00:05:16.860 what happened down there well good evening and thank you for having me on and it's a pleasure
00:05:20.820 always there shadow it was uh a sad day okay that's definitely what i can say right now it was
00:05:27.140 a sad day so uh we'll just jump to the end and then we'll jump to the beginning he he's not out
00:05:31.920 okay so he hasn't been released and uh we're gonna hear on january 8th the next date for the
00:05:37.720 decision so on january 8th is the day for the decision date you know it's kind of weird that
00:05:42.280 you have to wait for a decision date but that will be the next step for chris carbert unfortunately
00:05:46.620 he's not out uh at the stage but he's still very optimistic so i had a chat with him today which
00:05:52.440 was really helpful to me uh because if you watched my episode this morning we were sad
00:05:57.000 we were very sad uh bringing the details to you because um it we got a lot more details we got a
00:06:03.880 lot more information out of the crown now I want to preface this with uh the crown presented
00:06:10.400 information and evidence not proved uh there was nothing proven uh at the bail hearing but it was
00:06:16.740 presented and there's a lot a lot of information that most of us didn't know before that that we
00:06:22.360 had uh the displeasure to maybe see some of it but uh shadow look I got to tell you it's it's
00:06:29.520 looking like chris carbert as the individual uh really didn't have much to do with any of this
00:06:35.680 uh the evidence brought forward on chris carbert uh presented by the crown wasn't compelling it
00:06:42.120 wasn't strong there wasn't much there uh but because there's a conspiracy charge here there's
00:06:47.040 a chance that the actions and and evidence against the other men what could be used against chris
00:06:53.120 so uh majority of the information that came out of the crown yesterday was on the other men
00:06:57.580 uh so tony olenick chris slice and jerry morin and there were some details there shadow that we
00:07:03.520 didn't know prior to uh the bail hearing yesterday but yes well okay so first let's
00:07:10.700 start with the publication ban requirements so there's a publication ban in place and the things
00:07:15.320 we have to stay away from just so you're aware uh witnesses names so i won't be mentioning any
00:07:20.300 names here today or tonight. Details of the evidence, for example, quotes that were presented
00:07:27.660 in the hearing. I can't relay those to you. And then eventually the decision of the, and that's
00:07:35.360 always the weirdest one. The decision itself is under publication ban, but there hasn't been a
00:07:39.880 decision yet. So I certainly would be able to violate that one. Wait a minute, wait a minute.
00:07:44.080 Hold on, you're telling me that when they come out with a decision on January 8th, you're not
00:07:48.080 going to be able to say what they decided that's correct and we actually already had uh an issue
00:07:54.640 with that let me kind of backtrack a bit a couple months uh there was this envelope that we referred
00:08:00.240 to as a crime fraud envelope and we were waiting for a decision on that one and when that decision
00:08:05.300 came out a couple people reported on it and the court was not pleased uh the the court contacted
00:08:12.880 to some people uh made some warnings and what i understand possibly even banned a couple people
00:08:18.400 from attending again uh because they did report the envelope decision so they're very serious
00:08:23.640 here in alberta about the publication bans and reporting on decisions so no when the decision
00:08:28.400 comes out i won't be able to say anything although he won't be out or he will be out so you know
00:08:33.340 people will know but if i actually say it i could get myself in quite a bit of trouble you know i
00:08:38.740 wonder what kind of conditions if he does get out which we're hoping for what kind of conditions
00:08:43.740 he's going to have on this bail i mean will he be able to leave his home i wonder will he be able
00:08:48.000 to go within a block of his house if he can i mean this all seems so ridiculous it is very ridiculous
00:08:54.960 but they did present the bail plan so the defense does present the bail plan so it would be house
00:09:00.860 arrest uh with exception for work that's it they won't be able to go anywhere else uh unless it's
00:09:07.420 work uh i don't believe there's going to be a gps tracker because it's not really effective it
00:09:12.580 doesn't do anything but uh at any time the the authorities can show up at his house his mother's
00:09:18.320 house his brother's house to check up on him of course they will be like yeah yeah sure they will
00:09:23.300 um they made it very clear that they intend to because they even said hey if we have to show up
00:09:27.980 at his brother's house we might scare the kids because there's children there um yeah so it will
00:09:33.380 be very strict i assure you that because he would be can you tell us what what kind of shape he's in
00:09:39.160 and and the other guys too if you know if you have any kind of detail on that yeah so all of them
00:09:45.120 have lost a lot of weight uh we'll start with chris lysick because he was really physically fit
00:09:49.560 before he went in there he a very large man he took care of himself lots of exercise and he has
00:09:55.800 lost a lot of muscle mass and uh put on weight where he doesn't normally like it he's dealing
00:10:01.000 with some knee issues that I think he's handling the best he can there. But overall, a lot of
00:10:08.380 weight loss and muscle loss for him. Tony Olenek, I think, is the one suffering the most because he
00:10:13.500 actually has digestive issues and they're not treating him even with simple probiotics. So
00:10:18.760 he's struggling and he's been doing that for well over a year, fighting that battle. Jerry Morin,
00:10:24.380 I understand he's got a couple little issues, some skin issues. I'm not sure what that's like
00:10:29.780 anymore how that if that's cleared up or not and then carbert he's put on a little bit of weight
00:10:34.780 uh because he's not able to continue to do the exercises he normally would do um so physically
00:10:40.400 i think they're um struggling i would say that would be a fair assessment what about mentally
00:10:46.560 i mean day in day out like this oh well okay i can say for jerry and tony i haven't spoken to
00:10:54.320 a little while but they both had a lot of faith and they they absolutely turned to the book and
00:11:00.080 they were always optimistic and looking forward uh chris lysick had a rough couple months uh
00:11:06.400 he had his lawyer kind of let him down he wasn't excited about the lawyer and until there was a
00:11:11.440 fundraiser for a new lawyer for him he was really in the dumps and then chris carbert of course the
00:11:16.800 last couple months he's been very optimistic and excited and looking forward and surprisingly he's
00:11:21.840 was doing very well with the results of yesterday. He's still very optimistic and looking forward to
00:11:27.000 January, where he does still believe he's going to be getting a decision to be released.
00:11:32.180 Okay, so please tell us you were very sad yesterday when you left the court, but this morning
00:11:37.940 you felt happier because you spoke with Chris. So what's changed?
00:11:42.400 Correct. Well, what changed is in the court, when we were seeing everything being presented by the
00:11:47.760 defense she doesn't present it all to us so what i didn't really realize was we didn't see a lot of
00:11:54.720 the defense that was protecting him or supporting him real time we didn't see it but he helped me
00:12:00.720 realize that there was a lot of documents that weren't presented to the galley that the judge
00:12:04.400 is going to be going through and her time and reviewing and there's quite a few documents and
00:12:09.360 material that wasn't presented to the galley but the judge will see which chris feels is very
00:12:14.880 helpful to his claim to get bail and after having that conversation with him yeah he really
00:12:20.620 he helped me realize that he's in a far better position than it looked uh on Wednesday because
00:12:26.220 on Wednesday it didn't look great um my assessment was I don't think he'll get bail uh because the
00:12:32.880 uh the decision by the judge is gonna be a difficult one I'll give you two reasons why I
00:12:37.580 came to that conclusion and I still feel that way even though Chris gave me some more information
00:12:41.340 today uh one of them is he's pretty close to the trial date so january february if she's thinking
00:12:47.440 about letting him out it's may june he might be out anyways and she may use that as a reason to
00:12:53.240 not let him out because she doesn't know if he's going to be dangerous or not it'll be a risk on
00:12:57.300 her part to let him out we know he won't be dangerous but she doesn't she's an individual
00:13:02.260 that doesn't know him so she may find it difficult to release him somebody who she's been told is a
00:13:09.060 terrorist out and then if he harms somebody she may feel like it would be her responsibility
00:13:13.680 and if with the trial date so close she may decide not to take that risk if she can get
00:13:20.580 past it of course he's out but i think it's going to be difficult um you know there's a lot of people
00:13:25.520 jason who are talking about i mean you know here we are so close to christmas and one of the guys
00:13:31.900 has got a chance to get out and go home and spend time with his family and gets denied or delayed
00:13:36.620 at least until january 8th like you say a lot of people are talking about malice here like did it
00:13:44.220 seem at all that way to you even the slightest bit that they were going to keep him in for christmas
00:13:51.340 no matter what hard to say okay so we lost an hour at the beginning uh because they were messing
00:13:58.060 around with webex we work in cooperation from participants on webex it caused a big delay
00:14:03.420 And I don't want to say that the delay caused the reserve decision, but had we had that
00:14:08.300 hour, she may have been able to give a decision yesterday.
00:14:11.320 I don't think this judge is trying to keep him in longer than he needs to be.
00:14:17.120 I think she's really taken her time to go through this decision because of a few reasons.
00:14:21.220 One, it's very rare that we have, you know, accused terrorists in Alberta that you're
00:14:26.700 going to release.
00:14:27.300 So there's a very rare situation for her.
00:14:29.820 Plus, once she makes her decision, the three other men might be able to use that decision to get out as well.
00:14:35.760 So it's really, she probably has a lot of weight on her shoulders on this particular decision.

00:14:41.660 Her questions that she asked of the defense and the Crown were both kind of revealing that she is interested in getting to the details of this and looking at it a lot closer.

00:14:58.780 we're still pre-trial yeah and it was a bail hearing you know so i i don't understand why
00:15:03.800 the judge needs to have all like look i mean we've had murderers released in three days
00:15:10.640 in this country and it happens quite often we people violent criminals get out on a promise
00:15:17.640 to appear and yet these guys have been held for almost two years are any of the other three looking
00:15:24.780 at a bail hearing anytime soon or is it this the only one this is the only one because all three
00:15:29.920 of them are waiting for carbert's results um because it's very expensive to do the bail hearing
00:15:34.560 at least fifty thousand dollars so um they're waiting for that result to tack your other
00:15:39.560 question there about you know murderers get out in three days or so well the difference between
00:15:43.540 murderers and these gentlemen is they don't have the entire nation of canada trying to keep them
00:15:47.980 in there using the intelligence agencies of canada to try and keep them in there and using a false
00:15:52.900 narrative to try and keep them in there so you know what the the deck is really stacked against
00:15:57.780 these gentlemen something like we've never seen before in canada people have been asking you know
00:16:02.660 this this seems like a kangaroo court at best and i understand that you want to respect the process
00:16:09.380 and try as best we all can to respect the institution of uh the justice system in this
00:16:16.900 country but people are asking danielle smith is there anything she can do or any of her cabinet
00:16:22.900 can do to help this situation along anything the quick answer is no and we know that danielle is
00:16:29.920 well aware of this because betty carbert ran into her at the lethbridge mcdonald's bathroom
00:16:33.900 ladies room ran into danielle smith there uh not too long ago and had a conversation with her yeah
00:16:39.440 small world uh danielle smith was in town in lethbridge for you spare a square madam premier
00:16:44.500 basically but i can tell you that danielle smith did not patron the mcdonald's so she used the
00:16:49.000 bathroom without patronizing uh mcgarnolds but in either case she's aware of it yeah there's a
00:16:54.680 better than going in the alley in the back i'll tell you fair enough fair enough but uh you should
00:17:00.760 be aware though and this is pretty much everywhere uh elected officials have no place in the judicial
00:17:05.820 system they shouldn't be providing guidance or interfering in any way shape or form that that's
00:17:11.320 too political um and you saw what about the minister of justice who also happens to be the
00:17:16.500 attorney general of alberta because those roles are combined as we know from uh justin trudeau
00:17:22.720 and his uh his scandal a few years back where he tried to get jody wilson raybold to do something
00:17:29.340 that she didn't want to do and it became public obviously uh with snc level and so right and
00:17:35.820 she was fighting against a conflict of interest she can't do that so yeah yeah so there's a it's
00:17:41.760 a challenge because imagine if it was the other way around like an NDP government meddling in the
00:17:46.980 justice system directly you wouldn't want that or any other government really well it sure seems
00:17:51.420 like they are right now in this case doesn't it well you're not well look listen uh it's a unique
00:17:58.720 situation and um I am a realist okay so I understand that we have a flawed system we have some troubles
00:18:05.580 with it especially in Alberta uh but at the end of the day this is a very unprecedented unique
00:18:10.960 situation it's the entire country of canada that's trying to hold these guys in there in order to
00:18:17.280 uphold the use of the emergencies act so you can imagine the stakes are really high for some of the
00:18:22.960 some of the people high above now when you're asking about danielle smith look she's not
00:18:26.880 supposed to but we are aware that the ottawa is involved ottawa did provide people uh during the
00:18:33.520 investigation the arresting stage ottawa was advising uh the police officers here on the
00:18:38.960 the ground in alberta that came out during uh pretrial testimony um so look they're not supposed
00:18:44.740 to but here's ottawa doing it right now yeah so um what can you tell us what the charges are or is
00:18:52.780 that under a publication ban too i don't think it's under publication so the main charge is a
00:18:57.760 conspiracy to commit murder against police officers uh there's a there's an uttering of a
00:19:03.600 threat charge against LISIC. There's a legal, not illegal, it was a handgun that he's accused of
00:19:10.580 having that was loaded. So he was in possession of a firearm when he shouldn't be. And I believe
00:19:16.540 mischief and then blocking the border. So those are basically all the charges. So they were charged
00:19:21.460 with the infrastructure charge as well. Okay. So we've seen some Palestinian protests blocking
00:19:27.740 vital infrastructure in the last week or so. We saw a Palestinian protester threatened. It looked
00:19:33.300 like he was threatening a cop we found out later at least the cop said that he wasn't
00:19:37.460 uh threatening the cop but somebody who was standing close by that he would put it doesn't
00:19:41.680 matter it's still a threat in front of the police officer there's some actions been taken there
00:19:46.040 the police did nothing yeah at all and it seems to me that the charges that these guys are now
00:19:54.020 this gun charge uh obviously that's a little bit more serious but basically what they've got is
00:19:59.820 uh conspiracy to commit murder i i don't know what kind of proof that they have
00:20:07.380 that sounds kind of it sounds kind of flimsy to me uh uttering threats and whatnot and they've
00:20:15.720 they've been held for two years whereas these palestinian protesters uh didn't even get arrested
00:20:21.320 So this is politicized, obviously, completely given up two years of their lives almost now and missed in some cases with these guys, missed the growth of their sons, daughters, missed seeing family members on a regular basis.

00:20:47.020 when this goes go ahead sorry chris carver missed two funerals too his brother and his father
00:20:54.420 uh passed away while chris was in remand so so yes there's birthdays and funerals being missed

00:21:05.560 happen correct end of may and full month of june is scheduled oh my god end of may okay so
00:21:10.960 these guys could have been put away for over two years two and a half years
00:21:16.380 that would be the two-year mark february 14th 2024 will be the two-year mark and so if they win
00:21:22.980 these trials and as you say it doesn't sound like the prosecution the crown has got much evidence
00:21:27.380 to go on here is it possible go ahead sorry he did present he did present some information and
00:21:34.080 again it's presented it's not proven at this stage and we i do know that several pieces of
00:21:38.720 what he presented yesterday are just not factually true but the rest of it this was new to me and
00:21:44.100 some of it wasn't flattering it wasn't flattering but we do know that they're they're twisting it
00:21:49.640 into a narrative so they're cherry picking certain things you don't get the full context
00:21:53.700 this this evidence hasn't been challenged in trial or court or pre-trial yet there's a lot
00:21:58.640 of stages to happen before we actually hear about this evidence and the crown has a chance to prove
00:22:03.200 it but at this stage just on its face which is what the judge has to use in a bail hearing
00:22:08.700 that's just on the face of it, I think it's going to be difficult.

00:22:14.320 I think the defense has a lot of work to do, and I'm just being honest.

00:23:08.260 yesterday um so the crown's gonna be fighting hard on this one and i don't think anymore that
00:23:12.920 they're trying to run the clock out for the jordan decision i think they're trying to get
00:23:16.440 life sentence convictions here so we should have a lot of action uh in the pre-trials which
00:23:22.700 continue early february and hopefully they're all wrapped up by the time the trial starts
00:23:27.440 so that we can continue with that schedule as planned.

00:23:32.500 I mean, if the Barber-Leach trial is of any indication,
00:23:37.140 I don't think that any of this is going to be rapidly flowing its way through our justice system.

00:23:45.500 Well, I'm not sure if you know, but the Tony Olenek's lawyer is changing.
00:23:52.420 So Tony Rolison, which was basically the lead lawyer up to this point,
00:23:56.660 It was no longer employed by Chris Olenek, and this is what caused a two-month delay because we should have had a lot more pretrial dates in December, and we didn't because right before the pretrials were to resume on December 11th, we got word that the relationship between Tony Olenek and Tony Rolison failed to continue.

00:25:02.800 Now, Helen Groose is the cop who was investigating strange deaths of infants in Ottawa,
00:25:09.140 and she got reprimanded by the police.

00:25:13.580 Yeah, no, that's a horrible situation.
00:25:15.320 So where we left off when I was there in person in Ottawa a few weeks ago,
00:25:20.080 It was adjourned to January, but the last decision was whether or not she can have any of her expert witnesses.
00:25:27.200 So she applied to bring three doctors, one lawyer, Sean Buckley, and an ex-police officer from the Ottawa Police Services to testify.
00:25:37.800 Unfortunately, the decision was made that she's not allowed any witnesses and she's not allowed her police officer's notebook.
00:25:45.260 Those are two decisions that went against her.
00:25:47.520 And then she filed for a judicial review in an Ontario court and they upheld the tribunal's
00:25:53.300 decision.
00:25:54.600 So Helen Bruce is going to be taking a stand without her notes and without any witnesses.
00:25:59.100 And this will be continuing in January, January 8th in Ottawa.
00:26:02.900 You ever see The Longest Yard, the remake with Adam Sandler, where the ref is refusing
00:26:09.800 to call penalties that are blatantly obvious.
00:26:12.060 And so finally, Adam Sandler just hits him in the nuts with the ball a couple of times.
00:26:15.600 and that's what this feels like it feels like we're playing a rigged game here and
00:26:21.800 that's a common feeling right now their shadow for sure because some of these decisions are just
00:26:28.120 mind-boggling like how can the defendant not have their notes how can they not have
00:26:32.200 their uh witnesses i think what might be going on with the helen gruse case is just trying to
00:26:36.960 bankrupt her they're trying to penalize her um because she's she's likely going to hit appeals
00:26:42.080 court next after this decision because we can't see that the tribunal is going to decide in her
00:26:48.740 favor with all the decisions we've seen so far and all the handicapping that they've been doing to
00:26:52.900 her i can't see them siding with her so we're likely going to head to appeals court and she's
00:26:58.100 going to be spending a lot of money because she is completely self-funded her police association
00:27:02.400 is not funding this but they should be um so yeah she's she's doing things like uh boring against
