I mean, it's not the Democrats could not possibly be fair, especially I will say upstate New York Democrats. They're more like Midwestern Democrats. They're they're not crazy woke in my experience. And again, I've lived the majority of my life, my upbringing up there.
00:31:18.640And what we're learning today, Saurabh, is that some of them have already asserted, because the Title IX proceeding that was held on the grounds of Cornell did get statements from at least six of the seven defendants, maybe all seven.
00:31:34.380What's been leaked to the media only seem to say they got six to the seven.
00:31:37.960Maybe one young man got smart and had a lawyer who said, you're not giving a statement.
00:31:43.380We're leaving Cornell and we're not giving a statement because they have only one goal in mind, which is to ruin you.
00:31:49.560But in any event, the statements that we are seeing leaked to The New York Times include questions raised by the young men about their own capacity and whether they consented.
00:32:02.000Lopes, whose lawyer was on this show yesterday, and it is Lopes, not Lopez, Jilio, said that she was the one who initiated their sexual conduct.
00:32:13.220And just to keep it straight, because I know it's difficult, there were three threesomes.

00:32:25.140The second one involved John Newell, Lopes, and Jane Doe.
00:32:30.320And Newell was the one who tweeted out the Snapchat or posted the Snapchat free P word upstairs.

00:32:48.920And this guy, Lopes, was part of the second encounter who said she initiated the sexual contact and did not ask for his consent.
00:32:58.420He said he left the room around 2 a.m. because he had become uncomfortable.
00:33:03.420Guys were going in there to sort of take a look at what was going on, and he didn't like that, I think, and he wound up going to McDonald's.
00:33:11.560He did not tell his buddies what had just happened because he was, quote, admittedly a bit embarrassed.
00:33:16.520Then came Winston Lee, who was part of the third interlude.
00:33:22.260he also said that Jane Doe initiated sexual activity with him without asking.

00:33:37.360because I didn't want to engage in anything like sex, said Lee.

00:33:45.200But later that night, Mr. Lee said he asked for Jane Doe's consent

00:33:51.120He recalled telling Jane Doe that, quote, if you're uncomfortable with any of this or you don't want or you won't want to do this, that is perfectly fine.
00:34:02.000He said Jane Doe replied, we're all consenting adults here.
00:34:07.320And then there was another comment where Diego Sarabia, who was accused of having gone into the room and accused of having snorted a line off of her body, but not have actually been been part of a sex act.

00:34:24.760He was shocked by the scene in front of him.
00:34:27.780There were several fraternity brothers there.
00:34:53.660This is the account that was given to the university investigators on top of the woman's account, which we know in the six-page statement given to the cops did not accuse the men of forcing her to do anything.
00:35:06.860And yet, I stand with survivors like Jane Doe.
00:35:13.180Yeah, this was, first of all, not normal in medieval times, worth noting. But actually, that quote has the ring of truth to it, or at least plausibility to me. But look, let's step back here. This is a point that Sean and I and you, Megan, have made repeatedly about different cases, which is the sexual culture that led to all of this is a broken sexual culture.
00:35:33.400It's unhealthy for young men. It's unhealthy for women. It creates feelings of shame in the women who engage in it after the fact, etc. But the way to repair that culture is not to create a system of after the fact punishment that targets one side of the sexual equation and only one side, namely young men, while basically absolving all responsibility off of young women.0.64
00:36:01.840You know, the context to all this is not ketamine and drinking at Ki-Fi. In her own lawsuit, Jane Doe lays out a sequence of drinking activities, and it's her. Her sorority, Tri-Delta, had instituted a rule of no hard alcohol drinking in the house of the actual sorority.0.95

00:36:30.580houses for of hard alcohol yet in the jane doe complaint the civil suit she says it began it

00:36:45.960delta the sorority for not noticing that she had drank alcohol and yet taking her to the
00:36:51.960downtown strip of Ithaca, New York, where a bar had put an X on her hand that indicated she's
00:36:58.780underage, yet she drank. Then she went to like a kind of outdoors other party and she got a
00:37:04.620bracelet that indicated she was underage and yet was still able to get a drink and showed up. And
00:37:10.420by her own telling in the police statement, she was an intoxication level of, she said, five out
00:37:15.700of 10 by the time she got to Chi-Fi. So my point here in laying out that sequence of drinking is
00:37:21.380we've set up as much of a kind of patriarchal barriers, but if a young woman is determined to
00:37:28.000drink and put herself in sexually risky situations, at the end of the day, she can. If we want to
00:37:33.380change the culture, let's change the culture. But it cannot be changed after the fact punishment
00:37:39.420of young men. Now, I just want to, you mentioned the Title IX hearings that the university itself
00:37:44.780held. We at Unheard uncovered, which were not public because they were off the New York docket
00:37:51.300system. But he, one of the students, the accused, Scott Kirchmar, had sued Cornell, alleging that
00:37:57.680the process that the university used to convict him of attempted sexual exploitation, that process
00:38:05.440was defective in all sorts of ways. And I'll give you the example, the headline viewers can find,
00:38:10.520we called it, Inside a Rape Kangaroo Court at Cornell. And one of the hearing officers,
00:38:17.420one of the panel that was supposed to adjudicate his case, he is facing the second most heinous
00:38:22.720charge we have on the books. She was driving. The woman's name is Savannah Bowell. She's one of
00:38:29.720the Cornell staffer who was overseeing the case. One of his judges. One of the judges, that's right.
00:38:34.880And she's driving and Kirschmar's lawyer can see that the shadows across her face are changing.
00:38:41.300She's not focused on what's happening in the Zoom meeting. She's paying attention to the road.
00:38:47.420And in another instance, because she wore glasses, lawyers for the student, the accused
00:38:52.400student could see on her glasses reflected what she was watching on her monitor.
00:39:14.120One of the panelists isn't listening, isn't paying attention.
00:39:17.300Then subsequently, she took off her glasses, meaning she probably was warned by others, like, hey, take off your glasses.
00:39:23.500They can see you're not paying attention.
00:39:25.140So this student has already, and Scott, has already gone through one process, which is the police investigation, and they declined to charge for the reasons you laid out, Megan.
00:39:35.160Then he went through the kangaroo court of the university and was found guilty of attempted sexual exploitation, even though he was never apprised.
00:39:44.080He was never notified that this is the charge he's facing.
00:39:47.340He was brought up for rape and sexual exploitation.
00:39:50.040The university exonerated him of that, but they still struck him with attempted sexual exploitation, a charge that his lawyer didn't know about and therefore couldn't prepare for or attempt to refute.
00:40:03.320So they've already gone through this kind of kangaroo process.
00:40:07.420I still think with Sean and you, Megan, I hope that the new kind of criminal investigation led by the attorney general, Tish James, and the governor, it's still dealing with the same underlying facts, which are very, very unfriendly to the woman, to Jane Doe.
00:40:24.680So I hope that the outcome will still be the same because the facts haven't changed.

01:31:50.100But the reality is this is Texas. And, you know, Ken Paxton, he's got baggage like he obviously has baggage.
01:31:56.940The state's Republican establishment really can't stand him. He just absolutely beat the stuffing out of John Cornyn, an incumbent by 30 points. And so there's a lot of people who are kind of butthurt over that. But again, it's Texas. And I think I think I saw a couple of polls recently that showed Paxson up by two or three. I do think it's going to be close, but it's Texas. You now got the president's PAC getting involved. You've got a bunch of money. I think I saw something like 50 or 100 million going into the state.
01:32:25.860And I think Tallarico thus far has survived based on the fact that people really didn't know much about him.
01:32:31.700Once they get a month worth of ads about what a trans-frico this guy is, how he thinks God's non-binary and children have six genders and he loves talking to trans children, this is not a guy who's going to survive in Texas.
01:32:45.360And I look back to the race with Beto O'Rourke against Ted Cruz.
01:32:50.740I think Ted Cruz in many ways was kind of similar to Paxton.
01:32:53.540you know he didn't have some of the bad can stand him yeah people just don't really like him

01:33:03.480attention in a bad year for Republicans and cruising it up I think winning by four or five
01:33:08.460so I don't think Tallarico is going to win but a lot is going to depend on the actual political
01:33:13.760environment nationwide if it's a d plus five d plus seven electorate I think Paxton squeaks through
01:33:19.640If it's much worse than that for Republicans, I think that undertow might take out Paxton and even potentially Greg Abbott as governor there.
