00:02:32.540 that you heard about Cozy Earth right here. The jury tasked with deciding Lindsay Clancy's fate
00:02:39.540 remaining deadlocked after nearly 30 hours of deliberations, prompting the judge to use a last
00:02:44.600 resort instruction meant to push the panel toward a verdict. Yesterday's proceedings beginning with
00:02:49.600 fallout from an incident outside the courthouse one day earlier. Judge William Sullivan questioning
00:02:54.820 all 12 jurors under oath, making sure none had seen or heard anything that could compromise
00:03:00.680 their impartiality. The questioning following the arrest of a 56-year-old woman accused of
00:03:06.040 filming jurors as they left the courthouse Tuesday afternoon. The woman, Dawn Light,
00:03:11.060 pleading not guilty Wednesday to a felony jury intimidation charge, her attorney reportedly
00:03:16.320 calling the incident a misunderstanding, saying Light only wanted a picture of Lindsay Clancy.
00:03:21.520 Judge Sullivan apparently satisfied the jury could remain fair,
00:03:24.700 sending the panel back to continue deliberating.
00:03:27.640 Shortly after 2 p.m., another note.
00:03:29.800 The juror is telling the court, quote,
00:03:31.540 After much deliberation, we are still unable to come to a unanimous decision.
00:03:37.160 Their second declaration of a deadlock triggering what Massachusetts calls
00:03:40.540 the Tui Rodriguez charge, more commonly known as, quote, dynamite charge.
00:03:45.860 The nickname reflecting what the instruction is designed to do,
00:03:48.600 break through a deeply entrenched disagreement, giving the jury one final chance to reach a
00:03:54.040 unanimous verdict. The instruction pressing jurors on both sides to reconsider their positions.
00:04:00.440 At the same time, Judge Sullivan stressing that no juror should surrender an honest conviction
00:04:05.680 simply to agree with the others or produce a verdict. The charge bringing the trial closer
00:04:10.460 to a possible mistrial, while stopping short of making one inevitable. Under Massachusetts law,
00:04:16.000 once a jury returns a second time without a verdict, the judge cannot send it back again
00:04:20.880 without the juror's consent, unless the panel asks for another explanation of the law.
00:04:26.060 Now, if the jury reports another deadlock, jurors could agree to keep trying, or Judge
00:04:30.920 Sullivan could declare a mistrial. A mistrial would not amount to an acquittal. Prosecutors
00:04:35.780 would instead have to decide whether to try Clancy again. The jury set to resume deliberations
00:04:41.080 this morning. The man accused of running a cocaine ring through two fraternities tied to
00:04:47.220 Penn State now granted bail following testimony from several former students. 24-year-old Agostino
00:04:54.140 Abitiello, among 14 people charged in the alleged operation, which authorities say supplied cocaine
00:05:00.520 largely to Penn State students in 2023 and 2024. Prosecutors alleging Abitiello and former student
00:05:08.200 Thomas Robinson served as the operation's main suppliers, obtaining cocaine from New York and
00:05:13.800 Philadelphia. Fraternity pledges allegedly helping cut and package the drugs inside the
00:05:19.140 off-campus Sigma Chi and Delta Epsilon houses. Several other defendants also appearing for court
00:05:24.300 proceedings Wednesday, with some waiving their own preliminary hearings and allowing the charges
00:05:28.960 against them to move forward. Former student Thomas Robinson, described by authorities as
00:05:34.300 second only to Abitiello in the alleged operation, among those still taking the stand during
00:05:39.240 Abitiello's hearing. Robinson testifying that he began selling cocaine in 2023,
00:05:44.760 stored the drugs inside the Delta Upsilon house, and later purchased increasingly large quantities
00:05:50.020 directly from Abitiello. Former Delta Upsilon member Mohamed Huraibi also testifying that he
00:05:56.080 and Robinson bought cocaine from Abitiello, claiming Abitiello would only sell to people
00:06:01.280 who had been introduced to him, according to WJAC. Former Sigma Chi member Lars Zepfat himself
00:06:07.680 charged in the case, testifying that he also sold cocaine for Abitiello. Zepfat describing it as his
00:06:14.360 personal opinion that Abitiello was the biggest drug dealer at Penn State and testifying that
00:06:19.680 Abitiello pleaded with him not to cooperate with investigators. After Zepfat was later directed to
00:06:25.580 appear before a grand jury, he says Abitiello repeatedly told him, quote, please don't say
00:06:30.720 anything. Please don't say anything. Following that testimony, the judge ruling there is enough
00:06:36.240 evidence for Abitiello's charges to proceed toward trial. The judge also granting Abitiello
00:06:41.640 secured bail set at $250,000. Abitiello required to surrender his passport, live with his parents,
00:06:49.420 avoid drugs and alcohol, and have no contact with witnesses, according to ABC News. A separate
00:06:55.260 preliminary hearing focusing on Paul Robinson, the only non-student charged in the case.
00:07:00.620 The 59-year-old Pittsburgh attorney and father of Thomas Robinson facing felony charges of
00:07:05.420 tampering with evidence and hindering apprehension. Former Delta Upsilon member Ryan Mattson,
00:07:10.860 who has not been charged, testifying that he stored Thomas Robinson's safe beneath a desk
00:07:15.360 in his apartment. Following Thomas Robinson's December 2024 arrest, Mattson saying he and
00:07:21.000 another student drove the safe into the woods and covered it with leaves, dirt, and sticks.
00:07:26.580 Two days after Thomas posted bail, Matson testifying that Paul Robinson drove with him
00:07:31.640 to retrieve the safe, covered it with a blanket, and placed it in his car. Matson saying Paul
00:07:37.060 Robinson later asked him not to tell anyone about retrieving it. A state prosecutor telling the judge
00:07:42.600 that Thomas Robinson previously testified before the grand jury that he placed roughly 100 grams
00:07:51.000 in cash inside the safe. Paul Robinson's attorney arguing there is no evidence his client knew
00:07:57.040 what the safe contained, pointing out that text messages between Paul Robinson and Mattson
00:08:01.860 never mentioned drugs or money. Mattson also acknowledging that Paul Robinson never offered
00:08:07.080 him anything in exchange for his help. The judge ultimately ruling there is enough evidence for
00:08:12.280 the charges against Paul Robinson to move forward as well. The eight remaining defendants, all facing
00:08:18.280 misdemeanor drug charges, scheduled to appear for preliminary hearings October 14th.
00:08:24.540 Coming up, a five-year-old girl found dead after a massive overnight search. Her parents now accused
00:08:30.200 of steering crews away from the water where she was found. Tiger Woods avoiding jail in his DUI
00:08:36.140 case, but now barred from driving for five years. Everyone's talking about weight loss injections
00:08:45.820 because the results can be so dramatic.
00:08:48.220 They work by lowering blood sugar and reducing appetite.
00:08:51.660 But what if you're looking to lose weight
00:08:53.260 but are not interested in painful weekly injections,
00:08:56.860 especially when you hear about
00:08:57.780 some of those intense side effects?
00:09:00.060 That's why doctors created a weight loss supplement
00:09:02.280 called Lean, and the results could be remarkable.
00:09:06.020 Lean says the studied ingredients in their product
00:09:08.460 have been shown to lower your blood sugar,
00:09:10.860 burn fat by converting it into energy,
00:09:13.220 and to curb your appetite and cravings
00:09:15.760 so you are not as hungry.
00:09:17.760 But listen, lean is not for the casual dieter
00:09:20.120 with only a few pounds to lose.

00:09:45.640 The parents of five-year-old Sailor Hayes now under arrest following her disappearance and
00:09:50.500 death in South Carolina, with investigators accusing them of failing to protect their
00:09:55.000 severely nonverbal autistic daughter, then allegedly sending parts of the massive search
00:09:59.840 in the wrong direction. 70-year-old John Herb Hayes III and 31-year-old Jordan Nicole Hayes
00:10:06.000 arrested Tuesday evening in Carter County, Tennessee, each now facing a South Carolina
00:10:11.060 charge of unlawfully placing a child at risk or willfully abandoning a child. The arrest warrants
00:10:17.400 alleging the parents left Sailor unsupervised roughly 50 feet from the water despite her history
00:10:22.380 of wandering and what investigators describe as her known attraction to water. Agents with the
00:10:27.320 State Department of Natural Resources recovering Sailor's body at about 9.45 Monday morning,
00:10:32.240 finding her in the water near the place she was last seen.
00:10:35.480 The coroner reporting no visible signs of trauma.
00:10:38.440 Saylor's cause and manner of death remaining undetermined,
00:10:41.460 with an autopsy scheduled for tomorrow.
00:10:43.880 Saylor reportedly missing beginning on Sunday morning,
00:10:47.080 allegedly wandering away from the family's vacation rental on Polly's Island.
00:10:51.300 Her father, John, sounding increasingly frantic in a 911 call.
00:10:55.620 I need help.
00:10:56.380 My little four-year-old, five-year-old girl is very autistic, just escaped.
00:11:02.240 I'm at 76 Walk-A-Mall Drive.
00:11:05.180 She's took off.
00:11:06.080 I need help finding her.
00:11:08.020 Please, 76 Walk-A-Mall Drive, as soon as possible.
00:11:10.880 I don't see her anywhere.
00:11:12.560 She's autistic.
00:11:14.100 She's very autistic.
00:11:15.740 She's bad.
00:11:16.640 She's real bad.
00:11:17.960 That call setting off an enormous search lasting through the day and overnight.
00:11:22.420 Sheriff's deputies, firefighters, and K-9 teams combing the neighborhood
00:11:26.200 while boats and divers searching the surrounding shoreline and docks.
00:11:29.700 The South Carolina Law Enforcement Division sending a helicopter and an underwater drone.
00:11:35.660 The Coast Guard deploying a vessel, while a Charleston County Sheriff's Office helicopter joining the search with special tracking equipment.
00:11:42.600 Hundreds of local residents also searching properties and guarding docks.
00:11:46.840 A major part of that operation relying on Project LifeSaver, a program providing wearable radio transmitters for people with cognitive conditions who may be prone to wandering.
00:11:56.420 Saylor enrolled in the program in June of 2024, wearing a transmitter secured around her ankle.
00:12:01.960 South Carolina searchers trying repeatedly to detect Saylor's assigned frequency from the ground in the air without getting a signal.
00:12:09.220 Authorities then contacting the Washington County Sheriff's Office back in Virginia, asking deputies to check the family's home.
00:12:15.640 Those deputies detecting Saylor's frequency there, following it to a vehicle on the property, and finding the transmitter inside.
00:12:23.060 the tracking device never making the trip to South Carolina.
00:12:26.580 Washington County Sheriff Blake Andes saying the band had been working on Sailor's Ankle as recently as August 11th,
00:12:32.880 with investigators determining it was removed before the family left Virginia.
00:12:37.120 The band designed for continuous wear with a one-way closure,
00:12:40.840 meaning it cannot simply be unclasped or taken off by the child.
00:12:44.600 Authorities saying it must be physically cut to remove it.
00:12:47.980 Officials not yet saying who cut off the bracelet or exactly when.
00:12:52.480 Investigators alleging the parents knew Sailor was not wearing her tracking device,
00:12:56.300 yet encouraged searchers to keep trying to locate its signal.
00:13:00.060 The warrants further accusing them of directing search efforts away from the nearby water.
00:13:04.840 Both parents arrested Tuesday in Tennessee and booked on one count each of being a fugitive
00:13:09.800 from justice for a crime in another state.
00:13:12.400 They are being held without bond, an extradition hearing set for later this morning.
00:13:16.460 Tiger Woods striking a plea deal in his Florida DUI case,
00:13:21.620 avoiding jail but losing his driver's license for five years.
00:13:25.720 The 50-year-old golfer appearing yesterday in Martin County Circuit Court in Florida,
00:13:29.840 accompanied by his girlfriend, Vanessa Trump.
00:13:32.520 Woods saying little during the hearing,
00:13:34.420 speaking only to confirm that he had read and understood the agreement.
00:13:38.240 Woods pleading no contest to a reduced charge of reckless driving,
00:13:41.540 along with refusing to submit to a lawful test.
00:13:44.240 A no-contest plea not formally admitting guilt while allowing the court to treat the case as a conviction.
00:13:50.920 The court also finding Woods guilty of careless driving, a separate traffic violation.
00:13:55.640 The agreement requiring Woods to pay roughly $1,500 in fines,
00:14:00.040 with two five-year license suspensions running at the same time, according to Fox 29.
00:14:05.220 Judge Darren Steele issuing Woods a warning during yesterday's proceedings.
00:14:09.000 So I want you to understand that five years of driving is for the safety of the public.
00:14:13.980 There are no exceptions.
00:14:15.720 If you were to lie for any reason at all, you would go immediately back to jail.
00:14:19.700 The original DUI case ultimately turning on whether prosecutors could prove Woods was impaired by medication.
00:14:25.060 The March 27th crash occurred when Woods' SUV allegedly struck a trailer and rolled onto its side.
00:14:32.140 Neither driver suffering injuries, according to the Associated Press.
00:14:35.760 Authorities finding no alcohol in Woods' breath sample.
00:14:39.060 A deputy allegedly discovering two hydrocodone pills in his pocket.
00:14:43.220 Woods declining additional testing that could have shown whether drugs were in his system.
00:14:47.520 Investigators still documenting what they considered possible signs of impairment.
00:14:51.760 Martin County Sheriff's Deputy Tatiana Levinar writing that Woods was, quote,
00:14:55.700 sweating profusely, describing his movements as, quote, lethargic and slow.
00:15:00.160 Woods reportedly offering distraction as the explanation for the crash,
00:15:03.420 telling investigators his attention had shifted to his phone and the radio as the truck ahead of him slowed.
00:15:09.460 The deal prompting some criticism that Woods may have received favorable treatment because of his fame.
00:15:14.760 Martin County State Attorney Thomas Bacadal addressing that criticism yesterday during a press conference.
00:15:20.680 As it relates to our ability to prove, A, that he was under the influence of hydrocodone, and B, that he was impaired.
00:15:28.460 Both toxicologists reviewing the information and evidence provided to them were of the opinion that there was insufficient proof.
00:15:37.460 The defense expert indicated, at the conclusion of his report,
00:15:43.380 indicated that Mr. Woods, as a result of his use of this particular type of substance,
00:15:51.440 had built up what they called a pharmacological tolerance.
00:15:56.460 So what the doctors indicated as a result of Mr. Woods' long-term use,
00:16:02.520 he had built up a tolerance.
00:16:04.180 If he has a tolerance, then guess what?
00:16:06.600 It doesn't impair him.
00:16:08.640 So, and if he's not impaired, guess what?
00:16:11.640 I can't prove DUI.
00:16:13.820 And if I can't prove DUI, guess what?
00:16:17.920 I better come up with another plan.
00:16:20.760 This is how cases progress.
00:16:22.920 After his arrest, Woods announcing that he would step away from golf for a, quote,
00:16:26.840 period of time to seek treatment and focus on my health.
00:16:30.060 Woods later spending several weeks at an inpatient treatment facility in Switzerland,
00:16:34.060 according to ESPN.
00:16:35.660 This marking Woods' second DUI-related case in Florida,
00:16:38.860 after police found him asleep behind the wheel in 2017 following what he described as a bad mix of pain medications.
00:16:45.760 Woods later pleading guilty to reckless driving and seeking treatment for prescription drug use.
00:16:50.620 In 2021, Woods suffering serious leg injuries when his SUV rolled several times in a separate crash outside Los Angeles.
00:17:00.100 That'll do it for your AM update.
