00:00:03.360 The Biden vaccine mandate is as good as dead.
00:00:06.120 We said do not comply, and you did not comply.
00:00:08.320 In fact, over a million of you signed our petition saying as much.
00:00:12.020 And today, together, we kick the government's ass.
00:00:15.120 Today, the Supreme Court decided, by a huge majority of 6-3, to stay the Biden administration's
00:00:20.520 unconstitutional private employer vaccine mandate.
00:00:24.120 It's just a tremendous day for the American people, and a tremendous day for the founding
00:00:27.680 idea that this is a limited government of enumerated powers which exist to protect, not erode,
00:00:33.560 the God-given freedoms of the people.
00:00:35.560 More, the court stay will prevail even if the Sixth Circuit somehow rules in favor of the
00:00:40.180 Biden administration at some future date.
00:00:43.100 This spells all but certain doom for OSHA's unimaginable overreach into the private health
00:00:47.320 decisions of some 85 million Americans whose only crime is having a job at a company with
00:00:52.520 more than 100 employees.
00:00:54.480 According to the order, the Supreme Court said, quote, although COVID-19 is a risk that occurs
00:00:59.520 in many workplaces, it's not an occupational hazard in most.
00:01:03.680 COVID-19 can and does spread at home, in schools, during sporting events, and everywhere else
00:01:08.640 that people gather.
00:01:10.140 That kind of universal risk is no different from the day-to-day dangers that all face,
00:01:14.880 from crime, air pollution, or any number of communicable diseases.
00:01:18.900 Permitting OSHA to regulate the hazards of daily life simply because most Americans have jobs
00:01:23.660 and face those same risks while on the clock would significantly expand OSHA's regulatory
00:01:28.140 authority without clear congressional authorization.

00:01:34.860 The order further states, quote, although Congress has indisputably given OSHA the power to regulate
00:01:40.220 occupational dangers, it has not given that agency the power to regulate public health
00:01:44.380 more broadly.
00:01:45.340 Requiring the vaccination of 84 million Americans, selected simply because they work for employers
00:01:50.540 with more than 100 employees, certainly falls in the latter category.
00:01:54.060 So what does all this mean?
00:01:55.980 Well, it means we won.
00:01:57.420 It means we're still free.
00:01:58.540 It means the complainants, beginning with the Daily Wire, who brought the first in the
00:02:02.540 nation lawsuit against the mandate, and the nearly 60 other complainants, including the
00:02:07.020 Federation of Independent Business and a coalition of states who are invited to give oral arguments
00:02:11.340 before the court, have prevailed in our application for injunctive relief.
00:02:15.900 And it means that for today, and very likely forever, Joe Biden's attempt to turn private
00:02:20.700 employers into the enforcement arm of his federal vaccination scheme will not be implemented.
00:02:26.620 The scope of just how badly we beat the bastards is hard to overemphasize.
00:02:31.260 Writing in concurrence with the order, Justices Gorsuch, Thomas, and Alito point out that had OSHA's
00:02:36.780 rule been allowed to stand, quote, the law would afford OSHA almost unlimited discretion.
00:02:43.260 Says the concurring opinion, quote, the question before us is not how to respond to the pandemic,
00:02:48.620 but who holds the power to do so? The answer is clear. Under the law as it stands today,
00:02:53.980 that power rests with the states and Congress, not OSHA. If the court were to grant such emergency
00:03:00.140 powers, say the justices, declaration of emergencies would never end, and the liberties our
00:03:04.620 Constitution's separation of powers seek to preserve would amount to little. Total victory. Not
00:03:11.020 just for the millions of Americans who've exercised their right not to be vaccinated,
00:03:15.020 but the millions more who oppose the tyranny of this mandate, regardless of their vaccine status.
00:03:20.540 And utter defeat for the Biden government, which sought to enforce its will on the American people,
00:03:26.380 literally into the veins of the American people, at threat of financial ruin,
00:03:30.780 just because they're convinced that they know better than you do.
