00:08:44.720 lot of work on this you're back at it this week uh tamara and chris uh how are they looking and
00:08:49.620 feeling do they feel recharged or look recharged feeling better do you think um so this is something
00:08:54.680 i spoke of on viva fries earlier today was sort of my last uh word i think that tamara leach is
00:09:00.060 exceptionally confident and very positive in her energy um i find her uh it might sound odd but
00:09:06.820 she's got this positive aura about her she exudes confidence in the way that she's carrying herself
00:09:11.780 uh in the courtroom and uh around the courthouse always smiling always waving at people uh doesn't
00:09:18.480 seem angry i'm sure that again this this experience is not pleasant but she's not showing it she's

00:09:30.620 joke uh in the in the courtroom uh not in the courtroom sorry in the courthouse in the hallway
00:09:35.240 outside he's always positive so both of them seem to be feeling pretty good i mean you'd have to ask

00:09:50.380 we had today in the courtroom um i i'd wager a guess off the top of my head uh 15 to 20 at least
00:09:56.260 uh so defense is working hard we we had some witnesses today uh from the other side the
00:10:03.020 downtown residents including zexy lee am i correct that's true and uh just before we dive into the
00:10:08.300 main dish here so to speak uh we've been on these residents witnesses as you may have heard on
00:10:14.140 Wednesday last week unfortunately defense losing their application we talked about it the first
00:10:18.680 time or second time I was on the admissions to argument the defense losing that application
00:10:23.320 to withhold these witnesses these eight uh witnesses so the judge allowing them to testify
00:10:28.100 they began on Thursday and then Friday and then today again we had the uh the main show I guess
00:10:35.220 you could say uh so this is we uh Zexi Lee is the sixth witness of these eight to testify we also
00:10:41.260 So she finished today.
00:10:43.120 And then we got to the seventh, who is Paul Jorgensen, I believe is his name.
00:10:48.420 And how was, I understand Zexy had some bodyguards, some security with her.
00:10:53.400 Sure.
00:10:53.860 It's every one of the witnesses are being brought in by these detectives.
00:10:57.940 They just bring them in.
00:10:59.380 Even the police witnesses come in with the detective.
00:11:02.200 So this is normal.
00:11:03.060 But with Zexy Lee, we did have an additional police officer. 0.99

00:11:20.000 Now, this is nothing to say that it's her fault, but it's just so happened that there was a delay every time we would come back of a minute or two waiting for her to come from wherever she was staying.

00:11:35.240 Yeah, yeah. Like, so have any of these witnesses so far, Smoothie, had any kind of positive impact for the prosecution?

00:11:49.100 But without doing that, I'd say to me sitting in that courtroom, nothing being said in this proceeding.
00:11:55.180 In my opinion, justifies a 10 year jail sentence, let alone the proceeding itself, really.

00:12:07.760 It's been 17 days, 17 days for a mischief charge, for a counseling mischief charge for the other thing.
00:12:15.720 And, man, I haven't heard anything that just makes me go, wow, they're in trouble.

00:12:24.200 But, again, I can't get in anyone's head.

00:12:30.520 Even Jason Levine saying today that he found her very fair.
00:12:34.120 She's very fact-oriented, as we discussed the first time.
00:12:37.280 And she's trying to give each party the opportunity to run a fair trial.
00:12:40.780 As you know, we might find some of those decisions upsetting or unfair.
00:12:44.220 But at the end of the day, I think she's trying to keep this thing on the rails, as she would say.
00:12:47.940 But absolutely nothing that I've heard so far from anybody that just makes me go, whoa.

00:12:57.620 Or are they just winging it, like taking it day by day?
00:13:00.140 Again, I feel like you, I mean, there's things I think, but at the end of the day, I think some of those thoughts might be just better held back. But I feel that they do have a plan for where they're going with this. Like they do have a roadmap. At times, it seems like they're getting off of it a little bit, maybe, or maybe things are developing that aren't in the way they anticipated.
00:13:19.740 but certainly i feel they do have an overarching plan here whether it's landing or not as a total
00:13:24.780 other question um to me as a lay person just sitting in that court for all these days listening
00:13:30.240 to all this stuff nothing stands out to me like wow that's that's the end of it right nothing like
00:13:35.200 that at all so what what was the judge's rationale for allowing these witnesses in the first place
00:13:40.580 because it seems like there's a whole lot of hearsay going on okay well uh the rationale was
00:13:45.660 extensive uh the the decision took i'd say maybe half an hour to read so there was a quite a
00:13:51.620 substantial amount of thought that went into this decision it wasn't something like a whim
00:13:56.140 numerous supreme court case references law reference and laws one of the things that i
00:14:02.780 can remember this decision being based on uh was a supreme court decision i believe it might have
00:14:07.600 been an appeals court there was so many citations like every lawyer and the judge herself brought
00:14:13.100 plenty of references. They did their homework. But one that sticks out was the judge. One of
00:14:18.620 her citations, I believe, in her decision was a Supreme Court decision, I believe, again,
00:14:23.780 saying basically that trial management powers are not a license to exclude evidence for the
00:14:30.000 sake of efficiency. So there was a lot of case references. Basically, the Crown argued that if
00:14:35.140 these witnesses were excluded, that their case, their right to make a case and their case itself
00:14:40.220 would be damaged irreparably and so that they would not be able to prove the counts and the
00:14:44.440 information the charges beyond a reasonable doubt without these eight witnesses that was their
00:14:48.980 argument and the case law supports as the crown and as the judge cited case law supports the
00:14:55.640 crown leading their case as they see fit now that doesn't mean they can pull magic out of the sky
00:15:00.780 but as far as these eight witnesses concerned are concerned that they were allowed to proceed and
00:15:05.660 the judge agreed that withholding them wouldn't have damaged the crown irreparably. So it is what
00:15:11.420 it is. She's trying very hard, I feel, again, to keep this thing somewhat on the rails. And that
00:15:16.340 I think that there could be implications that we might not be considering properly at this time,
00:15:21.560 potential ramifications when it may be coming to appeal either way. I think she's trying to run
00:15:27.340 this as tight as possible, as fairly as possible, and as fact-oriented as possible. I feel that's
00:15:33.760 her mindset i really do so what have they been able to get from these witnesses and how are they
00:15:39.380 tying it to chris and tamara at all very limited tying to chris and tamara very limited i don't i
00:15:45.360 don't think there's a single witness that we've heard of of these eight who had any direct
00:15:48.820 interaction with chris and tamara that's a question typically that greenspan will ask
00:15:52.320 on cross-examination have you ever interacted with chris and tamara and i believe i think
00:15:57.120 none of them have said yes so absolutely none of them no contact um what are we getting from them
00:16:03.560 we're hearing about the horns we're hearing about the smells uh we're hearing about uh in one case
00:16:09.160 we had someone yes last week testify that there was protesters on a street corner wringing their
00:16:14.040 fists at the sky i guess wringing their fists i don't know what that means so now me and chris
00:16:19.200 dacy were joking whatever whatever we're protesting we're just going to stand there and say protest
00:16:23.120 protest i don't know which reality that really it's coming down to whether you like the protest
00:16:30.540 or not. That's what the testimony is boiling down to. Some other interesting testimony that
00:16:34.420 stood out from last week, and again, the names are escaping me because we're just moving through
00:16:38.240 them so fast. I think this was Vivian Lear who said this. She was the church. She worked at a
00:16:43.840 church downtown where she managed. She was an administrator there, very close to the main
00:16:49.940 drag on Wellington. So somewhere in that area. And she testified a couple of things. She said
00:16:55.500 that there was feces left on her property, though she never witnessed who made that,
00:16:59.740 and three cases of urination, I believe she cited.
00:17:02.600 And in each of those cases, you know, she couldn't identify the person who was doing it, so on and so forth.
00:17:08.080 She also made reference of a truck, and not any truck, but a truck playing Led Zeppelin, of all things.
00:17:15.440 How dare they play Led Zeppelin?
00:17:17.160 Now, she was quick to say that she's a child of the 70s, no problem with Led Zeppelin,
00:17:22.120 But he was apparently playing it far too loud for her taste. And apparently at one point they had words, I believe, and she testified that he swore at her after she confronted him at one point. And the police were outside involved in that and it made space for them.
00:17:37.720 She also testified that particular individual that smells were invading their sanctuary.
00:17:43.980 She testified that they were suffering from lower attendance at their Sunday Masses.
00:17:48.660 And she did not attend the Sunday Masses, but she knew that the Sunday Mass attendance was lower because she was watching on virtual and because they handed out pamphlets to the worshippers.
00:18:01.060 And on Monday, she would count the pamphlets, and it was lower on these weeks.
00:18:05.420 So therefore, she concluded that the attendance was lower.
00:18:08.060 Now, I think it was Eunice, one of the defense lawyers raised, well, you know what?
00:18:11.420 They could have came and not taken that.
00:18:12.960 You wouldn't have known.
00:18:14.120 And she conceded, yes, but that would be weird.
00:18:16.100 So things like that sticking out.
00:18:17.760 We heard much that type of testimony of another individual.
00:18:22.360 I believe his name was his last name.
00:18:26.900 Anyways, he testified, I believe, on Friday.
00:18:28.980 And he testified that him and his son, he was somewhere on Bronson.
00:18:32.020 And he doesn't remember where, but he had to park his car because there was a total jam, total traffic jam.
00:18:38.000 And he was speaking through an interpreter.
00:18:40.360 He did briefly speak to the court in English.
00:18:43.160 Again, I'm not one to judge, and you have a right to either language.
00:18:45.680 But he did answer some questions in English, but he was more comfortable to speak in French.
00:18:49.840 So those interpreter servicers, which we had trouble with the first day of his testimony,
00:18:54.240 Stéphane Belfoy, I think his name is Stéphane Belfoy, he came after Vivian Lear, I believe.
00:18:58.040 um he testified that uh with the with the um so yes the first day he had his interpreter
00:19:04.860 services mr interpreter have seen him before a bit of a trouble with some of the inaccuracies
00:19:09.200 in the transcription and the translation which is a big no-no defense constantly you know basically
00:19:13.960 this has to be done right every time first time so defense standing up to get that so the judge
00:19:18.620 getting quite frustrated i would say with this mr interpreter no fault of his own probably a long
00:19:23.740 day who knows it was the end of the day at that point and saying you know if you kept doing this
00:19:27.560 So we're going to get new interpreters tomorrow.
00:19:28.940 So the next day we came in, we had three interpreters, none of the same.
00:19:32.900 So we were able to finish out his testimony.
00:19:34.480 And the main thing that stuck out for me from what he said was, first of all, at that time when the protest began, he had been living in Ottawa for seven days.
00:19:42.640 So take from that what you will.
00:19:44.460 And again, downtown area, I believe he was somewhere on Lyon Street in the downtown area towards the main protest.
00:19:51.600 And so his main thing, again, back to this car thing.
00:19:54.140 So he was in this car jam, this traffic jam on Bronson.
00:19:57.400 Doesn't know the date, doesn't know the nearest intersection, doesn't know the area on Bronson.
00:20:01.860 And this jam was so bad that he had to park his car and abandon it and walk home.
00:20:07.100 And he had his son in the car and his son was attending hockey.
00:20:10.360 And as he testified at the time, the children had to come to the hockey arena prepared to play.
00:20:16.040 So his son was fully dressed in hockey gear and wearing his skates.
00:20:20.360 And on the kilometer and a half walk back from wherever they were on Bronson to where they lived, people were heckling them because his son was in hockey gear.
00:20:28.540 He also said that, I believe, on 10 instances, he had encounters with individuals who were against him for his mask and confronted him about that.
00:20:35.800 But I found it very odd that he was describing this kilometer and a half hike he took with his son, Magus, on cross-examination, trying to poke some holes in this story, basically asking him, OK, well, he has to come to the arena wearing this hockey gear and his skates.
00:20:49.440 he can't change there because of covid mind you uh why didn't you have boots in the car and then
00:20:54.660 he testifies oh i couldn't have boots in the car and magus is basically like what do you mean you
00:21:00.260 couldn't have boots in the car you weren't allowed like what do you mean he's like well i just
00:21:03.740 couldn't and it's like well and then magus said well what if you broke down on the highway what
00:21:07.380 would you do then what would you just be stranded with hockey skates on your son no i and he said
00:21:12.200 no no i i wouldn't do that we wouldn't walk i'd have someone come help me this i wasn't putting
00:21:17.420 the pieces together on that one that it didn't make a whole lot of sense again and i we saw lots
00:21:23.820 of people during the convoy playing hockey no one was in making fun of people for making for play
00:21:28.480 for wearing hockey equipment or skates or anything like that it makes it made very little sense it
00:21:33.520 didn't make sense again i have to by the way what smells are they talking about when they talk about
00:21:39.540 these smells gas fumes diesel fumes and in some cases this there was another person chantelle
00:21:45.540 B. Rowe and I believe that's her name and she runs a high-end clothing store which she described as
00:21:50.800 a very fun and loving very fun uh enjoyable job she was uh clear to get that on the record so she
00:21:55.800 runs this high-end store in Byward Market and she testified to the usual things the horns the
00:22:00.080 honking she felt unsafe she wouldn't venture out of her her store but she mentioned something
00:22:04.400 interesting that we haven't heard from the other ones and that was that uh there was people who
00:22:08.980 were standing in her doorway who she would often ask to move and some of them would oblige but one
00:22:13.680 lady in particular told her she was in something see you uh special word see you next tuesday 0.84
00:22:19.160 so one lady she said to move from her doorway called her a see you next tuesday and she said
00:22:24.320 that was nice very sarcastically she testified that was nice but that she noticed there was an
00:22:29.240 excessive amount of smoking she i think she described it as three times more than the
00:22:33.600 regular amount of smoking or something like that cigarettes and weed so now that we're on that
00:22:39.280 topic of being so much smoking, going back just for a second to Stefan Balfoy, he testified that
00:22:45.940 he, on the smell topic, that people were smoking illegal drugs. And the judge asked him, illegal
00:22:51.040 drugs? What are you talking about? And he said, marijuana. And the judge said, last I checked,
00:22:56.940 marijuana wasn't illegal in Canada. And he said, well, not in public or something like that. It
00:23:02.940 didn't really go any further than that, but it was quite a little funny moment. And back to,
00:23:07.520 I just really want to finish up with that story of the walk.
00:23:10.360 So he gets into this huge traffic jam.
00:23:13.100 They're wearing this uniform and maybe can't recognize it.
00:23:16.240 This is because of the situation we all as Canadians found ourselves in,
00:23:19.400 that his son is being limited and having to arrive to practice fully clothed,
00:23:25.180 can't use the change room, can't consider or doesn't want to consider,
00:23:29.100 you know, the bigger implications of that, let alone that thing.
00:23:32.140 The kilometre and a half rise.
00:23:33.300 You would think that if you left your car somewhere
00:23:35.360 and you had to walk for a kilometer and a half
00:23:37.740 and it was such a traumatic experience
00:23:39.140 where people were heckling you the whole way.
00:23:41.080 First of all, you would remember the date.
00:23:42.880 Second of all, maybe you would consider
00:23:44.200 going to law enforcement about it.
00:23:46.400 And third of all, you might actually consider,
00:23:48.620 you know, he went back for his car and he testified.
00:23:51.560 You would think you would remember after that,
00:23:53.880 seeing as how you had to go back there where you were
00:23:56.340 because you had to go back there at some point
00:23:58.160 and get your car, which he testified he did go back
00:24:00.600 and get it when the traffic jam was gone.
00:24:02.960 So just just I mean, I don't want to discredit these. I don't want to be too hard, but I just I find some of the things that are being said very difficult to understand and comprehend, even from the most neutral mindset that I can put myself in.
00:24:20.120 so does it sound to you like this is just a and i i don't mean to discredit the judge or any of the
00:24:28.580 attorneys or any of the witnesses or any of like tamara chris obviously but it sounds such like
00:24:33.520 like a kangaroo court is happening right now these people are testifying about nothing really
00:24:38.840 that have anything to do with tamara and chris so i i'll push back on the kangaroo court just
00:24:43.500 because i find again that justice heather perkins mcveigh is extraordinarily fair and fact-oriented
00:24:49.880 I feel like she is a judge who's judged. She is following the letter of the law. And the letter of the law, for example, permitted the admission of the eight witnesses, which, of course, is not something that anybody on this side, in quotation, wanted. But it was the letter of the law. So I feel total objectivity from her. The most that could have possibly ever happened. As far as good as it could have ever been.
00:25:13.620 Now, in regards to the Crown's case, that's a different discussion. Again, not for me to say what they're thinking or how they're in the ideal world. They are supposed to conduct their office, an important and integral office of our democracy, of the administration of justice in a way that makes sense both to the public interest and to the actual concepts of justice.
00:25:36.100 Now, whether that's being done or not, it's not for me to say. The Crown is running the case as they see fit and as they see necessary. The law gives them the right to do that. As far as accountability and who's going to be decided what and who's going to be punished the right way, that will rest upon Justice Heather Perkins McVeigh at the end of the case.

00:26:01.200 Zexy Lee testimony because she's an award
00:26:03.220 winner after all and probably the most 1.00

00:26:16.980 of the Ottawa Citizen that
00:26:18.820 Mr. Chap was in court today now I didn't notice him
00:26:21.200 I don't pay particular attention to the crowd
00:26:22.880 so he was there as well as
00:26:25.020 another attorney of that
00:26:26.020 case was also there and there was an interesting back and forth after lunch concerning that
00:26:29.940 particular attorney and what may or may not have been said between her and her client now i'm not
00:26:34.440 going to go too far into that i'll just summarize it but uh you you asked me about the star witness
00:26:39.560 so just getting that all the way and as we're on the topic of the lawsuit for three of the first
00:26:44.360 five witnesses now we're on the seventh at this time um they had been asked if they were aware of

00:27:59.060 very very matter of fact these are the routes that we had to reroute these are the streets that closed
00:28:03.280 when we came back uh she started talking more about her role at the ncrcc the national capital
00:28:08.620 region command center um how and there was an exchange between her and greenspun that went
00:28:13.720 back about five times the same question who decided to close the road the roads she was in
00:28:20.700 the national capital uh region command center along with ottawa roads ottawa by bylaw and three
00:28:25.840 police services the ottawa the ontario police provincial police the rcmp and the ottawa police
00:28:31.160 service so this this is the huge command center that is according to her testimony activated to
00:28:35.540 make complicated decisions with complicated situations and she testified she wouldn't answer
00:28:41.680 that question she was asked who made that decision i put it to you it was the ottawa police and she
00:28:45.740 said yeah you know the road with was taken by the demonstrators but who made the decision to close
00:28:51.920 the road and finally she admitted yes it was the ottawa police obviously it was who had the
00:28:56.360 authority to author to say that road was closed and from that point forward then oc transpo would
00:29:01.360 make those detours according to her testimony so ultimately the point of that was that the police
00:29:05.980 are responsible for those detours at least in some way um there was some uh and she also testified
00:29:11.660 something else very interesting she testified that the police uh were containing the protest
00:29:18.640 and that the city had installed big concrete barriers called jersey barriers that were also
00:29:24.800 containing protesters and she testified that after the demonstrators were removed or left
00:29:29.520 it took them 12 to 24 hours to reopen these affected streets because they had to go in and
00:29:35.020 remove these barriers and plow the snow of course so that's interesting isn't it that that took them
00:29:41.440 such an amount of time to recover the street because they had to remove the barriers that
00:29:45.020 the city itself in conjunction with Ottawa police put in place which could have very well you one
00:29:50.560 could assume this was not brought up in court one could assume these things could be problematic to
00:29:54.880 moving trucks willingly if they're being blocked in by police vehicles and barriers we heard that

00:33:48.080 demonstrate because the court kind of was having a bit of difficulty understanding uh what she was
00:33:52.620 getting at now she she admitted she never saw this thing that she said it was under a tarp
00:33:57.440 somewhere in her vicinity so it was under this tarp but she heard it she heard it but it was
00:34:01.940 tarped so that really stuck out to me there was also this pretty intense exchange between um
00:34:08.320 Greenspun and her on cross-examination between Sexy Lee and Greenspun, because earlier in her
00:34:14.520 examination-in-chief with the Crown, she testified about this makeshift food kitchen. That's her
00:34:19.340 wording. Makeshift would appear to be a makeshift soup kitchen that was in an intersection. So 0.97
00:34:26.160 Greenspun was getting into the nitty-gritty of the detail. Like, was this thing on the road or
00:34:29.920 on the sidewalk? And she was like, this went back and forth a lot. And she was like, it was partially,
00:34:35.320 she finally conceded at the end after maybe 10 back and back and forth questions the same question
00:34:40.820 over and over again she's like well it was maybe a little bit on the road a little bit on the side
00:34:45.320 and so so greenspan asked something about uh food trucks like that because i think she mentioned
00:34:52.000 food trucks and he's like well where do food trucks normally park a little bit on the side
00:34:56.620 you know she eventually conceded that sometimes they park all the way on the road in authorized
00:35:01.020 food truck locations, where they're authorized to do food truck business and operate as a food
00:35:06.100 truck. She was very clear to mention authorized location, operating with permission, and so on
00:35:12.760 and so forth. That was a heated exchange over something that should have probably been a simple
00:35:17.160 answer. She testified that she was taking pictures of a truck with jerry cans in it,
00:35:22.800 and she interestingly testified at one point that a truck attempted to back into her. That's what
00:35:27.180 she said to the Crown on her evidence on examination in chief, that a truck had attempted to back into
00:35:33.220 her. This is something we heard at POEC as well. And that she had, I believe she testified, she
00:35:38.720 made a police report, got an incident with a number, but it never went anywhere. She does not
00:35:43.460 remember the day that happened. Now, it was kind of, I kind of was thinking at the beginning that
00:35:47.900 she didn't also know the day, the where, where it happened. But she definitely didn't know the day,
00:35:53.400 but she didn't she she didn't say she didn't know the where and later on on cross-examination this
00:35:58.320 came up a lot with this truck but before i finish with this truck i have to open up another segue
00:36:03.340 to something that will lead us back to the truck okay sorry so we are enjoying this very much
00:36:11.360 she had said something she had famously said something i think this was reported at poec
00:36:17.060 where she basically told a group of protesters to go the f back wherever you come from and we
00:36:22.440 learned now, she added this today, and I believe this to be new information that has never been
00:36:26.460 revealed anywhere before. I had gone back and forth with a few people to try and confirm that
00:36:30.680 this may be new information. But she testified that after she had said that go the F home to 0.88
00:36:37.600 these protesters, that is when this truck that she has testified about in the past backed into her
00:36:43.060 or back towards her. She later, earlier in her cross-examination with Greenspun, this was with
00:36:48.100 Magus I believe with Greenspun she clarified that as the truck moved towards her she was able to
00:36:53.460 walk get out of the way so she never made physical the truck never physically contacted her
00:36:57.140 there was an exchange where she was trying to clarify where it was parked and Greenspun said
00:37:02.320 my question wasn't whether where it was parked where where was it going to touch you so there
00:37:06.440 was a lot of clarification on these questioning a little bit of talking over each other Greenspun
00:37:11.800 a lot of objections where Zexy Lee was asked to remove because the Greenspun would object and then
00:37:17.100 he would basically refuse to continue unless she was outside so he continued in absinthe of the
00:37:22.220 witness without her in the room which is pretty standard in an objection for a legal discussion
00:37:27.020 and uh you know that's that's basically where we're at so this she testified that this truck
00:37:32.840 had moved back but she kind of left it open-ended with the crown but on deep on defensive cross
00:37:37.340 examination she specified that she was able to get out of the way she further specified with
00:37:42.120 Magus that this happened after she had gone to this intersection to confront the protesters so
00:37:47.500 she said she went there to confront them and the way she confronted them is with her presence
00:37:51.580 and at some point this escalated and then uh I guess she said to them to go back to the
00:37:57.020 wherever the f they're from and then this person in this truck uh with the jerry cans I presume
00:38:01.920 this is the same truck with the jerry cans that she was out collecting evidence that's how what
00:38:05.420 initiated this she was out collecting evidence that the injunction of February 7th had been
00:38:09.720 broken. Remember that she is the representative plaintiff of the class action, and I believe
00:38:15.640 the injunction was brought as well under her behalf. So I believe that's three separate
00:38:19.840 legal motions. So the injunction of February 7th, the injunction of February 16th or 17th,
00:38:26.640 which because it was a 10-day, Justice McLean made it a 10-day injunction on the 7th. So they had to
00:38:32.160 come back 10 days later and do it again. Interesting point to mention about that injunction.
00:38:36.720 Something very interesting came out in the questioning with Greenspan on that injunction from Justice McLean.
00:38:42.580 But as she was saying with Meg, she went to that intersection where this all this confrontation happened to get evidence at some point after the injunction, not specifically aware of which date that these they were breaking the rules.

00:42:50.040 and in the affidavit they agreed like the parties agreed or concentred there was a word used i think
00:42:55.020 it was concentred if that's a real word that's i think that's what i heard from they concentred
00:42:59.500 The lawyers of hers and herself, as the affidavit witness, centered to that, that the witnesses were at liberty, that the defendants and other persons are at liberty to continue a lawful, peaceful and safe protest that they abide by in terms of the order.

00:46:01.620 on the ground, inside of these communications between these police liaison teams who are
00:46:05.260 the officers most in contact with Tamara Leach, with Chris Barber, with the protest leaders and
00:46:10.160 protesters themselves because that's just their job um inside of these internal communications
00:46:14.620 between these officers there's i i believe about 600 emails the defense has requested them all in
00:46:20.300 writing and i believe they did that on tuesday of last week and by friday of last week the crown got
00:46:25.780 back and basically said okay we've given you 200 and the crown the defense is like green spot says
00:46:30.120 we need the other 400 the crown says nope we've decided those 400 emails are irrelevant
00:46:34.940 they're duplicates they're this the other thing and so we're not giving it to you and the defense
00:46:40.320 is like no like and the crown's basically like it's it's case law if something's irrelevant we
00:46:46.360 don't have to give it and so the defense is like well i think it would we want them all we want

00:46:54.740 judge basically said if this is the way that it's going to go on tuesday which is when the plt

00:47:10.720 it would be more efficient for the Crown to just give these duplicate emails over, as the defense
00:47:17.540 and the Crown indicated. The defense indicated the Crown doesn't seem to be seeking a privilege,
00:47:22.500 claiming privilege on these withheld 400 emails. They're just not giving them because they say
00:47:27.020 that they're irrelevant and that this is going to be an issue with these next set of witnesses,
00:47:30.880 which would be the last set of witnesses for the prosecution afterwards the crown the defense will
00:47:36.760 begin which what was supposed to be a six-day case mind you the crown was supposed to have 10 days
00:47:41.980 the defense was supposed to have six and the trial was supposed to have ended this Friday that's not
00:47:47.020 what happened so the defense also indicated early on in their admissions to argument concerning the
00:47:52.400 withholding of these eight witnesses that in the eventuality that the eight witnesses be allowed to

00:48:02.640 what boils down to they didn't like the convoy then they may be required to call witnesses that

00:48:17.220 is gone the trial date we're on day 17 this is day extra one so and it's nowhere near ended we've got

00:52:59.120 and the usurpation of power, so all the power structure given to the occupying army or force

00:53:09.180 important. We've heard it a couple times to some of these other witnesses that they've been
00:53:13.080 cross-examined with that definition put to them. And the judge said, well, maybe she doesn't know
00:53:17.620 the legal definition. Maybe that's something that could be introduced to her. We never got that far. 1.00
00:53:22.020 The judge just basically said, we use the word demonstrator and protester. And there was a
00:53:26.820 couple times after that where she used the word occupier um and sometimes she would uh mix she'd
00:53:32.160 be protester demonstrator occupier you know mishmash them together um the second witness of
00:53:38.340 the guest of today was mr paul jorgensen and uh he used the word occupier more than anyone else
00:53:44.760 anyone else anyway occupation occupier and i believe again he was he was he was instructed
00:53:50.040 that we typically use the word demonstrator or protester that's just the court's friendly advice

00:58:23.200 privilege and so serious in fact that justice heather perkins mcbay said that anytime that
00:58:27.820 you're going to pierce the veil of that it's a very serious thing at one point when miss lee was
00:58:32.700 leaving the courtroom there was some chuckling from the public gallery from the audience uh from
00:58:36.860 the people um i believe they might have Googled in in my vicinity i'm not too sure and the judge
00:58:41.320 reminded the court that this you must show respect to these proceedings uh you must you must and that
00:58:46.720 if you're going to laugh like that that she will have not she will not hesitate to remove you from
00:58:50.780 the court now you have to agree we have to as as as as many feelings as we may have about all the
00:58:56.420 different things happening we have to show a little bit of respect in that room just a little
00:59:00.300 bit uh enough so so that was something and this was a very serious discussion about piercing the
00:59:05.720 veil of solicitor-client privilege and and basically where greensplint's questions were
00:59:09.560 going to go with that uh without getting into any detail because i i want to be careful about how i
00:59:13.980 talk about this you know like i don't know i don't know what the rules are here so i'm just going to
00:59:17.740 be i'm going to touch this with a 50 foot pole uh basically more or less what was the nature of the
00:59:23.100 discussion that was had between her lawyer uh immediately after being dismissed and for the
00:59:27.380 five or 10 minutes outside.
00:59:29.940 And basically Greenspun put it like this

01:00:36.520 that he's using the word occupation and occupier a lot.

01:01:26.580 system for the seconds or minutes not hours and then after that he can continue on with his work
01:01:31.660 or whatever has that's that's that has the expression yes has the expression phantom honking
01:01:38.440 come up at all yet zexy lee testified that she felt like there was honking all the time because
01:01:43.800 She testified originally that the conking never stopped, but then she testified that as of February 7th, it revved down, it stopped, there was a brief, there was a pause, and then it picked up again by, you know, two or three days later, and then it became frequent, but not constant.

01:01:59.500 It was constant all the time, never stopped, then it was stopped for a little bit, then it was got frequent again.
