00:11:50.160 prorogue parliament james manson reminds the court the prime minister stated reasons for advising

00:11:56.100 prorogation were one to reset a parliament that was no longer functioning and two to hold a liberal

00:12:37.540 about who caused the prorogation of parliament. Was it the prime minister who advised the governor

00:12:42.040 general to prorogue parliament, or was it the governor general who accepted that advice?

00:12:47.640 What? You mean he doesn't know this? The question pertains to the question of whether the federal

00:12:52.980 court has jurisdiction to rule on the exercise of federal or crown prerogative. Ooh, this is

00:12:58.960 interesting because a lot of armchair lawyers have been questioning using that question in the

00:13:03.780 past couple of months on social media. Number nine, James Manson responds by saying that in a system

00:13:09.560 of responsible government, the governor general must always act on the advice of the prime minister

00:13:14.360 to prorogue parliament. No request for prorogation has ever been refused, he states. Number 10, the

00:13:21.220 court is in recess until 1113. Number 11, James Manson quotes from the Miller case, this one in

00:13:26.500 the United Kingdom. They're using as a precedent where the court discusses parliamentary accountability

00:13:31.460 and responsibility. Read more about the application of the Miller case to the court challenge.

00:13:35.900 I don't know. We don't need to. Number 12, James Manson suggests that section five of the Canadian

00:13:41.080 Charter of Rights and Freedoms limits the power of a prime minister over parliament. Section three

00:13:45.940 of the charter guarantees the right of citizens to vote in fair and free elections. Number 13,

00:13:51.220 citing the Miller case again the one in the UK. James Manson invites the federal court to find

00:13:57.180 that there was no reasonable justification for this decision to advise the governor general to

00:14:01.800 prorogue parliament. The longer prorogation goes on the better the justification needs to be stated

00:15:15.620 in the case. They're Canadian citizens after all. They're affected by this case and they have

00:15:19.500 demonstrated a genuine interest with the issues, where are we at here, raised by this case. If my

00:15:26.780 clients don't have standing, who would have standing? Lawyer Manson says at page 28 of the

00:15:33.900 Respondent's Memorandum of Fact and Law, lawyers for the respondent argue that David McKinnon and

00:15:38.480 heiress Lebrano should not be granted standing. That's the government lawyers. Number 19, James

00:15:43.960 Manson cites case law supporting his argument. The prime minister's decision to advise prorogation

00:15:48.660 is just a, sorry, justiciable, justiciable, i.e. subject to judicial review in a court of law.

00:15:56.220 Number 20, at page 12 of the respondent's memorandum of fact and law, lawyers for the

00:16:01.500 respondent's argue that the prime minister's decision to advise prorogation is not reviewable

00:16:06.000 or justiciable, because in part, that advice does not affect any legal rights or interests.

00:16:12.840 James Manson argues the decision to prorogue Parliament violates the democratic rights of

00:16:18.080 Canadians protected by Section 3 of the Canadian Charter of Rights and Freedoms. Hang on, let me

00:17:07.260 in a similar way in Canada. James Manson says yes, pointing out that we have a constitution

00:17:12.440 similar in principle to that of the United Kingdom as per the 1867 British North America Act.

00:17:18.600 We have the same parliament. It's almost exactly the same. Number 22, James Manson reiterates the

00:17:25.000 four principles at play in the Miller case, responsible government, parliamentary sovereignty,

00:17:28.860 the rule of law, and the separation of powers. Do these principles compel us to reach the same

00:17:34.160 conclusion in this case or a different conclusion? Number 23, Manson emphasizes that if the Miller

00:17:39.900 case did not exist, his argument would be the same. Number 24, courts in recess. At that time,

00:17:46.800 James Manson will conclude his arguments. Court has resumed, so here is the conclusion. In response

00:17:51.520 to an earlier request, by the way, from Chief Justice Crampton, James Manson puts flesh on

00:17:56.740 the principle of democracy and argues that it underpins the other principles mentioned in his

00:18:02.360 argument. Chief Justice Crampton now invites Democracy Watch to share its evidence and

00:19:47.620 advice to the governor. What are they even talking about? They're the same thing. They're

00:19:52.920 playing semantics. Oh, this is so infuriating. Number 32, lawyers for the respondent argue

00:19:59.160 there are no limits on the power of a prime minister to prorogue except the requirement

00:20:03.480 that parliament must sit at least once every 12 months. They argue that this is entirely a

00:20:09.620 political issue, not a legal issue. When to prorogue, how long to prorogue, the conditions

00:20:15.180 under which a prime minister can advise a Gigi to prorogue

00:20:18.440 all their political aspects of our Constitution law.

00:20:21.660 They are not within the constitutional competencies of this court,

00:20:26.800 stated the lawyers for the respondent, meaning the government.
