00:02:29.620 Second, Lizzo should not have been given special permission to play the flute because the entire performance was intended as an act of hostility toward James Madison, toward the founding fathers, and toward the historical American nation.

00:02:52.480 Instead, the New York Times reported, quote, it was a symbolic moment as Lizzo, a hugely popular black singer, rapper, and songwriter, played a priceless instrument that once belonged to a founder whose Virginia plantation was built by enslaved black workers.

00:17:20.840 say, Michael, I want to hear the principled ideological argument for why we should ban
00:17:28.520 marijuana, but not tobacco. I'm just using an example. Or I want to hear the ideological
00:17:33.660 principled rationalist argument for why we shouldn't have gay marriage. Or Michael, I want to hear whatever.
00:17:40.160 And I say, you know, I don't need to give you, I think I could in many cases, but I don't think
00:17:48.380 that I need to be able to give you this perfect, modern, rationalistic kind of argument for my entire
00:17:57.680 political program in society. I think we can use some prudence. I remember when I was a student,
00:18:05.600 I got to meet Antonin Scalia. Someone asked him about gun control.
00:18:08.660 Is they said, you know, Justice Scalia, you support the Second Amendment, but you think there are some
00:18:13.800 limits here. And I'm not sure that the limits totally jive with the original understanding
00:18:17.880 of the Second Amendment and the Constitution. And I don't understand why some guns can be banned
00:18:21.940 and other guns are not banned. And how would you determine exactly where that line is on the limits
00:18:29.380 of the Second Amendment? And Scalia's answer has stuck with me. And I apply it to so many other issues.
00:18:35.320 He said, how would I determine where the line is on the Second Amendment? Very carefully.
00:18:44.240 And this answer infuriated the ideologues, and certainly on the left, but on the right as well.
00:18:51.780 But that's obviously the right answer. How do we determine these sorts of limits in society?
00:18:57.000 How do we determine when to show mercy to prisoners and when to insist upon a little bit more justice?
00:19:03.240 When to go lighter and let them out of prison and reintegrate them into society and say, forget the
00:19:07.380 past, and when to put some guardrails around these people? How do you do that?
00:19:11.920 Very carefully. You do it. How do we determine? Why can't Lizzo play the flute? Lizzo, if you oppose
00:19:18.260 Lizzo playing the flute, you're a racist, sexist. You would allow some other concert flautist to play
00:19:25.300 that flute? Yes, I probably would. But you won't allow Lizzo. Correct. I don't think Lizzo should play
00:19:30.320 the flute. Well, well, why? Because I look at Lizzo and she's wearing a weird little leotard thing and
00:19:38.480 she's jiggling around half naked and she's just behaving in a way that's not dignified. It's
00:19:44.500 actually obscene. Whereas the concert flautist wearing the white tie and tails is behaving in a
00:19:49.580 way that is dignified. And so if I'm talking about a national artifact from the father of the
00:19:54.300 constitution, I don't want that to be degraded by being played while a woman jiggles around on stage.
00:20:02.140 Well, but how? Define dignity, Michael. Define obscenity, Michael. No, I don't have to do that.

00:20:58.420 So why is it wrong? You know, I could give you a pithy enough explanation, but before I even
00:21:06.940 would be tempted to do that, because it just is. Because it just is. Because we all know
00:21:13.760 deep down in our stomachs that that is repugnant. We have a prejudice against that, and that prejudice
00:21:20.340 is good. Prejudice is not always bad. Prejudice is how we all survive. You don't want to be
00:21:27.360 mean or unjust or unfair, but you certainly, we have to rely on prejudices and instinct and received
00:21:35.140 wisdom, or we wouldn't be able to do a damn thing in the world. If we had to write a fleshed out
00:21:40.820 rationalist post-enlightenment treatise for everything that we do all day long, we would
00:21:45.820 never be able to do anything at all. How do we, why do we put a lot of safeguards around sex offenders
00:21:54.040 even after they leave prison? Well, because we know that there's a real risk that they will re-offend.
00:21:59.440 Speaking of crime and punishment, you've heard about the extremist pro-lifers, the domestic
00:22:07.800 terrorists, the threats to our country that the DOJ and the FBI and the Biden administration are
00:22:13.340 warning about. Here's a story you probably haven't heard about. There's a man, a 74-year-old man,
00:22:19.500 who shot an 84-year-old pro-life woman as she was canvassing to end abortion. The pro-life lady
00:22:29.060 was not violent. She was not creating a public disturbance. She was just a sweet little old
00:22:36.520 lady trying to convince people not to kill their babies. 74-year-old lunatic pro-abortion leftist
00:22:43.180 shoots the woman. Not only is he not in prison right now, not only is he not facing, one would
00:22:51.900 imagine a serious punishment. Life in prison, capital punishment even. He hasn't even been
00:22:58.420 arrested. You remember Mark Houck? We've been talking about him on the show recently. He's the
00:23:04.760 pro-life guy who was peacefully protesting in front of an abortion clinic and some lunatic leftist comes

00:23:16.260 guy away from his 12-year-old son. For that, the FBI shows up with 25, 30 agents, rifles drawn,
00:23:22.660 pointed at Mark, pointed at Mark's wife, busts in on the home. Seven kids there absolutely traumatized
00:23:28.640 from this because of Joe Biden's jack-booted Gestapo thugs. But a 74-year-old pro-abortion guy
