00:01:14.300 Let's be honest.
00:01:15.680 America can still be a dangerous place.
00:01:17.920 And you cannot afford to wait for help.
00:01:20.120 Sure, you could use a firearm, but in today's America,
00:01:23.120 defending yourself with deadly force could have legal consequences.
00:01:26.900 According to FBI data, 99.9% of all altercations do not require lethal force.
00:01:32.800 And that's exactly why so many are turning to Berna.
00:01:35.660 Berna is proudly American, hand-assembled in Fort Wayne, Indiana.
00:01:39.940 These less lethal self-defense launchers are trusted by hundreds of government agencies,
00:01:44.940 law enforcement departments, and private security companies.
00:01:47.720 Over 600,000 Berna pistols have been sold already,
00:01:51.900 most to private citizens who just refuse to be victims.
00:01:55.680 Berna launchers fire rock-hard kinetic rounds
00:01:58.860 and powerful tear gas and pepper projectiles
00:02:02.040 capable of stopping a threat from up to 60 feet away.
00:02:05.420 No background checks, no waiting periods,
00:02:08.020 and Berna can ship straight to your door. 0.97
00:02:10.720 Take responsibility.
00:02:12.480 Protect your future.

00:02:27.420 New details emerging about the victims of the Monday mass shooting
00:02:31.080 in a Manhattan commercial office building, home to the NFL,
00:02:34.760 which authorities say appears to have been the shooter's intended target.
00:02:37.960 A suicide note found on the shooter's body claiming he suffered from CTE,

00:02:48.660 of which he was not one.

00:03:06.060 shot while taking cover behind a security desk in the lobby.
00:03:09.620 Mr. Etienne's brother telling the New York Times,
00:03:11.800 quote,
00:03:12.020 He was a father, a son, and a light in our lives.
00:03:15.160 Our hearts are shattered.
00:03:16.880 Blackstone executive, 44-year-old Wesley Lepatner,
00:03:20.200 survived by her husband, whom she met on their first day,
00:03:23.920 freshman year at Yale University, and two children.
00:03:27.360 The family releasing a statement, quote,
00:03:29.340 She was the most loving wife, mother, daughter, sister, and relative

00:03:42.180 27-year-old Julia Hyman also killed
00:03:45.160 when the shooter appears to have mistakenly arrived on her floor
00:03:48.400 while in search for the NFL offices.
00:03:51.540 Hyman, a Cornell graduate, had been with Rudin for less than a year.
00:03:56.580 NYPD officer Diderul Islam,

00:04:12.080 The weapon used, an AR-15-style assault rifle,
00:04:15.600 was assembled by using a lower receiver purchased by an associate.
00:04:19.820 We have located that associate and others,
00:04:22.520 and we'll be questioning him about that purchase.
00:04:25.300 Two groups of detectives are currently en route to Las Vegas
00:04:27.780 to conduct interviews and execute a search warrant.
00:04:30.680 They'll also visit the gun store where he legally purchased a revolver on June 12th,
00:04:35.280 using a Nevada concealed carry permit.
00:04:37.460 A shooting at the Grand Sierra Resort Casino in Rideau, Nevada,
00:04:42.940 also on Monday, leaving three dead and several more injured.
00:04:46.700 Investigators yet to reveal much information about the attack,
00:04:49.740 though they say there is no reason to believe there was any connection
00:04:52.300 between the suspect and the victims.
00:04:54.640 The suspect remains in critical condition.
00:04:57.180 Reno police officers returning fire after the rampage began,
00:05:00.820 preventing the shooter from entering the casino.
00:05:02.960 Authorities releasing the identity of just one victim so far,
00:05:07.200 Andrew Kanepa, a co-owner of a cafe in Newberry Park, California.
00:05:12.140 Kanepa was attending a bachelor party.
00:05:14.140 At least three of the victims were part of that same group,
00:05:17.300 waiting at a valet stand when they were met with gunfire.
00:05:20.740 A former neighbor of Kanepa telling the Ventura County Star,
00:05:23.900 quote,
00:05:24.520 Kanepa's son was the love of his life.
00:05:27.040 Oh, it's just so awful.
00:05:28.380 On Monday evening, Attorney General Pam Bondi,
00:05:33.460 posting to X, quote,
00:05:34.800 Today, at my direction, the DOJ filed a misconduct complaint
00:05:38.300 against U.S. District Court Chief Judge James Bosberg
00:05:41.800 for making improper public comments about President Trump
00:05:44.860 and his administration.
00:05:46.460 These comments have undermined the integrity of the judiciary,
00:05:49.640 and we will not stand for that.
00:05:51.520 This filing in response to a story we reported to you here
00:05:54.780 about two weeks ago
00:05:55.920 with investigative journalist at The Federalist, Margo Cleveland.
00:05:59.420 The Federalist exclusively obtaining a memo
00:06:01.560 from the March Judicial Conference,
00:06:04.180 a biannual meeting of the lead judges
00:06:06.220 from the various circuits,
00:06:07.740 detailing a concern raised by Obama-appointed
00:06:10.820 D.C. District Chief Judge James Bosberg.
00:06:14.080 According to the memo, Judge Bosberg, quote,
00:06:16.480 raised his colleagues' concerns
00:06:18.500 that the administration would disregard rulings
00:06:21.100 of federal courts leading to a constitutional crisis.
00:06:24.340 Chief Justice Roberts addressing the concerns
00:06:26.900 by talking about his interactions with President Trump,
00:06:30.060 noting them to be civil and respectful,
00:06:32.300 expressing hope that no such crisis would materialize.
00:06:35.540 Cleveland explaining why Judge Bosberg's comments
00:06:37.900 were inappropriate.
00:06:39.340 The first reason that that's inappropriate
00:06:41.860 is because the Trump administration
00:06:44.220 is not just the administration,
00:06:46.440 separate branch of government.
00:06:48.420 Judges can criticize the executive branch,
00:06:50.920 just like the executive branch
00:06:52.580 can criticize the judiciary.
00:06:54.760 But here, the criticism
00:06:56.380 was about the president as a defendant
00:07:00.740 and that they would disregard court orders.
00:07:04.320 The second reason that that was
00:07:06.700 an inappropriate comment,
00:07:08.840 again, the comment is inappropriate
00:07:10.540 because of what it conveys,
00:07:12.800 and that was that they had
00:07:14.680 not just prejudged the president,
00:07:17.260 but that it goes against the normal presumption
00:07:20.360 that the courts are supposed to have,
00:07:22.860 which is that public officials
00:07:24.320 will properly discharge their official duties.
00:07:27.980 So my bigger concern with the comment
00:07:30.560 is not that it was made.
00:07:32.720 There's a concern there about comments
00:07:34.780 on public cases.
00:07:36.300 But my biggest concern is the sentiment
00:07:39.700 that it indicates or represents,
00:07:43.160 which is that there is this anti-Trump bias
00:07:46.520 and that the judges are not presuming
00:07:49.720 that public officials
00:07:51.200 are properly discharging the law,
00:07:53.620 but rather that Trump is not going to do
00:07:57.020 what they are told to do,
00:07:58.380 what he or his administration is told to do.
00:08:01.120 In fact, just days after that comment,
00:08:03.520 Judge Boesberg went on
00:08:04.640 to block the Trump administration
00:08:06.120 from deporting Venezuelan nationals,
00:08:08.740 alleged gang members,
00:08:10.140 to El Salvador under the Alien Enemies Act,
00:08:13.240 then scheduling contempt proceedings
00:08:15.560 against the Trump administration
00:08:17.240 for failing to halt deportation flights
00:08:19.480 already underway.
00:08:21.400 The Supreme Court ultimately vacating
00:08:23.100 Judge Boesberg's injunction order,
00:08:25.420 ruling that Alien Enemy Act cases
00:08:27.260 must be brought in the district
00:08:28.660 where the illegal immigrants are detained.
00:08:31.600 Given that the detainees were in Texas,
00:08:33.880 the high court found Judge Boesberg's court
00:08:36.000 in Washington, D.C. was the wrong venue.
00:08:39.320 Boesberg held onto the case anyway,
00:08:41.620 proceeding with his contempt hearing
00:08:43.240 and finding probable cause
00:08:44.920 that the Trump administration
00:08:46.000 removed the aliens in criminal contempt 0.95
00:08:48.700 of Judge Boesberg's orders.
00:08:50.660 That finding has been appealed to a higher court.
00:08:53.740 The misconduct complaint
00:08:54.900 just filed against Judge Boesberg by the DOJ
00:08:57.860 reads, quote,
00:08:58.900 Within days of his statements to the chief justice,
00:09:02.720 Judge Boesberg began acting on his preconceived belief
00:09:05.700 that the Trump administration
00:09:06.780 would not follow court orders.
00:09:08.300 By singling out a sitting president
00:09:10.440 who was and remains a party
00:09:11.980 to dozens of active cases,
00:09:14.060 Judge Boesberg attempted to transform
00:09:15.860 a routine housekeeping agenda
00:09:17.640 into a forum to persuade the chief justice
00:09:20.460 and other federal judges
00:09:21.740 of his preconceived belief
00:09:23.840 that the Trump administration
00:09:25.180 would violate court orders.
00:09:26.720 Cleveland walking us through
00:09:28.480 the finer points of the DOJ complaint.
00:09:30.660 They argue that Judge Boesberg's words
00:09:34.660 and deeds violated three different canons,
00:09:38.500 including canon one that says
00:09:41.380 a judge should uphold the integrity
00:09:43.600 and independence of the judiciary.
00:09:46.160 Canon two that states
00:09:48.020 that a judge should at all times
00:09:50.080 promote public confidence
00:09:51.860 in the integrity and partiality
00:09:54.080 of the judiciary.
00:09:54.860 And then canon three,
00:09:57.220 which says that a judge
00:09:58.540 should not make public comments
00:10:00.680 on the merits of a matter
00:10:02.620 pending or impending in any court.
00:10:06.300 Attorney General Pam Bondi's chief of staff,
00:10:08.680 Chad Mizell,
00:10:09.440 addressing the complaint
00:10:10.380 to the chief judge
00:10:11.340 of the United States Court of Appeals
00:10:12.960 for the District of Columbia Circuit,
00:10:15.040 Sri Srivastasen.
00:10:16.600 Cleveland here on what happens next.
00:10:18.440 The chief judge of the D.C. Circuit
00:10:21.400 will decide whether or not
00:10:23.860 to launch an investigation based on this,
00:10:27.300 and then he will make recommendations.
00:10:30.780 So in this case,
00:10:32.060 the Department of Justice is asking
00:10:33.940 that a special investigative committee
00:10:36.700 have an inquiry to determine
00:10:39.320 if the conduct was prejudicial.
00:10:42.300 And he also is asking,
00:10:44.080 or I should say the department
00:10:45.040 is also asking that in the interim,
00:10:47.260 that the court reassign
00:10:50.020 the cases to another judge.
00:10:52.860 So the cases in which Trump
00:10:54.460 is before Judge Boasberg.
00:10:56.620 And then they also request
00:10:58.560 any appropriate disciplinary action.
00:11:01.200 It could be that there's a public reprimand
00:11:03.660 or a reference to the judicial conference
00:11:07.080 for consideration of any sort
00:11:09.620 of impeachment-related recommendations
00:11:11.580 if the committee finds
00:11:13.180 that it was a willful misconduct.
00:11:15.860 I highly doubt that it is going
00:11:17.620 to get to that point.
00:11:19.500 I don't think that Judge Boasberg
00:11:21.340 was purposely trying to express bias.
00:11:26.420 I think that it was actually him
00:11:28.760 saying what he thought
00:11:30.720 and what the other judges thought.
00:11:33.020 And frankly, that's the problem,
00:11:35.140 that they had prejudged a party
00:11:38.460 in a lawsuit,
00:11:39.240 and that that is inappropriate.
00:11:43.160 But at least we know
00:11:44.700 what his state of mind was
00:11:46.740 because he actually verbalized it.
00:11:48.700 The timeline for when Chief Judge
00:11:50.640 Shrivanasen will act on the complaint
00:11:52.580 remains unclear.
00:11:55.100 Coming up,
00:11:56.160 the EPA planning to repeal
00:11:57.760 an Obama-era regulation
00:11:59.320 in a move described as,
00:12:00.900 quote,
00:12:01.180 a dagger to the heart
00:12:02.340 of the climate change religion.
00:12:04.480 And former Transportation Secretary
00:12:06.120 Pete Buttigieg
00:12:06.880 has no problem praising
00:12:08.560 New York City Democratic candidate
00:12:10.220 for mayor Zoran Mamdani,
00:12:12.300 but stops short
00:12:13.340 of an official endorsement.
00:12:19.380 It wasn't supposed
00:12:20.620 to get this bad.
00:12:21.820 You know, remember the time
00:12:22.680 when you actually were
00:12:23.360 on top of your bills?
00:12:24.740 Then inflation hit,
00:12:25.980 groceries, gas,
00:12:27.180 everything shot up,
00:12:28.020 prices up 26%
00:12:29.140 from just a few years ago.
00:12:30.740 It's not necessarily your fault
00:12:32.220 if you have fallen
00:12:32.920 into real debt.
00:12:33.780 Let me share a smarter,
00:12:35.800 faster, far easier way
00:12:37.120 out of it.
00:12:38.100 It's called Done With Debt,
00:12:39.440 and they are not like
00:12:40.140 other debt relief companies.
00:12:41.540 They don't push loans
00:12:42.420 or bankruptcy on you.
00:12:43.980 Done With Debt
00:12:44.420 has legendary negotiators
00:12:46.120 who go head-to-head
00:12:47.080 with your credit card
00:12:48.120 and loan companies.
00:12:49.360 And they have one goal,
00:12:50.720 to drastically reduce
00:12:51.840 or eliminate your debt
00:12:52.840 altogether.
00:12:53.720 They move lightning fast.
00:12:55.260 Most clients see more money
00:12:56.160 in their pocket month one.
00:12:57.500 But a word to the wise,
00:12:58.660 hurry,
00:12:59.320 because some of their
00:13:00.060 debt-erasing strategies
00:13:01.100 are time-sensitive,
00:13:01.840 so consider talking
00:13:02.980 to a Done With Debt strategist
00:13:04.320 before you make
00:13:05.860 another bill payment.

00:13:14.200 Environmental Protection Agency
00:13:15.920 Administrator Lee Zeldin
00:13:17.200 on Tuesday
00:13:17.820 announcing what he says
00:13:19.060 is the largest
00:13:19.940 deregulatory action
00:13:21.140 in the history of America.
00:13:23.440 Zeldin putting forward
00:13:24.240 a plan to rescind
00:13:25.280 an Obama-era
00:13:26.280 regulatory determination
00:13:27.660 called the
00:13:28.740 Endangerment Finding,
00:13:29.860 which says six
00:13:31.040 greenhouse gases,
00:13:32.400 including carbon dioxide,
00:13:33.820 methane,
00:13:34.240 and nitrous oxide,
00:13:35.680 are a threat
00:13:36.260 to public health
00:13:36.980 and welfare,
00:13:37.920 and therefore can be
00:13:38.920 regulated under
00:13:39.880 the Clean Air Act.
00:13:41.320 The Obama administration
00:13:42.680 and later the Biden
00:13:43.640 administration,
00:13:44.720 using that determination
00:13:45.640 to apply strict limits
00:13:47.140 on greenhouse gas emissions
00:13:48.520 from cars,
00:13:49.680 airplanes,
00:13:50.500 power plants,
00:13:51.140 and other major sources
00:13:52.320 of fossil fuel emissions,
00:13:54.340 they did it through
00:13:55.080 the EPA
00:13:55.680 as an end-around
00:13:56.860 Congress.
00:13:57.540 Zeldin Tuesday
00:13:58.940 on the Ruthless podcast
00:14:00.280 blasting the
00:14:01.320 Endangerment Finding
00:14:02.360 as junk science.
00:14:04.360 As the left would say
00:14:05.720 that it means
00:14:06.880 that carbon dioxide
00:14:07.760 is a pollutant,
00:14:08.560 carbon dioxide
00:14:09.140 is an endangerment
00:14:09.920 to human health.
00:14:12.380 They might say
00:14:12.920 methane is a pollutant,
00:14:14.140 methane is an endangerment
00:14:15.380 to human health,
00:14:16.720 and that's an
00:14:17.800 oversimplified,
00:14:18.780 I would say,
00:14:19.100 inaccurate way
00:14:19.920 to describe it.
00:14:20.900 They'll never acknowledge
00:14:22.160 any type of benefit
00:14:23.780 or need
00:14:24.560 for carbon dioxide.
00:14:25.820 Yeah, so stop breathing, right?
00:14:27.240 Yeah, like right now
00:14:27.880 as we're doing this interview,
00:14:29.740 I mean,
00:14:30.260 there's,
00:14:31.140 it's important to note,
00:14:32.640 and they don't,
00:14:33.580 how important it is
00:14:34.720 for the planet.
00:14:36.060 And they'll say,
00:14:36.480 well, let me lock you
00:14:37.720 in a tank
00:14:38.580 of just carbon dioxide.
00:14:41.360 Well, it's like,
00:14:41.800 you lock me in a tank
00:14:42.900 of just water
00:14:43.780 and see what happens.
00:14:45.380 I guess bad things
00:14:46.960 would happen
00:14:48.280 if I was just
00:14:49.080 stuck in a tank
00:14:50.020 filled with water.
00:14:50.580 They didn't actually
00:14:52.280 study carbon dioxide
00:14:53.640 individually,
00:14:54.680 and they made
00:14:55.660 assumptions on the science
00:14:57.060 that actually turned out
00:14:57.900 not to be true.
00:14:58.780 And they didn't go out
00:15:00.180 for public comment,
00:15:01.160 and they didn't weigh
00:15:02.120 the economic impacts
00:15:03.420 of the regulations
00:15:04.600 that would follow
00:15:05.720 if they did
00:15:06.300 the endangerment.
00:15:07.480 The proposal now
00:15:08.340 entering a 45-day period
00:15:10.000 allowing for public comments.
00:15:12.020 Zeldin expressing confidence
00:15:13.260 in the process
00:15:14.160 to the fellas.
00:15:15.540 We're going to go out
00:15:16.080 to public comment.
00:15:16.920 We're not afraid
00:15:17.720 of allowing the public
00:15:18.960 to weigh in.
00:15:20.520 We are going to consider
00:15:21.940 all the advancements
00:15:23.180 in technology
00:15:23.920 over the course
00:15:24.500 of the last 20 years.
00:15:25.600 We shouldn't shy away
00:15:26.960 from all of the innovation
00:15:28.700 in the way that we tap
00:15:30.500 into an energy supply
00:15:31.600 here in the United States
00:15:32.600 better than so many
00:15:33.780 other countries
00:15:34.260 around the world.
00:15:34.980 We aren't going to ignore
00:15:35.980 the fact that emissions
00:15:37.000 are down in this country
00:15:38.280 over the course
00:15:39.280 of the last 20 years.
00:15:41.080 Legacy media reacting
00:15:42.200 in a predictably
00:15:42.980 negative fashion.
00:15:44.140 The New York Times
00:15:44.660 reporting, quote,
00:15:45.380 the proposal would be
00:15:46.260 President Trump's
00:15:46.940 most significant step yet
00:15:48.140 to derail federal
00:15:49.140 climate efforts.
00:15:50.420 It marks a notable shift
00:15:51.480 in the administration's
00:15:52.420 position from one
00:15:53.540 that had downplayed
00:15:54.640 the threat of global warming
00:15:55.660 to one that essentially
00:15:57.040 flatly denies
00:15:58.000 the overwhelming
00:15:58.840 scientific evidence
00:16:00.120 of climate change.
00:16:01.760 The final rule likely
00:16:02.680 to face legal challenges
00:16:03.900 from environmental groups,
00:16:05.480 many of which have pocketed
00:16:06.700 millions of U.S. taxpayer dollars
00:16:08.360 since the endangerment finding
00:16:10.220 under the banner
00:16:11.220 of fighting climate change.
00:16:14.700 Far-left socialist
00:16:16.080 Democrat nominee
00:16:16.980 for New York City Mayor
00:16:18.120 Zoran Mamdani
00:16:19.160 struggling to pick up
00:16:20.400 endorsements from his
00:16:21.360 fellow Democrats,
00:16:22.740 including far-left
00:16:23.560 progressive former
00:16:24.420 Transportation Secretary
00:16:25.640 Pete Buttigieg.
00:16:27.100 Monday on the NPR
00:16:28.300 Morning Edition podcast,
00:16:30.300 Buttigieg lavishing praise
00:16:31.860 on the candidate,
00:16:32.900 but then going a little clammy
00:16:34.700 when asked about
00:16:35.620 an endorsement.
00:16:36.980 I want to remind people
00:16:37.720 that we're talking
00:16:38.200 in New York City
00:16:38.840 where the Democratic
00:16:39.740 candidate for mayor,
00:16:40.580 the nominee for mayor
00:16:41.240 is Zoran Mamdani.
00:16:42.300 What do you make of him?
00:16:42.980 I think that what he achieved
00:16:44.600 is extraordinary.
00:16:45.680 No matter what the context,
00:16:47.500 the topic,
00:16:48.040 the news of the day,
00:16:49.300 he went straight to
00:16:51.040 the thing that was
00:16:52.700 on New Yorkers' minds,
00:16:54.040 which is how hard it is
00:16:55.920 to afford anything,
00:16:56.920 rent, groceries,
00:16:57.620 you name it.
00:16:58.240 I think that he also,
00:16:59.520 just as a matter of
00:17:00.140 campaign strategy,
00:17:01.420 was omnipresent.
00:17:03.220 He was everywhere.
00:17:04.020 He was going on podcasts.
00:17:05.020 He was doing social media.
00:17:06.600 And so I think
00:17:07.380 a lot of more conventional
00:17:09.280 political operatives
00:17:10.760 didn't see him coming.
00:17:12.000 Would you endorse him?
00:17:13.280 Say, Big Ten approach.
00:17:14.320 I don't agree with him
00:17:14.960 about everything,
00:17:15.640 but I endorse him.
00:17:16.640 He hasn't asked me
00:17:17.320 to endorse.
00:17:17.800 I'm not really a player
00:17:18.460 in New York City
00:17:19.840 municipal politics,
00:17:20.820 but I would talk to him
00:17:22.600 about it, sure.
00:17:23.380 You would talk to him
00:17:24.300 about it,
00:17:24.960 meaning you're not sure
00:17:25.680 that you would or wouldn't?
00:17:27.420 Yeah, I would want,
00:17:28.420 to be honest,
00:17:28.820 as somebody who follows
00:17:29.840 this from afar
00:17:30.400 but hasn't exactly
00:17:31.120 dug in on it,
00:17:32.020 I haven't kind of dug in
00:17:34.160 on these policy proposals
00:17:35.760 he's put forward
00:17:36.460 and how they would
00:17:37.060 actually work.
00:17:37.640 I'd want to kind of
00:17:38.120 talk through that.
00:17:38.760 I think the most important
00:17:39.520 job, though,
00:17:40.040 of any mayor,
00:17:40.900 and by the way,
00:17:42.000 I also emerged
00:17:42.920 as a very young,
00:17:44.540 some would have said
00:17:45.420 untested,
00:17:46.500 disruptive figure
00:17:47.440 running for mayor,
00:17:48.380 right?
00:17:49.040 The most important job
00:17:50.340 of any mayor
00:17:50.800 is to pull
00:17:52.280 a community together.
00:17:53.800 You are the walking symbol
00:17:55.560 of what all of the
00:17:57.380 diverse,
00:17:58.140 disparate people
00:17:58.740 in your city
00:17:59.240 have in common.
00:18:00.540 And if I get a chance
00:18:02.140 to talk with him,
00:18:02.960 I'll want to talk with him
00:18:03.900 about how he aims
00:18:05.540 to do that.
00:18:06.680 Awkward.
00:18:07.820 House Minority Leader
00:18:08.660 Hakeem Jeffries
00:18:09.640 representing Brooklyn,
00:18:10.540 Congressman Richie Torres
00:18:11.900 representing the Bronx,
00:18:13.040 Congressman Dan Goldman
00:18:14.040 representing Lower Manhattan
00:18:15.580 and part of Brooklyn,
00:18:16.800 Senator Chuck Schumer,
00:18:17.760 Senator Kirsten Gillibrand,
00:18:19.160 among several others,
00:18:21.040 all yet to endorse
00:18:22.420 Momdani.
00:18:23.580 The elections in November,
00:18:24.800 where former Democrats
00:18:25.740 Eric Adams
00:18:26.460 and Andrew Cuomo
00:18:27.380 are also running
00:18:28.540 as independents.
00:18:30.280 And that'll do it
00:18:32.720 for your AM Update.
