00:08:28.560 those in the audience who aren't familiar with you sure i'd be happy to shadow and thank you
00:08:33.820 very much and i did not get the memo that today was a holiday i was just working like it was a
00:08:39.040 normal day yeah i did not get that memo so i'm not very good with the calendar uh however thank
00:08:46.300 you for having me on yeah my name is Jason Levine and I am running as an independent politician I
00:08:51.040 wasn't born and bred to be one of those I was a computer guy for the first 40 years of my life
00:08:57.520 and then I went back to law school no I went back to I went to law school to go ahead and get myself
00:09:03.400 a law degree because of a whole bunch of things with law I was very confused of you know the how
00:09:08.780 to work with it sometimes I had people come out of the woodwork when I was running a business so
00:09:13.560 employment law and administrative law and other things I had to get familiar with and I decided
00:09:18.360 to go to law school and take the opportunity to get a degree in Ontario as a paralegal
00:09:22.980 the gummies and then I moved out to Alberta during the height of the COVID lockdowns because I was
00:09:30.560 not pleased with the Ontario government and looked for a better opportunity out west found

00:09:43.160 went and did his emergencies act and he went and took his boots to our fellow canadians

00:10:34.980 the beginning. At the beginning, I was more naive. I absolutely wanted it to be real. I thought we
00:10:41.680 were watching the unfolding of an inquiry that would bring truth to us. When I was there and I
00:10:49.200 actually saw Trudeau and I listened to the testimony and saw how it worked, I was pretty
00:10:54.040 heartbroken by the end. I did not have the same feelings at the beginning because we did cover it
00:10:59.840 all and we covered things like how is he lying and then that one's lying and nobody says anything
00:11:05.000 or why are they hiding documents and and we don't we seem to really get them out i was pretty
00:11:10.780 frustrated for brendan miller and his team who were working really hard to uncover some redacted
00:11:15.800 documents and some really important information and also trying to bring forward some witnesses
00:11:20.580 it was so heartbreaking and and i felt a little jaded by the time we were done the poec and this
00:11:27.700 is before the report even came out I was feeling that way you were there watching it in person
00:11:33.200 yeah the last two days I was there watching Freeland and Trudeau himself what was it like
00:11:39.320 when Trudeau walked into the room late of course fashionably like just enough for the showmanship

00:11:50.080 as I can be I was impressed to see him in person he is our leader I may not like him I didn't vote
00:11:57.220 for him but there's standing our leader and he did come in late he did a little thing where he
00:12:02.480 looked around tribial coy and then kind of sat down but i did i did have the hope maybe i guess
00:12:09.760 too naive at the time that this would help turn things maybe he would tell us why he did what he
00:12:15.380 did and it would make sense but when he made that comment about i didn't call anybody names
00:12:20.900 the entire room the air let out there was no chance that we were going to see any justice

00:12:33.000 later is how i was taking my notes because i knew we weren't going to be doing much here anymore i
00:12:37.580 knew this was a kangaroo inquiry at this point so i was just taking notes getting ready for
00:12:42.720 hopefully we could address some of these lies later you know i did talk about that uh that
00:12:47.940 moment that you just referred to when he said i didn't call any unvaccinated people names

00:12:59.480 i was streaming the thing and i couldn't believe it and we heard an actual audible gasp come from
00:13:07.180 the people in attendance what was it like in that moment you said the air came out of the room but
00:13:11.720 were you watching trudeau's face the entire time oh he was smug okay so the left side of the room
00:13:18.420 is where more of his supporters were and that's where i put myself i put myself right in the
00:13:22.800 middle of the lion's den. In fact, I was sitting right next to somebody who's known as the biggest
00:13:27.760 counter protester there is. She has a name. She's been fighting lots of people. But I sat right
00:13:33.240 beside her during that moment, her and her daughter. The other side of the room was more of
00:13:38.460 the freedom supporters. It was pretty obvious that the rooms were kind of split up. But the
00:13:44.040 left side where I was was a mixed group. It wasn't completely just his supporters.
00:13:48.520 but the right side was definitely not his supporters um when he made that comment
00:13:54.260 giggles all around me gasps on the other side audible gasps and a lot of what and under the
00:14:02.000 breath because we've been chastised a few times about being noisy but that that group did do what
00:14:08.900 canada wanted to do which was to let him know we were not impressed with that answer but he was
00:14:14.520 looking at the side that i was on i think he was looking at the little girl that was sitting beside
00:14:18.460 me in fact because his eyes were near there and he had a smug look he just had a smug look like
00:14:22.900 yeah that's me what was the uh what was the interplay like between those people the people
00:14:30.440 that you put yourself in uh and and the other side the freedom people was was there any at all
00:14:36.280 no no it was very cordial very nice i even interviewed that lady later on um i spoke to
00:14:42.820 a whole bunch of people there because again i'm trying to get the whole story which means you
00:14:46.500 speak to everybody but no there was no cheering or jeering between the groups there was nothing
00:14:51.440 like that uh everybody seemed to be on their best behavior and there to be allowed to stay i think
00:14:56.980 it was the behavior that people were in because the room was packed and if you had to go to the
00:15:01.120 washroom your seat was gone there was somebody waiting to come in and take it so that day
00:15:06.340 everybody was absolutely in their best behavior but i never did see even uh outside in the in the
00:15:11.720 halls or anything i did not see anybody cheering or jeering each other or making comments about
00:15:16.600 masks or anything like that it was well-behaved canadians which was probably a lot similar to
00:15:21.300 the actual convoy itself uh same type of behavior of the people uh no there was no problems nobody
00:15:27.020 got kicked out or removed or anything like that you know it's interesting when we talk about
00:15:30.720 justin trudeau is the way you did anyway he's the leader of our country he's elected the leader of
00:15:35.660 our country I would not call him that but my only real exposure to anybody in that situation was
00:15:42.460 meeting Brian Mulrooney in the 1980s and I remember I was working in radio at the time and I remember
00:15:47.780 when he came into the building he had CSIS agents all around but when he walked into the room it was
00:15:55.820 like he was this larger than life presence and maybe it's because you know we see these guys on
00:16:01.240 TV all the time they're always talking to reporters they're you see him standing up in the
00:16:05.300 house of commons you know they are the prime minister and so you know you have reverence for
00:16:11.480 that and i was actually impressed as you just pointed out but i'm not so sure like my opinion
00:16:16.600 of of justin trudeau would be like that given all of this crap that he's pulled off since he's been
00:16:23.020 the prime minister for eight years but was there that vibe that that presence in the room yeah
00:16:28.760 yeah yeah yeah and there was no cheers or hate or even comments when he walked in i think there was
00:16:34.680 admiration on one side and reluctant respect on the other side. Nobody was willing to be the one
00:16:41.100 that threw a bad word or say something or show disrespect, whether it was reluctant because they
00:16:46.320 were worried about being kicked out or it just wasn't something they're prepared to do. But there
00:16:51.020 was a reluctant respect, I would say, on one side of that room. And then the other side, it was
00:16:55.160 admiration. They were very happy to see him. Interestingly, we've seen a lot of protests
00:16:59.340 and a lot of flags regarding Justin Trudeau in this past year or so. Whenever he makes an
00:17:03.960 appearance in any canadian city or town he's met with a entourage of people yelling at him in one
00:17:09.140 case we had a couple of years ago people throwing gravel and sand at him and you know i don't think
00:17:13.940 i've ever seen that with a canadian prime minister have you ever no no like the last absolutely last
00:17:19.820 year or so it's really deteriorated and they're not even trying to stop the crowd anymore and it
00:17:24.000 doesn't even seem like the press is even trying to stop the information it seems like he's not
00:17:28.700 protected when it comes to the public image anymore i think people were just as frustrated
00:17:33.000 but we get to hear it more and and it's coming out more and there's more recordings of it
00:17:37.640 i still think he was disliked even back then yeah okay let's get to your coverage of the uh the
00:17:43.800 coots political prisoners which is what we have been calling them and should be calling them
00:17:48.180 because that yes that's what i believe they are uh there is no real precedence for these guys to
00:17:53.760 still be in lockup after what 440 days is that right you're correct it's 540 days you're correct
00:17:59.200 I'm sorry, 540 days, and we have had Granny Margaret McKay on the show a couple of times.
00:18:06.120 She gives us an insight as to how they're doing physically, spiritually, and mentally,
00:18:10.980 and how their family members are doing, but when it comes to the actual process of the court,
00:18:16.600 you have been following this case since the early days, correct?
00:18:21.220 Well, what I did is I got involved late, so in June, but I did sit down with people who did sit there,
00:18:26.760 uh grant granny mckay or margaret mckay is certainly one of them uh she has a friend
00:18:32.260 that i met as well her name is danielle i actually don't know her last name but we know her as
00:18:36.840 danielle and she took wonderful notes every single day she wrote things down that she didn't even
00:18:42.260 understand what it meant but she heard it so she wrote it down so as a legal person as i'm reading
00:18:46.720 this there's some phonetically spelt stuff and i'm like oh she knows what that word is well she
00:18:50.860 doesn't know what the word is because she can't spell it but she got it phonetically so i know
00:18:54.420 what she means um it was incredible to sit down with both of them and go through a lot of the
00:18:59.660 details and then later some of the family members as well i got to sit and get some of the details
00:19:04.320 from them as well i did spend every minute of the last week there though so the last week where it
00:19:09.800 was the 24th to the 28th i was there every single day every single minute uh and covering every
00:19:15.520 single part of that and i think we caught some of the more important pieces of this uh matter
00:19:20.600 during that week because there was three major things that happened yeah you know i commend you
00:19:25.080 for you know getting in on this late but then actually getting all the information required
00:19:29.920 to give yourself the uh you know the perspective of what's happened since the beginning so you can
00:19:36.180 actually make sense of what's going on now can you give us uh knowing that you have done that
00:19:40.920 summary because there's people that don't know they know exactly what the situation is for those
00:19:46.500 guys now but they don't know exactly what the genesis of this was of course we all know about
00:19:52.260 the blockade but you know can you give us some background as to what exactly happened possibly
00:19:58.220 in a timeline style or you know the best you can do with it from beginning until now where we
00:20:04.860 where we have come well let me give you the summary of the last day which was the officer
00:20:11.300 of rcmp staff sergeant who was responsible for the silver level command so they have gold silver
00:20:17.960 bronze so he was in the middle there and he gave us a lot of the information the timeline of that
00:20:22.240 evening of the week or so so let me just start with that around uh february 9th so february 9th
00:20:29.620 they started to receive information that there was a possible cachet of guns or some sort of
00:20:34.940 issue around a church so we heard on friday that there was a church involved in the local area
00:20:42.740 fort mcleod that the police were concerned about that may have had what they called extremist
00:20:48.780 elements in there by the way these are all the allegations of the police and the crown at the
00:20:54.020 time i am not making the allegations myself the because it's important because uh it turns out
00:21:00.640 later, these are allegations that were not proven. So this church apparently had these guns and it's
00:21:06.600 on the 9th or so, and they're worried about it. On the 10th, they're starting to look at
00:21:10.800 arresting people and trying to find guns and they're working the crowd. They're trying to
00:21:15.840 decide are they going to arrest the leadership, which is a four person group, or are they going
00:21:20.800 to arrest what they call the security detail, which was a larger group, which included the
00:21:25.300 four men's inevitably included the four men on february 11th they were trying to get permission
00:21:31.680 to get a warrants so at this point they were issuing warrants under emergency under immediate
00:21:38.420 need and turns out they had these warrants for four days so there's nothing much immediate about
00:21:43.480 them on the 12th they're starting to look for guns around the situation so they're now searching
00:21:48.260 semi-trucks to find guns they still don't have a cachet guns and their intelligence isn't getting
00:21:53.820 very good. Somewhere around this time is when an informant or two informants were put into the
00:22:00.480 crowd who went and buddied up with some people. I got to let you know, these informants did not
00:22:05.880 have any recording devices. There's no wires. There's no recordings of any of the encounters
00:22:10.480 that these informants had. Actually, I want to be careful of that. They're not informants.
00:22:14.260 They're undercover officers. So they're actually employed by, whereas informants could be just via
00:22:19.220 a civilian uh they're undercover officers on the 13th according to the testimony is when they
00:22:26.280 decided to start to execute and go find the guns they haven't located the guns with the church
00:22:32.100 they haven't located the guns in the semi trucks that they were searching but they had information
00:22:36.720 from these undercover officers that there may be guns the information i'm going to interrupt you
00:22:41.860 for one second did they have or need warrants to get into all the places that they wanted to look
00:22:47.440 okay well i don't know about the semi trucks it wasn't talked about whether or not there were
00:22:52.920 warrants about those semi trucks what did come out is the warrant that was eventually used on
00:22:58.080 the residence that has a house which they call a mobile at times and then two trailers two hunting
00:23:03.880 trailers so these are alberta hunting trailers so there was a warrant issued for those that location
00:23:10.080 on the 13th just prior to that though the decision was made to go and start arresting people at
00:23:17.220 nine o'clock 9 p.m on the 13th uh chris lisik was streaming uh he was streaming the police officers
00:23:25.780 the comment he made was that's a nice gun i wish i had one this was his way of being jealous of it
00:23:35.880 maybe liking it the police reported that he said that's a nice gun i want to take one which they
00:23:44.200 then said is uttering a threat and they arrested him on the spot for uttering a threat now for
00:23:49.900 unfortunately for the crown we do have the recording he didn't say that but the police
00:23:54.160 officer in the charging documents that's the that's what they said they he said so they arrested him
00:24:00.240 on um uh on that charge right there the uttering a threat but that's a lie he never said that and
00:24:08.580 even if he did say it he he was joking obviously not even joking like it's clear that he was
00:24:15.740 envious that i would be the word i would use he was envious but he certainly wasn't uh possessive
00:24:21.900 he wasn't trying to acquire it which would be the criminal charge you're trying to acquire it
00:24:26.640 he was uh i would say absolutely jealous if anything else um but he never made a move towards
00:24:33.640 them he didn't do anything like that they just arrested him and again there is a recording of
00:24:37.700 this um that 9 50 so about 50 minutes later tony olenik was also streaming he was recording and he
00:24:47.280 was recording the police officers around him and i guess he noticed that they were kind of coming in
00:24:51.620 and he's talking about hey i wish you guys would just put your guns down and have a coffee and
00:24:56.020 let's just hang out and do all this kind of stuff little did he know he was recording his arresters
00:25:01.240 because as soon as that thing ended he uploaded it and they arrested him they arrested him for
00:25:06.860 mischief uh then now this is the 13th of february at 12 30 in the morning on the 14th this is when
00:25:14.620 they went to go get chris carbert so i want to emphasize something at this point chris lysic
00:25:20.740 is arrested at nine o'clock tony olenik heard about it didn't run didn't go collect the guns
00:25:27.680 didn't go tell an entire organization what's going on with chris lysic or anything like that
00:25:32.260 He just kept doing his thing, which was participating and being at the event.
00:25:37.020 And also, I want your viewers to know, none of these people had guns on them, only the police officers.
00:25:41.800 So none of the weapons or firearms that we see later was acquired during these arrests.
00:25:48.020 At 1230 in the morning, Chris Carbert, who also heard that Chris Lysak was arrested at nine o'clock, also heard about Tony being arrested just before 10 o'clock.

00:25:59.380 He went to sleep because he wasn't feeling well.
00:26:01.620 so he was sleeping in the trailer which is a hunting trailer if you're in southern alberta
00:26:06.820 or even southern prairies hunting trailers are fifth wheels they have the equipment in it you
00:26:12.600 can do stuff it's for hunting you'll eat you'll have your what your your firearms and that kind
00:26:17.120 of stuff in it he was sleeping in a hunting trailer they surrounded him come out with your
00:26:22.660 hands up that whole thing he comes out peacefully 12 30 he's arrested now they find some uh firearms
00:26:31.600 in in his trailer and they find firearms other places and then bring them together this ends
00:26:37.600 up being what they call the cache um we don't know whose weapons are who we don't know which
00:26:42.720 people own what that's not disclosed yet in the disclosure but we do know that there was 15
00:26:47.980 weapons put on that table but only six of them were found in in one of the trailers that had
00:26:54.480 one of the men in it we don't know about the other trailers and and the other uh firearms
00:27:00.040 Now, Jason, this is where I'm sorry to to interrupt you, but this this is where people are speculating that there was a plant that happened by the RCMP.

00:27:13.580 So there's rumor about Joanna Pearson, I believe her name is, who recorded a five hour recording, who claimed at one point that this was proof of planting of weapons.
00:27:25.220 She has since recanted that. So I'm glad you gave me the opportunity to bring this up.

00:27:32.520 And really, if you listen to the recording, it does not show or say or imply a planting.

00:27:51.180 I think the evidence does show that the multiple weapons from multiple locations were brought to one spot.

00:28:08.820 firearms they're legal hunting firearms and there's no real reason to create a concern around
00:28:15.180 planting um so we've looked at this pretty closely and we don't believe that that's what happened
00:28:20.100 nor do we think it changes the guilt or innocence of the men we're all 15 of the weapons
00:28:26.420 registered as far as we know yes but we're not getting those details so they're not releasing
00:28:34.720 registered to who we do know they're not they don't belong to the men so immediately during
00:28:41.280 one of the interviews uh with chris carbert when he was showing that picture immediately he said
00:28:46.260 those aren't ours that's not mine i don't know where those came from so from that statement from
00:28:51.120 chris carbert and others uh we don't know whose or whose or what or what we do not have a list of
00:28:56.840 registered owners but they're not being charged with illegal ownership they're being charged with
00:29:01.220 other stuff um so as far as i know there are no hell related license uh charges they're just
00:29:09.160 having a armed one with uh with the fire with um that was armed i think that was one of the charges

00:29:24.460 more about it but please continue with the story before i so rudely interrupt it uh when you flash
00:29:30.140 forward you've covered three of the four guys and i think you were getting to number four
00:29:33.920 so here's where it gets complicated because the timeline is fuzzy so just before noon
00:29:42.000 approximately the rcmp came out and made a statement that they rounded up and arrested
00:29:47.540 multiple people they didn't say four people and they didn't give any names but they said multiple
00:29:52.220 people in a cachet of guns they announced this at about 11 o'clock uh mountain standard time

00:31:49.300 the EA has been invoked. So I think the timeline is important here because the police even came out

00:31:59.240 firearms but even one of the gentlemen wasn't arrested yet and none of them were charged with

00:41:39.520 hundreds of guns and thousands of ammunition. We ended up with 15 weapons or firearms and
00:41:47.920 handful of ammunition. So whether it was intelligence or whether it was embellishment
00:41:52.800 or whether it was just hyperbolic or scripted, even the testimonies and the information that
00:41:59.440 did come out of the undercover officers doesn't even match the reality of the situation that
00:42:03.400 happened. Not a single person was arrested and charged with being a leader of this group,
00:42:08.360 being a part of this group, or an accomplice of this group. So if the intelligence was correct
00:42:13.040 from the RCMP when they were given a press conference,

00:57:23.000 an application for disclosure is it is quite literally the defendant getting on his knees

00:57:41.740 disclosure should be full and complete every single time the crown should be providing all
00:57:46.780 disclosure but unfortunately with our system that's not quite how it works they will provide
00:57:52.380 the disclosure they want to give you and then it's up to you to discover more well the defense
00:57:58.040 did discover some missing scribe notes and some information that wasn't in there so they provide
00:58:03.920 an application for disclosure for these notes the judge wasn't impressed with the crown usually
00:58:09.680 they're not because they shouldn't be this way it should be let's get to trial let's go as fast as
00:58:13.640 we can give them everything so the judge is forcefully saying you need to produce this like
00:58:19.240 now the crown in a haste provided another dump of documents to the defense unfortunately for the
00:58:27.800 crown stephen johnston uh there was a document in there that he intended to redact and did not
00:58:33.120 intend to give without redaction he wanted to protect it under client solicitor privilege which
00:58:38.280 wouldn't normally have worked it would have normally worked it would have been redacted
00:58:42.700 and it would have been put under client solicitor privilege but in a haste where they're unprepared
00:58:48.900 some some speculate a leak but this one particular document with four lines in it was passed to the
00:58:56.020 defense the defense discovered it and immediately knew the value in it immediately knew the value
00:59:01.700 in it they contacted the law society of alberta they go through a procedure with the law is this
00:59:08.000 is the sealed document that we're talking about well it leads to the sealed document this is how
00:59:12.880 we get to the sealed document okay so they find this document that has information on it uh they're
00:59:19.040 not sure if it's client solicitor privilege or not and whenever a lawyer is finds himself in
00:59:23.800 this situation where there's an inadvertent disclosure and it could be privilege there's
00:59:28.660 a procedure through the law society of alberta so you contact the law society of alberta you tell
00:59:33.880 them what you think you got you don't show them but you tell them what you think you got it might
00:59:37.780 privilege, it's very sensitive, and it's very important information. This is the procedure
00:59:43.480 they went through with the Law Society, and the Crown did admit in court that the defense did
00:59:48.480 everything proper when it came to doing this particular procedure. This procedure creates
00:59:53.140 a sealed envelope. All other copies are destroyed, digital and otherwise. You have to attest to that
01:00:00.380 as the lawyers who saw it. This envelope goes to the Crown and to the court, and then the discussion
01:00:07.560 of the application that's filed with the defense
01:00:10.840 is to whether or not the court will pierce the veil
01:00:13.960 and open that envelope and take a look at it.
01:00:17.320 So that's what we had set up before we got there.
01:00:20.920 This envelope was with the court, was not opened up,
01:00:24.040 and Tuesday was the beginning of the arguments
01:00:26.680 for the defense and the Crown
01:00:28.780 on whether or not the piercing of the veil should happen.
01:00:32.420 So that's what we got to see on Tuesday, Wednesday, and Thursday
01:00:36.340 were the arguments from both sides.

01:01:12.440 and even the men haven't seen it yet.
01:01:14.100 And the men don't know the contents,
01:01:15.780 but there's a lot of speculation.
01:01:17.580 I know that there are a lot of orders
01:01:22.160 not to talk about certain things in relation to this case.
01:01:29.160 But have you heard what might be in that envelope?
01:01:33.640 And if so, are you able to talk about it?
01:01:36.780 No, I have not heard what's in it.
01:01:38.740 And what I can talk about is what's said in the court.
01:01:41.260 So let me clarify to you what the publication bans are.
01:01:44.300 So there was one initial publication ban put in place by the defense
01:01:47.740 around these documents called Information to Obtain, ITOs.
01:01:52.480 There's something like 10 of these ITOs.
01:01:54.580 Again, I haven't seen them because they're part of a publication ban.
01:01:57.780 But those contain the narrative that the Crown put together
01:02:01.400 in order to scare the public about what's going on.
01:02:04.740 So the defense requested and received a publication ban
01:02:08.800 on the contents of some of the ITOs.
01:02:12.120 Nothing else was put under a publication ban.
01:02:14.020 So you could go there for all other stuff other than the ITOs
01:02:18.500 and you could report on it.
01:02:20.420 Unfortunately, I think for a Canadian democracy,
01:02:23.540 the entire media apparatus in Canada, mainstream and alternate,
01:02:28.120 claimed it was a government media ban
01:02:30.940 and that's why none of them were reporting on it unfortunately or fortunately depending how
01:02:36.980 you look at this alt media was there on monday and tuesday live treat live tweeting just one
01:02:42.940 member of alt media live tweeting the entire days so all day monday all day tuesday that established
01:02:49.720 the precedence that media can be there there was no publication ban because that person was
01:02:54.940 absolutely legally allowed to do what they were doing nobody stopped them and he didn't get in
01:02:59.260 trouble. That could have been happening the entire 540 days. It happened for two days. It could have
01:03:05.360 been happening the entire time. So one of the first things I did when I got involved in this
01:03:09.240 case is I broke the story that this publication ban is not a media ban. It's not a government
01:03:15.280 issued one. It's a defense issued one on certain items called the ITOs. But the entire proceedings
01:03:22.380 after that were allowed to be, media was allowed to be there to report on it. So we're disappointed
01:03:28.140 about that part of the media ban or the publication ban.
01:03:32.380 There's a second publication ban that got put in place
01:03:34.680 on the Thursday from the Crown.
01:03:37.500 They were able to get it in,
01:03:39.420 even though I was allowed to stand up and speak
01:03:41.500 on behalf of citizen journalists and independent journalists
01:03:44.220 because nobody else was there.
01:03:45.920 There was no accredited media.
01:03:47.120 There was no mainstream media.
01:03:48.180 There was no alt media.
01:03:49.680 But I did oppose the Crown's application for a publication ban
01:03:53.560 based on the grounds that we're the public.
01:03:56.460 We have a right to know.
01:03:57.400 So the judge did allow me to go up there, give my opposition to the court on that particular item.
01:04:04.500 Unfortunately, the Crown was successful in getting that publication ban.
01:04:08.280 That one is on the contents of the secret envelope.
01:04:11.980 So whatever it says, we're not allowed to talk about it.
01:04:14.980 And then the decision of the piercing, we won't be able to talk about it when the decision comes out.
01:04:21.640 The only caveat I'm going to put on there is this is a temporary publication ban.
01:04:25.700 The judge was clear about that.
01:04:27.400 which means it's not sealed.
01:04:29.900 So I could actually physically go take a look at it
01:04:32.400 when the time is right and see it,
01:04:34.420 but I won't be able to talk about it.
01:04:36.740 And it's a temporary publication ban,
01:04:38.620 so the judge can lift it at any point.
01:04:41.240 So if it turns out that maybe the defense is right,
01:04:44.800 I think the judge will do the right thing
01:04:46.300 and release that publication ban, and we can talk about it.
01:04:49.260 Interestingly, the judge has not seen this document.
01:04:53.640 I'm sure if he had seen it,
01:04:55.200 his decision may have been a little bit different um do you do you think it might be enough to
01:05:01.180 declare mistrial and let these guys walk the defense believes so so the defense are using
01:05:07.600 terms like misconduct gross misconduct and the and the most important term is crime fraud
01:05:14.040 so crime fraud is a specific thing it's not two words brought together crime fraud is a specific
01:05:19.660 thing under the law and the only people that can do crime fraud are lawyers it's when a lawyer
01:05:25.360 through legal advice gives advice for the commission of a crime that's called crime
01:05:32.360 fraud and that is the exception to the client solicitor privilege so if the information is
01:05:39.440 legal advice to commit a crime you get to pierce the veil you get to look at it and it becomes
01:05:45.980 regular evidence at that point there is no protection for it so we're discussing then
01:05:50.300 the possibilities of rcmp officers involved in this situation to go to lawyers asking can we
01:05:57.820 do this and the lawyer saying absolutely of course you can that's within the boundaries of the law
01:06:02.400 they go ahead and do it and it turns out no that this is in fact a crime which creates the gross
01:06:08.880 misconduct situation am i correct and wrongful imprisonment okay so so when this document does
01:06:16.100 come out and again i mean the trial is not even scheduled to begin until may of next year right
01:06:21.460 i believe it's may 27 2024 so um even if all of this information does come out i mean what chance
01:06:32.060 that they have there is no trial yet correct but they can still come out so here's what the
01:06:38.220 defense wanted they wanted the envelope opened immediately they believe that it is going to
01:06:44.260 end the case this was talked about during the arguments one of the standards is if the information
01:06:49.720 is so bad that it will end the case you can pierce the veil um and that's there's many different ways
01:06:56.780 that the piercing of the veil could happen according to the defense because of how bad this
01:07:00.740 is crime fraud they brought up a lot of good arguments i gotta tell you though shadow what
01:07:06.180 was discovered on thursday with the judge and everybody else this is brand new case law so this
01:07:11.920 decision he's making is case law there is no precedence for this it's never happened before
01:07:17.280 where the crown provided information to the defense it's called crime fraud it has to go
01:07:21.940 into an envelope piercing of the veil has to happen this has never happened before in canadian
01:07:26.300 law so they were using civil case law to talk about opening it they were using some loosely
01:07:31.360 connected criminal case law but there was no case law so the judge did make the comment he needs to
01:07:37.700 take his time on this because he has to actually make a decision that will have precedence going
01:07:44.160 forward right and generally speaking and this is a very rare situation for a judge i would suspect
01:07:51.460 that a judge may have one decision like this in his or her entire career usually there is a precedent
01:07:57.960 of some kind because a lot has happened before yeah and that's normally how court cases go is
01:08:04.300 you're persuading the judge to follow the law the current law the case law the common law statute
01:08:10.080 law your job mostly as a defense or prosecution is to take the judge down the law and just show
01:08:16.920 them the law so they don't decide they just interpret and make a choice in this case he
01:08:23.740 actually has to make a decision he has to decide whether or not piercing the veil for the crown
01:08:28.300 is a good idea going forward if they screw up like this or for the interest of justice do we
01:08:33.720 protect the crown so we don't mess up the trust in the justice system and he brought that up by
01:08:37.940 the way this is why i mentioned it to you these are the the issues he's wrestling with i mean look
01:08:42.980 I mean, the trust in the justice system, give me a break.
01:08:45.660 I mean, we've seen a lot of precedent-setting decisions from judges across the country regarding these ridiculous COVID tickets and regulations and lockdowns and all of that stuff.
01:08:56.120 And they've taken the safe path, these judges have, and just gone along with government in most cases.
01:09:03.340 Now, people have been wondering why the government of Alberta cannot get involved in this.
01:09:10.420 we know that politicians are not supposed to get involved in the court system i mean that you know
01:09:17.300 snc lavalon case is a classic example of that but is there any kind of mechanism at all i mean the
01:09:23.000 attorney general uh in our system of government provincial and federal is also the minister of
01:09:28.100 justice so is there anything like even in terms of getting these guys the medications they need
01:09:33.960 and maybe some better treatment being stuck in a remand for 540 days is you know as far as i'm
01:09:40.220 concern cruel and unusual punishment is there anything that we can do to get the government
01:09:44.680 involved maybe the minister of health maybe the minister of justice to do something not to let
01:09:49.340 them out but just to give them some humane treatment at least so those are all the avenues
01:09:54.520 that we're doing because of the tony issue and other issues has been an ongoing thing i can tell
01:09:59.680 you though that they're not helpful um health will point to justice justice will point to remand
01:10:05.340 re-men will point to court court will it does just a circle and we even got as far as we got
01:10:10.220 a hold of someone in um danielle smith's office and this gentleman flat out told the family
01:10:17.640 members who were calling you guys are all calling with the same story you must be part of a
01:10:22.700 conspiracy theory there's no way the system would treat the men like this click and that's from the
01:10:28.900 prime or premier's office so no they're not they're not doing anything at this stage they're
01:10:34.520 not assisting the premier wants to be involved in any of this after those cbc allegations even
01:10:39.980 though they were proven false and cbc had to retract the story regarding daniel smith's office
01:10:44.540 being in touch with people regarding arthur pavlosky but um still there is something that
01:10:51.480 they can do they just refuse to hear any of it which is remarkable to me uh let's let's get back
01:10:56.940 let's get back to uh what happened in court last week and wrap this up um sure and where we stand
01:11:03.340 Now, so this sealed document has not been unsealed, and the prosecution was delaying, delaying, delaying last week.
01:11:11.900 When do the hearings open up again, the pretrial?
01:11:15.960 November 1st is the next scheduled court date, and we will continue at that point.
01:11:21.920 And we don't even know if that will be on the CC1 application or if we'll continue with it.
01:11:27.100 Keep in mind, we're in the middle of an application for disclosure.

01:11:31.440 we're still trying to get the disclosure so november is going to be all about continuing

01:11:47.140 trial the judge says he'll open it up at the latest the day before the trial or sooner so we
01:11:55.040 You may not see this envelope opened up until the 27th of May, 2024 or sooner.
01:12:05.640 What processes might be in place for the defense to get this thing opened?
01:12:11.560 I know they tried and the prosecution continues to file motions to delay based on one thing or another.
01:12:18.460 And I recall you watching or watching you on Viva Fry this afternoon talking about how brilliant some of their tactics have been.
01:12:24.540 is this something they can keep doing over and over and over again yes there's no one to decipher
01:12:30.660 that no and it's it's legit like they're procedural things so when the crown introduces a affidavit
01:12:39.500 five minutes after the afternoon session starts that he had created during the lunch hour and
01:12:45.020 this affidavit had no material value but that's what they needed an entire german for in order
01:12:50.380 to tell the court there's no material value here so the defense had to adjourn so we lost the entire
01:12:56.000 afternoon uh to the next day just to address the sudden affidavit that had no value to it
01:13:02.060 never did have value does the judge not have any leeway here to say you are stalling i'm sorry but
01:13:08.620 let's get on with it no but we have seen his frustration when they're stalling for sure and
01:13:14.740 even when the defense asked for i think it was for four hours of time he pushed him down to two
01:13:20.380 hours so the judge is trying to move this along but unfortunately there's definitely things like
01:13:26.240 sudden affidavits or changing the argument the very next morning that happened so the defense
01:13:32.280 was all prepared to argue the position of the crown the first thing the crown did the next day
01:13:38.160 was stand up and change their position which means all the arguments have to be changed they're not
01:13:42.740 in the right context anymore wait wait wait i didn't think that was even you couldn't even do
01:13:47.440 that once you've established and submitted your argument to the judge that's it no you're talking
01:13:54.280 trial this is pre-trial where it's a little bit different a little bit looser i'm frustrated
01:14:00.380 listening to these answers man i'm sorry i mean like there is something in canada about the right
01:14:04.720 to a speedy trial right correct that's a jordan decision and that's 30 months for these guys so

01:20:00.400 now the hong kong police were instrumental in beating down hong kong citizens just a couple
01:20:08.140 of years ago and in some cases transporting them back to mainland china for uh totalitarian court
01:20:14.340 proceedings those people have never yet uh come out or been seen or heard from ever again

01:21:28.720 on this person's channel and i didn't know when it was on and i thought well what is this i've
01:21:34.440 got people sending me this video so now i've got to go and research it to find out for myself what
01:21:39.420 it was this is not bearing witness this is it's great video all they needed to do was say what
01:21:45.700 was going on without bias right so right and i think you're right and that's a lost art really
