00:01:53.040 what the left says. So it is always an incoherent sort of ideology. But when you add the trans to the

00:02:01.320 mix of it, it becomes impossible even to fathom. Big news today is 106 House Republicans are joining

00:02:08.680 this lawsuit. So we've discussed the various legal challenges to the 2020 election, and I thought some

00:02:15.040 were better challenges than others. I thought that Pennsylvania challenge was stronger because

00:02:18.980 Pennsylvania obviously violated their state constitution with their election practices.

00:02:24.160 This case is a little more unusual in that you have one state suing other states over the state's

00:02:31.020 election practices because there was clear evidence of crooked election practices going on in those

00:02:36.500 states. Well, how does Texas have the right to do that? Because obviously if other states are

00:02:41.740 cheating at the presidential election, that will change who the president is going to be. Or if that

00:02:47.300 does change who the president is, then that obviously will affect Texas as well. We haven't seen a

00:02:53.440 lawsuit like this before. Also, why does it go to the Supreme Court? Because when states sue other states,

00:02:58.560 then the Supreme Court has original jurisdiction there. As a legal matter, it seems like it's more of a

00:03:03.620 long shot. As a political matter, though, there's a ton of support. When you've got now 18 states and

00:03:08.500 the president and 106 House Republicans, there's a lot of political pressure on the court, even if

00:03:13.940 there's less legal pressure, rather. We will know very shortly. It may happen while this show is on

00:03:21.140 because the Supreme Court is going to decide, I believe, today. Some House Republicans are not

00:03:27.280 joining that lawsuit. Chip Roy is one of them, and I don't want to attack Chip Roy because I think

00:03:31.660 Chip Roy actually has pretty good reasoning here. I do support the legal challenge. I do support the

00:03:37.800 Texas lawsuit and the House Republicans who are supporting it and the other states as well and

00:03:42.680 the president. But I think Chip Roy makes a good point. What he says is, today, a number of my

00:03:47.420 colleagues will be filing an amicus brief in support of the, by the way, there's some, there's some

00:03:53.400 disagreement over how to pronounce amicus or amicus. I being a swarthy person from the continent and

00:04:00.000 Italy. Prefer amicus, but do as you wish. In support of the lawsuit filed by the state of Texas

00:04:05.020 regarding the election results of several other states, respectfully, I will not join because I

00:04:09.620 believe the case itself represents a dangerous violation of federalism and sets a precedent to

00:04:14.540 have one state asking federal courts to police the voting procedures of other states. This to me seems

00:04:20.960 like a pretty legit reason to not join this lawsuit because you know the result of this, if the election

00:04:27.000 were to go the other way, is you'd have liberal states suing conservative states for perfectly legitimate

00:04:30.940 voting practices like requiring a voter ID. And while I'm more than willing to have the battle on the

00:04:38.660 standards themselves, while I'm more than willing to say it is good to have laws that require voter ID, it is

00:04:44.480 bad to have crooked election officials in Georgia illegally counting their votes to the wee hours of the

00:04:50.060 morning after they send poll workers home. I'm totally willing to have that debate, but this would be

00:04:54.480 unprecedented. This would be something that we haven't seen before and probably in the short to

00:05:00.420 medium term, it would not work out very well in our favor. So I understand that. I'm still willing

00:05:06.600 to take the risk. I'm still willing to back the Texas lawsuit, but this is not an issue where I want

00:05:14.300 to castigate Republicans who are uneasy about it because I don't think it's just a matter of the hardliners

00:05:19.660 and the squishes in terms of supporting this particular lawsuit. And as a legal matter, I just

00:05:26.700 don't see it happening. If the Supreme Court wasn't willing to hear the strong case, I'm not sure they're

00:05:31.960 willing to hear this case, which is just not quite as strong. Some people disagree, however. Country star

00:05:37.660 John Rich is now betting $10,000 that the Supreme Court will intervene and hand the 2020 presidential

00:05:46.380 election to Donald Trump. 10 grand. That's pretty good. I mean, I like the fervor. I like the encouragement.

00:06:35.320 habits. That story broke in October. But a lot of people didn't hear about that story breaking in October

00:06:43.020 because the left-wing media and big tech, most especially, covered it up. They actively suppressed

00:06:50.760 the story. They wouldn't let you share the story. They wouldn't let you send the story in a private message.

00:06:56.060 They knew the story would damage Biden. There was a media research center poll that showed that Biden

00:07:00.620 gained something like 14 points because people didn't know about the Hunter Biden story, the story

00:07:07.340 of the Biden family corruption. 14% of people who voted for Biden, according to this one poll,

00:10:07.140 The federal government and 48 attorneys general filed twin lawsuits against Facebook on Wednesday,

00:10:14.020 seeking to potentially break up the big tech giant and restrict future business practices.

00:10:19.480 The federal trade commission is here. Attorneys general from 46 states plus DC plus Guam are

00:10:26.660 challenging. Specifically, the way they're challenging this is Facebook's acquisition of

00:10:30.760 Instagram in 2012 and 2014. When in 2014, they acquired WhatsApp. These lawsuits are trying to

00:10:38.040 force Facebook to notify the federal government of any acquisitions worth $10 million or more.

00:10:44.580 They're not just pursuing section 230 the way that Facebook and other big tech giants

00:10:49.420 have abused a special legal protection that they have from a 1990s era internet law,

00:10:55.120 though they should do that too. They're not just pursuing fraud the way that Facebook and big tech

00:11:01.280 have been able to get a critical mass in the public square. They're also going after them

00:11:07.660 with antitrust. They're also going after them for acquiring companies in a way that's illegal.

00:12:41.960 speeding up executions of people who have been on death row, some of them for 20 years or more,

00:12:47.860 and they're speeding them up because Joe Biden wants to let all these criminals off the hook.

00:12:52.400 Last night, they killed this guy, Brandon Bernard. Brandon Bernard was convicted in the year 2000

00:12:57.700 of abducting and robbing two youth pastors who had offered him a ride, who had actually done him a

00:13:03.540 favor. Robbed them, stuffed them in a trunk, drove all around for hours, sold their wedding rings and

00:13:09.260 things like that, tried to pawn off all their goods. Then as they were begging for mercy and begging for

00:13:13.460 their lives and reading the Bible, his buddies, this whole group of guys, shot them to death, but the

00:13:20.580 woman actually didn't die yet, and then Brandon Bernard set the car on fire and she burned alive.

00:13:24.940 Uh, that guy has to be executed by the state. If, if criminal justice has any meaning at all,

00:13:31.240 that guy's got to be executed. There was a last minute call, including from people on the right

00:13:35.260 to give him a pardon or delay his execution. That is a bad idea. Uh, he rightly was executed

00:13:43.180 as quickly as possible given the circumstances and may God have mercy on his soul. I think some people

00:13:49.260 have the wrong impression that I am bloodthirsty for the death penalty. I'm eager. I love the death

00:13:54.620 penalty. I'm so thrilled when the death penalty happens. I do, in a sense, I guess I love the

00:14:02.220 death penalty. I, I, I love it in that I, I know that the state must exact justice. That is the role

00:14:09.680 of a state, but I don't get giddy, you know, when criminals are killed. That, that's not the issue.

00:14:16.620 I am pleased when justice is done because justice must be done in this system. I have no personal

00:14:24.260 ill will toward this guy, Brandon Bernard. Apparently he turned his life around while in

00:14:30.360 prison, you know, and kind of death row really did something for him and it really changed his mind.

00:14:35.540 And I, I don't know his religious thinking by the end of his life, but he really did turn around.

00:14:40.720 That's not an argument against the death penalty. That's an argument for the death penalty because

00:14:45.880 the death penalty obviously is retributive. The death penalty is obviously deterrent. And apparently

00:14:50.380 the death penalty is rehabilitative too, because this guy facing his own mortality turned his life

00:14:57.200 around. That's very good. And so the, the appropriate response to this sort of thing is not to say that

00:15:03.520 vicious, awful, terrible people who commit awful, vicious, terrible crimes like monsters should get off

00:15:10.280 the hook. That's not the answer. That's extraordinarily unjust. And there is a role for

00:15:15.020 mercy in a, in a civil society, but there is not a role to, to have no justice whatsoever. That would

00:15:22.200 be crazy. That would be a perversion of society. So that's not the response. And the response is also

00:15:27.240 not, yeah, go get, I'm so glad you're being killed. The response is the guy committed this crime

00:15:32.400 and certain particular heinous crimes must meet with the ultimate penalty and we should pray for his soul.

00:15:40.640 It's a good thing. It's a good thing for everybody involved. A materialist culture doesn't quite

00:15:46.480 understand that, but that is a good thing. There's a guy that's going to be executed today,

00:15:50.240 hopefully, we all hope, because there's probably going to be another push to get him off the hook

00:15:55.220 too. He sexually abused his two-year-old daughter and then tortured her and killed her because she

00:27:47.040 information out. We're in the peak of flu season right now. This is the beginning of peak flu season.

00:27:52.640 And yet, according to the CDC, seasonal influenza activity in the United States remains lower than

00:27:57.860 usual for this time of year. Flu activity is unusually low at this time, but may increase in

00:28:03.260 the coming months. Well, what's the model look like? I mean, what, can we see some charts and

00:28:08.460 numbers and stuff? No, we can't actually because flu hospitalizations are so low that the CDC can't even

00:28:17.520 model them. Huh, that's weird because we're, we're in the midst of this, the worst, most terrible

00:28:26.580 pandemic that's ever afflicted mankind, right? According to the left, coronavirus. And there's

00:28:33.820 been some question about some of these numbers that have come out about coronavirus. And flu during

00:28:38.660 peak flu season almost doesn't exist. Now, why is that? What the left will tell you is the reason,

00:28:46.600 there's a very clear reason why flu numbers are so low. Because we're wearing the masks and the masks

00:28:53.240 totally work, you know that. And we're social distancing. And the measures that we've put into

00:28:57.940 place, the measures under President Trump have been working very, very well. Oh, wait a second.

00:29:04.040 Uh-oh, there's, there's the problem. Because while the left makes that argument that the reason flu

00:29:09.180 numbers are so low is because all these measures that have been put into place for nine months have

00:29:12.400 worked very well, the left is simultaneously making the argument that Trump has completely botched

00:29:17.380 those measures. That the, the way that the masks and the lockdowns and the, the treatments have been

00:29:23.100 implemented have been haphazard and they haven't worked. And people haven't even been abiding by the

00:29:27.680 guidelines. And that's why coronavirus numbers are spiking because those measures haven't worked.

00:29:32.480 So which is it? You can't have both. You can't have both. The very low number of flu hospitalizations,

00:29:40.760 so low that you can't even model it, has to force the left to give up one of those two arguments.

00:29:48.040 They're not going to because they don't care anymore, because they don't feel that they have

00:29:50.940 to answer to anybody, because they think they've locked up at least the next four years.

00:29:55.220 But it, it does show you the, how disingenuous they're being. It does show you how unreliable

00:30:00.500 the scientists and the experts and the data are on this. Doesn't make a lot of sense. And you don't

00:30:06.020 need a lab coat and you don't need all the degrees that Dr. Fauci has to know that. You just need

00:30:10.260 common sense. Meanwhile, the left is still using all of these scientists and experts to shut down

00:30:20.080 the things we most cherish and some of our most basic civil rights. And they're doing it in the

00:30:26.620 name of science to mask the political arguments that they're making. Best version of this the other

00:30:31.920 day, and this guy knows a thing or two about masking himself, is Ralph Northam in Virginia.

00:30:36.040 Governor of Virginia is attacking people who go to church. And he's saying that people shouldn't go

00:30:42.600 to church. You got to stay home. You can probably go to a BLM rally. You can probably go loot the

00:30:48.200 local store in the name of justice. You can probably go to a politically correct funeral,

00:30:52.600 but not the funeral of your grandmother. And you certainly can't go to church.

00:30:59.000 Well, here's Northam's argument. He said, is it the worship or the building?

00:31:02.880 You do not need to sit in the church pews for God to hear your prayers.

00:31:08.140 Wow, wow, wow, wow. This is obviously not a scientific statement he's making. It's a theological

00:31:14.620 statement and it's a very stupid one. Just, I'll just speak as a Catholic here. We need church

00:31:21.100 buildings. We need to go into the confessional. We need to receive the blessed sacrament because ours

00:31:25.940 is an incarnational faith. We need to gather together. Doesn't matter, let's say you're not Catholic.

00:31:31.060 Let's say you are the least Catholic Protestant in the world. Certainly you would agree we all have

00:31:35.520 to gather together. Ralph Northam says, no, you don't. Just, nah, just pray in your own mind.

00:31:41.060 That's it. That's all you have to do. This is a theological problem that began really in earnest

00:31:47.800 under the Obama administration because Obama started to popularize this phrase, a freedom of worship

00:31:54.080 rather than freedom of religion. Freedom of religion implies that there's a much broader public

00:32:00.440 aspect to it, right? And we have religious freedom in this country. I don't just have the freedom to

00:32:05.740 think what I want in my head, which is, by the way, even that is increasingly under attack.

00:32:09.840 But I have the freedom to enact my religion. Religion and faith have a shape. They look like

00:32:16.220 something. They look like public practices. They look like public rituals. They look like public

00:32:20.100 monuments for that matter. They look like church buildings. They look like people gathering together.

00:32:25.200 And that freedom of worship, what that changes is, no, you're allowed to believe whatever you want

00:32:30.220 in the privacy of your own little mind. But there's no public sense to that.

00:32:37.320 Always among the modern left, science is invoked as this category outside of politics.

00:32:46.120 Look, we can have our religious disputes. We can have our political disputes. But let's put politics

00:35:13.000 one, this is temporary. Two, churches are not being discriminated against. All of Manitoba is

00:35:17.940 shut down with the exception of essential businesses. Three, a $5,000 fine. Four, bad publicity. What are

00:35:22.940 your thoughts? Yes, open all the churches immediately. Period. Simple as that. I think that there is a world

00:35:31.040 in which it is legitimate for churches to shut down for some period of time for certain reasons.

00:35:38.380 This is not one of those reasons. This is not that time. What are your dad's arguments? This is

00:35:43.700 temporary. Is it? Is it temporary? On March 16th, I was told 15 days to slow the spread.

00:35:52.020 March 15th. So by, what is it? Oh, it's December. And Joe Biden's promising that it's going to go on

00:36:03.700 for another 100 days if he's sworn in on January 20th. So it's not temporary. This is going to be

00:36:10.080 temporary forever. Two, churches are not being discriminated against. They are. They are. Because

00:36:46.080 liberal, secular, materialist society, frivolous things are considered essential and church is

00:36:53.660 considered non-essential. I don't think that's true. I think church is the most essential institution

00:36:59.900 there is. I think not only the country, but the whole civilization will go to hell in a handbasket

00:37:06.340 if you close the churches for too long. And I don't care if you got to close the head shop or you got to

00:37:10.720 close the liquor store. And I really like liquor too, but I don't care because that's not the most

00:37:14.980 important institution. So the church is being discriminated against. They're just pretending

00:40:32.920 way we view life. So those boil down to theological debates. The problem is, notably the left has lost

00:40:41.020 the theological and philosophical sophistication to have those debates. So they don't even know that

00:40:45.780 they're having them when they are. But we talk about it all the time. Ultimately, it's sort of the

00:40:50.480 only thing worth talking about. And when we're having sort of cultural discussions, which are

00:40:54.600 lovely, and political discussions and discussions about the food even, very often that will refer

00:42:35.120 mandates. From Zach, Michael, one of the key things I've learned since listening to the Daily Wire is

00:42:40.300 the importance of words and defining terms in discussions. I was wondering if you could help me

00:42:45.140 clarify the following to be more effective. When are the proper times to use liberal, progressive,

00:42:50.720 libertarian, and conservative? Should classical liberal be a separate category or political ideology

00:42:55.500 from the others? I wish there was a simple right or left spectrum, but I believe there are more

00:42:59.440 nuances to consider. Thank you for all you do and putting covfefe in my coffee. The first thing I

00:43:03.780 would recommend you do is get specific about what you're talking about. I mean, I think that's kind

00:43:08.920 of the premise of your question anyway. But even beyond these labels, sometimes these labels are

00:43:12.900 not particularly helpful. Because when I say libertarian and when somebody else says libertarian,

00:43:18.180 we might be referring to different things. And we might both have a point, but I think it helps to

00:43:23.420 get even more granular than that. What issue are we talking about? What stance are we talking about?

00:43:27.300 How will this work in reality? One great thing about conservatives is that we're not metaphysical,

00:43:33.280 abstract people all the time with our heads in the hair and never looking down to planet Earth.

00:43:38.520 We want to know how things work in practice, with prudence. Those are not bad. They're bad words to the

00:43:43.840 ideologues, but they're not bad words to us. So just broadly, liberalism refers to the political

00:43:50.640 philosophies that developed largely in the 17th and 18th centuries. This then splits off and there's

00:43:59.960 a sort of right liberalism, which now we usually call libertarianism, although there is a left

00:44:04.280 libertarianism too. And then there's a left liberalism, which develops in the late 19th and

00:44:10.100 early 20th centuries into progressivism. Progressivism is in some ways a natural outgrowth

00:44:17.040 of liberalism because it's a rationalist political ideology that says basically we need to get rid of

00:44:24.480 the sort of robust political debate that we have. We need to ignore the eternal laws of the universe

00:44:30.080 upon which our constitution is grounded. And we need to move into the world of evolution and progress

00:44:36.640 and Darwin and recognize that human nature can change. And we need to take politics away from the

00:44:41.600 people and give it to the scientific experts. You're seeing that play out as well. Whereas the

00:44:45.440 modern libertarians, modern libertarians kind of take the older liberalism, which you might call

00:44:50.540 classical liberalism, and then they've just read too much Ayn Rand or something. And they watched a lot

00:44:56.060 of Milton Friedman videos. And so it is still distinct from classical liberalism in the way that it's

00:45:05.700 practiced in the United States, but it tends to be a little more right wing. But it's still,

00:45:09.420 all of those sorts of ideologies have, I think, an incorrect view of human nature, the human person.

00:45:17.640 They all seem to posit that the individual is the basic building block of society.

00:45:23.700 Whereas conservatives disagree with that. Conservatives tend to believe that the family

00:45:26.800 is the basic building block of society. Liberals of all sorts, the right ones, the left ones,

00:45:31.120 the libertarians, the progressives, they tend to believe that we ought to look at politics primarily

00:45:36.380 through a lens of rights. I think that we, and conservatives think that we should look at politics

00:45:40.840 primarily through a lens of duty, loyalty, gratitude, obligation, prudence, providence,

00:45:46.540 taking the inherited wisdom of the past and taking it seriously. And so when you, but I say that even

00:45:53.020 the left and right versions of liberalism, call it progressivism, libertarianism, whatever,

00:45:58.140 they take the individual and then on the left, they take all those individuals and bunch them up

00:46:02.700 together. And you have collectivist politics and on the right wing version of liberalism,

00:46:07.960 they just keep the, the individual atomized. So, you know, it's sort of classic idea of it's,

00:46:13.540 it's all just about me and I'll do whatever I want. I can exert my will however I want and pursue my

00:46:17.700 appetites and, and you can't say nothing about it. And then you see in the idea of bunching up

00:46:22.900 individuals into the collective, you, you, that's where you get the, actually the word fascism comes

00:46:27.320 from the idea of the fasci. Yeah. You bundle up all these sticks together and then you've got the

00:46:30.960 nation. You get obviously communism from that, you get socialism from that, and then you get

00:46:35.340 the atomized individuals too. And I just think all of those kind of miss the mark. And that's why

00:46:39.380 we ought to all be conservatives. From Tim, I'll take one more. If Biden is elected, can we not sue

00:46:44.960 the DNC for putting up a candidate who knowingly had a condition that would keep him from finishing

00:46:49.380 his term? Can the Senate do something? Thanks. No, we can't, we can't. I hate to tell you that,

00:46:57.620 but we can't. As I think we've all learned over the past several weeks, if we didn't know it before,

00:47:04.280 elections are extraordinarily messy. I keep going back to Lyndon Johnson who stole the 1948 Senate

00:47:11.060 seat in Texas. And by the time people really figured it out, he was already dead. He'd already

00:47:16.280 been Senator, Vice President, President, and already transformed the country.

00:47:19.140 There were irregularities and outright crimes in certain places, in certain key states that may

00:47:31.040 well have changed the results in those states. I really have no doubt about that.

00:47:39.140 I have no doubt that machine-run Democrat cities did lots of illegal things.

00:47:44.400 The trouble is there's a process. And so the states are going to certify those votes. They're

00:47:51.640 probably going to send electors. The electors are going to vote. So that's kind of the left-wing

00:47:56.160 argument is, or the pro-Biden argument is that's the process. Ha ha, sorry. Even if there was

00:48:00.260 election fraud, doesn't matter. He's the president. Now the right-wing version is, okay, yeah, okay,

00:48:04.980 you're going to have your shenanigans. Well, we're going to fight this in court tooth and nail.

00:48:08.320 And we're going to fight, challenge the Pennsylvania constitution. And on the basis of the constitution,

00:48:15.000 we're going to have Texas sue other states. We're going to have other states join in and

00:48:19.660 the president and 106 house members. And then the left yells, this is unconstitutional. This

00:48:24.220 is unfair. This is fraudulent. This is terrible. No, I don't think, I think it's great. I think

00:48:27.820 it's fabulous. I think it would be absolutely terrific if the Supreme Court would weigh in and

00:48:32.740 say, okay, Texas, you got it. Trump's the president. I think that would be terrific and perfectly

00:48:37.700 legitimate and perfectly constitutional. The court has signaled probably it's not going to do that.

00:48:44.320 Hope springs eternal in the human breast. But both of those views, the pro-Biden view and the

00:48:50.720 pro-Trump view will culminate in the reality of the messiness of elections that the electors are

00:48:57.420 going to vote. And whoever they vote for is going to be the president. And it doesn't really even matter

00:49:05.040 quite how they got there. That is the process. And we can be thrilled about it and the left can

00:49:10.980 be screaming about it or the left can be thrilled about it and we can be screaming about it. But it

00:49:15.060 doesn't change the fact that that is the process. And we're going to know a whole lot more about that
