00:08:00.040 for coming on such short notice carrie um what exactly is going on here well so let's clear up
00:08:11.060 first of all. We received the injunction. We went to court on January 31st. The ostriches
00:08:20.080 were to be executed on February 1st. And we went on an emergency application basis to the federal
00:08:28.480 court. And Justice Batista, the federal court on that short notice, gave us a judge. Justice Batista
00:08:36.340 presided over that matter. He took submissions from both sides. So the Department of Justice
00:08:41.780 lawyers are acting on behalf of the Canadian Federal Food Inspection Agency and then our
00:08:48.100 team of lawyers. And at the conclusion of that hearing, he gave us his decision later that
00:08:53.300 afternoon and said the injunction would be granted. He did not put a time limit on it.
00:08:59.960 so what we were asking for is that we just have a literally a stay of execution I feel like we're
00:09:07.620 in medieval times here stay of execution for these animals until such time as our judicial
00:09:16.360 review is heard now so many people are just becoming sort of quasi lawyers and all this
00:09:21.880 so we might as well explain that too so when an administrative tribunal issues an order so whether
00:09:28.300 it's a school board, a human rights tribunal, there's a lot of different tribunals involved
00:09:35.760 in business, and or the Canadian Food Inspection Agency, you have what's called the opportunity
00:09:43.200 to have the court look at that.
00:09:45.960 So a 30-day time window happens called the judicial review, and you have 30 days to put
00:09:51.900 notice into the court that you want that decision reviewed.
00:09:55.020 So that kind of gives you that 30-day window to prepare the court documents, tell the court you're going to have the review.
00:10:02.420 And then typically that hearing or that review is held before the court three to four months down the road.
00:10:10.160 In this case, we decided because we did not have the luxury of that 30 days because the execution date was coming up fast approaching.
00:10:21.000 And I think this is one of the very strange challenges that anybody has who wants to challenge this agency, Shadow, is that they don't give you the time properly.
00:10:33.420 The court dates for notice and everything don't align with how you have to operate in this matter.
00:10:39.460 So, of course, we did not have the luxury of 30 days.
00:10:41.800 We had the luxury of a very short amount, I think, seven days in the case by the time we got the lawyers engaged.
00:10:49.060 so we had to make the emergency application not to have to kill those ostriches um and the court
00:10:56.040 found in our favor we'll give you the injunction this matter is important there's valuable things
00:11:01.380 that need to be talked about here um so nobody gets to kill the ostriches until such time as
00:11:06.960 the judicial review can be held now they also just said the matters involving the quarantine
00:11:13.180 were going to stay in force. And so that was fine. We, you know, that's great. We, the birds could
00:11:19.640 live. Then we got notice earlier or late last week that the Canadian Food Inspection Agency
00:11:28.640 didn't like the decision and the judge maybe didn't take into consideration the right
00:11:35.020 sections of the act. So two acts govern this. It's a real strange character, this Canadian
00:11:45.280 Food Inspection Agency, and then the Animal Health Act as well. So those two acts govern this. And
00:11:50.880 well, the judge didn't really say he took into consideration this section. And we really don't
00:11:58.200 want you guys to have a whole bunch of time. So we're going to go back to court this week.
00:12:05.020 And we're going to challenge whether or not we can kill the ostriches under these certain sections without having the judicial review.
00:12:15.400 And we want the, you know, in any case, we want the hearing expedited.

00:13:26.660 override that decision would be an appeals court the federal appeals court or the supreme court of
00:13:31.700 canada correct correct so when that came out i kind of went oh no no now now i've got to get a
00:13:38.760 hold of carrie we got to get this straightened out so here we are and thank you for that uh shadow

00:14:43.960 think people are at the point they don't trust government they don't trust the courts they don't
00:14:49.740 trust bureaucracy for sure so anything is possible and I think that is a sad state of affairs but I
00:14:55.880 think that that process and that thought process it has some legitimacy regrettably yeah well the
00:15:02.960 institutions are no longer trusted by people right and when when that did get released i think it was
00:15:08.460 on x first um the comments were amazing and somebody said to me just exactly as you expressed
00:15:15.260 um i just like to see one day without going full communist here right you know even with the state
00:15:22.220 the Liberal Party is in and all the lies that are being told by government officials, by
00:15:27.960 ministers of the crown. I mean, bald-faced lies that what are you supposed to believe anymore?
00:15:36.460 And I suppose that's one of the tactics they've been using on us to try and keep us confused and
00:15:40.800 powerless. But that's why we need to be able to clear the air here. So what exactly is going to
00:15:48.240 happen they're going to go back to court on tuesday or wednesday and they're going to challenge
00:15:52.680 the judge's wording on his ruling so yeah we're all kind of like um okay did they get to the judge
00:16:01.580 like what okay so because that's the other thing right like we we joked about that yesterday did
00:16:06.600 they get to him that would be judicial interference which is illegal but how would you ever be able
00:16:11.800 to prove that right right the judge now this is only me predicting this but i think that the judge
00:16:19.200 when he hears this i can't even believe he's allowing them to present this uh does he have
00:16:24.980 to do it or is it something he can say no to the judge so we're going back it'll probably be
00:16:31.160 wednesday or thursday i'll certainly the minute we get confirmation of the date oh you'll you'll
00:16:36.040 be among the first to know. Thank you. Justice Bautista, if in fact he is not amused by and
00:16:46.320 finds legitimacy to the question regarding the intent of his ruling, because that's what they're
00:16:52.480 challenging, right? The intent of his ruling. He was very clear, these birds stay alive till this
00:16:57.620 can be heard. So for the Department of Justice lawyers to even be raising this, you know, I would
00:17:06.520 not. It's going to be a big slapback. It's going to be a big slapback. I mean, these judges,
00:17:13.520 you know, is the wording clear in his ruling, in your opinion? Absolutely. There's no, no, no,
00:17:20.360 nothing, you know, anywhere that you could look at it differently. This discussion needs to be
00:17:29.740 before the court. It is a value and important discussion that has to happen, including
00:17:35.360 some issues around the constitutionality of what's going on here, Shadow. So he went above and beyond
00:17:41.760 even saying there's only one factor that needs to be discussed in the courts. He said, no,
00:17:47.180 there's there's other things that we need to to look at here and so his intent is so clear and
00:17:54.800 obvious it's just there's no mistaking what it is now do they have the right to go to court and ask
00:18:01.020 for an expedited hearing sure you know that if that's what you really want to do because you
00:18:06.640 think now that we have what 20 some odd days where no birds have died you know after 14 days is when
00:18:14.660 everything should be dead, according to the literature on avian flu. These birds are healthy,
00:18:22.240 they're happy, they're dancing. And of course, there's another part to that too, because
00:18:27.660 we can't have that happening. So CFIA has now imposed further restrictions on the family. But
00:18:36.680 as far as the court goes, no, there's no... I want to get to those restrictions in just a second.
00:18:43.660 But, you know, when the judge hears what these Department of Justice lawyers have to say, I cannot wait for his response, because we've seen some pretty incendiary responses from judges in the last few years.

00:19:18.120 Well, so this is in keeping with the modus operandi of CFIA. You know, they try to gain power in all ways over the farms that they target, right? So in this case now, the quarantine protocols that are in place aren't good enough.

00:21:15.000 opposition are they allowed to do that well one one would think that um cfia considering all the
00:21:23.160 problems they're having trying to contain avian flu the the mass slaughter of healthy birds is
00:21:31.040 rising every year because their stamping out policy isn't working if it was working we would
00:21:36.980 be seeing a reduction on all of this at least that's the logical mind would conclude that
00:21:41.880 but we're not seeing that we're seeing more and more so you think that now these birds have
00:21:48.000 miraculously recovered um from a death sentence you know not one you know imposed supposedly by
00:21:55.840 nature and avian flu um that they would be the first to line up and go you know we should test
00:22:03.460 these birds we should find out what's what is making them live what what is happening here
00:22:08.660 but no no no no no no they are prohibiting any form of testing on anything whether it be a bird
00:22:17.480 a dead bird no autopsy no organ slice samples no eggs no egg yolks nothing going to any
00:22:27.960 independent testing lab to find out what's really going on here as a matter of fact
00:22:33.300 if anybody engages in that kind of testing you're looking at six months in jail and or a two hundred
00:22:39.100 thousand dollar fine so they still can't do that no we're we're asking and of course they're not
00:22:45.900 agreeing and so how are they going to argue their case if they can't get any additional testing

00:23:32.220 supposed to put up additional fencing now and CFIA wanted them to do this a while ago and so
00:23:39.360 the family said well provide us with the panels we'll be happy to put it up because you again the
00:23:45.420 ground is frozen up there right now how are you going to dig and put a fence up they need to put
00:23:51.060 all the ostriches under a barn so somehow we're supposed to build a barn overnight and my favorite
00:23:57.660 one. No more loving for Frank and Lulu. They have to be separated because, you know, the love's got
00:24:07.200 to get out of there. No loving in those pennons right now between those ostriches. So now think
00:24:13.220 about that. All this time, these birds have flocked together, flocked, emphasis on flocked,
00:24:20.460 I didn't say anything else. And, you know, so what is it that they're really after now?

00:29:42.260 the males from the females, you know, that is cruel in the animal kingdom that, you know,
00:29:48.380 you're you're causing unnecessary stress to them all kinds of things so you know we're looking at
00:29:55.760 a number of things here including are these people in violation of the criminal code are they without
00:30:02.520 lawful excuse asking for these birds to be murdered and if they don't have a reasonable excuse
00:30:10.020 not one that they can prove not this speculation nonsense that's in the legislation empowering
00:30:16.080 cfia you know let's find whether or not this is justifiable under the criminal code and i bet the
00:30:22.960 game will change really quick i wonder if it's possible to get a an order to prevent cfia from
00:30:31.480 meddling for a certain amount of time in what's going on at the farm i think you know if we can
00:30:37.740 prove to the judge they're being completely unreasonable you know i think that may may be
00:30:43.200 one of the areas that we can look at. They have to act in accordance with, at least at the very
00:30:50.940 least, a reasonable approach to what they're doing here. You think they'd be happy to have
00:30:56.700 humans that weren't protected if, in fact, avian flu mutating and now infecting humans was a real
00:31:05.240 issue. Here you have a considerable amount of people happy to walk alongside the ostriches
00:31:12.820 without hazmat suits and you know to date nobody's been sick i
00:31:17.420 when the dave one of them doesn't catch a cold or something no no dave went with katie who was
00:31:26.960 on the show with us the daughter of karen first showed up during this crisis of course she had a
00:31:32.460 cold and then of course dave got the cold well public health is calling them harassing them
00:31:38.760 You have to get tested, you know, this and that. And on the video a couple of days ago, I said, wow, for a dead man walking, you're looking pretty good.

00:31:56.500 We're gearing up for that. We knew this was coming, right?

00:44:49.220 going to get a fentanyl czar and there was going to be 10,000 frontline troops at the border and
00:44:56.020 and there was going to be more drones, more equipment,
00:44:58.240 more everything at the borders, right?

00:45:02.740 But the whole time, Trudeau has been saying,
00:45:05.700 well, fentanyl going into the United States is not a problem in Canada.

00:46:10.860 But I understand you think that that is not sort of something that we should be focusing on, the fact that it's a small amount, particularly compared to Mexico.

00:46:19.960 Well, several months ago, you had the biggest lab in the history of the world, you know, taken over by the Royal Canadian, Canadian Mountain Police in Vancouver.

00:46:39.720 OK, so that, you know, and definitely where there was Chinese organized crime, possibly Iran as well.

00:46:58.480 The fact that this thing emerged and it's tied to these biker gangs who've been hired to go down to the United States in some cases and assassinate people like, you know, my former boss, Secretary Mike Pompeo, President Trump and others.

00:47:15.880 But the key thing to focus on is that someone was making over 100 million doses of deadly fentanyl that you didn't know about right under your nose.
