00:01:01.300 We were all together Friday when the judge finally declared a mistrial after the jury could not come to a unanimous decision after seven days of deliberations and two months of trial.
00:01:11.760 Clancy's attorney, Kevin Reddington, spent the six-week trial in Plymouth, Massachusetts, making the case that Clancy was not criminally responsible for killing her three children due to postpartum psychosis.

00:05:42.080 It's actually gotten worse. This campaign, he writes, now fueled by insatiable media coverage
00:05:46.880 remains at a fever pitch and has resulted in real life threats to Patrick's reputation,
00:05:52.060 livelihood, and life. He said legal action could be taken against those responsible for
00:05:58.420 these claims. Quote, enough is enough. This spread of blatant and baseless falsehoods must
00:06:04.920 stop. Those responsible should understand that there will be consequences and every
00:06:09.020 appropriate measure will be pursued to hold them accountable, including legally. Law enforcement
00:06:13.600 has been notified. People are sick. Get it together, people. He did not kill his children.

00:07:36.640 You know, again, at the end of the case, I made statements to the effect that I was upset.
00:07:44.500 And the reason I was upset, I would defend that individual's right to be a holdout forever.
00:07:52.860 That's part of our judicial system, and I respect that, and I would certainly defend his right to do that.
00:08:00.720 What I was upset about was after that lengthy trial and the work that everyone put into this case,
00:08:07.340 including these jurors that spent literally almost two months away from their home, their job, their family,
00:08:14.220 where a gentleman had an opinion, not that he was sticking like, you know, the movie Twelve Angry Men,
00:08:22.340 but in fact he had agreed, according to the note from the forelady,
00:08:27.180 that he had doubt, but he would not apply the law of reasonable doubt as presented by the judge.
00:08:35.200 That's not right. And that's why I was upset.
00:08:38.900 I'm glad you explained that. I look forward to the follow up question from George Stephanopoulos
00:08:43.840 asking you, how dare you accuse this citizen servant who went in there and took two months
00:08:50.680 out of his life to sit on your jury of a felony. How dare you? Truly, like there's upset and then
00:08:58.300 there's baseless accusations against an innocent civilian who was dragged into court through no
00:09:06.460 fault of his own, who you chose to sit on your jury and who did so. And by all accounts, according
00:09:14.600 to his principles, no one was accusing this juror of holding out or not following the reasonable
00:09:20.220 doubt standard before the judge kept calling the jury in three times over saying, please come to a
00:09:27.200 verdict. Then finally, it seems clear the other jurors turned on him and said, well, that guy said
00:09:31.940 he had a doubt, but he won't apply it to reasonable doubt. In other words, his doubt didn't rise in
00:09:36.300 his mind to a reasonable doubt. And they were pissed off because they wanted to go home.
00:09:40.200 So they tried to find another way of ending this thing, which was to potentially bounce this guy.
00:09:44.840 And the judge, to his credit, Judge Sullivan, wasn't persuaded. And he understood exactly
00:09:49.240 what they were doing and didn't fall for the nonsense, notwithstanding Reddington's theatrics.
00:09:53.780 But again, wouldn't it have been nice if we had a competent journalist sitting across from
00:09:58.940 Reddington to say, how dare you accuse a civilian juror of committing a felony when he's not there
00:10:06.500 to defend himself and based on nothing other than an ambiguous four persons note? Shame on you.
00:10:12.860 reddington was asked about his client lindsey clancy's alleged postpartum psychosis
00:10:20.460 and whether it was simply an excuse to avoid a murder conviction watch and what do you say to
00:10:27.660 those critics who say this is a rationalization what we're talking about here is just plain evil
00:10:32.200 oh please it's not it's not evil these people don't understand they don't know what she went
00:10:38.180 through they didn't see her text messages they didn't see her journal they didn't see the notes
00:10:42.420 that she wrote. They didn't see the text she sent her mother in October saying, mommy, can you please
00:10:46.980 come to here? I am sick. Something's wrong. And it was a result of the medications. They don't
00:10:51.820 know about the number of times that she reached out. She went to the women and infants. She went
00:10:55.440 to the suicide hotlines. She reached out to everybody and anybody that would listen to her
00:11:00.280 and kept saying, I am not good. I am not well. And it was ignored. A lot of people who commit
00:11:06.740 crimes are not well. Most of them, in fact, especially crimes like this. They're not. They're
00:11:11.220 not well. Some of them have had a mental break. Some of them are just incredibly depressed,
00:11:17.940 suicidal, homicidal. They're having serious mental illness. We don't excuse them from murder.
00:11:24.200 That's not the way our law works. We've been lured into a bunch of nonsense by these very,
00:11:31.820 very diehard Lindsey Clancy supporters. I'm not talking about the people who were genuinely
00:11:36.300 persuaded that she didn't know right from wrong. Okay, there is that group, and that's a real
00:11:40.860 thing. But there are just nutcases who think if you get super depressed and you kill your kids,
00:11:46.180 it's not your fault. That's not true. Mental illness does not excuse you from criminal
00:11:52.100 behavior. It has to rise to the level of legal insanity, which is a nearly impossible standard.
00:11:59.380 It is extremely high for good reason in the law. So it's just I'm sorry for Lindsay Clancy. I'm
00:12:08.000 really sorry for her children and for her now ex-husband. But this, she had ordered behavior 0.99
00:12:17.680 pre-planning and was, and she had her wits about her when this thing went down. To me, the most
00:12:24.920 telling part is the fact that she took the phone call from her husband, Clancy, in the middle of
00:12:29.740 the murders, was cool as a cucumber. 14 seconds, they chatted about whether he could get the generic
00:12:36.280 form of the medicine at CVS. She kept it together. She wanted to make sure he didn't come home.
00:12:43.340 This was not some crazy psychotic person. She knew exactly what she was doing, whatever.
00:12:49.640 He wants to say people who think she should be convicted of murder, they don't understand. No,
00:12:56.560 we understand. We do understand. A lot of us really got up to speed on this case and understand
00:13:01.760 exactly what your defense says. We just rejected it. And you know what? Good for you, Kevin
00:13:06.420 Reddington, because you apparently convinced 11 members of your jury to go along with your excuses,
00:13:11.460 but not 12. And that's what you need in order for a not guilty by reason of insanity. You didn't
00:13:18.780 get it. You almost did, but you didn't. Sorry. That's the way it goes. So now you have to live
00:13:25.780 with it. And yeah, a deal would be great. But that deal, I think, is going to have to involve
00:13:30.160 a guilty plea by your client to at least voluntary manslaughter. I could live with that.
00:13:38.180 It's not my preference. I could live with it though, but I just don't think a not guilty
00:13:45.820 by reason of insanity sentence, which would be indefinite commitment to a mental facility,
00:13:51.480 is going to be agreed to by the DA, Tim Cruz. Maybe I'm wrong, but he did not sound like a
00:13:56.240 guy ready to do that at his presser on Friday. Sadly, whether the Clancy case would influence
00:14:03.060 other mothers no longer appears to be a theoretical question. This story is so
00:14:08.160 disturbing. We brought it to you on AM Update today. 40-year-old Corey Walsh of Frankfurt,
00:14:13.440 Illinois, is now facing first-degree murder charges for killing her two-year-old son.
00:14:20.640 Last Tuesday, Walsh allegedly hanged her own child in the basement before allegedly attempting to kill herself.
00:14:29.740 I'm sorry, but once again, it doesn't look like she actually tried to kill herself.
00:14:35.080 It doesn't.
00:14:36.580 An autopsy confirming that her two-year-old boy Barrett died due to asphyxiation.
00:14:42.600 That'll do it.
00:14:43.640 I mean, that'll happen when you hang him from a rafter in the basement.
00:14:47.340 Walsh reportedly telling law enforcement that she killed her son because he was, quote, the devil and, quote, the Antichrist.
00:14:54.340 Witnesses say Walsh followed the Lindsay Clancy trial closely and that she was texting her friends about the case just hours before she allegedly killed her own son.
00:15:05.480 According to Walsh's attorney, she was suffering from a, quote, psychotic episode at the time of the killing.
00:15:14.300 So I've got a question for the people who are ready to excuse Lindsay Clancy.
00:15:18.420 Do we excuse all the mothers if they just throw out that word, psychosis?

00:16:11.140 this behavior in a way are going to rue the day in sending any sort of a message to the
00:16:18.640 mothers of America that there is a get out of jail free card potentially awaiting you

00:16:38.100 really got under her skin

00:16:44.620 about what that child went to as she strung him up.

00:17:18.920 In fact, a lot of news organizations won't discuss the specific way a person does it now because it is suggestive and it is a little contagious.
00:17:31.000 And there tends to be when there's a very famous person who dies by suicide, there tends to be another one and then possibly another one in the days and weeks thereafter.
00:17:40.160 I mean, I've been at this for 25 years now and that is how it goes.
00:17:43.520 And as a result, news organizations are now more reluctant to publish the details of how somebody dies by suicide these days.
00:17:53.540 Well, I feel like this is a similar problem.
00:17:58.360 The more we talk about this kind of murder in a way that has anything other than abject contempt for the perpetrator, the more we encourage it.
00:18:12.880 the more we bless it as an option. Like you could consider this as a solution and you might
00:18:22.000 actually get away with it. It's very sick. This is like extremely sick. And we are becoming sick
00:18:30.980 as a society with this. I mean, I really, this should be a no brainer that we cannot be doing
00:18:40.800 this. Cannot be sending this kind of messaging. Giving you a little bit more detail here
00:18:45.980 on this Corey Walsh, this woman accused in this latest case out of Illinois.
00:18:52.320 They say a neighbor came over. This is the prosecution. Now, they've been at it for a week
00:18:58.660 because this happened, as I said, last Tuesday. The prosecution filed a petition to try to keep
00:19:03.820 this woman from being released pending trial. And they alleged that a neighbor, a neighbor came over
00:19:10.040 and found Walsh lying in a tub, fully dressed, surrounded by bloody water.
00:19:18.600 The neighbor told police she had taken a knife from Walsh
00:19:21.680 and tried to help her by holding a towel on her left inner thigh.
00:19:26.180 Walsh had cuts on her wrists and thighs that they do not believe were life-threatening.
00:19:33.240 um the neighbor told police that walsh asked the neighbor why she was taking the knife away from
00:19:40.280 her and she said that walsh told her she was trying to kill herself and that bear which is
00:19:45.660 what she called her son was in the basement again the injuries were not considered life-threatening
00:19:53.000 though she was taken to the hospital after police saw that she was allegedly attempting to harm
00:19:58.300 herself. Then the neighbor found Barrett in the basement. And you already have heard enough about
00:20:06.260 that. Three other children still at home or returned home around the time that Barrett was
00:20:12.220 discovered. An infant was present unharmed. Two school-aged children returned home around the time
00:20:17.860 of the discovery. They were not physically injured. The husband who lives at the home was out of state
00:20:23.140 at the time of the incident, flew home Tuesday evening.
00:20:27.920 I mean, your heart goes out to this guy.
00:20:29.580 I'm sure there's more to this story.
00:20:31.540 And this business of Walsh becoming obsessed
00:20:33.820 or very interested in the murder trial of Lindsay Clancy
00:20:36.460 is, of course, very interesting.
00:20:38.240 I want to know how she was in some group text message thread
00:20:43.500 with her friends and was discussing this case
00:20:48.380 as recently as 12.30 p.m. last Tuesday.
00:20:53.140 That's roughly three and a half hours before her son was discovered dead at her hand, allegedly.

00:21:04.680 I mean, who among us does not have a text thread with our girlfriends? 1.00
00:21:09.460 You'd like to think you'd know if somebody in your text thread was a psychotic mother planning on murdering her two-year-old sometime that afternoon.
00:21:21.120 I mean, each one of those moms is going to be a witness, and that text thread is probably going to become public at some point very soon.

00:21:38.660 I just, you know, I keep coming back to the same proposition.
00:21:44.340 You have to be somewhat nuts to kill your child.
00:21:46.740 to kill in almost all circumstances unless, you know, it's like when someone harms a child and
00:21:54.080 that child's father or sometimes mother murders the person who harmed their kid, that's not crazy
00:22:01.220 to me. That's not crazy. It's, you know, it's reckless and it's illegal, but that's not crazy.
00:22:08.100 But the vast majority of murders, I would say, are crazy things to do. And in most of those cases,
00:22:14.560 is like literally insane. These gang bangers on the south side of Chicago, that's a lifestyle.
00:22:23.360 But like if you pick up a gun and you go and assassinate somebody, a school shooting, God
00:22:28.180 forbid, a mass shooting, these crazed people we see on the subway, there's something very
00:22:34.160 seriously wrong with them. But keep in mind, medical insanity and legal insanity are not
00:22:41.260 the same. The bar for legal insanity is much higher. It's much higher because those people
00:22:49.820 can get back out and they can kill again. And they do. We talked about the case of Constance
00:22:57.820 Fisher last week. The woman in Maine, she drowned her three children. She went to the mental
00:23:05.300 institution. She got let out. She had three more children with the same husband. She had the first
00:23:11.020 three with, and she drowned them too. I mean, this is deadly serious what we're dealing with here.
00:23:19.460 And it is our job as a society to protect kids, the most vulnerable among us, from the Lindsay
00:23:27.120 Clancy's of the world, from the Corey Walsh's of the world. We're not doing so well. We aren't.
00:23:33.440 And telling them implicitly or otherwise that this is, I don't want to say okay. It's not exactly
00:23:39.960 that we're saying it's okay, but understandable and we'll be quickly forgiven is dangerous stuff.

00:25:58.020 You know, this Lindsey Clancy case, her bizarre request for a presidential pardon, which isn't going to happen.
00:26:04.840 And now what appears to be a copycat in Illinois, Victor, as another mother kills her own child and claims psychosis.
00:26:17.400 Yeah, I think in this therapeutic culture that we have, we don't realize that human nature is unchanging and people are actually rational.
00:26:26.480 So if people believe there's no deterrence, that's really the only thing that stops people from doing bad things, whether it's social opprobrium or shame or law.
00:26:36.320 But if you channel that this is acceptable, then anybody who feels that the burdens of child-rearing or they get depressed one day, then there's a message that they can do some dastardly, horrific act and not pay the price for it.
00:26:55.540 And that transcends almost everything.
00:26:58.360 For the last century, we've recognized that people can plead insanity, but that's a very careful, narrow definition.

00:29:44.820 than I think had prior evidence of more derangement than in this case.

00:40:15.140 never really experienced that they were old fuddy-duddy reactionaries, which they are in
00:40:21.260 some sense. And that's why I think all of these have a political motive. And we kind of forget
00:40:27.980 that. We think they're crazy or Luigi Mangione. But you take a deep breath and you think,
00:40:33.140 well, Charlie Kirk's gone. And in those two or three states in the 2024 election,
00:40:39.580 you can make the argument that his get out of the vote and registering young people made the
00:40:44.260 difference in places like michigan and he was a very heroic figure and he's gone now and he's
00:40:50.420 not going to be replaced i don't see anybody on the horizon that has that talent oh at least not
00:40:57.280 yet and so nobody talks about that the that that killing really made a difference in for for i
00:41:08.080 think for years in the political landscape if he was there right now and the midterms that are
00:41:13.720 coming up, he would be the one person that would be saying, let's not be pessimistic.

00:41:24.060 blanket these key races. And he's not there. And there's nobody that can take up that slack.
