00:02:34.760 which authorities say appears to have been the shooter's intended target.
00:02:37.960 A suicide note found on the shooter's body claiming he suffered from CTE,
00:02:43.140 a brain disease linked to head trauma commonly found in former NFL players,

00:03:51.540 Hyman, a Cornell graduate, had been with Rudin for less than a year.

00:03:58.960 working a paid security detail at the time of the shooting,
00:04:02.200 leaves behind an eight-months-pregnant wife and two young sons.
00:04:06.420 NYPD Commissioner Jessica Tisch, Tuesday afternoon,
00:04:09.140 providing an update on the investigation into the gunman.
00:04:12.080 The weapon used, an AR-15-style assault rifle,
00:04:15.600 was assembled by using a lower receiver purchased by an associate.
00:04:19.820 We have located that associate and others,
00:04:22.520 and we'll be questioning him about that purchase.
00:04:25.300 Two groups of detectives are currently en route to Las Vegas

00:05:41.800 for making improper public comments about President Trump
00:05:44.860 and his administration.
00:05:46.460 These comments have undermined the integrity of the judiciary,
00:05:49.640 and we will not stand for that.
00:05:51.520 This filing in response to a story we reported to you here
00:05:54.780 about two weeks ago
00:05:55.920 with investigative journalist at The Federalist, Margo Cleveland.
00:05:59.420 The Federalist exclusively obtaining a memo
00:06:01.560 from the March Judicial Conference,
00:06:04.180 a biannual meeting of the lead judges
00:06:06.220 from the various circuits,
00:06:07.740 detailing a concern raised by Obama-appointed
00:06:10.820 D.C. District Chief Judge James Bosberg.
00:06:14.080 According to the memo, Judge Bosberg, quote,
00:06:16.480 raised his colleagues' concerns
00:06:18.500 that the administration would disregard rulings
00:06:21.100 of federal courts leading to a constitutional crisis.
00:06:24.340 Chief Justice Roberts addressing the concerns
00:06:26.900 by talking about his interactions with President Trump,
00:06:30.060 noting them to be civil and respectful,
00:06:32.300 expressing hope that no such crisis would materialize.
00:06:35.540 Cleveland explaining why Judge Bosberg's comments
00:06:37.900 were inappropriate.
00:06:39.340 The first reason that that's inappropriate
00:06:41.860 is because the Trump administration
00:06:44.220 is not just the administration,
00:06:46.440 separate branch of government.
00:06:48.420 Judges can criticize the executive branch,
00:06:50.920 just like the executive branch
00:06:52.580 can criticize the judiciary.
00:06:54.760 But here, the criticism
00:06:56.380 was about the president as a defendant
00:07:00.740 and that they would disregard court orders.
00:07:04.320 The second reason that that was
00:07:06.700 an inappropriate comment,
00:07:08.840 again, the comment is inappropriate
00:07:10.540 because of what it conveys,
00:07:12.800 and that was that they had
00:07:14.680 not just prejudged the president,
00:07:17.260 but that it goes against the normal presumption
00:07:20.360 that the courts are supposed to have,
00:07:22.860 which is that public officials
00:07:24.320 will properly discharge their official duties.
00:07:27.980 So my bigger concern with the comment
00:07:30.560 is not that it was made.
00:07:32.720 There's a concern there about comments
00:07:34.780 on public cases.
00:07:36.300 But my biggest concern is the sentiment
00:07:39.700 that it indicates or represents,
00:07:43.160 which is that there is this anti-Trump bias
00:07:46.520 and that the judges are not presuming
00:07:49.720 that public officials
00:07:51.200 are properly discharging the law,
00:07:53.620 but rather that Trump is not going to do
00:07:57.020 what they are told to do,
00:07:58.380 what he or his administration is told to do.
00:08:01.120 In fact, just days after that comment,
00:08:03.520 Judge Boesberg went on
00:08:04.640 to block the Trump administration
00:08:06.120 from deporting Venezuelan nationals,
00:08:08.740 alleged gang members,
00:08:10.140 to El Salvador under the Alien Enemies Act,
00:08:13.240 then scheduling contempt proceedings
00:08:15.560 against the Trump administration
00:08:17.240 for failing to halt deportation flights
00:08:19.480 already underway.
00:08:21.400 The Supreme Court ultimately vacating
00:08:23.100 Judge Boesberg's injunction order,
00:08:25.420 ruling that Alien Enemy Act cases
00:08:27.260 must be brought in the district
00:08:28.660 where the illegal immigrants are detained.
00:08:31.600 Given that the detainees were in Texas,
00:08:33.880 the high court found Judge Boesberg's court
00:08:36.000 in Washington, D.C. was the wrong venue.
00:08:39.320 Boesberg held onto the case anyway,
00:08:41.620 proceeding with his contempt hearing
00:08:43.240 and finding probable cause
00:08:44.920 that the Trump administration
00:08:46.000 removed the aliens in criminal contempt
00:08:48.700 of Judge Boesberg's orders.
00:08:50.660 That finding has been appealed to a higher court.
00:08:53.740 The misconduct complaint
00:08:54.900 just filed against Judge Boesberg by the DOJ
00:08:57.860 reads, quote,
00:08:58.900 Within days of his statements to the chief justice,
00:09:02.720 Judge Boesberg began acting on his preconceived belief
00:09:05.700 that the Trump administration
00:09:06.780 would not follow court orders.
00:09:08.300 By singling out a sitting president
00:09:10.440 who was and remains a party
00:09:11.980 to dozens of active cases,
00:09:14.060 Judge Boesberg attempted to transform
00:09:15.860 a routine housekeeping agenda
00:09:17.640 into a forum to persuade the chief justice
00:09:20.460 and other federal judges
00:09:21.740 of his preconceived belief
00:09:23.840 that the Trump administration
00:09:25.180 would violate court orders.
00:09:26.720 Cleveland walking us through
00:09:28.480 the finer points of the DOJ complaint.
00:09:30.660 They argue that Judge Boesberg's words
00:09:34.660 and deeds violated three different canons,
00:09:38.500 including canon one that says
00:09:41.380 a judge should uphold the integrity
00:09:43.600 and independence of the judiciary.
00:09:46.160 Canon two that states
00:09:48.020 that a judge should at all times
00:09:50.080 promote public confidence
00:09:51.860 in the integrity and partiality
00:09:54.080 of the judiciary.
00:09:54.860 And then canon three,
00:09:57.220 which says that a judge
00:09:58.540 should not make public comments
00:10:00.680 on the merits of a matter
00:10:02.620 pending or impending in any court.
00:10:06.300 Attorney General Pam Bondi's chief of staff,

00:10:16.600 Cleveland here on what happens next.
00:10:18.440 The chief judge of the D.C. Circuit
00:10:21.400 will decide whether or not
00:10:23.860 to launch an investigation based on this,
00:10:27.300 and then he will make recommendations.
00:10:30.780 So in this case,
00:10:32.060 the Department of Justice is asking
00:10:33.940 that a special investigative committee
00:10:36.700 have an inquiry to determine
00:10:39.320 if the conduct was prejudicial.
00:10:42.300 And he also is asking,
00:10:44.080 or I should say the department
00:10:45.040 is also asking that in the interim,
00:10:47.260 that the court reassign
00:10:50.020 the cases to another judge.
00:10:52.860 So the cases in which Trump
00:10:54.460 is before Judge Boasberg.
00:10:56.620 And then they also request
00:10:58.560 any appropriate disciplinary action.
00:11:01.200 It could be that there's a public reprimand
00:11:03.660 or a reference to the judicial conference
00:11:07.080 for consideration of any sort
00:11:09.620 of impeachment-related recommendations
00:11:11.580 if the committee finds
00:11:13.180 that it was a willful misconduct.
00:11:15.860 I highly doubt that it is going
00:11:17.620 to get to that point.
00:11:19.500 I don't think that Judge Boasberg
00:11:21.340 was purposely trying to express bias.
00:11:26.420 I think that it was actually him
