00:00:30.000Good morning, everyone. I'm Megan Kelly. It's Tuesday, October 27th, 2026. And this is your
00:00:38.380AM update. Nothing's changed with me. I'm still innocent. I'm still not afraid of these people.
00:00:43.020And I still believe in the independent federal judiciary. The DOJ bringing two new criminal
00:00:48.660charges against former FBI director James Comey, accusing him of illegally leaking national defense
00:00:54.920information to the media a decade ago. Brazil's left-wing president Lula da Silva winning a surprise
00:01:01.920fourth term, defeating the son of former president Jair Bolsonaro and breaking a recent streak of
00:01:08.620right-wing victories across Latin America. A 15-year-old boy accused of shooting 11 people
00:01:14.560near Florida A&M University set to be tried as an adult. And a man who went to extraordinary lengths
00:01:24.060to hide the evidence, convicted of stealing nearly $770,000 worth of diamond earrings
00:01:30.820from Tiffany & Co. All that and more coming up in just a moment on your AM Update.
00:01:40.040Our sponsor, the Electronic Payments Coalition, says Washington politicians are always getting
00:01:45.200in your wallet, and now they're messing with your credit card. They say your credit card and
00:01:50.000the security it offers are under attack, and that Senators Dick Durbin and Roger Marshall
00:01:54.820want to change the nation's payment system to benefit corporate megastores like Walmart and
00:01:59.700Target at the expense of everyday Americans. Credit cards can keep your payments secure
00:02:04.680and provide rewards that families use to help make everyday purchases more affordable.
00:02:09.500The Electronic Payments Coalition says the Durbin-Marshall mandates would let corporate
00:02:13.780megastores cut corners on credit card processing, routing transactions over cheaper, untested
00:02:19.140networks with weaker security and fewer protections. Find out more at GuardYourCard.com

00:02:29.420The DOJ bringing two new criminal charges against former FBI Director James Comey,
00:02:35.420accusing him of illegally disclosing national defense information to the media a decade ago.
00:02:41.280Prosecutors filing the charges under seal on October 5th, Trump appointed U.S. District Judge
00:02:46.360Trevor McFadden, granting Comey's request to make the case public yesterday. The two-count
00:02:51.780filing accusing Comey of violating the Espionage Act by knowingly transmitting sensitive national
00:02:57.860defense information to someone who was not authorized to receive it and conspiring with
00:03:02.500others to arrange the disclosure. According to prosecutors, the alleged misconduct taking place
00:03:07.720in October 2016 while Comey was serving as FBI director. The filing alleging Comey worked through
00:03:14.580one or more co-conspirators to direct an unnamed individual to share national defense
00:03:19.720information with a reporter for a major news publication. According to court filings,
00:03:24.740the allegations centering on an October 5, 2016 article in the New York Times about Yahoo's
00:03:31.180cooperation with a secret government email surveillance program. Prosecutors allege Comey
00:03:36.480sought to correct inaccurate information published by Reuters the previous day,
00:03:40.820directing FBI staff to speak with a Times journalist about the earlier report.
00:03:46.460The DOJ arguing those communications resulted in the illegal disclosure of classified national
00:03:51.640defense information. Prosecutors filing through a legal procedure known as a criminal information,
00:03:57.580a formal document allowing prosecutors to bring charges against someone without first securing
00:04:02.180an indictment from a grand jury. While the procedure is sometimes used when a defendant
00:04:07.140agrees to plead guilty, that's not the case here. MSNOW legal analyst and former federal
00:04:12.720prosecutor Andrew Wiseman and longtime Comey supporter assessing Comey's legal strategy last
00:04:18.520night. It appears that James Comey has been aware of these charges coming down the pike and has both
00:04:24.500moved to unseal and to simultaneously to dismiss them. We don't know how the judge will rule on
00:04:32.660But there's those are very unusual things to see the defendant agreeing that the charges can be brought, but then saying and they should be immediately be dismissed.
00:04:42.800That suggests to me, given the caliber of James Comey's defense team, that there may be a real problem, a real flaw in the case.
00:04:51.120But that remains to be seen because we haven't seen those papers where James Comey says this is why the case should be dismissed.
00:04:57.220A DOJ spokesperson telling the Associated Press prosecutors filed the document to prevent the 10-year statute of limitations from expiring, describing the practice as widely recognized and approved by multiple federal appeals courts.
00:05:10.640Comey is challenging the prosecution, his attorneys arguing that the government was required to obtain an indictment within 10 years and that filing a criminal information was not enough to stop the statute of limitations from running out.
00:05:24.580Comey responding to the latest charges in a social media video last night.
