00:12:23.380 and the leader of the opposition because, especially these days, all the polls are showing
00:12:27.600 that Donald Trump would beat Joe Biden, especially in the swing states.
00:12:30.580 So Biden's got to get rid of him.
00:12:32.300 And Trump has argued, hey, man, I was the president.
00:12:35.600 I've got some immunity here.
00:12:36.620 You can't just go after your political opponents like we're a tinpot banana republic dictatorship.
00:12:42.520 And the U.S. Court of Appeals says, yes, we can, actually.
00:12:45.420 And we are going to do that specifically to you, Donald Trump.
00:12:48.580 So the Trump team will certainly appeal this to the Supreme Court.
00:12:52.360 And there are two things I'm certain of when that appeal goes up to the Supreme Court.
00:12:56.440 The two things I'm certain of are that the Supreme Court will want nothing to do with this.
00:13:01.100 The Supreme Court does not want to decide this case.
00:13:04.440 And the second thing that I'm quite confident of is that the Supreme Court will not be able to avoid it.

00:13:17.180 And I met him twice when I was a student.
00:13:20.940 And on at least one occasion, maybe both times, Bush v.
00:13:24.280 Gore came up when the Supreme Court in 2000 decided the presidential election.
00:13:28.140 And he said, are you people still complaining about this?

00:13:33.780 You think that the Supreme Court wanted to decide the 2000 election?
00:13:36.800 We didn't want any part of it, okay?
00:13:38.620 But no one would decide it.
00:13:40.780 So we became a mockery, the United States.

00:13:45.560 We're supposed to be the greatest democracy in the world.
00:13:47.220 And so because the legislature wouldn't deal with it and the states couldn't deal with it, the Supreme Court had to deal with it.
00:13:52.460 And we ruled the way we ruled and get over it.
00:13:54.200 But they didn't want to.
00:13:55.120 And I'm sure they don't want to now.
00:13:56.540 But likewise, I'm equally confident they won't be able to avoid it.
00:14:00.100 Because if the Supreme Court declines to hear this case, then the Supreme Court is getting involved.

00:14:08.820 But if they don't hear the case and they uphold the appellate decision, then that's the very same.
00:14:13.960 It's the Supreme Court saying, in America today, you can prosecute the leader of the opposition.

00:14:24.780 It would be a stamp of approval to Joe Biden and to all of the Democrats who have been trying to stymie President Trump, even from running, since 2015.

00:14:47.320 Now, speaking of removing people from office, there is an effort underway to remove DHS Secretary Alejandro Mayorkas, who is the figurehead of this open border crisis.
00:14:57.760 And some Republicans want to impeach him.
00:14:59.740 And the very principled, reasonable, moderate Republicans are saying that this is a bad idea.
00:15:08.100 They're saying that Mayorkas might be terrible, you see, but he has not committed an impeachable offense.
00:15:15.000 And therefore, because I'm a very principled conservative, I'm not going to become like those Democrats, you see.
00:15:22.640 I'm not going to actually wield any political power or threaten the liberal establishment.

00:16:28.720 To impeach someone, they need to have committed treason or high crimes and misdemeanors.

00:16:39.860 Well, it would seem to count.
00:16:41.600 You know, there's only been one cabinet secretary who's ever been impeached in American history.
00:16:48.560 This was Secretary of War William Belknap in 1876.
00:16:53.280 And what was he impeached for?
00:16:54.900 Among the charges included were that he, quote, disregarded his duty as Secretary of War.
00:17:01.880 So you're not supposed to impeach someone for maladministration, just for being kind of incompetent.
00:17:08.960 But historically speaking, now we're going back 150 years.
00:17:12.780 The one time this has happened, the one precedent we have, is that a cabinet secretary was impeached for actively disregarding his duty in his cabinet position.
00:17:23.660 Furthermore, the House Judiciary Committee outlined about 50 years ago when impeachment is proper.
00:17:30.900 And impeachment, according to them, is proper when an official exceeds the powers of his office.
00:17:36.500 Or behaves in a manner grossly incompatible with the proper functions and purpose of his office.
00:17:40.500 Or employs the power of his office for an improper purpose.
00:17:44.480 So even according to that, the 1970s, surely the, and that was obviously a Democrat House, surely Mayorkas qualifies.
00:17:55.240 He is abusing his power.
00:17:58.880 His behavior is grossly incompatible with the proper functions of his office.
00:18:02.320 The function of his office is to secure the border.
00:18:04.820 That's largely his job.
00:18:06.820 And he's not doing it.
00:18:07.860 He's intentionally not doing it.
00:18:09.160 He is abusing his power by releasing these illegals into the interior of the country.
00:18:14.140 He's certainly exceeding the powers of his office.
00:18:16.180 And he's seeking to imply the powers of his office for an improper purpose.

00:18:22.960 And then, then you get to, that's the legal and the historical basis.

00:18:28.720 We now use, now we, the Democrats, now use impeachment in this country as just a kind of a referendum on leaders that they don't like.
00:18:35.980 They impeached Donald Trump twice, but the first time they impeached him in 2019, they impeached him for acting, quote,
00:18:42.860 in a manner contrary to his trust as president and subversive of constitutional government to the great prejudice of the cause of law and justice and to the manifest injury of the people of the United States.
00:18:53.260 Now, that is so absurdly broad, especially when we're talking about impeaching a president of the United States.
00:18:58.640 It's ridiculous.
00:18:59.280 It was ridiculous then.
00:19:00.360 But if that's the new precedent, can anyone, could Chuck Schumer even argue, could Mayorkas himself argue that he has not done that, that he's not acting in a manner contrary to his trust as the secretary of Homeland Security and subversive to constitutional government?
00:19:15.720 And he's intentionally breaking the law and encouraging hundreds of thousands, millions of people to break the law as well.
00:19:22.400 Basic laws like who gets to come into the country.

00:19:27.080 There's no real argument against this.
00:19:29.500 Good legal case, stronger historical case, airtight political case.
00:19:33.220 And yet there are two Republican congressmen who don't want to do it.

00:19:40.220 Tom McClintock says, quote, the only way to stop the border invasion is to replace the Biden administration at the ballot box.
00:19:47.560 Swapping one leftist for another is a fantasy, solves nothing, excuses Biden's culpability, and unconstitutionally expands impeachment that someday will bite Republicans.
00:19:55.400 So this is the classic squish argument.
00:19:58.980 Look, I'm sympathetic to Tom McClintock.
00:20:01.000 I don't want to unfairly malign him, but he's just flat wrong here.

00:20:10.220 And they say, well, listen, if we in any way push back against Democrat injustice today, then hypothetically in the future, they might do it to us, even though they're already doing it.

00:20:26.360 If we fight back at all, they, the Democrats in the future, might continue to do the very thing that they are doing to us right now.

00:21:33.860 But if we can't unify to take a vote that is largely symbolic, that is totally justified by history and politics and law to stop the issue of our time, the defining political issue of our time, that is mass migration, the complete blowing up of our borders, and an invasion from foreign countries.

00:32:52.960 regarding the value and importance of gender-affirming care for minor children.
00:32:56.120 This has been a major policy initiative of the Biden administration.
00:33:02.020 The Assistant Secretary of Health is a dude who thinks he's a woman himself,
00:33:06.000 and they continue to talk about the importance, Biden and the rest of the administration,
00:33:11.680 of transing the kids.
