00:14:49.940 and she's right a bc ostrich farm fighting to stop a cull of its 400 strong flock over an avion

00:15:07.360 and january of this year because all the cfia did was run two pcr tests and this is something i

00:15:21.080 been any number of things and by the way they're also claiming now that there is wild birds like
00:15:26.940 geese and ducks in the area who have died from bird flu. That's what the CFIA is claiming right

00:15:58.480 execution of the birds they've been trying to stop cfia from destroying these birds since the
00:16:06.000 cull was ordered amid an avian again faulty reporting amid an avian flu outbreak in december
00:16:12.400 that would go on to kill 69 ostriches they state that is fact here so again you guys watch out for
00:16:18.380 the media the farm is lost in federal court and the federal court of appeal but on thursday their
00:16:23.420 lawyer sought another stay on the call and filing a series of documents as the farm seeks a hearing
00:16:28.720 in canada's highest court that would be the supreme court obviously so in this decision
00:16:33.600 which came out on saturday the federal court of appeal granted an interim stay until the stay
00:16:40.200 motion is decided on the basis of a full record now what does that mean are they finally going

00:18:31.080 it so they're saying that allowing these birds to remain alive means a potential source of the
00:18:37.240 virus persists and increases the risk of reassortment or mutation of the virus and again
00:18:42.560 there's been no sign of that at all except for what cfia says regarding some wild animals

00:23:35.660 disease control. In the case of Universal Ostrich Farm in Edgewood, B.C., conservative representatives
00:23:41.620 have urged federal authorities to pause the cull, allow independent testing of the surviving birds,
00:23:47.680 and pursue non-destructive options such as controlled research partnerships or relocation,
00:23:52.880 rather than defaulting to stamping out while ensuring any measures protect both animal and
00:23:57.180 public health. We're also pressing for full transparency and accountability from the CFIA,
00:24:02.620 clear publication of the evidence behind its decisions in proportionate least harm tools,
00:24:08.040 along with fair treatment and compensation for affected producers. Conservatives will keep
00:24:13.220 advocating for a balanced approach that protects both the public and animal health, respects
00:24:17.580 farmers, and uses the minimum necessary measures, including independent testing, that's the big one,

00:25:13.920 the early days of the trial the earlier originally five days set aside for the trial and then
00:25:20.940 He had to set three more days, and there were further days set later in 2024 and earlier this year,
00:25:28.780 but his reasons for decision were focused primarily on the first eight days of trial.
00:25:36.580 And he said it was nothing that the Defense Council did during that time could include the delay to the defense,
00:25:45.940 that it was all crown defense, crown delay, or institutional delay.

00:27:18.140 our friend Wright Blend. Trucker Chabavizzi was in court today for day one of his pre-trial motion
00:27:25.240 where his defense team Diane Magus is arguing that his charter rights were violated in the process of
00:27:31.520 his arrest during the Freedom Convoy in 2022. Chabavizzi gained international notoriety when
00:27:37.920 a video of his arrest where he was held down by a group of police officers while another kicked him
00:27:43.040 as hard as he could repeatedly was seen around the world. Now Chaba is arguing that his charter
00:27:50.220 section 8 and charter section 9 rights the rights to not have an unreasonable search and seizure and
00:27:56.180 not be unduly unfairly unjustly arrested were violated specifically in the order of which his
00:28:02.780 documents and identification were received by police and also other information that may have
00:28:08.000 been over the line whether or not he was properly given his warning and his right to counsel and at
00:28:13.620 which point that happened whether it happened while he was searched after he was searched before
00:28:17.300 he was searched so in the morning we heard from ops detective constable shane farley i believe his
00:28:23.460 name was who spoke to some video evidence that was introduced and some pictures or mainly a facebook
00:28:28.700 profile belonging to Chaba and in the videos where the first one was Mr Chaba having an exchange with
00:28:34.940 the police where the police were basically informing him that there is an injunction
00:28:38.640 against honking asking him if he understands he said no and basically the female officer in the
00:28:43.460 video told him that if he continued to honk they have identified him now by his license plate and
00:28:48.200 that if that continues he'll be civilly arrested or something along that line and then at various
00:28:53.940 points different people in the video were interjecting someone in the background yelled
00:28:57.400 that famous phrase hold the line and someone else in the truck perhaps said it back but defense
00:29:04.020 counsel diane magas argued i think quite astutely that the videos posted on facebook don't
00:29:10.080 definitively say when the videos themselves were filmed and in fact officer farley had to testify
00:29:15.120 that the metadata was removed from the videos so there's no way he can actually guarantee on which
00:29:20.840 date those videos were posted however he argued or testified that there were lives on the channel
00:29:27.120 showing Mr. Vizzy, so it's reasonable to assume that at some point he had carrying control of the
00:29:31.800 channel, but theoretically it's possible he gave the password to others. Again, I think the defense
00:29:36.180 here is trying to raise doubt about who was actually posting these videos, whether it was
00:29:40.840 Mr. Vizzy himself or someone else. As well, Ms. Magus seems to have an issue with how the police
00:29:45.760 have his name at all, saying that the fact that they do have that information is a violation
00:29:49.800 of his rights because it came from an unjust, I think it was called, a seizure leading to arrest,
00:29:55.740 a very specific phrase that was used several times, and different case law that the defense
00:29:59.780 used to argue in favor of that position. There were at least two other videos that I can recall
00:30:05.280 off the top of my head, again introduced by Constable Farley. There was a video of a vest
00:30:11.160 in Mr. Chaba's vehicle, and at which point he pointed to it and he said, I've been asked by
00:30:15.640 police, I believe he said, why I have this vest, and it's because I'm an organ donor and I want to
00:30:21.000 protect my organs. And then there was another video, I believe it was a Fox News video,
00:30:26.080 where an anchor had been at the door of a truck where Mr. Vizzi was apparently inside and asked
00:30:31.360 him, is he going to leave? When is he going to leave? And Mr. Vizzi replied, I'm going to be
00:30:36.580 leaving just around the corner in August, at which point I will go down and get my favorite
00:30:40.920 effing pizza and I'll come right back. And then there was a short discussion between the anchor
00:30:46.280 and Mr. Vizzi about how Mr. Vizzi's intention is to make it clear that he's not going to
00:30:51.780 leave and he did that in a very humorous way.
00:30:54.920 There was a legal argument where the defense wanted to call another police witness, Detective
00:31:00.280 Anne Diehl, I think I'm saying that right, who was the person who took custody of Mr.
00:31:05.140 Vizzi on the day of his arrest from the HOT team where he was passed from the arresting
00:31:10.340 officer I believe to him to be processed and there was a lot of arguments about what happened
00:31:14.720 in that process and whether it was according to the rules you know honest to god and right
