00:00:31.220 Welcome to The Megyn Kelly Show, live on Sirius XM Channel 111 every weekday at New East.
00:00:42.620 Hey everyone, I'm Megyn Kelly. Welcome to The Megyn Kelly Show.
00:00:45.980 So for the next week, 10 days, I'm going to be spending some time with my family.
00:00:51.140 We're going on our annual June vacation, so this will be our last new show
00:00:57.800 until I come back on Monday, June 23rd.
00:01:01.100 But we're going to have a lot of great content for you here while I'm gone.
00:01:04.360 Today, however, is new because I needed to weigh in before I go on the status of the Diddy case
00:01:10.020 and also the bombshell that happened this week in the Justin Baldoni-Blake Lively case.
00:01:16.940 Diddy entered its fifth week of trial with testimony from his ex-girlfriend Jane,
00:01:23.560 who we have got to talk about.
00:01:25.880 And on Monday, a judge, a federal district court judge in New York,
00:01:29.860 dismissed Justin Baldoni's $400 million lawsuit
00:01:34.440 against Blake Lively, Ryan Reynolds, The New York Times, and a PR person named Leslie Sloan.
00:01:43.760 It was a resounding victory for Blake Lively.
00:01:47.140 There's no two ways about it.
00:01:49.660 However, that's the legal victory.
00:01:52.640 And we're going to talk about what I mean.
00:01:54.980 Let's be honest.
00:01:56.320 America can still be a dangerous place,
00:01:58.500 and you cannot afford to wait should you need help.
00:02:01.380 Sure, you could use a firearm, but in today's America,
00:02:04.520 defending yourself with deadly force could have some legal consequences, unfortunately.
00:02:09.640 According to FBI data, 99.9% of all altercations do not require lethal force.
00:02:16.220 And that's exactly why many are turning to Burna.
00:02:19.140 Burna is proudly American, hand-assembled in Fort Wayne, Indiana.
00:02:23.080 These less lethal self-defense launchers are trusted by hundreds of government agencies,
00:02:27.900 law enforcement departments, and private security companies.
00:02:30.800 Over 600,000 Burna pistols have been sold,
00:02:33.920 mostly to private citizens who refuse to be victims.
00:02:37.660 Burna launchers fire rocket-hard kinetic rounds
00:02:40.520 and powerful tear gas and pepper projectiles,
00:02:44.300 capable of stopping a threat from up to 60 feet away.
00:02:47.660 No background checks, no waiting periods,
00:02:50.200 and Burna can ship straight to your door.
00:02:52.840 Take responsibility.
00:02:54.120 Protect your future.
00:02:55.540 Visit Burna.com right now,
00:02:57.760 or your local Sportsman warehouse.
00:02:59.360 That's B-Y-R-N-A dot com,
00:03:01.800 or your local Sportsman warehouse.
00:03:03.620 Visit now and be prepared to defend.
00:03:07.220 Let me start with Baldoni.
00:03:08.960 It was a shock.
00:03:09.980 It was a shock to see Judge Louis Lyman of the U.S. District Court in Manhattan
00:03:13.460 dismiss Justin's lawsuit.
00:03:15.380 Just as a reminder of how this case got started,
00:03:17.980 Blake Lively went to the California Human Rights Office,
00:03:24.700 the California Civil Rights Department.
00:03:27.020 And she filed a legal proceeding there to try to get Justin Baldoni in some trouble
00:03:33.940 and trying to sound the alarm that he was some sort of a sexual predator.
00:03:37.900 And very clearly, she then provided that document to the New York Times,
00:03:43.320 and they ran with it.
00:03:45.540 And using the allegations of that complaint,
00:03:48.280 they painted him in a very irresponsible piece as a sexual predator,
00:03:53.140 basically just taking the words of Blake Lively,
00:03:55.760 allegations unproven from that document,
00:03:59.260 and perhaps others, perhaps other statements as well,
00:04:02.160 though exactly what else she provided remains unclear.
00:04:05.700 Here, it should have been exposed in the discovery process,
00:04:09.900 where Baldoni will have the opportunity, or would have,
00:04:12.920 to depose Blake Lively, to depose the New York Times,
00:04:15.880 and figure out exactly what happened, how they got their hands on it,
00:04:19.460 what additional statements were made by Blake Lively
00:04:22.480 and or her team to the Times before they ran with that piece.
00:04:25.860 That's now not going to happen because the Times has been dismissed as a defendant
00:04:29.620 and with no leave to refile.
00:04:32.360 So, that was on December 20th that we saw that complaint,
00:04:39.020 and the Times then ran an article.
00:04:41.020 By the 31st of December this past year,
00:04:45.320 Blake Lively sued Justin Baldoni,
00:04:47.780 and Justin Baldoni also filed suit against the New York Times,
00:04:52.660 alleging that that piece defamed him.
00:04:55.340 And then two weeks later, on January 16th,
00:04:58.380 Justin Baldoni sued Blake Lively,
00:05:00.980 sued Ryan Reynolds,
00:05:01.800 and sued this PR agent, Leslie Sloan, and her company.
00:05:08.060 What's happened this week is this federal district court judge,
00:05:12.080 reviewing what's called a 12B6 motion,
00:05:13.940 a motion to dismiss the case without even getting to discovery,
00:05:17.940 never mind trial,
00:05:19.460 has granted that motion filed by Lively
00:05:21.640 and the other defendants against Baldoni.
00:05:23.860 His entire case against her has been thrown out except for two minor claims for breach of the implied covenant
00:05:35.800 and tortious interference with the contract.
00:05:39.020 So, implied covenant of good faith and fair dealing and the tortious interference with the contract,
00:05:42.700 which are based on one smaller allegation made in the Blake Lively,
00:05:48.520 or sorry,
00:05:49.060 in the Justin Baldoni complaint,
00:05:50.760 suggesting that,
00:05:51.800 I think this one is based on the fact that they allegedly went,
00:05:56.100 Ryan Reynolds allegedly went to WME,
00:05:59.160 this large agency where Ari Emanuel is the owner and chief agent,
00:06:03.920 and said,
00:06:04.400 you need to dump Justin Baldoni as a client,
00:06:07.740 and that he did it.
00:06:09.340 And I believe Ari Emanuel has admitted this happened.
00:06:11.440 I think he was on a podcast admitting that this happened.
00:06:13.720 And the question is whether that can amount to the tortious interference with the contract
00:06:18.280 between Justin Baldoni and WME.
00:06:22.380 Even if they went on that,
00:06:23.620 it's,
00:06:23.840 it's peanuts.
00:06:25.260 Okay,
00:06:25.460 that's not,
00:06:26.320 I'm just being honest with you.
00:06:27.620 As you know,
00:06:27.980 I'm on,
00:06:28.860 I'm on,
00:06:29.740 having looked at this very closely,
00:06:31.900 I believe Justin Baldoni is the truth teller by and large in this case,
00:06:36.560 and that Blake Lively has either exaggerated or made up the overwhelming substance of her,
00:06:43.400 of her complaint.
00:06:44.220 She wanted to save her own ass after suffering some bad publicity.
00:06:50.540 And she's orchestrated this whole thing,
00:06:52.700 which she thought would give her a,
00:06:54.340 an I am woman,
00:06:55.720 hear me roar a moment.
00:06:57.180 And now thanks to this judge,
00:06:58.720 she's sort of getting it,
00:07:00.140 but that's what I think this whole thing is about.
00:07:01.760 Not about actual harassment by Justin Baldoni of Blake Lively.
00:07:05.260 As we've seen,
00:07:06.760 her complaint against him has fallen apart.
00:07:09.180 I mean,
00:07:09.440 just piece by piece,
00:07:10.920 her scurrilous allegations of what,
00:07:12.740 what he did to her have proven in my clear view as an attorney to be lies.
00:07:17.860 I believe she lied.
00:07:19.560 I believe she lied when she complained that he burst in on her while she was breastfeeding in her trailer.
00:07:24.240 And then we've seen the,
00:07:25.080 the correspondence between the two of them where she says,
00:07:27.740 come on over,
00:07:28.860 I'm breastfeeding.
00:07:29.700 I mean,
00:07:30.000 okay.
00:07:30.740 Um,
00:07:31.720 it seems you only told us half the story,
00:07:33.500 madam.
00:07:34.100 She was forced to look at porn by these evil producers working with Justin.
00:07:38.280 And they responded that in fact,
00:07:40.820 and they produced the pictures,
00:07:41.920 what they wanted her to look at was a totally benign,
00:07:45.780 not even PG 13.
00:07:47.100 It's like a G rated photograph of the producer,
00:07:49.840 uh,
00:07:50.840 and his wife in a bathtub after a bathtub birth,
00:07:53.820 no nudity.
00:07:54.860 It's like a beautiful shot of a new baby with the parents.
00:07:57.960 It's like,
00:07:58.340 like she's insane.
00:07:59.800 This is not pornography by anybody's definition.
00:08:02.960 Now,
00:08:03.400 maybe when we get to trial,
00:08:04.460 she's going to show us some triple X porn that they,
00:08:07.080 they threatened to show her or did show her.
00:08:09.520 I doubt it.
00:08:10.160 I doubt it.
00:08:10.780 I doubt it.
00:08:10.800 She hasn't exactly held back and trying to rehabilitate her image.
00:08:14.440 So those are just a couple of examples of how her claim in chief is falling
00:08:18.560 apart.
00:08:19.840 Um,
00:08:20.800 but in any event,
00:08:21.840 Justin tried to fight back by saying,
00:08:25.140 she's now trying to smear me in addition to like not being able to handle some
00:08:30.580 bad PR around the launch of this movie that she brought upon herself and blame
00:08:34.840 it all on me.
00:08:35.920 Now she's gone next level by trying to smear me by filing this complaint with
00:08:41.100 the civil rights division in California by clearly letting her,
00:08:44.280 leaking it to the New York times and trying to let the country know I'm some
00:08:48.300 sort of a sexual predator,
00:08:49.480 all of which is false.
00:08:50.260 So he fought back and he fought back not only by going,
00:08:54.360 you know,
00:08:54.640 into a PR stance and,
00:08:56.140 and unleashing Brian Friedman,
00:08:57.800 his lawyer.
00:08:58.560 And as you know,
00:08:59.400 mine on the world,
00:09:01.440 but filing a counterclaim against her or claim against her.
00:09:05.400 And,
00:09:05.900 uh,
00:09:06.080 that did not work out.
00:09:07.760 So here's how bad it is.
00:09:10.060 Okay.
00:09:10.340 Before we get to where this is going,
00:09:12.500 it's very bad.
00:09:13.460 It's the,
00:09:14.420 the dismissal is very,
00:09:15.800 very bad for Justin Baldoni,
00:09:17.820 at least as of right now,
00:09:18.980 because California has this wacky rule.
00:09:24.060 It's a new rule under a law Gavin Newsom signed in October,
00:09:28.200 2023.
00:09:29.320 Uh,
00:09:29.880 it's California civil code,
00:09:31.100 47.1.
00:09:32.640 And,
00:09:33.360 uh,
00:09:33.480 this was signed by Gavin Newsom.
00:09:34.660 it extends the California civil codes definition of a privileged communication in a defamation action to include communications made without malice about an individual's own experience of sexual assault,
00:09:49.260 sexual harassment,
00:09:50.060 workplace harassment,
00:09:50.600 workplace harassment,
00:09:50.880 or discrimination and cyber sexual bullying.
00:09:53.380 And what this means is that any defendant accused of defaming someone who then wins who gets,
00:10:05.900 for example,
00:10:06.340 the case dismissed against her.
00:10:08.480 she's been accused of defaming him,
00:10:10.160 um,
00:10:11.440 in,
00:10:11.820 let's say a 12 B six motion for,
00:10:15.140 and what was at issue was her privileged communication about her alleged sexual harassment or workplace harassment is entitled to recover attorney's fees and costs as well as trouble damages and punitive damages.
00:10:31.820 Trouble means triple.
00:10:34.040 This is what Gavin Newsom did was said,
00:10:36.540 if you get wrongfully sued for defamation and the defamation you're accused of is you're a woman accusing somebody of sexually harassing you.
00:10:48.540 And basically he fights back by saying this is defamation and you as the woman,
00:10:53.520 it could be the other way,
00:10:54.520 but let's just go for in this particular case,
00:10:56.780 because that's the facts here that it's the female accusing the male of sexual harassment,
00:11:00.980 that you are not only entitled if you win,
00:11:03.800 if you prevail against this defamation charge to your attorney's fees and costs,
00:11:10.400 but we will triple those damages and potentially award you punitive damages to punish him and discourage others like him from bringing such defamation claims in California.
00:11:22.260 Now that's very bad.
00:11:23.840 This case wasn't in California,
00:11:25.800 but it was governed by California law.
00:11:28.140 And this is brand new.
00:11:30.840 This is one of,
00:11:31.820 if not the first case in which this law has kicked in.
00:11:37.160 And so I don't know how bad this is going to get because I mean,
00:11:42.960 her lawyers might've expended $5 million.
00:11:45.100 I've worked at large law firms where you easily expend millions of dollars in fees in fighting a 12B6 motion or in filing one for that matter.
00:11:54.120 And so there's,
00:11:56.640 it's going to be millions.
00:11:57.560 The attorney's fees are going to definitely,
00:11:58.980 definitely be in the millions.
00:12:00.360 The only question is how high there would also be a question of reasonable reasonableness.
00:12:04.800 This law,
00:12:05.300 this judge is not going to say,
00:12:06.280 Oh,
00:12:06.300 you spent $50 million,
00:12:07.920 uh,
00:12:08.720 team lively.
00:12:10.000 Yeah.
00:12:10.440 Okay.
00:12:10.820 He,
00:12:11.280 now he has to pay you 50 million and I'm going to triple them.
00:12:14.400 That's not happening,
00:12:15.240 but let's say she has $5 million in attorney's fees.
00:12:19.380 It is not outside of the realm of possibility that he then triples those and awards her 15 million in damages.
00:12:30.100 And also potentially punitives.
00:12:34.680 I don't think that's going to happen.
00:12:36.780 It's all within the judge's discretion.
00:12:38.280 And I,
00:12:39.700 these claims are far from so specious or speculative or without merit that I think that a sane judge would say,
00:12:48.620 I'm going to impose that kind of a punishment or pain on the defendant here.
00:12:53.880 Well,
00:12:55.000 technically in this particular claim,
00:12:56.780 he's the plaintiff.
00:12:57.820 He's the defamation plaintiff against her.
00:13:00.160 I just don't think that this judge is going to do that to Justin,
00:13:02.620 given how strong his defenses to her underlying claims and how his defamation claim against her really was.
00:13:10.500 It was well supported.
00:13:11.920 It was the reason they've been dismissed is because he recognized that there's a privilege in California to make the claim she's making of sexual harassment under California law.
00:13:26.020 If you do it in a legal proceeding,
00:13:28.120 that's really why his defamation claim against her was dismissed.
00:13:32.620 It's not because,
00:13:33.420 you know,
00:13:34.220 he has no grounds to say he didn't harass her,
00:13:37.840 that she's doing all of this to build up her own me too cred and trying to make herself into a,
00:13:43.620 you know,
00:13:43.900 feminist hero.
00:13:45.260 He does have the proof of all of that.
00:13:48.640 It's that there's this privilege that covers,
00:13:52.420 according to this judge,
00:13:54.180 her complaint in the California civil rights division or department.
00:13:59.260 And for that matter,
00:14:01.440 he says it kind of extends to the New York times.
00:14:04.980 So a reporter like somebody at the times like yours truly,
00:14:09.340 who cites allegations in a complaint,
00:14:13.020 a legal document generally won't be subjected to defamation claims.
00:14:17.480 If you just repeat what somebody is alleging in a lawsuit.
00:14:20.000 And I have to say,
00:14:20.700 as a,
00:14:20.920 as a somebody who's in the journalism business,
00:14:22.460 I like that law.
00:14:24.020 I like that general rule because I should be allowed to tell you what somebody is alleging in a court without endorsing it in such that I get sued for defamation myself.
00:14:35.240 But Brian Friedman's lawsuit on behalf of Justin Baldoni to me included far more than just allegations that were in that complaint lively filed with the California civil rights department.
00:14:47.420 It was clear to me that what was in that New York times article included allegations beyond that complaint.
00:14:53.420 And to me,
00:14:54.480 the judge just never squared that circle.
00:14:56.640 He,
00:14:56.820 I,
00:14:57.100 he just kind of seemed to gloss over the fact that there had clearly been additional communications between team lively and the times.
00:15:04.380 Um,
00:15:04.980 that's how I read it.
00:15:07.640 He's ignoring that and just saying that the privilege that protects a sexual harassment victim making allegations in a legal document gets her off the hook and the reporter privilege gets the New York times off the hook.
00:15:21.320 He has to jump through a few more hoops to get Ryan Reynolds and the PR woman off the hook,
00:15:27.240 but he's basically saying that as pleaded the complaint against those two doesn't really amount to a cognizable legal claim.
00:15:37.420 He's saying you want to sue Justin Baldoni,
00:15:40.440 sorry,
00:15:40.660 you want to sue Ryan Reynolds for defamation.
00:15:43.840 But what you're really alleging is that he went to WME and said fire Justin Baldoni because he's a sexual predator.
00:15:56.440 And you really haven't given me any facts in the complaint that would justify the standard that's needed in a defamation case.
00:16:05.080 When you're bringing that case as a public figure,
00:16:08.220 which is the highest burden of proof under the law,
00:16:11.660 public figures have a very difficult time recovering defamation damages.
00:16:15.540 And Justin Baldoni is the public figure here trying to sue for defamation against Ryan Reynolds.
00:16:20.460 And the court was saying to recover from Ryan Reynolds for allegedly making that statement to WME,
00:16:25.400 you've got to prove he said it with knowledge that it was false or with a reckless disregard for its potential falsity.
00:16:36.260 And you haven't done that.
00:16:37.720 And what the judge said,
00:16:38.480 based on the facts alleged in this complaint,
00:16:40.680 what I see is at best you've alleged he was told that by his wife.
00:16:44.900 Now I have a question about that because there are allegations about Ryan Reynolds having met with Baldoni
00:16:50.960 and Taylor Swift and his wife in that infamous apartment meeting where there was an explosion,
00:16:57.200 there was a fight over control of the film and some scenes there.
00:17:02.220 There was at least,
00:17:03.140 I believe one allegation that he went to set and would have been observing something with his own eyes.
00:17:07.720 So I'm not sure all of his knowledge came through the wifey,
00:17:10.860 but what the judge seemed to be saying was at least the vast majority of his knowledge would have come through his wife.
00:17:16.800 And that means that that inures to Ryan Reynolds benefit that the judge seems to be saying in worst case scenario,
00:17:25.920 Ryan Reynolds was wrong,
00:17:27.500 but not lying.
00:17:30.120 Okay.
00:17:30.800 So that's how he got off the hook.
00:17:33.260 Though,
00:17:33.840 I guess the judge is leaving open the possibility that that claim,
00:17:37.480 at least that those allegations could potentially support a claim for torches interference with contract.
00:17:42.660 If Baldoni refiles them with additional allegations.
00:17:47.680 Again,
00:17:48.180 that's a very minor victory for team Baldoni.
00:17:52.080 It's better than nothing.
00:17:53.320 They still have a couple of counterclaims,
00:17:54.540 but trust me,
00:17:55.300 this is it.
00:17:56.360 Nobody on team Baldoni would be over there saying,
00:17:58.680 yay,
00:17:59.180 yay.
00:17:59.500 In response to this ruling.
00:18:02.400 So.
00:18:03.900 The claims by Baldoni are gone.
00:18:06.780 They're really gone.
00:18:08.280 And we'll see what the judge does.
00:18:10.540 He could potentially say,
00:18:12.560 I'm not going to rule on attorney's fees.
00:18:14.260 Again,
00:18:14.400 we're recording this on Tuesday.
00:18:16.240 So.
00:18:17.440 I beg your forgiveness.
00:18:18.440 If something has changed between now and tomorrow,
00:18:20.860 Wednesday,
00:18:21.180 when you are hearing this,
00:18:22.860 we're taping it the day,
00:18:23.660 the day I'm leaving for vacay,
00:18:25.140 but I wanted to give you some fresh content on this.
00:18:27.500 Um,
00:18:28.300 but it's possible the judge could issue a ruling now on fees and punitive damages.
00:18:32.100 My God.
00:18:32.700 Again,
00:18:33.060 I just don't see punitives coming.
00:18:35.300 Uh,
00:18:35.700 or he could say,
00:18:36.440 I'm not going to issue a ruling on this until the end of the trial,
00:18:38.840 which would also be kind of.
00:18:42.760 Well,
00:18:43.200 standard,
00:18:43.740 but also annoying because you could get to trial.
00:18:46.440 You could have Justin win now as the defendant on the claims against him and potentially have all of her claims thrown out by a jury.
00:18:57.580 Like,
00:18:58.140 we don't think you,
00:18:58.820 you made your burden Blake and we find in favor of the defendant.
00:19:02.420 And then Justin still at that point,
00:19:05.680 walking away,
00:19:06.880 having to pay her millions of dollars because his counterclaim was thrown out.
00:19:11.960 And there's this wacky law in California.
00:19:15.920 I mean,
00:19:16.620 it's just,
00:19:17.420 this is not good.
00:19:18.360 Not a good ruling for team Baldoni by any interpretation I can offer.
00:19:24.460 I should point out to you just full transparency.
00:19:26.580 I've not spoken with Brian Friedman about this at this point.
00:19:30.040 I'm sure I will.
00:19:31.020 And I'll update you when I have,
00:19:32.920 and I'm sure he'll come back on and speak to it directly.
00:19:35.260 Um,
00:19:35.780 but just to be clear,
00:19:37.840 I'm not like operating from inside knowledge here.
00:19:40.900 This is just my own take as a lawyer and a reporter who's been covering the case.
00:19:45.020 Um,
00:19:45.820 here is however,
00:19:47.960 why I think Blake Lively's euphoria is a little premature.
00:19:52.500 And I guess I should tell you what she's saying.
00:19:55.180 She's thrilled.
00:19:56.240 You won't be surprised to hear.
00:19:57.660 She's absolutely thrilled.
00:19:59.780 I'm going to show you a video as she arrived Monday night at the Tribeca festival.
00:20:05.240 It's the artist's dinner.
00:20:06.680 This is Monday.
00:20:07.300 Here she is.
00:20:07.800 Let's watch it.
00:20:09.680 She's all smiles.
00:20:11.940 She's clearly in a great mood.
00:20:14.740 I mean,
00:20:15.520 she's acting like she won the case in chief against him.
00:20:19.020 She didn't.
00:20:21.000 And nor did the judge find that Justin's allegations are untrue.
00:20:27.200 The judge just said,
00:20:28.560 basically you can't sue her for allegations.
00:20:30.960 She makes in a complaint.
00:20:33.580 She filed with the civil rights department.
00:20:37.080 Can't sue her for defamation for that.
00:20:38.980 It's covered by a privilege.
00:20:40.400 He didn't say what she said was true.
00:20:43.900 He didn't say Justin's likely to lose this case at trial,
00:20:47.060 like the case against him,
00:20:48.680 but she's acting like the judge did.
00:20:51.860 And it's a lie.
00:20:53.580 She comes out.
00:20:55.120 Uh,
00:20:55.540 this is per Buzzfeed on her Instagram story.
00:20:58.920 Uh,
00:21:00.500 she referenced the 19 organizations that wrote amicus briefs and in support of her for friends of the court.
00:21:06.040 She began last week.
00:21:07.620 I stood proudly alongside 19 organizations united in defending women's rights to speak up for their safety.
00:21:15.300 Like so many others.
00:21:16.680 I've felt the pain of a retaliatory lawsuit,
00:21:19.280 including the manufactured shame that tries to break us.
00:21:23.460 While the suit against me was defeated.
00:21:25.460 So many don't have the resources to fight back.
00:21:27.820 Okay.
00:21:27.940 She's got a billion dollars.
00:21:29.280 Give me a break.
00:21:29.920 I mean,
00:21:30.680 it's absurd that any court would even consider making her pay Baldoni's legal fees,
00:21:34.700 but he does not have a billion dollars.
00:21:36.780 Ryan Reynolds made that off of the sale of his liquor company reportedly,
00:21:40.140 nevermind what they've earned as actors.
00:21:41.740 I'm more resolved than ever to continue to stand for every woman's right to have a voice in protecting themselves,
00:21:49.080 including their safety,
00:21:51.100 their integrity,
00:21:52.400 their dignity,
00:21:53.120 and their story.
00:21:55.820 Remember,
00:21:56.440 she said that they made her perform the birth scene with like,
00:22:00.580 like a,
00:22:01.600 like a slit covering up her lady parts.
00:22:05.140 And then he brought on his best friend to play the doctor and let him linger down there below where he could check her out.
00:22:11.740 From a gynecological perspective.
00:22:13.640 And then that person,
00:22:14.940 that actor came forward to say,
00:22:16.280 this is such a lie.
00:22:17.280 That's not true.
00:22:18.020 She had on biker shorts the entire time.
00:22:20.360 And by the way,
00:22:21.260 I'm not just his buddy.
00:22:22.220 I've been in all sorts of like Shakespearean productions and other big productions.
00:22:27.020 And I'm insulted at their description of me just coming over as like an ogling buddy of Justin's F off.
00:22:34.360 You just yet another one of her obvious lies,
00:22:37.760 but now she needs to speak out to protect one's integrity and dignity and one's story.
00:22:44.820 Yeah.
00:22:45.020 It's a story.
00:22:45.800 All right.
00:22:46.420 With love and gratitude for the many who stood by me.
00:22:49.060 Many of you,
00:22:49.820 I know many of you,
00:22:50.580 I don't,
00:22:51.360 but I will never stop appreciating or advocating for you.
00:22:55.300 Um,
00:22:56.080 okay.
00:22:57.300 She's,
00:22:57.820 and then according to one insider per people magazine,
00:23:00.620 she's been crying with relief.
00:23:02.720 She's obviously relieved.
00:23:04.180 They both are.
00:23:05.000 Someone tells people she feels vindicated.
00:23:07.360 Everyone is happy on the legal team.
00:23:09.140 Well,
00:23:10.000 I really think her days of feeling relieved and super happy about this case are numbered.
00:23:14.780 And to be honest,
00:23:15.840 I think they're not as,
00:23:17.940 they're not as joyful as she's portraying.
00:23:20.680 And her PR people are portraying in the media right now.
00:23:24.020 And here's what I really want to say.
00:23:26.120 Um,
00:23:27.460 so what's happened now,
00:23:28.580 and as a practical matter,
00:23:29.640 what's going to happen going forward is Justin's now the defendant and Blake is now the plaintiff.
00:23:35.560 And that's a very simple formula.
00:23:37.100 And I've tried cases like that myself,
00:23:39.880 many of them,
00:23:40.560 uh,
00:23:41.260 in the past,
00:23:41.820 both worked on as a litigator and actually seen through to trial.
00:23:45.260 And it's a very simple case.
00:23:46.880 Now he said,
00:23:48.680 she said,
00:23:49.100 that's what it is.
00:23:49.840 No more cross claims.
00:23:51.220 Really.
00:23:52.400 Um,
00:23:52.840 no more New York times,
00:23:54.120 uh,
00:23:54.660 no more press,
00:23:55.840 press people.
00:23:56.800 It's her versus him.
00:23:59.520 And on the merits of that case,
00:24:01.860 I believe she will lose in this court of law.
00:24:05.800 She's going to get Amber herded.
00:24:08.200 That's what's going to happen.
00:24:09.820 It's going to be brutal.
00:24:11.360 She's going to get cross examined by Brian Friedman,
00:24:13.800 and it's not going to be pretty.
00:24:15.800 Mark my words.
00:24:17.020 It's not going to be pretty when she gets crossed.
00:24:19.060 I don't believe,
00:24:20.640 I don't know.
00:24:21.800 I don't believe either side is in the mood to settle.
00:24:24.420 It's possible because don't forget,
00:24:26.720 she lost a major piece of her complaint to earlier,
00:24:31.200 uh,
00:24:32.100 last week when her claims for emotional distress,
00:24:36.060 uh,
00:24:36.860 had to be thrown out.
00:24:37.960 Well,
00:24:38.300 she thrown them through them out because team Baldoni said,
00:24:41.840 okay,
00:24:42.100 give us access to your psychiatrist records.
00:24:43.980 Let us see your mental health records.
00:24:46.120 You're claiming we have to pay you all these damages for the severe mental
00:24:49.120 distress that we inflicted on you.
00:24:50.920 Great.
00:24:51.840 Let's see what those damages look like.
00:24:54.360 And that's a totally appropriate request by them to say,
00:24:56.880 you're asking us to pay for all your medical visits.
00:25:00.780 Let me see your medical visits.
00:25:01.820 Now I have to see whether you complained about me or you were complaining
00:25:05.020 about life as a Hollywood star and Ryan,
00:25:07.340 Ryan doesn't pay enough attention to me.
00:25:09.460 And she immediately dropped those,
00:25:11.100 uh,
00:25:12.380 counts saying,
00:25:12.960 nevermind.
00:25:13.820 Nevermind.
00:25:14.360 And she asked if she could drop them without prejudice.
00:25:16.580 So she could hold them over Justin's head from now to the point of trial.
00:25:20.220 And the court said,
00:25:20.980 we're not doing that.
00:25:22.320 They're dropped.
00:25:23.300 If they're dropped,
00:25:23.940 they're dropped.
00:25:24.800 And if they're not dropped,
00:25:25.900 then fork over your records.
00:25:27.640 So she also suffered a loss in this case in the past two weeks.
00:25:31.800 So they both suffered a loss.
00:25:33.320 His is bigger than hers.
00:25:34.140 No question.
00:25:34.740 I'm not trying to spin you,
00:25:35.780 but now if they're going to settle would be the time for them to say,
00:25:40.040 okay,
00:25:41.420 you know,
00:25:41.700 Blake can say,
00:25:42.460 I will waive my right to damages or more than likely.
00:25:45.800 She'll say,
00:25:46.440 you do have to pay my attorney's fees,
00:25:48.440 but we're going to pay those,
00:25:50.880 you know,
00:25:51.220 to like some charity.
00:25:52.100 It'll be some me too,
00:25:53.040 like a times up type thing to try to make her look good.
00:25:55.740 And Justin Baldoni could potentially do that and make this thing go away while he's not looking
00:26:00.480 like he's paying for sexual harassment.
00:26:02.520 That could be a potential outcome.
00:26:04.820 But what I believe as of now anyway,
00:26:07.200 is that both sides are so dug in,
00:26:08.800 they are likely to barrel forward to trial.
00:26:10.600 And Brian Friedman wants to get Blake Lively under deposition and Ryan Reynolds under deposition and force them to respond to some of the very,
00:26:20.260 very strong evidence he has that they're liars.
00:26:24.560 That at least she's a liar and he's been misled deeply by his troubled wife.
00:26:29.140 So I think that's probably where I'd put my bet that that's what's likely to happen.
00:26:33.760 And I believe when this goes to trial,
00:26:35.340 she'll lose.
00:26:35.800 But all of that also is not the point that I want to make.
00:26:38.940 And here is the point that I will move on.
00:26:40.700 The point is she's already lost this case.
00:26:45.600 This whole case was about P R.
00:26:50.440 This case began.
00:26:52.180 And I believe,
00:26:53.200 including her complaint with the California civil rights department,
00:26:55.640 it began because when they launched this movie,
00:26:58.280 it ends with us,
00:26:59.620 which is about domestic abuse.
00:27:01.520 She suffered a round of unflattering press.
00:27:06.020 She suffered that round of press.
00:27:08.040 I believe thanks to her own terrible personality and bad behavior and bullying tactics,
00:27:13.500 both against reporters and against Justin Baldoni and others on that set,
00:27:19.480 which started to leak and turned the public on her.
00:27:23.040 She was inappropriate and promoting the movie,
00:27:25.420 which is about,
00:27:25.980 you know,
00:27:26.340 battery of women.
00:27:28.280 And she kept smiling and laughing and pimping her hair company and her weird flowers.
00:27:33.700 And her affect was too light.
00:27:35.920 And she seemed off like she didn't understand what actual victims of abuse go through.
00:27:41.060 She unfollowed Justin on all of his social accounts before the premiere.
00:27:44.960 She relegated him to a basement on the premiere.
00:27:47.860 She was clearly trying to gin up questions about what had happened between the two of them.
00:27:53.280 And then,
00:27:53.720 boom,
00:27:54.060 she dropped the hammer a couple months later with this complaint,
00:27:56.620 which mysteriously,
00:27:57.800 miraculously wound up in the New York Times.
00:28:00.100 This was,
00:28:01.360 in my opinion,
00:28:02.080 Blake Lively trying to redeem herself in the public eye because she couldn't stand the round of bad publicity she suffered that she brought upon herself.
00:28:12.940 We've talked about this many times recently on this show.
00:28:15.840 George Clooney couldn't stand the fact that I said he's not a journalist,
00:28:19.160 so he had to launch into some diatribe about how I'm not and going off on me.
00:28:24.380 Okay.
00:28:25.020 All right.
00:28:25.960 Why don't you dye your hair another shade of black,
00:28:28.320 George?
00:28:29.040 Also,
00:28:29.500 you should consider what's happening with those enormous bags under your eyes.
00:28:31.980 Okay.
00:28:32.400 I'm just saying it's probably why you haven't been cast in anything other than a play for a while.
00:28:36.800 So that's George.
00:28:38.660 But there's a lot of people who just aren't used to any sort of negative publicity about themselves.
00:28:45.400 And if they get one word of it,
00:28:48.840 they have to lash out because it's so unusual.
00:28:52.240 They're surrounded by all these yes men.
00:28:55.220 I mean,
00:28:55.420 honestly,
00:28:55.860 I feel like the only person who gets like negative press like that,
00:28:59.440 who's a huge star and doesn't fight back against it is like a Tom Cruise.
00:29:03.560 Cause he's used to taking all these hits for Scientology and he's such a big star.
00:29:07.120 He's just kind of like,
00:29:08.120 whatever,
00:29:08.340 but these other stars cannot take negative publicity about themselves.
00:29:15.320 And same for Ryan Reynolds and Blake Lively,
00:29:17.640 especially her.
00:29:18.820 That's why she did this.
00:29:19.980 I'm convinced.
00:29:21.600 So she thought she was going to be able to bully him that this was 2018 again,
00:29:28.160 and that he would cower on the receiving end of these me too allegations.
00:29:32.100 She leaked that she had made on set where she was failing and struggling.
00:29:37.360 And I mean,
00:29:37.980 she's terrible in the movie.
00:29:38.880 If you've watched it,
00:29:39.620 a lot of people have commented on it.
00:29:42.700 And that she would emerge like she called herself in that text message.
00:29:47.720 She sent to Justin as Khaleesi from game of Thrones,
00:29:52.060 that she would be the mother of dragons,
00:29:55.040 this fierce warrior that Taylor and Ryan were her dragons who are going to kill for her.
00:30:03.400 Anybody who got in her way or tried to smear her reputation.
00:30:07.860 And while she wrote that to Justin in a friendlier moment,
00:30:10.660 although there was clearly a veiled threat in there for him too,
00:30:13.480 that's really how she thinks about herself.
00:30:15.360 And she wanted to have that me too moment.
00:30:18.640 I mean,
00:30:19.080 this is the same thing with Gretchen Carlson.
00:30:20.780 Gretchen Carlson sees herself as like the heroine of the me too movement.
00:30:24.060 It's pathetic.
00:30:24.920 Look what's happened to her.
00:30:26.280 She's gone completely crazy,
00:30:28.080 hard left.
00:30:29.060 She's as bitter as they come on the left.
00:30:30.720 She's one step away from the enormous blue glasses and blue bracelet and shaving her head.
00:30:36.020 It hasn't really worked out well for her.
00:30:38.380 And this hasn't worked out well for Blake Lively because he did not cower.
00:30:43.040 He did not hide in the basement.
00:30:44.680 He did not roll over.
00:30:45.880 He hired Brian Friedman who fought back against Blake Lively.
00:30:49.260 And she looks like a craven liar.
00:30:53.900 Her reputation is in tatters.
00:30:56.860 Not sure if she realizes that because she only insists on hanging out with fellow leftists
00:31:01.380 at places like the Time 100 where I saw her and I told you about that.
00:31:05.660 She's Amber Herded herself.
00:31:10.880 Good luck getting your next big Hollywood blockbuster role.
00:31:14.300 You guys are going to be dining off of Ryan Reynolds money from here to eternity.
00:31:19.100 And she knows it.
00:31:20.280 And by the way,
00:31:20.820 it's not about money for her.
00:31:21.860 She wants to be a star.
00:31:23.080 She wants to be cast.
00:31:24.880 Do you think it's tough to find a lot of beautiful blonde Hollywood actresses who really would like to star
00:31:28.740 in a film who don't have a reputation of being a complete diva who's going to meet to the producer,
00:31:35.460 director, creators of the film?
00:31:37.160 It's really not.
00:31:38.400 They're a dime a dozen.
00:31:40.480 Good luck to her.
00:31:42.280 What I would recommend for her is that she have her husband produce and cast all future movies,
00:31:46.660 and then she might actually have a career ahead of her.
00:31:49.560 She's already ruined her own career.
00:31:52.400 Justin Baldoni's fight was always a PR one.
00:31:58.320 She was trying to drag him to improve her own standing.
00:32:02.740 He fought back, and he's done what he needed to do already.
00:32:06.860 He's done it.
00:32:08.300 People know.
00:32:09.480 No one will ever look at her the same.
00:32:10.840 No one will ever look at her allegations except the most partisan,
00:32:13.420 rabid leftists who believe every Me Too allegations and say,
00:32:16.640 oh, he did it.
00:32:17.300 It's just not going to happen.
00:32:18.420 They've been too effective on team defense of dismantling her allegations and fighting back.
00:32:25.000 I mean, you could make the argument that even this dismissal is in some PR ways good for him
00:32:30.540 because it just draws more attention once again to how flimsy her case is and how absurd this is.
00:32:35.660 And as she tries to act like this embattled, put-upon victim who emerged with this great legal victory,
00:32:44.960 it's only going to make people like me and probably a lot of you get their backs up again about her
00:32:49.880 and how ridiculous she is and how she's tormenting him.
00:32:54.260 And you can treble that if she actually does get a big damage award against him,
00:33:00.180 and God forbid it gets trebled or she gets punitives too.
00:33:03.380 So she's not in a good position.
00:33:05.300 She doesn't give a shit about this money.
00:33:06.640 As I say, she's married to somebody with more money than God.
00:33:08.860 And she cares about her reputation and her ability to get cast in future films.
00:33:13.480 And I'm sure she'd love for Justin Baldoni to never be able to make a movie again.
00:33:17.380 She's failed at both goals.
00:33:19.680 Both goals.
00:33:21.500 So it's good news, bad news for both parties.
00:33:25.560 Those damages could really hurt Justin.
00:33:28.060 I don't think he has a lot of money or any.
00:33:30.880 So we'll see.
00:33:32.220 That's got a big question mark over it.
00:33:33.780 And his claims, obviously, are not going forward.
00:33:36.500 But she has lost this battle, which I believe was always about PR.
00:33:41.880 And this didn't help that.
00:33:43.760 It did not help that.
00:33:44.840 With her doubters, the only way she can redeem herself with all the people who were fans of hers but now aren't
00:33:51.900 is if she has some sort of spike-the-ball moment every day when this thing goes to trial.
00:33:58.440 And she's not going to, people.
00:34:00.240 The biggest question mark that she has that she could somehow pull through, and we'll see, is these alleged other women
00:34:06.480 she finally got around to referring to in her amended complaint,
00:34:10.840 saying she's not going to be the only one to accuse him of creating a hostile work environment or sexual harassment on the set.
00:34:17.000 And we'll see.
00:34:18.360 He's denying all of that, too.
00:34:19.660 And her word is not good.
00:34:22.360 But that's the only sliver I have opened for her at trial.
00:34:26.760 If she has a parade of women, come on, with very compelling allegations.
00:34:30.380 Okay, now you got my attention again.
00:34:32.300 I doubt it.
00:34:33.340 For very good reasons.
00:34:34.700 I doubt it.
00:34:35.360 So that's Baldoni.
00:34:36.460 I do want to spend some time on Diddy.
00:34:39.880 I can't say enough negative things about this man.
00:34:42.960 I'm not sure he's human.
00:34:44.300 I, like, in the same way you look at, like, a psychopath, that, like, Dahmer, who kills people and eats them.
00:34:53.180 That's how I am now looking at Sean Combs.
00:34:57.620 There's something deeply wrong with him.
00:35:01.560 There's a depravity to this man that we did not know about.
00:35:06.180 And, honestly, I'm going to forgive even some of these massive Hollywood celebrities who went to his so-called white parties because it's so much worse than, really, I'm sure even they knew.
00:35:17.120 But his intimate team around him knew, and they do not get forgiven.
00:35:21.720 Unfortunately for the prosecution, they are also amongst the chief witnesses in this trial.
00:35:27.000 You know, there's the thing in the law where you say, like, the devil doesn't hang around with angels.
00:35:30.520 And so when you're going after the devil, who can put him behind bars?
00:35:35.760 The devil's helpers.
00:35:37.580 And they're not all that likable either.
00:35:40.280 So he's had, you know, this cast of characters around him that's helped him.
00:35:44.460 That's looked the other way as all these women come into his life and get abused, get hooked on drugs, get farmed out to male escorts like they're barnyard animals.
00:35:54.060 Yeah, put out for stud.
00:35:55.360 It is disgusting what he did to these women, the women in his life.
00:36:00.900 He doesn't understand what love is.
00:36:04.920 It's weird because all the people around him are so enamored with him, and they come back to him over and over.
00:36:09.580 And to this day, they talk about how complicated it was.
00:36:11.980 I don't think that's his loving side that they're remembering, like the good times.
00:36:15.940 It's their, it's the fact that they're star effers, not all of them, but many of them, and they're intoxicated by his money and his celebrity.
00:36:26.760 Most of these people come from nothing and were very ripe targets for his power and his money, his ability to pay their rent and so on.
00:36:34.740 So they were easy targets, and he knew it.
00:36:38.720 He was dazzling the security force at the L.A. Intercontinental Hotel.
00:36:45.920 These guys are kind of, you know, law enforcement adjacent.
00:36:49.560 Even they were like, yeah, we'll take the money to hide that tape of you beating her.
00:36:54.840 Fork it over.
00:36:56.220 Even those guys could be bought.
00:36:58.840 You know, he did not look at the law as a threat.
00:37:01.480 He looked at the law as something he could buy and overcome, and time and time again, he was proven right.
00:37:07.780 And even the people he most harmed kept forgiving him and going back to him for a job or rent or to be in a relationship with him,
00:37:19.860 even though, again, they were being treated like barnyard animals.
00:37:25.580 And these women knew it.
00:37:28.540 They did not enjoy it.
00:37:31.040 They did not want it to a woman, you can see.
00:37:34.160 I know I'm aware of texts from, like, Cassie Ventura early in the relationship saying, yeah, I can't wait to freak off.
00:37:41.440 I enjoy the freak offs.
00:37:42.680 Keep reading, people.
00:37:44.620 Keep reading.
00:37:46.140 Great.
00:37:46.560 Let's do her text messages.
00:37:48.400 Talk to me when you get to the ones that say, I love the freak offs when we both want them.
00:37:52.520 And how about, you know, if you like evidence, because I like evidence too, how about her running out of the freak off for her life and getting beaten to a pulp and dragged back into the freak off?
00:38:03.980 Because that's been the testimony.
00:38:05.000 How about that?
00:38:05.660 Can we agree that maybe the consent that was there initially had waned?
00:38:09.820 Now we've spent this week listening to Jane, who followed on the heels of Mia, both pseudonyms.
00:38:18.240 Mia was an employee.
00:38:19.380 Jane was another girlfriend.
00:38:21.620 Mia.
00:38:21.920 It's just like serial sexual abuse, serial physical abuse through all of these witnesses.
00:38:31.320 Mia testified about him coming into her room in his home where she was required to keep the door unlocked.
00:38:39.760 All the male employees and security guards could have locks on their doors, but she couldn't.
00:38:43.820 And that he would come in and abuse her.
00:38:47.220 She testified she didn't want it.
00:38:49.620 Can we know?
00:38:50.400 I don't know.
00:38:51.300 I don't know.
00:38:51.640 He was such an, I don't know what I want to say.
00:38:54.980 I don't want to say aphrodisiac because that's something that actually turns you on.
00:38:57.980 But he was such a, like a God in the eyes of all these staffers.
00:39:03.840 Can we really believe she didn't want him when he walked in, in these, in her rooms?
00:39:08.440 I don't know.
00:39:09.500 But I've heard enough from Cassie Ventura and from Jane to know that this guy was happy to force these women
00:39:18.820 into a life of the state or you are left out of the scene or 막ering the people that were trying to do it to beat the óENE
00:39:21.100 or debauchery or hotel nights or whatever you want to call it.
00:39:23.160 or whatever you want to call it and to beat them and to understand that they didn't want to be
00:39:28.300 there, but to hold the threat of violence, the threat of exposure, um, the threat of their
00:39:33.460 careers, the threat of rent over their heads to try to force them into it. That I think that the
00:39:38.140 government's got him. I think they have got him. I think they've got him on every count.
00:39:43.480 Some people are thinking they don't have them on the Rico count where you have to prove
00:39:46.360 he's sort of a mob boss overseeing multiple crimes. Um, you know, each individual, you only
00:39:51.940 need two underlying crimes for Rico. They've got him. And just, just the, the video from the
00:39:57.520 intercontinental alone is kidnapping and battery. And now you've had testimony from the guy who took
00:40:02.840 his bribe, the guy, the security officer there who took his hundred thousand dollars. He said,
00:40:08.960 you know what? Diddy, if you want me to destroy the tape, uh, you're going to have to take it up
00:40:14.460 with my boss or you're going to have to get a subpoena to, to get control of that tape. And
00:40:19.320 instead did he said, well, you know, how about a hundred thousand? And that guy's boss said,
00:40:24.360 sure. That guy's boss said, here, give me 50 loser. Absolute cretin took 50 grand. And then the guy
00:40:31.840 who testified he'd been given immunity took half of the remaining 50 and gave the other half to
00:40:37.660 another guard who'd been on duty. The only one who didn't take the bribe was the first guy who was the
00:40:43.180 first witness in this taste, in this case, who testified that not only did he not take the money
00:40:47.760 and he'd been shown a hundred thousand dollars in cash by Diddy security guard that was in a bag.
00:40:52.220 He said, no, but he took out his cell phone and videotaped the security guard tape showing the
00:40:58.400 beating before he left. It was a Friday for the weekend. He said he wanted to show it to his wife.
00:41:04.200 And I'm sure the guy knew there was a very good chance this thing would be disappeared by the time
00:41:09.320 he got back on Monday. And it was, he's the one who gave it. We believe to CNN and the reason that
00:41:15.140 we've seen it and the reason the prosecution opened its case with it, that video, that's like the only
00:41:21.820 man of honor who wouldn't take the money and videotaped the videotape. Um, person after person
00:41:30.740 has taken the stand and talked about watching Diddy beat the, these various girlfriends. I mean,
00:41:36.600 relentlessly beat. There's no, there's no amount of beat. That's okay. But just like the, the inhumanity
00:41:42.240 of how he beat them, splitting Cassie's lip, throwing a frying pan at her. Allegedly. Um,
00:41:47.640 we saw what he did to her on tape, each woman reporting how she had to go down. She went down
00:41:52.680 to try to avoid, you know, protect her internal organs and prevent too much injury and how he
00:41:58.200 would kick them in the stomach while down. The thing about Jane, I do want to get into what
00:42:03.180 happened with Jane because it was just stunning and heartbreaking and disgusting and tracks what
00:42:10.120 Cassie Ventura told us perfectly. What he did to Cassie Ventura from the day he got together with
00:42:14.580 her back in 2000. Well, it was earlier than 2008, but all straight through to 2018. She got together
00:42:22.520 with him, I think around Oh six, but from the beginning, this is Cassie around Oh six to 2018.
00:42:29.860 He was making her do these freak offs with male escorts and hotel rooms. And as soon as that was over,
00:42:36.500 he was doing it with others. And I was like, Cassie now sees all the women see that they were,
00:42:40.960 you were, you were part of an assembly line of women. He used like a barnyard animal. Again,
00:42:46.240 that's no comment on the women. It's, um, that's a comment on how he valued them. That's how he saw
00:42:51.540 them. Um, Jane comes out and she took over basically as Combs, his girlfriend, uh, I think shortly after
00:42:59.200 he and Cassie broke up and she was his on again, off again, girlfriend straight through to when he got
00:43:04.720 arrested in 2024. And this is the saddest story. I got to tell you, like spend time with your
00:43:13.140 children. You don't have to tell them everything they do is wonderful. Every two marks on an art
00:43:18.740 paper is a Picasso, but you do have to build up your child's sense of self and self-confidence and
00:43:24.780 understanding that they belong in this world to a family, ideally with family dinners and time
00:43:29.300 invested by a parent. And if God forbid the child loses a father figure, either from the beginning
00:43:34.640 or some way along the way, make sure they have a strong male role model. So they don't need to be
00:43:39.240 affirmed by random men who can't fucking stand them or respect them. Like Sean Diddy Combs.
00:43:46.880 I just feel like there's a couple of stories here. There's a story about the depravity of this man.
00:43:51.720 I don't know how that happened. Had to be more than wealth and fame because a lot of people get
00:43:56.320 wealthy and famous and don't, don't do this. But it's also the story of these women and how
00:44:01.120 sad they were, how unfilled they were, how unsated as humans they were on a like confidence and brain
00:44:10.280 level that they would time and time again, allow him to force them into these freak offs. And then of
00:44:19.920 course, go back to them, go back to him over and over in the beatings. It's a tale that's related to
00:44:25.260 domestic violence. It is domestic violence, but it's just, it's so hard for women who are fine,
00:44:30.060 find themselves in abusive relationships. And if you can understand why a woman allows herself to
00:44:34.200 get beaten more than once, you can understand why a woman allows herself to be forced back into these
00:44:38.600 so-called freak offs more than once. It's all part of a pattern of abuse. If this had been once or twice
00:44:44.160 and you had a text message saying, I want it, or like in Jane's case, she said, or I think it was
00:44:48.880 either Jane or Mia, forgive me. I'm, I blend them sometimes saying in the beginning, I, I, it was Jane
00:44:53.800 saying I wanted it in the beginning because it seemed taboo. Then, then he might have a defense
00:44:58.540 that like there was consent. I wasn't forcing it. And I had no reason to believe that there was no
00:45:02.380 consent. It's so far beyond that people. It's just so far beyond that. And let me get into just a
00:45:08.520 couple of the details of Jane. Um, she, she testified about a hotel night. She didn't call it freak offs.
00:45:17.920 They called it either hotel nights or debauchery in which, um, she wanted the male partner,
00:45:24.120 the escort to wear a condom and Combs did not want her to wear. He did not want the guy to wear,
00:45:32.700 um, the condom. The prosecution played the recording. Um, cause there was a recording
00:45:37.660 audio from this freak off or this hotel night played the part of the recording for the court.
00:45:42.540 It was roughly eight minutes and 25 seconds. Uh, the audio revealed a tape of Jane Combs and a male
00:45:49.940 sex worker, Don. She requested Don used a condom. Combs interjected, questioned why, what they are
00:45:56.040 doing. Jane said Don did not use protection during the sexual encounter with her. Jane was asked why
00:46:01.200 she needed Combs permission to have the man wear a condom. Jane seemed to get emotional and said she
00:46:05.400 was quote, still trying to process that. She said she didn't insist on the man wearing a condom
00:46:10.080 because Combs would be unhappy. She said that after, uh, she would, she would sexually engage
00:46:17.520 with the male sex worker. Combs would have sex with her immediately. She would not clean up the
00:46:23.600 sex workers bodily fluids. Combs and she would play with the bodily fluids. Forgive me. Then she would
00:46:31.220 shower and repeat the process. Jane said that most hotel nights lasted longer than 24 hours. It's all
00:46:37.480 tracks perfectly with what we heard from Cassie with no sleep testifying that Combs would give her
00:46:43.520 ecstasy to stay awake and continue performing the longest hotel night. According to Jane's testimony
00:46:49.100 lasted more than three days with no sleep. Same Cassie Ventura said, same it's the, the, the racehorse
00:46:55.820 has a fractured leg and should not be put out on the track or it could die. And the trainer shoots it up
00:47:05.160 with all sorts of drug cocktails to make it run, run. I want my prize money. That's how this feels.
00:47:15.820 These women are trying to do what this man who feels more like their owner than their love,
00:47:24.360 their partner wants them to do. And they keep falling. They don't want it. They get disgusted.
00:47:32.080 They try to leave. In Jane's case, she got physically ill and he sends them back out there,
00:47:37.540 bum, leg or not run, do it. He's a disgusting, filthy pig. That's my opinion. I'm horrified by
00:47:49.220 this man. I can't wait to watch him rot behind bars forever. And if God forbid this guy gets acquitted,
00:47:57.040 I can't wait to watch the shunning and I can't wait to personally shun and humiliate anybody who
00:48:04.480 doesn't shun him because they haven't been paying attention. They haven't been listening to the
00:48:09.260 testimony. If that's what happens. Jane cried and was emotional as she detailed a different hotel
00:48:16.840 night in 2023 in Miami, where she had sex with three other men at Combs's insistence on her birthday.
00:48:22.840 She testified she flew to Miami with Combs, who told her they'd spend quality time together.
00:48:27.940 If you've seen the testimony of Jane, she kept begging him to just be her boyfriend,
00:48:31.340 to just love her. She just wanted quality time with him. She saw the paper or through text or
00:48:36.100 whatever that he was with other women, like in what appeared to be like an actual date.
00:48:41.200 And she wanted that. And he kept luring her in saying, OK, yes, let's do that. Let's get together.
00:48:47.780 Let's go out in Miami, only to surprise her with another night of debauchery. She flew to Miami
00:48:54.480 with Combs, who told her they would spend quality time together, only to then bring up plans for a
00:49:00.600 hotel night during their nice romantic dinner. On the stand, Jane grew very emotional while
00:49:07.160 discussing the birthday. She heaved more than once as she cried. She is overwhelmed with these memories.
00:49:13.160 And prosecutor Maureen Comey asked her repeatedly if she needed a break. Each time Jane said no.
00:49:21.240 But that was extremely emotional testimony. She said she felt obligated to perform these acts for
00:49:28.460 Combs. She said he began paying her $10,000 per month in rent in what she described as a love contract
00:49:34.740 during their three-year relationship. She said she felt like she had to perform the sex acts
00:49:39.060 and that she expressed her displeasure many times. Quote, I don't want to be used and locked in a
00:49:45.560 room to perform and fulfill your fantasies, she texted him. And the jury saw this text.
00:49:50.860 I don't want to play this role in your life anymore. It's dark, sleazy, makes me feel disgusted with
00:49:57.060 myself. I feel it's the only reason you have me around and why you pay for the house. I don't want to
00:50:02.280 feel obligated to perform these nights with you in fear of losing the roof over my head. At one point,
00:50:07.020 he texted her asking if he could come over, adding, that's my house too. At another, he texted her the
00:50:12.440 same message six consecutive times. Are you going to let me in our house? Prosecutions alleging that
00:50:19.800 paying rent was a form of financial coercion employed by Combs. In other words, he gets her, he says,
00:50:25.260 oh, I'll pay for your rent. Move on in. You're going to love it. I'll take care of you. Then she moves in.
00:50:29.600 And then when she doesn't perform as he insists, he threatens to remove the roof from over her head.
00:50:34.560 And I know what you're thinking. She could have walked out. She could have walked out.
00:50:40.460 It's the same thing as a domestic violence victim people, which she also was. He was also beating
00:50:45.620 her. She alleges it's, it's just so much more complicated than that. It is not like she's a
00:50:53.440 gold digger. You have to look at the overall relationship and the number of abusive incidents
00:50:58.300 between them and the threats again, that were allegedly made by him to expose this behavior
00:51:03.740 that he had on tape. That's why the prosecution is alleging it's all part of a Rico scam, like a
00:51:08.640 criminal enterprise where he, he was using coercion to, to force the women to continue doing it.
00:51:14.680 In response to her concerns, she says Combs invited her to New York
00:51:18.420 and said that it would be a proper trip. He keeps doing this. The one in Miami,
00:51:23.500 the one in New York, it'll be a proper trip. But shortly after her arrival, he arranged another
00:51:28.000 hotel night at Trump international hotel. He gave her ecstasy, um, and invited a cowboy wearing heels
00:51:37.920 to come over. This is one of those escort services that Cassie testified that it was like cowboys for
00:51:42.980 angels. These guys would show up like this to join them and have sex with her while he watched. That
00:51:48.620 was his thing after the New York trip was that Miami trip that we were just getting into. And we'll get
00:51:53.940 into the details of that in a second. And, um, Jane texted that text. I read you. I don't, I don't
00:52:01.140 want to do this anymore. Here's another text. I don't feel like performing loveless, cold sex.
00:52:05.780 She texted him in October, 2023. I'm not a porn star. I'm not an animal. I need a break. He wrote back
00:52:13.740 saying he just wanted to spend the day with her. You're going to spend the day. What love bombing
00:52:18.320 me? She said, so you can get what you want. It's not genuine. I've hit a mental and spiritual wall.
00:52:25.020 Nonetheless, he got her down to Miami. And once again, another night of debauchery,
00:52:32.200 every time she trusted him that they might have just like a dinner, like a date, like go to a movie.
00:52:37.900 He, he, he said, Oh, that's what it'll be. And then every single time he was like, now we're
00:52:44.120 having an escort come. And if she didn't, she was going to lose everything. No more roof over your
00:52:49.140 head. This is obviously not a strong woman. I'm sorry. I don't mean that insulting, but Jane is
00:52:53.300 obviously extremely vulnerable, extremely vulnerable. And he loved exploiting her. He loved
00:53:00.220 making her suffer. I feel like this is part of it. You know how Harvey Weinstein couldn't get off
00:53:04.880 unless he was doing something dirty. I feel like Diddy couldn't get off unless the woman
00:53:09.200 wasn't there under a bit of protest that he knew. And he was forcing this stranger on her.
00:53:16.500 Like, I definitely think this is part of his fetish. Jane told the court after exchanging a
00:53:23.140 series of messages with Combs, she did agree to meet him. And after this one, this is October,
00:53:28.440 2023, they met at the Beverly Hills hotel. Combs said that this would be the last one. We're going to
00:53:33.880 have a sobriety party. We're going to get off drugs and we're going to stop doing this.
00:53:38.480 And at that freak off, she did it sober. Combs took ecstasy and cocaine and invited three men to
00:53:46.040 have sex with Jane. She said after having sex with the first two, she threw up. That's how horrified she
00:53:53.500 was at what she was being forced to do. But Combs encouraged her to continue. Jane, she testified,
00:53:59.880 felt absolutely terrible. I was just disgusted, she said. I was repulsed. She said she subsequently
00:54:07.560 developed a urinary tract infection and a yeast infection. She texted Combs, he placed and paid
00:54:13.520 all of these harmful men on me and risked my health. She told him the relationship was never love
00:54:19.000 and quote, I regret everything and all this dark, toxic shit that entered my life. She testified about
00:54:28.000 how that night in that hotel room, she was forced to, well, she had sex with the two escorts.
00:54:39.980 That's when she got sick and went back into the bathroom and said, I can't, I can't do this anymore.
00:54:43.740 And he said, oh good. You threw up. Now you'll feel better. Now get back out there.
00:54:51.520 And she went back out there and there was a third escort that she had sex with.
00:54:57.440 This is, this is an animal. He's an animal. He tried to make her into a barnyard animal.
00:55:04.240 There's something deeply wrong with this man. I don't give a shit about his fucking gray sweater
00:55:09.000 and his little collar and his Bible. How dare he bring the Bible in there? How dare he pretend to
00:55:16.220 understand the Bible or God or goodness? He's the living opposite. He's a devil in a gray sweater.
00:55:28.400 This stuff is so beyond disgusting. I, I don't, I need to know how I need to know what happened to him,
00:55:36.340 that he behaved like this, that he became like this with people. He was supposed to love people.
00:55:43.560 He was supposed to take care of. It's just, Jane says Combs threatened to release her sex tapes
00:55:52.100 to her child's father. Uh, she testified at one point after Cassie Ventura's lawsuit became public.
00:56:00.180 And she says she almost fainted. She said, I think, in fact, I think I did faint. It was a nightmare.
00:56:06.480 I can't believe I'm reading my own story. She texted Combs immediately. I feel like I'm reading
00:56:11.820 my own sexual trauma. The sick part is you knew this was coming and you gaslit me. You made me feel
00:56:17.240 crazy about the sex trauma I was developing, knowing you've been here before. It's also clear
00:56:22.240 that this was sexual exploitation that you framed as love for your sick fetishes. Jane's not dumb.
00:56:28.700 The court then heard audio of a conversation Jane had with Combs a few days later in which Combs tells
00:56:34.140 Jane he needs her friendship and that they need to get through this together. I need you to be there
00:56:40.020 for me. He said, you know, you don't get to worry about anything else. Jane testified that she took
00:56:44.840 that to mean he would continue to pay for her rent if she cooperated with him. Um, she says
00:56:54.840 she testified at one point about Ventura's lawsuit becoming public and that Combs told her to quote
00:57:02.500 charge me for your resentment over the relationship. I just need you to get over this. She recalled
00:57:09.260 Combs telling her, I don't want any loose ends. After Jane proposed, he pay her $150,000,
00:57:15.520 which is a pittance. I say pittance. Cassie testified. She settled that case for 20 million
00:57:20.680 bucks. Combs accused her of being an opportunist, threatened to release video recordings of her
00:57:26.040 having sex with other men during hotel hotel nights to the father of her child. Jane said that
00:57:32.220 she reported the threats to KK, Christina Coran, Combs' chief of staff, and asked Coran to intervene.
00:57:39.840 According to Jane, KK assured her that nothing would happen and that she and Combs just needed to give
00:57:44.240 each other space. Again, his enterprise around her, KK, around him, KK, and others are part of the
00:57:52.440 alleged enterprise engaging in the criminal conspiracy. Um, she also testified, and I'll wrap
00:57:59.780 it up after this. She testified that he beat her. She admits that in this beating, she hit him back.
00:58:09.020 Let's not kid ourselves, people. He, he was twice her size. She's a small little thing. She told the
00:58:16.700 court that in 2024, this is after, it's after the three men in the hotel and her vomiting and him
00:58:26.500 saying, that's good. You'll be ready to go back out there. It's after where the, don't wear the condom.
00:58:32.220 It's after I feel like a barnyard animal. It's just, if you understand women who go back to men
00:58:39.240 who abuse them, then you can understand Jane's decisions better too. She told the court, she
00:58:44.500 missed him 2024 and that they eventually got back to back together. June 18th, 2024. He came to her
00:58:52.700 house in Los Angeles after he got back from a family trip to Utah. She doesn't get to go on the family
00:58:56.520 trips. They got, neither did Cassie, by the way, this is one of Cassie's complaints. She was also the
00:59:01.400 side piece animal kept in a pen asked to perform. She was not, she was never the main squeeze. And
00:59:06.600 she saw him like Jane did out with other women who were, you know, presentable, okay to be seen
00:59:11.420 with in public. The others occasionally did, but they knew that they weren't really being presented
00:59:15.260 as the girlfriend. And they got into an argument that escalated into physical violence. Said she was
00:59:20.540 upset by a young woman that she thought he was with on that trip and called him a pedophile. Said she
00:59:26.320 pushed his head into a marble counter and started throwing candles around the house and locked herself in a
00:59:30.880 bathroom. Combs kicked the bathroom door off of its hinges, she said. So she ran into a closet
00:59:35.360 and then tried to leave. Jane said Combs caught her at the front door, kicked her in the thigh and put
00:59:41.400 her in a chokehold. She said she was able to squirm out of it and ran outside. Testified she returned to
00:59:46.480 the house thinking Combs had left, but he followed her inside. This time she said she hid in the guest
00:59:51.960 bedroom and locked the door, which Combs also kicked in. He was after her man and he meant business.
00:59:56.780 Then ran onto the patio. Think of him this angry. Think of what you saw in that videotape.
01:00:02.080 How would you like that man running after you as a hundred pound woman? Where they punched each
01:00:06.340 other. Jane said she went into a ball on the ground in her backyard as Combs kicked and punched her.
01:00:12.980 She said he grabbed her by the hair and dragged her back into the house. Where have we seen that
01:00:16.180 before? Does that sound like a pattern to you? Shortly after the fight, Combs invited a male
01:00:21.980 entertainer over because he said, we're not going to end the night and we're not going to end the
01:00:28.700 night like this. I, this is like the lowest moment I've had in this whole trial. This is after the three
01:00:35.520 escorts. This is after you threw up so you can do more. This is after all the other things. She gets
01:00:40.560 back with him. She, she gets beaten by him. She runs, she keeps locking doors down that he busts down.
01:00:47.260 He kicks and punches and beats the shit out of her. And then he says, we're having a hotel night.
01:00:56.140 A male escort is coming over. Jane said he told her to put on makeup and put her hair to the side
01:01:04.680 to cover her injuries and insisted she take an ecstasy pill before having sex with the male escort
01:01:13.280 while Combs watched. She told the court Combs had his assistant and a security guard later deliver
01:01:19.520 10,000 to $12,000 in cash for damage to the home, which included four broken doors and to pay the
01:01:25.200 male escort who did come and have a hotel night. Photos of the damaged doors were shown in court.
01:01:33.940 I like, I can't, I guess I need to tell you at this point, he denies all these allegations.
01:01:38.560 He's entitled to the presumption of innocence. Some of the testimony of some witnesses has fallen
01:01:47.060 apart. Like the one woman who acted as his chief of staff for a period of time, uh,
01:01:55.680 Bangolan, the one who said he dangled her over the balcony. He's produced, uh, receipts and cross
01:02:01.420 examination that show her alleged pictures of injuries are from a time when he was out of the
01:02:06.640 country. She fell apart on the stand. It was a major victory for Diddy. So we cannot take
01:02:13.540 everybody's word as gospel. And he has not yet begun presenting his defense. What we know that
01:02:18.840 that helps him. We know from his cross examinations of these witnesses, but I'm sorry. You're never
01:02:26.600 going to convince me. These women are making this shit up. His defense, by the way, with most like
01:02:30.960 with Cassie and with Jane appears to be like, at some times you consented and you took the money
01:02:37.260 and you liked having an apartment or in Cassie's case, you liked having the trappings of wealth
01:02:42.700 and somebody to produce your records. It does not appear to be, they did not do this stuff
01:02:46.580 that he's not an inhumane, callous asshole. I just like, it's, it's overwhelming. I'm, I guess I
01:02:54.320 should have included like a warning before we did this show for people who've experienced sexual
01:02:58.060 violence or domestic violence. Cause I, I know this stuff actually can be triggering.
01:03:02.660 I am thankfully not a victim of such violence, but I've interviewed and known so many that I know
01:03:07.920 this actually can be triggering. So my apologies for not putting that up front. I assume you kind
01:03:11.720 of know it when we're going to get into the Diddy case, but that's where we are. The government's
01:03:16.060 proving its case. This guy's going to be convicted. I will be stunned if he does not get convicted
01:03:21.280 and he's likely going to jail for the rest of his natural life, which is where he belongs.
01:03:25.460 He should not be able to prowl the world seeking the ruination of souls. If you know the reference.
01:03:34.780 Um, okay. Sorry to end on such a dark note, but I guess the positive on all of this is he's
01:03:42.940 caught. He is on trial right now because we have a justice system that recognizes these are crimes.
01:03:50.160 You're actually not allowed to coerce women into sexual acts with prostitutes and make them effective
01:03:57.040 prostitutes against their will over and over and over again by threatening to tell their baby daddy
01:04:03.320 or their parents or the world that they're the sluts you've turned them into. You're not allowed to do
01:04:10.780 that. It actually is a crime. It counts as sex trafficking by force, which is the second and
01:04:16.540 one of most serious crimes he's charged with. So I, I don't care that it's Maureen Comey. I don't care.
01:04:23.800 The prosecution's right. This case was proper. That's my opinion. Um, and we'll, we'll wait to
01:04:33.120 see what his defense is. There actually is serious talk about him possibly taking the stand, which I
01:04:40.020 believe would be a mistake. The reason some think it wouldn't be is because clearly this man has the
01:04:46.140 devil's ability to charm or this wouldn't have gone on for so long. Some, somebody on his staff
01:04:52.400 would have done something clearly, right? Like somebody would have said, gee, I think you fire
01:04:58.360 bombed somebody's car. We should probably call the cops or somebody would have said, I'm watching you
01:05:02.980 beat woman after woman. A lot of the staff saw that and did nothing. Um, and clearly he's got some
01:05:09.280 mystical ability. And again, I believe it's related to his enormous money wallet and fame,
01:05:15.760 enormous fame and people falling under his spell, like a cult master almost. Um, so maybe they're
01:05:25.520 banking on that same, is it charisma? Is it like the ability to sound self-deprecating? That was
01:05:32.340 Danny. The fact that you're a huge star, he can't buy the jury. He can't offer them a roof over their
01:05:37.860 heads. He can't threaten them. So I'm not sure you can bank on those abilities if he were to take
01:05:43.580 the stand. So I do feel heartened that the prosecution was brought, you know, in a way it's
01:05:50.540 like the Epstein trial that we never got this gross, disgusting, super rich, super connected guy who
01:05:56.220 just over and over exploited vulnerable women. And we never got to see this with Jeffrey Epstein,
01:06:03.120 but we're getting to see it with Sean Diddy Combs and he deserves every freaking minute of it.
01:06:09.580 My only regret is that these women aren't on camera because it would be even more powerful
01:06:15.140 for us to see their testimonials. But I appreciate it for their sakes that it's not federal court
01:06:21.060 doesn't allow cameras. And I'm sure these women were very happy that it wasn't televised, you know,
01:06:25.300 for obvious reasons. Just, you know, I'd like to see, I'd like to have the tape out there. It's just
01:06:31.780 very powerful to see the tape and America, like his defenders should be forced to see the tapes
01:06:37.540 and defend them. This is not the Amber Heard trial. The Blake Lively trial is the Amber Heard trial,
01:06:43.820 in my opinion. This is not, this is real. He's a deeply problematic man. And I hope justice prevails.
01:06:52.600 Okay. On that, I'm going on vacation. We've got some good content queued up for you, uh, while we're
01:06:59.420 gone, we'll miss you. Uh, but this is, uh, our, our family vacation where the kids and we go someplace
01:07:05.660 great. And I'll tell you the details when we get back. I never liked to really broadcast it in advance
01:07:09.600 because then you kind of inviting the paparazzi to show up. It happened to us in Italy. I don't want it
01:07:14.020 to happen here. So anyway, a more details when we get back, I won't subject you to a bunch of vacation
01:07:18.280 details and photos, but I'll just fill in a couple of the blanks. And I really hope you guys have a
01:07:23.240 great 10 days. Um, please continue listening and downloading. That'll help our show. And, uh,
01:07:27.880 I appreciate that. And AM update same. And, uh, we will reconnect on Monday, June 23rd,
01:07:36.960 unless something big breaks between now and then where I will be bringing my broadcasting
01:07:42.320 technology with me. So you may actually hear from me between now and then. So do continue downloading
