00:28:28.600 So in the last Parliament, I appeared on Bill C-26 and talked about some of these issues when legislation aims at giving more power to the state to protect infrastructure and to disable and to take certain steps.

00:28:50.320 We needed to put in the legislation a criterion on necessity and proportionality,
00:28:55.440 making sure that the exercise of those powers is going to be tested from a privacy perspective to say,
00:29:01.000 is this necessary?
00:29:02.580 Does it achieve the result for which it's been put in place?
00:29:05.380 And is it proportional?
00:29:07.040 So that's the substantive element.

00:30:06.740 The cabinet minister would have the power to issue the order,
00:30:11.020 would prohibit that the existence of the order to cut that service,
00:30:15.900 which would, of course, eliminate the ability for anyone,
00:30:19.600 including you in your role as commissioner,
00:30:22.220 to have any oversight whatsoever.
00:30:24.480 Isn't this a direct circumvention of the act
00:30:27.940 over which your mandate is concerned?
00:30:30.540 Well, that's why, again, to make sure that we're not making it more difficult
00:30:34.560 to raise rights and to protect privacy,
00:30:36.840 The reporting to appropriate authority, even if done in a confidential manner, is something that I recommend.
