00:10:59.160 does not bark at him. That dog, he says, barks at him every single day from wherever the dog is
00:11:04.700 in the house. But this day, nothing. Graybill does not see Mackenzie anywhere. It strikes him
00:11:12.000 as strange. If Lacey is walking Mackenzie off property past 1035 a.m., then she is alive after
00:11:20.880 Scott leaves the house for the marina. But Karen Service says the mailman is wrong. She says she
00:11:29.020 personally put the dog back in the Peterson's yard at 10.18, closing the gate behind her.
00:11:36.420 The jury never hears about the allegedly open gate or the dog that did not bark. What the mailman
00:11:44.200 Graybill tells police is written down by hand and then it gets lost in the mass of paperwork.

00:12:24.560 screaming that she has been robbed. Susan Medina and her husband have just driven back from Los
00:12:31.600 Angeles. They find their French doors have been kicked in. The safe from their master bedroom is
00:12:37.200 gone, and the dolly from their tool shop out back is sitting on the front porch. The police officer
00:12:43.820 assigned to the Medina burglary writes a supplemental report explaining why he did not go
00:12:49.220 door-to-door investigating the burglary. Due to the priority given to 523 Covina, he writes,
00:12:56.500 I did not contact neighbors in regards to this incident. On January 2nd, police arrest Stephen
00:13:03.480 Todd and Donald Pierce for the Medina burglary. The men live at the same address in Modesto's
00:13:10.040 airport district, the low-income neighborhood that borders the Petersons. An officer sits
00:13:15.820 Stephen down to talk about the burglary. Before he can even start, Stephen says he had nothing
00:13:21.620 to do with, quote, the woman. The officer asks him what woman he's talking about. The missing
00:13:28.020 woman with the baby, says Stephen. The officer's report shows what happens next. He asks Stephen
00:13:34.840 again to tell him about the burglary. There is no record of him asking about the missing woman

00:15:50.860 The burglar, Stephen, tells police he went over the fence at 3 a.m. the morning of December 27th.
00:15:57.620 That's clearly incorrect since the Medinas came home and found they'd been burglarized on December 26th.
00:16:04.020 Co-burglar Donald's account put Stephen there on December 26th, saying Stephen came to him for help moving the safe.
00:16:12.120 And when I interviewed Detective John Buehler in 2021, he gave me still another version of the department's timeline.
00:16:18.900 So he broke into the house on the 25th and he took a bit of property on the 25th.
00:16:23.800 But there was a safe and some tools and other things that he couldn't take on his bike.
00:16:27.380 So he returns home and he's living in a shed behind his friend Don, who's living with his mother.
00:16:33.980 And he tells Don, hey, there's a safe over there. We need to go back over and get that.

00:16:39.420 And the reason we know that they were there on the 26th is they said they saw the media down the street when they were in the house.
00:16:44.900 And it was a big hoopla and they couldn't figure out what it was because they didn't know.
00:16:48.780 The Modesto Police Department settles on December 26th as the date of the burglary and announces it has nothing to do with Lacey Peterson's disappearance.

00:17:46.060 25 years to life. He got eight years. Donald got 180 days. Both men pleaded guilty to breaking

00:18:02.180 crime. That is three days after Lacey Peterson disappeared, and it is a version of events that
00:18:09.160 puts them nowhere near Covina Avenue on Christmas Eve. Two weeks or so after Lacey Peterson
00:18:15.540 disappears, a lieutenant with the California Department of Corrections named Xavier Aponte
00:18:21.960 hears about an inmate at his prison who has allegedly been talking about Lacey. The inmate
00:18:28.980 is Sean Tenbrick. His brother Adam Tenbrick knows burglar Stephen Todd. Lieutenant Aponte
00:18:37.300 calls the Modesto police tip line twice.
00:18:41.180 He says it takes at least a week
00:18:42.560 before a detective calls him back.

00:19:20.700 shut because, quote, you don't know who you're dealing with. Lieutenant Aponte says he taped
00:19:26.680 that call, but he was never called as a witness. And when investigators went looking for that tape
00:19:32.780 years later, it did not materialize. ABC reported this summer that Lieutenant Aponte walked back his
00:19:41.060 story entirely, saying he doesn't really know what he heard. Modesto police and the prosecution
00:19:47.340 dispute all of this account. They say there are no reports showing anyone from the department
00:19:53.200 was ever in contact with Lieutenant Aponte. In May of 2003, more than a year before the Scott
00:20:00.660 Peterson trial. The videotaped police interviews with burglars Stephen and Donald are marked for
00:20:06.980 destruction. Prosecutors say the burglary was solved. Both men had confessed and the evidence
00:20:12.880 was destroyed as part of routine procedure. Scott Peterson's defense says that in a capital case,
00:20:20.020 evidence potentially connected to an alternate theory should have been preserved. Lacey Peterson
00:20:26.380 was a member of the neighborhood watch group. People who knew her said that if there was
00:20:31.860 somebody untoward in that neighborhood, she would have let them have it. But for any of that to
00:20:37.000 matter, she has to have walked up on the burglary while it was in progress, and no eyewitness can
00:20:44.360 put her there. On Christmas Day, the morning after Lacey Peterson vanishes, a van is found burning
00:20:51.940 in an alleyway a mile and a half from her front door.
00:20:56.840 A Modesto fire investigator works the scene, rules it arson,
00:21:01.320 and hands the case to the Modesto Police Department.

00:22:21.660 I mean, it's if everybody, you know, if Diane Jackson sees a van at 1140 in the morning with three guys in it, but she can't even tell us if it's white, tan or black, it kind of calls into question her, you know, viability as a witness.
00:22:36.260 Bueller says both burglars asked to take a polygraph examination because they knew they were going to jail
00:22:42.420 and didn't want other inmates thinking they had killed a pregnant woman and her baby.
00:22:48.320 Bueller also points to other pregnant women in Lacey's neighborhood.
