00:01:17.520 the world fighting for a seat in one room they have seen on TV for weeks. All of them are here

00:01:24.460 to watch in person the trial of a mother accused of killing her two-year-old daughter.

00:01:37.580 25 floors up is the courtroom of Judge Belvin Perry Jr. He grew up in Orlando,

00:01:43.380 where his father had been one of the city's first black police officers.

00:01:48.160 The jury in the Casey Anthony case has been out deliberating since yesterday afternoon,

00:01:52.520 in all between 10 and 11 hours of deliberation so far.

00:08:13.700 Anthony begins, a pseudo-trial kicks off. CBS News hires Richard Gabriel, a trial consultant

00:08:20.740 working for Anthony's defense team, to see how the evidence might play in the courtroom.

00:08:26.920 Gabriel assembles a mock jury of 12 Orlando adults and presents the evidence from both sides for

00:08:33.380 four and a half hours. Then he asks them to vote, guilty or not guilty. On first-degree murder,

00:08:40.020 nine mock jurors stand up. They would acquit. They all say they believe Kaylee died accidentally

00:08:47.580 but cannot agree on how. Gabriel offers a different charge. Who would convict her on

00:08:54.580 involuntary manslaughter? Nearly the entire mock jury stands. Judge Perry has observed Casey Anthony

00:09:02.660 from the bench for six weeks. He later tells NBC that whenever the jury left the courtroom,

00:10:07.760 On July 6, 2011, the day after the verdict is read, juror number three speaks to ABC.

00:10:15.000 Her name is Jennifer Ford, and she is a 32-year-old nursing student.

00:10:19.720 She is the first juror to speak to the press after the trial.

00:10:23.400 ABC's Terry Moran presses her on how Casey behaved during the 31 days her daughter was missing.

00:10:30.840 Here is Ford's response. It looks very bad. The behavior is very bad,

00:10:35.160 but bad behavior is not enough to prove a crime. Well, if you consider the whole family,

00:10:43.080 they didn't really live in reality. They wanted everything to be happy and everyone to be fine.

00:10:47.320 Even when she in the jail video, she came up smiling and she looked happy. She's in jail.

00:10:52.920 Do you think that's how she really feels? I'm guessing not.

00:10:55.880 As to the cause of death, Ford does not believe that Kaylee drowned in the family pool,

00:12:33.300 investigate it further to see if it fit based on the evidence that we were given. So what convinced

00:12:54.340 exactly how she died if you put even just the 12 jurors in one room with a piece of paper

00:12:59.060 write down how kaylee died nobody knows we'd all be guessing how can you punish someone for

00:13:03.540 something if you don't know what they did in the abc interview moran pushes back on ford saying

00:13:09.460 the tape on Kaylee's body wrapped in a plastic bag hidden in the woods would suggest murder to most

00:13:16.100 people. Here's how Ford responds. In our country, unfortunately, we have to prove it. You can't just

00:13:21.540 be like, yeah, that really looks bad. Smells bad, looks bad. I get that. It does. Smells bad,

00:13:25.780 looks bad. I get that. But it's someone else's life. And if I'm wrong and I kill someone else,

00:13:31.300 I can't live with that. Judge Perry would later say that a few more minutes

00:13:36.820 of instruction to the jury could have changed this verdict entirely but that it was not his place

00:13:43.700 to volunteer it listen to how he explains it to court tv in 2020 the judge's job is to give the

00:13:50.580 standard jury instruction is the prosecution or the defense to request a special instruction

00:13:58.980 Would a special jury instruction indicating that proving how she died was not an element

00:14:08.000 of the crime to be proven, I think that may have made a tremendous difference.

00:14:20.960 Prosecutor Jeff Ashton will later say he felt the state did show the jury how Kaylee died

00:14:54.440 Do you think if the prosecutors were not seeking the death penalty, it might have affected how you deliberated about this case?

00:15:08.640 If they charged her with other things, we probably could have convicted or got a guilty sentence, but not for death, not for first degree.

00:15:15.640 There's not enough to substantiate that. That's a very serious charge.

00:15:19.680 Prosecutor Jeff Ashton disputes the overcharge idea in his book, Imperfect Justice, written

00:15:31.600 still convicted her on either second-degree murder or on manslaughter.

00:17:09.260 to protesters gathered outside of their home. People shouted at the parents, held signs calling

00:17:15.600 Casey a baby killer. At least one woman went through the Anthony's trash looking for some

00:17:20.900 way to help investigators. TV news covered the story of missing and then dead Kaylee Anthony

00:17:28.560 almost every night. Nancy Grace rocketed to national stardom through her coverage of the 1.00

00:17:34.740 case. She eventually threatened Bill O'Reilly for the number one evening spot. A month after the

00:17:41.200 verdict, one of the men on that jury speaks anonymously to People magazine about the moment

00:17:46.920 they took their final vote, when the decision stopped being something they were debating

00:17:51.880 and became the verdict. He says, quote, and then we sat there for a few minutes

00:17:57.840 and were like, holy crap, we are letting her go free. Everyone was just stunned at what we

00:18:04.980 were about to do. One of the women jurors asked me, are you okay with this? And I said,

00:18:10.900 hell no. But what else can we do? We promised to follow the law.

00:18:16.880 Ten years later, People Magazine goes back to this juror, and he is still wrestling with his decision.

00:18:24.320 He says, quote, I think of the case at least once every single day.

00:18:29.400 Every time I see her face or hear her name, I get a pit in my stomach.

00:18:33.740 I think about those pictures of the baby's remains that they showed us in court.

00:18:37.840 I even remember the smell of the courtroom.

00:18:40.780 My decision haunts me to this day.

00:18:42.500 I think now if I were to do it all over again, I'd push harder to convict her of one of the lesser

00:18:48.900 charges like aggravated manslaughter, at least that, or child abuse. I didn't know what the

00:18:55.560 hell I was doing, and I didn't stand up for what I believed in at the time. He says the jurors

00:19:02.240 stayed in touch for a while. They had a group text. He says eventually even seeing one of their names

00:19:08.180 light up on his phone made him feel sick, so he muted it. Two days after the verdict is read,

00:19:15.580 Casey Anthony is back in Judge Perry's courtroom, this time getting sentenced for the four

00:19:20.840 misdemeanor convictions. Judge Perry gives her one year in jail and a $1,000 fine on each count

00:19:27.620 with credit for the three years she has already spent behind bars. He asks if Casey wants to say

00:19:34.480 anything. Jose Baez answers for her. No, your honor. Casey says nothing at all in that courtroom.

00:19:43.120 10 days later, just after midnight on July 17th, 2011, she walks out of the Orange County jail,

00:19:50.340 a free woman. The case keeps moving without her. The next spring, Florida passes Kaylee's law,

00:19:59.180 making it a felony in certain circumstances to wait to report a missing child.

00:20:04.240 Several other states follow with laws of their own.

00:20:07.420 In January 2013, an appeals court cuts Casey's four convictions down to two.

00:20:13.540 The court says the four lies she told came during two police interviews

00:20:17.440 and that prosecutors cannot turn every false statement inside those interviews into separate crimes.

00:22:24.040 State investigators found it after the verdict had been handed down. The defense had found it

00:22:29.640 much earlier. It comes from the Anthony's home computer. What emerges after the verdict

00:22:35.940 is just how serious a miss this was for the prosecution in July 2012 Jose Baez reveals

00:22:43.980 the find in his book explaining the defense was waiting for the prosecution to drop this bombshell

00:22:50.340 it never did it never found the search on June 16 2008 the last day Kaylee was seen alive someone

00:22:59.820 using the family computer opened the internet browser Firefox. That was the browser Casey

00:23:05.920 Anthony primarily used. At about 2.51 that afternoon, someone typed a query into the search

00:23:12.540 bar. Full proof suffocation. Suffocation was misspelled. The next page opened was about suicide.

00:23:21.380 It discussed methods that included poison and putting a plastic bag over one's head.

00:23:27.100 Then, a minute later, the same browser session records activity on MySpace.

00:23:32.740 Casey used MySpace. George did not.

00:23:36.540 The Orange County Sheriff's Office later admits its computer examiner had missed the Firefox browser history.

00:23:43.400 The original investigators had pulled just 17 entries from Internet Explorer.

00:23:50.720 More than 1,200 Firefox entries from that same day were left behind.

00:25:09.160 George Anthony's cell phone calls the landline inside the Anthony house.

00:25:14.300 That does not tell us exactly where George was standing.

00:25:20.320 But now there is something besides George's memory of when he left.

00:25:23.880 A phone record showing his cell phone calling home 11 minutes after the suffocation search.

00:25:30.920 Casey's own phone, meanwhile, remains in the vicinity of the home until later that afternoon.

00:25:36.260 And the Firefox browser activity immediately after the search goes to MySpace, a site associated with Casey.

00:25:45.660 None of that proves who typed the words, but it doesn't take much to get there.

00:25:51.080 And it is evidence the jury never received.
