00:01:20.840 but we begin with the breaking news out of the high court in a truly surprising decision.
00:01:25.960 The justices in a 5-4 decision upholding a Mississippi law already it's weird because the Trump administration is on the other side of a Mississippi law, which you would already expect that those two things would be aligned, the Trump administration and a Mississippi law, but they weren't.
00:01:42.340 the Republican National Committee actually brought this suit and then the Trump administration got
00:01:46.320 involved because it involves what is the question of what does election day mean? When can one vote
00:01:53.080 when the law says election day is this particular day? Can they vote for two weeks after, two months
00:01:59.520 after, like in California, where it seems as long as you can convince them that your ballot
00:02:05.780 may even have your own handwriting on it saying, I swear this is being postmarked on election day,
00:02:11.300 It can be counted for days and weeks thereafter. Or does it have to be the day of? Does that ballot have to be received the day of the election? And the Trump administration and the RNC have lost. And this is big. This is this is I'm sorry to say this, but this is a massive gift to Democrats.

00:05:18.000 conservatives to libs. And today we only had four conservatives and that's how we lost because
00:05:25.940 Roberts and Barrett jumped over to the liberal side and Barrett even wrote the court's majority
00:05:33.180 opinion. Mississippi's a red state. But the decision is expected to have a major impact 0.68
00:05:39.440 more than anywhere in Democrat heavy states whose elected officials often encourage residents to
00:05:46.440 vote by mail, which in turn causes votes to still be counted days, if not weeks after the election's
00:05:52.680 over. Case in point, California, as I mentioned, with the Spencer Pratt situation there. The RNC,
00:05:58.540 the state Republican Party, various individuals as well, had filed the initial lawsuit.
00:06:02.020 And the case was combined with a similar lawsuit from the Libertarian Party of Mississippi.
00:06:07.380 The plaintiffs arguing that the federal law defines an election as the day by which ballots
00:06:14.400 must both be cast and received, meaning absentee votes received after election day should not be
00:06:22.740 counted. This just seems so basic. But the majority at the high court disagreed with Barrett writing,
00:06:29.500 quote, Election Day statutes do not set a deadline for ballot receipt, so they do not
00:06:34.660 prevent Mississippi from counting ballots postmarked before Election Day yet received
00:06:40.460 afterward. Justice Alito, a true conservative, writing a blistering dissent, quote, Not only is
00:06:46.560 today's decision inconsistent with statutory text, legal context, historical practice and precedent,
00:06:52.320 it also threatens to produce lamentable consequences. The majority's holding spawns
00:06:58.140 a slurry of troubling election law questions and risks further undermining America's confidence
00:07:05.720 in election integrity. Boy, does he get it. Alito during oral arguments appearing to make the case
00:07:11.760 that election day should, as every other quote day with a capital D we have, be considered one
00:07:19.080 single day. We have lots of phrases that involve two words, the last of which the second of which
00:07:27.940 is day. Labor Day, Memorial Day, George Washington's birthday, Independence Day, birthday, and
00:07:36.600 Election Day. And they're all particular days. So if we start with that, if I have nothing
00:07:44.300 more to look at than the phrase Election Day, I think this is the day in which everything
00:07:50.940 is going to take place, or almost everything. And then we have three points in time.
00:07:57.940 1844, 1872, 1914. And we can ask, what would people have thought on those days is meant by
00:08:05.820 this phrase election day? Well, unfortunately, didn't go his way. Those years that Justice
00:08:12.540 Alito listed there are the years the federal election laws at issue in the case became law.
00:08:17.260 According to the New York Times, there are similar absentee ballot laws in at least 18 other states

00:12:05.180 Yeah, we're going to have this. The effect of this Supreme Court ruling written by Justice Amy Coney Barrett, Professor Barrett, is we're going to have third world elections. Election day does not mean election day.
00:12:20.040 It means on Election Day, when Democrats figure out how many votes they're behind, they're going to be able to go find those votes, fill out ballots, have their postal workers postmark those ballots.

00:13:31.680 Then you made a reference to a pair of other decisions that came out today and they involve
00:13:37.000 two federal firings that Trump affected.
00:13:39.720 Um, one was of Lisa Cook, who is a member of the board of governors on the federal reserve.
00:13:47.160 The audience may remember she was accused of having lied in her mortgage applications,
00:13:54.060 uh, in a way that was deeply troubling and she got fired as a result of it.
00:13:59.040 And she filed a lawsuit saying, you can't fire me for stuff I may or may not have done
00:14:04.580 prior to being nominated for this role. And like, as if, you know, whoops, you found out that I
00:14:11.440 committed, you know, some felony larceny when I was 25. That should no longer be relevant when
00:14:18.080 you're elevating me to an important position of trust. She was trying to argue it happened so
00:14:23.080 long in the distant past and no one raised it. No one caught me when I was applying for this job
00:14:27.400 that you can't ever raise it. That was basically her argument. And whether she actually did it is
00:14:32.740 still in dispute too, though seems pretty clear to me based on what we reviewed. In any event,
00:14:39.220 today the high court said, well, look, the Fed is an independent body and the president's ability
00:14:45.480 to mess with who's on it, who's on that board of governors is more limited than his powers are
00:14:52.820 across other federal agencies. Though they did not say he can never fire her. Basically,
00:14:57.760 they just said he can't fire her during the pendency of her lawsuit. So she is not done yet.
00:15:03.700 She has not won. She won temporarily, and their fight is going to go on, and he could still win
00:15:09.420 that. But he did get a big victory in his attempt to fire Rebecca Kelly Slaughter, who was on the
00:15:16.360 Federal Trade Commission. And the court, Mike, held that the president's powers to fire executives
00:15:24.400 at these so-called independent agencies,
00:15:29.000 whether it's the FTC,
00:15:31.260 the Equal Employment Opportunity Commission,
00:15:34.640 the NLRB, that's the Labor Board,
00:15:36.940 the Nuclear Regulatory Commission,
00:15:38.580 the Consumer Protection Bureau,
00:15:39.680 all these things is much greater
00:15:41.860 than many people thought
00:15:44.980 because it views these
00:15:46.940 as essentially executive agencies
00:15:49.080 and he's the chief executive.
00:15:51.160 And the left is already freaking out about this,
00:15:53.120 saying these are oversight watchdog types. You know, President Trump's going to go nuts like 0.71
00:15:59.060 this president in particular. And Sotomayor basically said that from the bench today, like, 0.86
00:16:03.400 forget it. There's nobody to oversee the president anymore. He can do whatever the hell he wants
00:16:07.860 at any one of these oversight agencies and no one will be watching him. So your thoughts on
00:16:12.300 that pair of rulings, the Lisa Cook and the Rebecca Kelly slaughter.
00:16:16.400 Well, it's very chiefy, as we say, that the chief justice would release these rulings at the same
00:16:23.100 time today. You release one ruling where Rebecca Slaughter gets canned and the Supreme Court says
00:16:29.360 that's okay. And conservatives are very happy. The Supreme Court overturned Humphrey's executor
00:16:35.700 the Supreme Court ruling from the 1930s that said essentially the president can't fire people who
00:16:43.040 work in the executive branch unless he had a good cause. The Supreme Court got rid of that,
00:16:48.480 which is a good thing. Six to three, the six conservatives found their way to stay in line
00:16:53.460 for once. But then we have this other ruling with the Federal Reserve Board Governor, Lisa Cook,
00:16:59.700 where somehow she has special status under our Constitution. I remember reading Article 1 of
00:17:08.580 the Constitution that creates Congress and the legislative power, Article 2 that creates the
00:17:13.300 president and his executive power article three that creates the supreme court the lower federal
00:17:18.540 courts and their judicial power i guess we missed megan when we went to law school this separate
00:17:24.520 part of the constitution that creates this fourth branch of government called the federal reserve
00:17:30.440 board of governors and it's really really really hard for the president of the united states to
00:17:36.260 fire anyone on this federal reserve board of governors that was a five to four decision that
00:17:41.920 apparently the Federal Reserve Board of Governors is separate from the executive branch. Apparently
00:17:47.420 the president doesn't have the Article II power to fire the Federal Reserve Governors,
00:17:53.980 but he does have the power to fire the FTC and other so-called independent commissioners. It's
00:17:59.400 a head-scratcher, but you had the chief justice write that opinion. Justice Kavanaugh joined that
00:18:05.180 opinion, which surprised me, and it was a five-to-four decision with Professor Barrett.

00:19:51.300 is it? I would ask that to the Chief Justice and Justice Kavanaugh. What is the Federal Reserve?
00:19:56.000 If the president doesn't have the power to fire the governors, is that is this some special committee of the Supreme Court, this Federal Reserve Board of Governors?

00:20:54.580 And here is how the president responded on the Cook lawsuit. He writes the Cook lawsuit having to do with her suitability and sitting on the board of the Federal Reserve was sent back by the Supreme Court on a strictly procedural basis. We will take appropriate action immediately to make sure that someone who has committed wrongdoing will not be making vital decisions concerning the welfare of the USA. Thank you for your attention to this matter. And by the way, my team did send me his his comment on Mississippi and what Election Day means. Here's it's very long. I'll read it to you in part.
00:21:22.740 In light of the tremendous loss in the Supreme Court today regarding voters' rights and the fact that people's, in quotes, votes, meaning President Trump has questions about whether these are real votes that come in after the day, are allowed to be counted long after an election's over, it's more important than ever to pass the Save America Act.
00:21:40.840 One, all voters must show up for their ID. Two, all voters must show proof of citizenship. Three, no mail-in ballots except for illness, disability, military deployment or travel. There's no excuse for a politician or otherwise to be against the above three requirements. There is only one reason to oppose cheating. The House of Representatives has approved this vital act three times.
00:21:59.320 the U.S. Senate seems unable to do so in a time when there is a powerful communist movement
00:22:04.140 taking place in our country, one more dangerous than World War I, II, Pearl Harbor, or September
00:22:08.860 11th. All Democrats and our five Republican Senate holdouts, Murkowski, Collins, Tillis,
00:22:14.240 Cassidy, and McConnell must vote to save our country. There can be no more excuses. Those
00:22:19.760 are the senators who are saying no on the Save Act, not just on getting it a vote, but on the
00:22:25.960 actual act itself they are prepared to vote no they don't like the save act and then no i don't
00:22:32.120 i don't know what can be done to preserve integrity uh at the ballot box without the
00:22:38.500 save act and now with this lawsuit uh with this with this supreme court decision back to
00:22:43.080 lisa cook and this rebecca slaughter and this pair of decisions mike something extraordinary
00:22:49.160 happened on the Supreme Court bench. Sotomayor was very angry over the slaughter decision. Again,
00:22:56.480 that's the one in which the court said he does have the ability to fire these executives at
00:23:02.020 these so-called independent agencies, these agencies that I just listed, though they didn't
00:23:06.800 limit them. There's some 18 of them. And basically Trump can fire executives at all of them now.
00:23:11.300 And the next president can too. And they essentially overruled this case called
00:23:15.640 Humphrey's executor that had allowed that. And the court said, no, they're not like the floating
00:23:20.840 piece of bone. They're connected to the spinal column and Trump rules that. But Sotomayor was
00:23:27.780 P.O.ed. She dissented. And this is the New York Times reporter who was in the courtroom writing
00:23:33.660 one of the most notable moments was her dissent when she criticized the court for extending its
00:23:38.820 quote maximalist view of presidential power. She spoke firmly, often extending a look to Chief
00:23:44.760 Justice Roberts, who delivered the majority opinion, which in this case went against the
00:23:49.400 libs. He did not meet her gaze as the minutes went on. She began to stumble over her words
00:23:55.280 as Sotomayor asserted that, quote, the one thing that does appear to be clear going forward
00:24:01.480 is that chaos will follow. End quote. Her fellow liberal Justice Elena Kagan seated several chairs
00:24:08.260 to her left, looked overcome with emotion. What is it with these, you know, the hens up there like, 1.00
00:24:17.020 oh, I'm distraught. I'm overwrought. I'm, you know, pointed barbs about President Trump,
00:24:23.600 the man and overwrought with emotion. This is not good for womankind.
00:24:28.340 I would say this to Justice Sotomayor. Look, does she think that we should have 0.98
00:24:35.380 these executive branch bureaucrats not report to the duly elected president of the United States. 1.00
00:24:44.180 We should just have the Tony Fauci's of the world just do whatever the hell they want. And there's 0.98
00:24:49.880 no Democrats accountability ever. The reason the liberals wanted Humphrey's executor, this
00:24:56.500 Wilsonian mess of government is because the liberals control the federal government. These
00:25:02.420 career bureaucrats who work in the executive branch are overwhelmingly liberals, or even worse,
00:25:09.700 Marxist, socialist, communist, right? And so we're just supposed to defer to these so-called experts
00:25:17.040 who are unelected and unaccountable to anyone, including the American people through our duly
00:25:23.180 elected president. We have something that's called elections to Justice Sotomayor and the other
00:25:29.780 liberal hens. And if they if they if they don't like what the president is doing with his
00:25:37.280 executive branch, A, we don't have to give the executive branch bureaucrats as much power

00:49:56.180 reading a one sided view of the Haitian influx in Springfield. Their presence in Springfield and all
00:50:00.820 of Ohio has been detrimental. But the only people the media interviews are pro Haitian. Our political
00:50:05.900 leaders are not advocating for the majority of the citizens. There are some that work, but at lower
00:50:10.600 wages, less or no benefits and no complaints. That's not good for Americans, by the way. TPS
00:50:16.240 Haitians have been treated better than the citizens of Springfield. There are many complaints

00:50:46.740 fueled the fire. That's what's real. The media is on board with whitewashing all of these problems
