00:02:45.320 who caucuses with the Democrats, sided with the GOP to advance a deal which will begin the
00:02:51.220 process of reopening the government, without extending the Obamacare tax credits set to
00:02:56.480 expire at the end of the year.
00:02:58.560 Democrats holding out since the government shutdown began on October 1st, demanding Republicans
00:03:03.860 include the Obamacare tax credit extension if they want to reopen the government.
00:03:09.680 Republicans standing firm in their refusal to relitigate Obamacare as a condition of extending
00:03:15.280 the current government spending levels.
00:03:17.860 Late Sunday, the eight defectors caved, agreeing to advance the House-passed continuing resolution,
00:03:24.060 which keeps spending where it's been, as the first step to reopening the government.
00:03:29.040 The GOP agreeing to hold a vote on the Obamacare subsidies next month.
00:03:33.380 Late Monday evening, the Senate voting to pass a series of spending bills fully funding certain
00:03:38.900 key departments through the end of the fiscal year, September 30th, and funding the rest of
00:03:43.900 the government until January 30th, sending the legislation back to the House for approval,
00:03:49.020 which could happen later this week.
00:03:51.020 Senator King explaining his decision to vote with Republicans Monday on Morning Joe.
00:03:56.100 Joe, you have to go back to what the strategy was at the beginning of the shutdown.
00:03:59.100 There were two goals, both of which I support.
00:04:01.580 One was standing up to Donald Trump.
00:04:03.480 The other was getting some resolution on the ACA premium tax credit issue.
00:04:08.880 The problem was the shutdown wasn't accomplishing either goals, and there was practically, well,
00:04:13.680 there was zero likelihood that it was going to.
00:04:16.180 In terms of standing up to Donald Trump, the shutdown actually gave him more power,
00:04:20.660 exhibit A being what he's done with SNAP and SNAP benefits across the country.
00:04:26.160 Oh, by the way, Joe, you're going to love this.
00:04:27.660 Guess who's getting paid during the shutdown?
00:04:30.680 Not the park rangers or air traffic controllers, the ICE agents.
00:04:37.480 U.S. Senator from New Hampshire, Gene Shaheen, a Democrat, another defector, saying, quote,
00:04:43.120 keeping the government shutdown for another week or another month does not indicate that
00:04:47.680 there would be any change in the outcome.
00:04:49.880 U.S. Senator from Vermont, Bernie Sanders, an independent caucusing with Democrats,
00:04:54.180 raging against the deal Monday night in a social media video.
00:04:57.800 Eight Democrats voted with the Republicans to allow them to go forward on this continuing
00:05:03.740 resolution.
00:05:05.160 And to my mind, this was a very, very bad vote.
00:05:10.180 Just on Tuesday, we had an election all over this country.
00:05:14.740 And what the election showed is that the American people want us to stand up to Trumpism, to his
00:05:20.640 war against working class people, to his authoritarianism.
00:05:24.400 That is what the American people wanted.
00:05:26.600 But tonight, that is not what happened.
00:05:30.200 So we've got to go forward, do the best that we can to try to protect working class people.
00:05:34.700 Senate Minority Leader Chuck Schumer, who was not one of the eight Dems to join Republicans,
00:05:39.880 but is being blamed as a feckless leader, also facing significant backlash from Democrats and
00:05:46.120 members of the media.
00:05:47.760 Senate candidate Graham Plattner of Maine posting to X, quote, Chuck Schumer should step down.
00:05:53.680 Democrat Governor J.B. Pritzker of Illinois also slamming the deal.
00:05:57.720 Gavin Newsom calling it pathetic, writing on X, quote, this isn't a deal.
00:06:02.200 It's a surrender. This is the second time this year, Minority Leader Schumer has taken
00:06:06.920 extraordinary flack from his own party in relation to government funding.
00:06:11.760 The Minority Leader caving earlier this year to advance an earlier continuing resolution,
00:06:16.880 which ultimately brought us to the current battle.
00:06:19.720 This time, Senator Schumer, not one of the crossover votes, but not stopping the cave either.
00:06:25.120 For months and months, Democrats have been fighting to get the Senate to address the
00:06:30.520 health care crisis. This bill does nothing to ensure that that crisis is addressed.
00:06:36.580 I am voting no, and I will keep fighting.
00:06:39.580 As mentioned, the House will ultimately have to approve any legislation passed by the Senate
00:06:44.340 before it can be sent to the president's desk. Mr. Trump's signaling on Monday he stands ready
00:06:49.720 to sign the deal. Many Democrat members of the House, none too pleased with the Senate plans.
00:06:54.680 U.S. Congressman from California, Ro Khanna, slamming the deal, accusing Schumer of being
00:07:00.160 ineffective and calling for his ouster as Senate leader Monday on the Takeout podcast.
00:07:06.040 It's time for him to be replaced. He is not meeting the moment. He's out of touch with where
00:07:11.260 the party's base is. House Minority Leader Hakeem Jeffries asked about the discontent
00:07:16.660 among House Dems. Some Democrats in your own caucus are suggesting Schumer is an effective
00:07:22.380 Senate Democratic leader and should be replaced. You, of course, are the people of this deal.
00:07:27.400 Do you view him as effective and should he keep the job? Yes and yes.
00:07:32.100 Senator Schumer is up for re-election in 2028.
00:07:36.800 Early yesterday morning, U.S. pardon attorney Ed Martin posting on X a signed order from President
00:07:43.000 Trump containing, quote, full, complete and unconditional pardons for 77 individuals tied
00:07:49.940 to their roles in Mr. Trump's alternate slate of electors strategy in the 2020 election.
00:07:56.360 After an election, every state appoints electors to cast its electoral college votes as determined
00:08:01.880 by the state's election results. When Mr. Trump challenged his loss in 2020, his allies in the swing
00:08:08.220 states created their own list of electors ready to cast their votes for him if his litigation
00:08:14.560 challenges to the vote were successful. Names on the list including attorney Rudy Giuliani,
00:08:20.420 attorney Sidney Powell, former Trump chief of staff Mark Meadows, DOJ attorney Kenneth Chesborough,
00:08:26.720 and even attorney Jenna Ellis, who was criticized by Team Trump for flipping and ultimately aiding
00:08:32.620 prosecutors in Arizona. The alternate electors, called fake electors or false electors by critics
00:08:38.660 of President Trump's 2020 election challenges, working in several battleground states, submitting
00:08:44.500 alternate election certificates claiming Mr. Trump had won those states, hoping their votes might be
00:08:50.200 counted during the January 6th vote certification, depending on how his challenges played out.
00:08:56.220 Team Trump describing these as contingent electors meant to preserve his legal rights amid ongoing
00:09:02.280 legal challenges to the election results. Importantly, Sunday's pardons are largely symbolic,
00:09:08.480 given the alternate electors did not face federal charges under special counsel Jack Smith's
00:09:13.300 election interference investigation. President Trump only has the power to issue pardons for
00:09:18.940 federal crimes. Some of the newly pardoned people still facing charges at the state level.
00:09:25.140 CNN legal analyst Ellie Honig breaking down the state of those cases and what this pardon means
00:09:30.540 going into the future. Several of these people are currently being prosecuted at the state level
00:09:36.020 relating to the fake electors scheme in Wisconsin, Michigan, Nevada, Georgia, and Arizona. So the
00:09:43.240 pardons have no impact on those state prosecutions. Now it's worth noting, those state prosecutions are
00:09:48.900 largely in the process of collapsing or have collapsed in their own right, but the pardon has no impact.
00:09:54.160 Also, pardon has no impact on any civil lawsuit. So for example, Rudy Giuliani has been found liable
00:10:00.360 for millions of dollars in defamation for statements that he made against Georgia election workers.
00:10:05.460 That verdict, that liability is completely unimpacted, no impact by this pardon. The only thing it could
00:10:12.720 impact is federal criminal cases. None of these people have been charged federally with any crimes.
00:10:18.760 It's, I think, very unlikely they would have been charged during the rest of Pam Bondi's term as attorney
00:10:23.640 general. And even if they were to be charged by a hypothetical next DOJ, that would be in 2029,
00:10:29.780 way beyond the statute of limitations. So in that respect, Sarah, I think they're largely symbolic.
00:10:34.740 Critics slamming President Trump for the move, naturally. Here, a sampling from CNN, MS Now, and CBS.
00:10:42.640 He pardons cronies. He pardons people who support him, who say nice things about him. And he pardoned
00:10:49.780 people in this case and in the case of January 6th, people who are attempting to erode the foundations
00:10:55.660 of our democracy. This is something that fits in with a long-held goal of the president and of Ed
00:11:01.700 Martin, his pardon attorney, which is that they have essentially said, quote, no MAGA left behind.
00:11:07.200 This statement of pardons comes as the president has resumed claiming the 2020 election was rigged.
00:11:13.000 This type of move amplifies those baseless claims once again, nearly five years later.
00:11:18.780 The pardon memo framing it quite differently, quote,
00:11:21.860 This proclamation ends a grave national injustice perpetrated upon the American people following
00:11:26.760 the 2020 presidential election and continues the process of national reconciliation.
00:11:32.680 The president did not pardon himself, saving the constitutional debate over whether he has that power
00:11:38.540 for another day. Coming up, President Trump threatening the BBC with a $1 billion defamation lawsuit over a
00:11:47.460 documentary featuring a drastically edited version of his January 6th speech and two more professional
00:11:54.920 athletes wrapped up in an alleged gambling scheme. A full report.
00:12:03.840 As President Trump is settling into his new administration, one of the top Democrats in Congress
00:12:08.400 aiming to undermine the Trump agenda is Democrat Senator Dick Durbin of Illinois. And according to our
00:12:14.500 sponsor, the Electronic Payments Coalition, Senator Durbin has a new plan, a government takeover of your
00:12:20.940 credit card. Today, Americans have thousands of choices in credit cards, but they say Senator Durbin's
00:12:26.640 plan will result in less competition and less security, which means more risk for your credit and your
00:12:32.540 identity. You can learn more for yourself at guardyourcard.com. And you could consider
00:12:38.300 telling your senators to stop Dick Durbin's government takeover of your credit card before it's too late.
00:12:46.400 President Trump taking on the British Broadcasting Corporation, or BBC, the latest in Mr. Trump's
00:12:52.180 crusade against media bias. Mr. Trump on Monday demanding a full retraction apology and payment
00:12:58.280 to compensate for harm caused by a BBC documentary in which the president's January 6th remarks were edited
00:13:06.400 in a grossly misleading way, according to a letter obtained by the New York Times. The president setting
00:13:12.460 a Friday deadline or threatening a $1 billion defamation lawsuit, which would be filed in Florida,
00:13:18.980 according to the BBC. The firestorm kicking off last week when The Telegraph reported on an internal
00:13:24.740 whistleblower memo from a former advisor to the BBC's Standards Committee, Michael Prescott,
00:13:30.580 addressed to members of the BBC board. Prescott blasting the network over a range of issues,
00:13:36.580 including its documentary titled Trump, A Second Chance, the doc originally airing the week before
00:13:43.320 the 2024 election. Prescott writing, quote, I watched the program and found it to be neither balanced
00:13:49.560 nor impartial. It seemed to be taking a distinctly anti-Trump stance. Chief among the complaints,
00:13:56.120 a clip of the president's remarks at the Capitol on January 6th, 2021. The version aired by the BBC here.
00:14:05.300 We're going to walk down to the Capitol and I'll be there with you. And we fight. We fight like hell.
00:14:13.540 And if you don't fight like hell, you're not going to have a country anymore.
00:14:17.280 And here is the original version of Mr. Trump's remarks that day.
00:14:21.480 We're going to walk down to the Capitol and we're going to cheer on our brave senators and congressmen
00:14:30.320 and women. And we're probably not going to be cheering so much for some of them because you'll
00:14:36.800 never take back our country with weakness. You have to show strength and you have to be strong.
00:14:42.800 We have come to demand that Congress do the right thing and only count the electors who have been
00:14:50.700 lawfully slated, lawfully slated. I know that everyone here will soon be marching over to the
00:14:57.740 Capitol building to peacefully and patriotically make your voices heard.
00:15:03.280 So they took, quote, we're going to walk down to the Capitol, quote, and I'll be there with you, quote,
00:15:11.680 and butted it to words about, quote, fighting like hell or you won't have a country anymore.
00:15:17.160 Words which actually came 54 minutes later in his speech. This is clearly unethical.
00:15:24.280 They also omitted entirely Mr. Trump's words, urging people to march, quote, peacefully and
00:15:31.000 patriotically to make your voices heard. Prescott writing, quote, this created the impression that
00:15:37.120 Trump said something he did not and in doing so materially misled viewers. On Sunday, the head of
00:15:43.960 the BBC, Tim Davey, and the head of news, Deborah Turness, resigning in the wake of the controversy.
00:15:49.980 The BBC is publicly funded, holding a special status in the UK. The New York Times reporting,
00:15:56.320 quote, it is funded primarily from an annual license fee paid by households that watch TV,
00:16:01.600 supplemented by commercial revenue, and it has a mandate to, quote, act in the public interest,
00:16:07.200 providing impartial, high quality content that informs, educates and entertains. BBC chair Samir
00:16:14.980 Shaw, writing a letter Monday to the governing body overseeing the BBC, largely defending against
00:16:20.900 the accusations of bias, but writing, quote, I want to make clear that we have taken Mr. Prescott's
00:16:25.840 concerns seriously and considered the points he made carefully, going on to say, quote, we accept that
00:16:31.660 the way the speech was edited did give the impression of a direct call for violent action. The BBC would
00:16:38.460 like to apologize for that error of judgment. As far as a response to President Trump, the BBC is,
00:16:44.760 quote, considering how to respond. Donald Trump Jr. posting to social media on the day the story
00:16:50.680 originally broke, quote, the fake news reporters in the UK are just as dishonest and full of shit as
00:16:57.800 the ones here in America. Well said. What is going on in the world of professional sports? Two Major League
00:17:06.060 Baseball pitchers indicted by federal prosecutors out of the Eastern District of New York in Brooklyn,
00:17:11.380 accused of rigging pitches in an illegal gambling scheme. 26-year-old Luis Ortiz and 27-year-old
00:17:18.680 Emmanuel Classé, both members of the Cleveland Guardians hailing from the Dominican Republic,
00:17:24.580 now facing charges including wire fraud conspiracy, honest services wire fraud conspiracy,
00:17:30.580 meaning using wire communications to betray public trust in the faithful applications of one's duties,
00:17:35.800 conspiracy to influence sporting contests by bribery, and money laundering conspiracy. Authorities
00:17:42.980 arresting Ortiz Sunday in Boston. Ortiz making a court appearance yesterday, the judge setting his bond
00:17:48.240 at $500,000. Ortiz will be arraigned at a later date, according to prosecutors. Class A is not yet in U.S.
00:17:55.600 custody. According to the indictment, quote, the defendants conspired with bettors to rig pitches in
00:18:01.860 professional baseball games so that the bettors would profit from illegal wagers made based on that
00:18:07.600 inside information. Prosecutors say the men agreed in advance to throw specific types of pitches,
00:18:14.540 for example, tossing a ball instead of a strike, in what are known as prop bets or specific bets placed
00:18:21.120 on a player's performance. In return, the pitchers allegedly receiving kickback payments and bribes.
00:18:26.700 The indictment alleging the unidentified bettors won at least $450,000 from betting platforms
00:18:33.140 on more than 100 pitches thrown by Class A and Ortiz. NPR reporting, quote, Class A, the Guardian's
00:18:40.160 former closer, and Ortiz, a starter, have been on non-disciplinary paid leave since July when
00:18:46.240 MLB started investigating what it said was unusually high in-game betting activity when they pitched.
00:18:52.820 Major League Baseball releasing a statement to ESPN, quote, MLB contacted federal law enforcement
00:18:59.360 at the outset of its investigation and has fully cooperated through the process. We are aware of
00:19:05.220 the indictment and today's arrest, and our investigation is ongoing. If convicted on all
00:19:10.660 charges, each player facing a maximum of over 65 years in prison. Ortiz's lawyer releasing a statement
00:19:17.660 asserting that his client is innocent and, quote, would never improperly influence a game. Class A's
00:19:24.240 lawyer releasing a statement claiming, Emmanuel Class A has devoted his life to baseball and doing
00:19:29.440 everything in his power to help his team win. Emmanuel is innocent of all charges and looks forward to
00:19:35.280 clearing his name in court. Noticeably absent from the attorney's statement for Class A are the words,
00:19:41.660 he did not throw pitches in exchange for kickbacks. And that'll do it for your AM update. I'm Megan
