00:21:55.580with one of the strongest vaccination mandates for travelers in the world. She admitted during
00:22:01.080cross-examination that she had never seen a recommendation from Health Canada or the Public
00:22:08.260Health Agency of Canada. I believe our buddy Keith Wilson was the lawyer who got this information
00:22:13.580out of them in court. Never seen a health recommendation from Health Canada or the
00:22:19.720Public Health Agency of Canada to the Ministry of Transport to implement a mandatory
00:22:25.120vaccination policy for travel. At the same time, Dr. Lisa Waddell, a senior epidemiologist and
00:22:31.780the knowledge synthesis team led at the Public Health Agency of Canada, admitted during a
00:22:37.760cross-examination that there was no recommendation from the Public Health Agency of Canada to impose
00:22:43.900vaccination requirements on travelers. In June of 2022, the government of Canada announced
00:22:49.860it would suspend the travel vaccine restrictions, but that it would not hesitate to reinstate the
00:22:56.120mandates if the government considered it necessary. So they never went away, as we all know.
00:23:02.420As a result, the federal government moved to have Premier Peckford's constitutional challenge
00:23:08.140struck for mootness. The Crown argued that travel restrictions were no longer a live issue because
00:23:14.220they had been lifted and should not therefore take up further court resources. The Crown brought
00:23:20.040this motion after each side had produced expert evidence, called on experts to testify under oath,
00:23:25.120cross-examined the other side's experts and witnesses daily for six weeks, conducted
00:23:30.460significant legal research, and prepared substantive written arguments. This was their plan the whole
00:23:35.400time to ask for dismissal based on mootness, and they got it. Lawyers for both sides spent
00:23:42.720hundreds of hours, placing all the evidence and legal arguments before the federal court for its
00:23:47.060consideration. The only remaining step in the trial process was the presentation of oral arguments
00:23:52.600scheduled for October 31st of 2022. The federal court was fully and properly equipped to render
00:23:59.300a thoughtful decision as to whether the travel restrictions had been a justified violation
00:24:03.720of charter freedoms. Even though the federal government can impose the same travel restrictions
00:24:10.320on Canadians again. Without notice, the federal court granted the Crown's motion on November 9th
00:24:17.360of last year and dismissed this charter challenge as moot. The federal court of appeal affirmed the
00:24:24.700lower court ruling on November 9th. Effectively, the courts determined that a constitutional
00:24:29.380challenge to the use of unprecedented emergency powers was neither sufficiently interesting to
00:24:35.420the Canadian public, nor an appropriate use of court resources, if you can actually believe that.
