00:02:44.820weird sort of revelatory moments where you've kind of uh you know uh been a part of almost
00:02:50.360living the moment envisioning it to the point of like of almost living it for for so long even
00:02:58.160well before uh you know the real challenge came down like before and i know i've mentioned this
00:03:03.540on winnipeg alternative media broadcast and i believe on yours as well too shadow that uh the
00:03:08.020impetus between you know uh myself patrick allard minister tobias dr jerry and sharon was to even
00:03:17.400before arrest warrants came out was to know that we were being challenged by the provincial
00:03:23.340government you could hear it in their press conferences you know the media was goading it
00:03:27.420continuously last year uh throughout last april and march and may march april and may i should
00:03:35.580say in consecutive order sorry um and um knowing that this was kind of you know uh coming up for
00:03:43.020uh and but this this was a different appearance this was kind of a surprise appearance today so
00:03:48.400maybe if you could take the people who were unfamiliar with the situation back to the
00:03:53.260beginning and and explain the notorious manitoba five and then and then tell us what you were
00:04:00.480planning to mount later on next month but kind of got stymied maybe a little bit today by the
00:04:05.620by the province of manitoba yeah you know absolutely and you know and and good call um
00:04:10.480So, again, like I was just saying, we kind of had the idea going back well over a year ago, again, before arrest warrants came out to try to push the government, to try to push the provincial government and their public health orders, meaning, you know, Manitoba public health alongside with it, which is, you know, sometimes I get, you know, confused about whether I should say it in that way because I don't want to confuse other people.

00:04:36.260Because, you know, people kind of think, you know, Rusin and Pallister, you know, have, you know, some sort of like difference between them and the bodies that they work for.
00:04:44.100And, of course, that's entirely not true.
00:04:48.480You know, call it public health, call it Manitoba justice, the people they, you know, hire to go send out tickets and everything else.
00:04:54.540But that's still that's just Manitoba government.
00:04:56.940So let's go straighten that out right from the get go.
00:04:59.020So we had the, you know, the idea, not the idea.
00:05:02.440Well, kind of the I'll just say idea to to push what we were doing to the ends of hoping that we would get a response from the government in the way that we started to.
00:05:16.160And once we started to go see that press conferences between, you know, the media and Roussin and Pallister and Roussin Pallister and the chief of police were being harbored in a way where the media and also then the general public, which was then goaded on by Pallister with his famous quote of, you know, if you float the public health orders anymore, you'll get your name mentioned on TV, which was a threat.
00:05:41.680It was it was it was a verifiable threat, meaning like, you know, we can't break the law.
00:05:46.480But if you push us into doing it, maybe we'll break the law for you.
00:05:50.140But it's not the law. It's the public health orders. It's the mandates.
00:05:53.860That's right. That's right. Yeah. But they got to be clear on that.
00:05:57.000But they were still kind of saying, we'll bend the law for public health order if enough of you kind of want us to do that.
00:06:04.220And that was sort of the that was their impetus right there to say, you know, we can't just go ahead.
00:06:09.200Because, you know, I'll always remember this.
00:06:11.060You know, there's so many moments that came from just over a year ago that will always stick with me for forever.
00:06:17.060That were really interesting little feathers in the cap where, you know, we would be sitting back laughing about how they would say anything and everything except for can't you just throw McDougall, Allard, Bohemia, and Thiessen just in jail?
00:06:34.660Like the media would be going to be goading on the police chief or even some of his others as well, too, for just, you know, again and again and again.
00:06:42.120Can't you just do it? Can't you just do it?
00:06:43.680And when we started to hear that, we knew we had got to where we had kind of sort of hoped to be, where we were we had pushed way past the line.
00:06:53.640And then it was a specific grudge match or specific battle between, you know, us and them.
00:07:00.480And then the arrest warrants came and that was to be expected.
00:07:04.120the arrest warrants then got handled in a way that we didn't expect we did now wait a minute
00:07:08.580these arrest warrants were based upon charges of what uh well just breach of public health order
00:07:15.320that's it uh you know uh and specifically and this was handled for the first time that we got
00:07:20.460to hear it spoken legal fashion today where it wasn't just that you breached public health order
00:07:25.280it was that you know say they mentioned it specifically about patrick well patrick has
00:07:29.680an affidavit saying this this and this but he breached public health order over 12 times
00:07:33.740so you know it's kind of like so how could he be surprised that eventually it became an arrest
00:07:39.800warrant well but so therefore there's the constitutional challenge because well whoever
00:07:43.700got arrested with anything to do with public health or doesn't matter how many times
00:07:47.080it's so new it's so fresh we still have the ground to go fight for well then you need to
00:07:53.120explain it legally because it's your job to do so not ours but how many times were each of you
00:07:57.760incarcerated and for how long um well uh what i was first mentioning you know when they mentioned
00:08:04.000this in court today was when they said you know charge they were talking about tickets which is
00:08:07.560really interesting because it's not actually a charge it's not like it's a criminal charge or
00:08:10.920anything like that it's just a ticket it's a fine yeah so when they actually mentioned the word
00:08:14.940charge that could actually be refuted right there interestingly enough because we were focused on
00:08:19.420many other things today that wording wasn't refuted today but of course if we were allowed
00:08:23.500to get to our five-day trial that was already booked for the end of august this year and i'll
00:08:27.640get to that in a moment because that really relays how interesting this whole proceeding
00:08:31.480actually is um and how rare it actually is then you know we would have had the better chance to
00:08:36.800go ahead and talk about you know why we why we feel that way um but yeah so no we were all arrested
00:08:43.060and spent at least one day some some of us a little more than 24 hours in in jail and then
00:08:48.940me and Patrick Allard were also arrested both on a breach for things that we're also throwing into
00:08:53.960different challenges because of course we believe our breaches uh that just the same of our as our
00:08:59.220initial arrests are um not just unconstitutional uh but um but also just egregious in the eyes of
00:09:08.180the law as far as you know the measures that we were taking and the measures that the government
00:09:13.260were taking at the exact same time there's multiple different points to refute that including
00:09:16.880all kinds of things to do with you know what was happening throughout the province and throughout
00:09:20.620the country at the same time as we were being punished that other people were not being punished
00:09:24.460for under the exact same eyes of the law and this kept being refuted back and forth today so okay so
00:09:30.840let me back up a second so today with all that all that being said yes so us five the manitoba five
00:09:37.720me sharon tobias patrick and dr jerry were all arrested uh at the end of last may uh we all
00:09:46.200spent at least 24 hours in jail me and patrick allard uh went in for breaches uh that are going
00:09:52.160to be refuted uh separately um but uh we were happy to have those first arrest warrants kind of
00:09:59.720be uh set on the docket because it gave us a chance to do one thing and one thing only and
00:10:04.780i'll start with this because i really and i'm going to keep touching on this because i want
00:10:08.000to let people know this i don't think we've said it enough and it might be even kind of our fault
00:10:11.660though we haven't said it enough over the last calendar year it wasn't about trying to get into
00:10:16.820the courts to get some big win it wasn't about going to the courts and you know uh beat them
00:10:22.300and then walk out popping champagne bottles and say we beat them we beat them we beat them
00:10:27.080you know that wasn't even before there was a rest war it's even before things got really
00:10:32.160personal and bad uh we already had conversations of knowing that the main perspective for us
00:10:40.800should be to just simply bring it into a court of law in any way that we can and if that included
00:10:46.680arrest warrants and i guess bail conditions i guess so be it again we didn't expect the bail
00:10:51.340conditions to be so personal and so harsh and now we've got the chance to include that on the
00:10:55.240constitutional challenge because you just told random people to not be friends anymore for 15
00:11:00.520months that's disgusting right unbelievable you know right so that's not that that is that is a
00:11:06.000part of it but it's not a major part of it that's just kind of you know obviously because of the
00:11:09.800reality of the situation that's just kind of thrown into the mix but the main perspective on
00:11:14.980that was to just simply bring all of what we were doing and the fact that we were being clearly
00:11:21.280clearly and this was well defined in court today even though we were just there for just one hour
00:11:26.560one hour a very very interesting and intriguing hour to say the least um was that we didn't care
00:11:36.460to go about this process as some sort of instant win and some sort of push for victory and some
00:11:41.640sort of push to be heroes no no no no it was to just simply have it in a court of law so that
00:11:48.820all conversation all debate and all points made from either side would be on the
00:11:53.580that's not something that's happening too extensively i guess right now especially in
00:12:00.720the case of people like us who pushed it so far and challenged you know continuously uh i know
00:12:06.420what's happening and there's been some big wins there was a big win in newfoundland recently there
00:12:10.240was a decent win in alberta recently there has been some very interesting push pushbacks in the
00:12:15.640same way that we're doing it and so therefore of course you know again we have also kind of in that
00:12:19.600way received some uh you know some veritas that were uh we're on the right path and uh and that
00:12:26.400path is just what i'm saying right now it was not to be heroes or instantly victorious or think that
00:12:32.120we were going to roll over uh this process in any way shape or form even with the jccf and the
00:12:38.340seven churches versus the manitoba government of last may uh which they now call in our case the
00:12:43.900gateway case uh gateway case because they're saying that that case is too similar to ours so
00:12:54.360therefore don't have a five-day trial period throw it out okay wait a minute wait a minute
00:12:59.300Yeah. Hold on. Oh, whoa, whoa, whoa, whoa. One second. When Todd gets up ahead of steam, sometimes you got to pull him back pretty hard. So I want to.

00:13:13.560And that is this court case today, this court appearance today was to to decide whether or not your constitutional challenge, which was scheduled for next month, will be heard or not.

00:13:50.160And we kind of have a good idea where that came from, but still, I still want proper FIPA on all of it.

00:15:00.140before it even gets its day in court which is extraordinarily rare in two ways one if you
00:15:07.620already booked the court date and the lawyers and both sides have already started to build their
00:15:12.120cases why do you change that randomly and in a very in as far as courts go a fairly small amount
00:15:19.340of time and we learned that in a harsh way today as well too because so many people are taking
00:15:24.340vacations including the judge that just now presided over our case is taking a break for
00:15:29.220the next several weeks which is some sort of other goofball system that i mean it's it's it's
00:15:35.780all it's all it becomes a bit of an interesting joke uh but it's still kind of working with us
00:15:40.520and i'll get to that in a moment um but the uh no the other one was to again like i was saying
00:15:48.920it was it was to just get this on record we just wanted this all this whole conversation to be
00:15:55.000on record. And there's so many interesting points that have come from that. And in just one hour in
00:16:02.040court today, it was amazing how the conversation quickly turned to one thing. And I want to make
00:16:08.540a strong point of saying this because I don't think it's been heard anywhere before. And this
00:16:14.040makes things that just happened in Manitoba today really intriguing, where the main conversation
00:16:20.560happening between the crown attorney and our lawyers ended up being about should section 15
00:16:27.840being discrimination apply to us because we are not a sort of like a specified group under the
00:16:36.160eyes of the law right you're not an identifiable group like that's right by skin color or religion
00:16:41.900or anything else by that's right yeah sex gender faith or i think the other one was um
00:16:50.240like disability right um and uh and because none of those apply to us even though of course still
00:16:59.580under the eyes of the law uh you know any sort of uh you know general concern or general protest
00:17:06.800against government is supposed to be adhered to because we don't have that working for us
00:17:12.480specifically because it's all new this ends up being a new conversation that it almost had to
00:17:18.420feel like that the judge that presided over the hearing today is now going to be the judge for
00:17:24.360the rest of the whole hearing we learned wait a minute like this is about discrimination now or
00:17:29.120was this just something that the conversation kind of led to well because we made multiple
00:17:33.340points in our case about how you know while we were getting punished and we were getting
00:17:37.580countlessly ticketed and then they you know the the uh the defense always makes the point of well
00:17:42.100these people got ticketed and you know and sort of broke the rules so many times that's what led to
00:17:46.880the arrests and so therefore you can't complain about it it's sort of like you know three strikes
00:17:50.680you're out kind of thing is what they were kind of trying to throw down but we still said yeah but
00:17:54.360you know none of that's none of that really really really adheres to law when you know the NDP is
00:18:00.700having rallies outside of uh Manitoba Hydro not wearing masks that's Wab Canoe and Nahanni Fontaine
00:18:07.020um you know you got 10,000 people right uh right whenever you want right when the first big
00:18:12.900restrictions and lockdowns happened back in 2020 out in front of the legislative building 10 000
00:18:16.900people for black lives matter you had every child matters movements happening you had multiple other
00:18:23.000churches of different faiths that were allowed to gather in cars while the church of god was
00:18:26.960blocked by rcmp vehicles all up and down the road so many different points that we had in place that
00:18:31.920were all spoken about in court today and it only equaled the conversation of basically okay so then
00:18:38.280how do you fit that into section 15 if it hasn't been defined for that group specifically yet
00:18:44.380and even though no answers or conclusions were made of that yet because we're still moving this
00:18:50.100forward and we're going to stick with everything we can and keep pushing it forward we'll appeal
00:18:53.720everything you know you know forever in a day uh again because the impetus here is not to just
00:19:00.280you know win and be champions and go we did it we did it we did it we beat them we beat them no no
00:19:04.520know it's just to keep there stay there be statues fight them uh you know hold hold steady
00:19:09.940in their process and then have every bit of their process pointed out on record so that we can just
00:19:14.880simply have it at all times to point to whether we win or lose it's all about getting all of this
00:19:19.600just simply on the record for future use yeah you want to i think that's all the precedent yes i
00:19:25.520think that's the most important thing it's not about instant victory or instant gratification
00:19:28.980it's about laying something down in history and doing the best that we can with every bit of
00:19:34.020energy and every bit of uh momentum that we can still have in a legal fashion uh to put this on
00:19:42.360the record and make a point for the future you know what's interesting is that uh you know whether
00:19:47.320or not this case gets heard you could now because of that conversation in court today regarding the
00:19:54.520discrimination you could now decide you want to make that a case instead of the constitutional
00:20:01.600challenge that you guys are mounting and hopefully you will get that but i mean every human rights
00:20:07.320commission across this country has said no you're not being discriminated against because you're not
00:20:11.840an identifiable group but today what happened was you started that conversation in court where it's
00:20:20.140all down now on paper the court reporter was writing all this down right now what was the
00:20:24.760judge's response uh through all of this like what did the judge say when you started talking about
00:20:30.860discrimination um there was no argument necessarily uh that's a very interesting
00:20:37.200question um and of course we would have loved to hear more on that and it was really kind of sad
00:20:41.620and shocking that uh after both sides uh doing what they could with just one hour the judge was
00:20:47.400only left with about like less than 10 minutes roughly five to seven minutes to kind of do her
00:20:52.040own thing we were happy to go see the judge that got presented to us because we thought it might be
00:20:56.220like joyal or a friend of joyal's but it's not uh we spoke to both lawyers that are standing with
00:21:01.240me uh us and allard afterwards as well too and they were both kind of surprised like no that
00:21:05.640wasn't because that lawyer is now if we get the five-day trial that's our that's that's our judge
00:21:10.560that's our judge like she's our judge throughout the rest of everything now which is good actually
00:21:15.080we're actually really happy with that and um no with the discrimination conversation as you know
00:21:22.060Is that a funny rhyme? No, she didn't really scoff at it. There didn't really seem to be a direct denial of that as a conversation or a good debate to have. She could just only end with at four o'clock today, I'm on holidays until August 16th.
00:21:40.020And then interestingly enough, she then stated, and this might be maybe a tip of the hat, saying, well, between August 16th and 22nd, there's not a lot of time left.
00:21:47.380So I'll have to come back earlier to make my original ruling on whether we continue forward, which is funny because if she knew she already didn't like anything, she would have gladly just came back on the 16th and said, OK, that's when I'm coming back.
00:21:57.720And so that's what you get, knowing that I'm just going to cancel you and screw the 22nd.

00:22:22.180conversation of discrimination uh it was not refuted it was just of course talked about like
00:22:28.700the same as everything that was basically what happened today was both sides discussed their
00:22:32.240points laid it all out the judge heard it asked a couple questions just to kind of straighten out
00:22:37.480a bit of minutiae and then said okay i now have a few weeks off i'm gonna have to go research all
00:22:43.960of this and because i don't want to make you wait too long let's schedule a time where i will come
00:22:48.660off my holidays for for a moment and you know move this forward and i mean we could have all0.66
00:22:56.560scoffed at that and laughed at it and said you know that's ridiculous and how dare you as well
00:23:00.100too and i'm sure a lot of us felt that way obviously just because it's you know it's an
00:23:03.480emotional roller coaster we've been going on for over a year here and so now it gets dragged out
00:23:08.000further but we kind of aren't surprised by that either so it's okay it's it's it's really it's
00:23:13.680and we know what's what's your impression what's your impression of why uh the crown would come
00:23:19.540forward now and say well you know what we don't need to hear this case because we've already heard
00:23:22.800this case well that's that's the really kind of pathetic part right there because you know never
00:23:26.740mind the uh the sort of uh attempt at comparing one versus another uh which obviously can be
00:23:34.600refuted and was refuted very very well today in court and i can't wait for it to be i mean this
00:23:39.420again there's so many reasons that we want to go see this get pushed forward to the proper five-day
00:23:43.840trial that we already had scheduled um is uh is that it was very very obvious that their attempt
00:23:51.680comparison was was was was just not accurate uh you know we're talking about churches saying well
00:23:58.140if walmart is open why can't i be why can't my people be in my church or if walmart is open why
00:24:04.180can't my people at least be in cars in their parking lot right when rcmp was blocking parking
00:24:08.540lots and weird stuff like that and so you know all of that laid in place uh you know already being
00:24:14.880done and and and said um after that it was it the comparison you know then becomes a couple other1.00
00:24:24.880things it becomes you know okay so yeah then i tried to say uh judge joyelle ruled over outdoor
00:24:30.140gatherings he didn't he didn't there was a really the the crown attorney kept trying to say that
00:24:34.860inside of uh the what they call the gateway case again jccf and the seven churches uh you know
00:24:41.380ruled on outdoor gatherings they absolutely did not it was not a major part of that case at all
00:24:45.440because the churches weren't arguing that they were talking about people going into the church
00:24:48.220or people being able to sit in their cars in the parking lot well that that case was heard over a
00:24:52.300year ago by the way and yes i know that joel didn't come up with his with his decision until
00:24:56.880sometime in november i think last year but a lot has changed since then and and you know something
00:25:01.620else yes i mean you you could definitely use the canadian bill of rights it's not in the charter
00:25:08.340it's not in the constitution but it's the bill of rights then it's enshrined in law in canada
00:25:12.660that uh absolutely allows for gatherings public gatherings and freedom of movement
00:25:18.320and i believe that's what was just one in newfoundland recently right or newfoundland
00:25:22.460it was it was new brunswick where the where these uh yeah two people were ticketed i think
00:25:28.080with the same amount of money as we've been ticketed 1296 dollars that's right and it was
00:25:34.240basically it was kind of like the language right no public gatherings well we're gathering to
00:25:41.820protest this is what we're doing we're gathering this is not a public gathering here in manitoba
00:25:46.820yeah and so here in manitoba like the judge the judge in in new brunswick said well in that case
00:25:53.160if you're getting together to protest that is absolutely your right to do so and they won that
00:25:58.100case which sets down another precedent right so they want to say two things to us one you pushed
00:26:03.760us too far so we deserve to arrest you that was basically said in court today you know these are
00:26:08.500not just people who just flouted it once or twice they did it so it's persecution and they actually
00:26:12.940admitted to persecution today a little bit a little bit yes yes which is a good point to make
00:26:18.400and you know and again if we really get our proper this is the unbelievable thing you've already
00:26:23.880scheduled the five days you've scheduled the five days you know that us and our lawyers are building
00:26:28.760a case today we had the references called for expert witnesses and the judge agreed that if
00:26:33.960we get our five days in court we get our expert witnesses we get kettner we get uh um a few a few
00:26:41.640others as well too chris schaefer the mask uh the guy from edmonton who like this the public or the
00:26:46.960there's a few of them there's a few of them that we have on call and it was all agreed upon uh from
00:26:51.560the judge today that you know um if we get expert witnesses and hey that's all good so again another
00:26:58.640interesting tip of the hat that we haven't necessarily lost this all yet that kind of
00:27:01.840happened interestingly enough throughout the day or throughout the hour i should say um but uh
00:27:08.420yeah no still it ended up coming back to this conversation of prove that these are
00:27:16.320a political dissident or something you know political protests of a certain elk a certain
00:27:22.980elk that you know that makes sense under the eyes of the law and so of course that was refuted with
00:27:27.940going like well everything that's happened around the entire world to do with the last
00:27:33.260come on refutes all different forms of
00:27:48.940business shutdowns of schools whatever you might want to go talk about this is clearly just the
00:27:54.760same as say you know multiple people or of all different kinds of walks of life could have
00:27:59.400different views on all kinds of other social issues and intricacies might come at it from
00:28:06.380a different challenge but if it's because they're refuting what the government had specifically said
00:28:10.740they have the right to do so and so of course then you know it became this kind of like interesting
00:28:16.340debate about semantics and i'm really happy to push that forward and all we could do me and
00:28:22.300mallard you know spoke uh spent a little bit of time just right outside the court uh building
00:28:26.700right afterwards you know at around at around three o'clock uh this afternoon kind of just
00:28:32.080discussing how this is kind of a hidden gem we were just of course thinking well we just want
00:28:39.160this entire conversation about hey the right to protest the right to protest outside in a field
00:28:44.880you know where people are just you know standing amongst wherever you know just being at a location
00:28:50.920to say we oppose what's happening to our society right now we believe that's enshrined entirely
00:28:57.300throughout the bill of rights and the constitution and all legalities in this country and we're going
00:29:02.140to challenge that to the ends of the earth and then it became a conversation of well we're not
00:29:06.060saying that you can't say that but what gives you the right to say it because what group do you
00:29:10.900belong to and now that's beautiful that's actually really beautiful that then that
00:29:17.140that gives us the chance to go define that yeah and so it adds a whole other interesting realm
00:29:25.380to what we've already wanted to push forward and say so so now with that added into the mix
00:29:32.160it's so important that we win this and get the right ruling on the 2nd of august because
00:29:38.960well let's put it this way and our you know and our lawyer did a great job at proving this very
00:29:43.980very well and i could watch the judge kind of scratching her head going yeah you know that's
00:29:47.920hard to refute that with just saying of course the most simplistic thing of law who cares about
00:29:53.040section 15 who cares about any constitutional section all people equal under the eyes of the
00:29:58.800law and if you've already done the job as the courts as the legal system of this province to

00:31:52.400to kind of close up and um and it was just really kind of sad that we didn't get the close up or
00:31:58.740any kind of sort of conclusion today that we would have been looking for but maybe not so sad again

00:32:10.980to get a read from the judge what i could say from speaking to our lawyers afterwards was they

00:35:54.720the shopping mall is open, why aren't we the churches? That's it. That's it. That was, again,
00:36:00.460properly refuted and well mentioned to the judge today. And that'll be up to her to, you know,
00:36:06.020I guess mull that over I guess it's kind of interesting and kind of funny that she probably
00:36:12.260left work today kind of going like ah crap I'll have to do a whole bunch of work on my holidays
