00:03:15.160 why is this administration having so many problems getting rid of the seemingly simple cases?
00:03:20.320 How did this guy's deportation get so screwed up that we have to keep listening and going over it six months later?

00:03:42.400 it's because in part due to incompetence.
00:03:46.840 And I'll explain how.
00:03:48.840 So,
00:03:49.320 first of all,
00:03:50.820 you know,
00:03:51.000 that's the guy who had a withholding of removal order,
00:03:54.240 meaning he went through the immigration courts when they arrested him and accused him of being an MS-13 gang member.
00:04:00.060 And he managed at that time to pitch his sob story to some bleeding heart on the immigration bench
00:04:05.200 who gave him,
00:04:06.760 instead of a deportation notice,
00:04:09.160 gave him kind of a get out of jail free notice,
00:04:12.300 which is called a withholding of removal,
00:04:14.060 meaning you can deport him if you really want to,
00:04:16.600 but you can't deport him to El Salvador because he's convinced me that there are terrible gangs there that mean to do him harm.
00:04:22.340 And I think that was all bullshit.
00:04:23.760 To be honest,
00:04:24.260 I don't believe any of that.
00:04:25.600 I think he just didn't want to go back to El Salvador.
00:04:28.880 And even that notice is no longer good when the threat is removed.
00:04:33.300 So if the gang that was after you has been disbanded 10 years later,
00:04:38.200 you can be sent back to El Salvador.
00:04:40.580 And by the way,
00:04:41.300 that's exactly what happened.

00:04:45.560 so that's the first problem.
00:04:47.400 Some bleeding heart on the immigration bench fell for his little act and gave him that order.
00:04:52.500 Then when we were deporting people under this first year of the Trump administration,
00:04:57.940 he got rounded up appropriately.
00:04:59.780 And the one place we couldn't send him to,
00:05:02.980 we sent him to El Salvador because we struck that deal with Bukele to take these people and put them in this prison.
00:05:10.280 And it wasn't that he wasn't deportable.
00:05:12.180 He was deportable,
00:05:13.160 but just not to there.
00:05:14.920 And then the administration made the mistake of admitting they had made that mistake,
00:05:21.360 which,
00:05:22.280 you know,
00:05:22.620 it's not great to say in court,
00:05:24.600 whoops,
00:05:24.860 we made a mistake.
00:05:26.020 Would have been better to come up with an argument.
00:05:27.640 That's kind of what lawyers do.

00:05:31.640 They were already on record as admitting it was a mistake,
00:05:34.160 turned into a big national controversy.
00:05:36.440 And then they came up with criminal charges to slap him with while they tried to save face
00:05:42.460 and bringing him back to the United States.
00:05:44.620 And out of that is El Salvador in prison and all that after the visit and all the publicity around it.
00:05:49.980 And as soon as he got back here,
00:05:51.640 they slapped him with criminal charges relating to his alleged trafficking,
00:05:54.360 which it was,
00:05:54.720 seems pretty clear he did.
00:05:56.720 So that,
00:05:57.300 that was sort of their,
00:05:58.220 okay,
00:05:58.560 he's coming back,
00:05:59.320 but it's still not a win for the other side because now he's facing criminal charges.
00:06:03.140 And this one judge who's an Obama,
00:06:04.760 Obama appointee,
00:06:05.960 who is also a far leftist,
00:06:07.800 is judge Zinnis.
00:06:09.120 She,
00:06:09.640 she's 100% against the administration on this.
00:06:12.620 And while I'm not on her side,
00:06:13.940 I can't be too harsh on this judge because
00:06:16.220 we've been botching it over on the administration side.
00:06:20.160 I mean,
00:06:20.360 it hasn't been good.
00:06:22.160 And then finally,

00:06:24.860 they go into court for the most recent hearing.
00:06:27.540 Now they're trying to just deport him the old fashioned way,
00:06:29.620 like get out and go to this.

00:06:31.020 It's like Uganda someplace.

00:06:33.080 It's some African country.
00:06:34.020 Can't remember which.
00:06:35.520 And as they're,
00:06:36.680 his lawyers are challenging that they're challenging it all.
00:06:39.120 And to his lawyer's credit,
00:06:41.140 they said,
00:06:41.940 let's let us see the order of removal that preceded,
00:06:46.340 like the order of deportation that preceded the order,
00:06:49.040 the withholding of removal.
00:06:50.520 Cause for,
00:06:51.260 before you say,
00:06:52.280 but you can't deport him to El Salvador,
00:06:54.260 you need the order that says you can deport him.
00:06:58.180 And it turns out they don't have it.
00:07:00.380 That lame immigration judge who handled this thing in the first go round,
00:07:05.140 never issued one.
00:07:07.280 So it turns out he's got an order saying you can't deport him to El Salvador,
00:07:13.460 but he doesn't have an order saying you can deport him.
00:07:16.720 So it's beyond F'd up,
00:07:19.120 which means,
00:07:20.220 and I've contacted many administration officials saying it.
00:07:24.140 Aren't you just going to now get a deportation order from any immigration judge?
00:07:29.900 And they all seem to be telegraphing.

00:07:32.260 that's their next move.
00:07:33.740 But judge Zinnis has said,
00:07:36.000 you're not,
00:07:37.060 you're not locking him back up.

00:07:44.620 they're going to know where he is.
00:07:45.700 And he is going to get dragged before an immigration judge.

00:07:49.860 He's not an American citizen.
00:07:51.300 He has no right to stay here.

00:07:57.840 Soon we will be done with a bad penny and he will be somebody else's problem.

00:08:07.180 crappily our immigration system has been working.

00:08:18.580 He's allegedly trafficking people into the United States,

00:08:28.200 Not to mention his MS-13 gang affiliation,
00:08:31.240 which has been proven to my satisfaction and to the satisfaction of the two

00:08:39.720 which wants to hang on to every last illegal.
00:08:42.400 They're hoping that they'll become voters and put Kamala Harris in office.
