrees that you're a scumbag and
00:21:46.680 almost no one who's been around you will say otherwise. Well, you know, I think probably
00:21:51.000 we can draw some conclusions at that point. Number three from the daily wire, uh, it says NBA superstar,
00:21:57.760 LeBron James claims that the votes of black people do not matter in America,
00:22:01.800 noting that he's seen recounts and apparent suggesting that black votes have been intentionally
00:22:06.560 voided in his lifetime. Um, James said black people in the community don't believe that their vote
00:22:12.240 matters. And he was explaining why he was apathetic about voting when he was younger. We grow up and
00:22:17.400 don't think that our vote actually matters. It doesn't. We've seen recounts before we've seen our
00:22:21.940 voices be muted our whole lives. And then he goes on from there. Yes. Uh, LeBron James,
00:22:29.080 superstar, mega celebrity. I mean, everything he says is headline news, but his voice is being muted.
00:22:37.160 LeBron James's voice is being muted. Let me, let me just ask LeBron at this point. Um,
00:22:43.300 maybe you could just tell us LeBron, how much attention do you need the whole world to pay to you?
00:22:52.320 Before you will agree that you're not being oppressed. Like how much is needed? Because
00:22:58.280 right now, do you need to, I guess my question is, do you actually need everyone in the world to,
00:23:05.040 to do nothing with their lives, but listen to you and talk about you? Is that what you require in
00:23:10.700 order to not be oppressed anymore? Because apparently being a multimillionaire, mega, super famous

00:25:41.000 of works out. So I didn't watch it, but I did, uh, there was one segment from the show that caught
00:25:45.800 my eye after the fact, as it's been making the rounds online. This is a, I guess supposed to be
00:25:51.700 a comedy bit between host Jimmy Kimmel and actor Anthony Anderson. But the cringe factor here is off
00:25:58.920 the charts. Watch. Before we announce the nominees, you know, I have a few things that, uh, I'd like to
00:26:04.480 say. You do? Yes, I do. Because in rehearsal, I thought we decided that we're just going to- You
00:26:09.560 know, we have a record number of black Emmy nominees this year, which is great. This is the part where

00:26:26.240 have been all-star. These Emmys would have been NBA All-Star Weekend and Wakanda all wrapped in one.

00:29:17.400 was still smashed. He performed the choreography, dance, the jig, jump through the hoops, and
00:29:22.780 they still went after him anyway. That's the way it goes. Cause that's the way it always
00:29:26.000 goes. And when I say that's the way it always goes, I mean, I'm talking about going back through
00:29:30.780 history. Okay. Way before BLM, this is how evil oppressors always operate. This is one of the
00:29:36.880 hallmarks of oppressors is that they demand pledges of allegiance, displays of fealty,
00:29:42.400 whether sincere or not. One of the most common things that tyrants do is that they, they, they,
00:29:49.300 they need you to at least pretend. They need you to say the words and perform the actions.
00:29:55.000 Your purse, because your personal views are irrelevant to them. They don't care about that. It's your
00:29:58.760 submission they want. So BLM is following this script and there's a lot of historical precedent
00:30:04.400 for it. None of it good, but there's a lot of it. On the other hand, you know, you notice how
00:30:09.160 you never see gangs of, of pro-lifers at the March for Life. You never see them gathering around
00:30:17.080 someone and demanding that the person express their support for the pro-life cause. That never happens
00:30:24.500 because pro-lifers really care about their professed cause and their professed cause is saving babies
00:30:31.320 and coerced statements of, of, of support from people who are scared of, you know, getting their
00:30:37.740 asses kicked by a mob of angry people that does nothing to advance the cause of saving babies.
00:30:43.060 Now for BLM, Antifa, et cetera, the real cause is control and coerced statements of support really do
00:30:52.320 advance that cause. And they would advance it no matter what the statement was. Doesn't even matter
00:30:57.940 what it is. They might as well demand that you do the Macarena or, you know, saying she'll be coming

00:32:19.060 function is. It serves the function of Japan being able to say to the world, Hey guys, look at this
00:32:23.800 thing that we did. And the world goes, Oh, cool. And that's it. That's the whole purpose.

00:32:33.420 spent years going to work to build this. Okay, honey, I'm off to work to buy the, to build the
00:32:38.540 giant robot today. All right. Hey, by the way, has anyone explained to you why you're doing that?

00:32:49.600 Japan is going to take over the world with its giant robots. They're saying that we should be
00:32:53.760 shaking in our tiny boots as we behold the future of warfare. No. Do you realize how utterly useless
00:33:00.360 this hunk of metal would be in the context of modern warfare? First of all, you could easily knock
00:33:06.760 it over with a missile from a fighter jet. That would be it. Probably a strong wind would do it.
00:33:10.220 And then it will crash down and crush whatever happens to be underneath it.
00:33:13.760 Speaking of crushing things, where would you use this robot? You couldn't use it to defend your
00:33:18.740 own cities because you just ended up destroying as many buildings as you save, which if you recall
00:33:22.760 was a major problem in Power Rangers. Are you going to try to launch some sort of foreign invasion
00:33:27.220 with these things? The enemy would see you coming literally from a mile away, lumbering along at the,
00:33:33.560 you know, the speed of two miles an hour in your giant tin cans. A few missiles later and all of
00:33:38.040 your robots are splayed out on the ground like really expensive dominoes. You know where this
00:33:43.000 would come in handy? If you were, say, laying siege to a fortress in medieval Europe. I could see it
00:33:51.420 being useful in that setting. But unfortunately, Japan is about 600 years too late for that. It would
00:33:56.920 also be useful in the Star Wars universe, where the technology to make fully conscious robots
00:34:01.440 is so ubiquitous that every hobo in the galaxy has five of them a piece. And everyone flies around
00:34:07.860 in spaceships that can exceed the speed of light like it's nothing. And yet the most advanced weapon
00:34:12.680 is a laser sword. You know, that you need to be within two feet of the enemy to use. So in that sort of
00:34:20.640 reality where technology is somehow a million years ahead of us and 700 years behind us at the same
00:34:25.520 time, I could see the giant robot filling a role. But not in this reality. The reality we happen to
00:34:33.080 live in and are stuck with. Listen, I would love if there was a real function for giant robots
00:34:39.760 in this world. I would. But there isn't. And so for that reason, Japan is canceled.
