00:22:35.980 government witnesses will detail the facts and events leading to the decision

00:22:40.780 to declare a public order emergency.

00:22:44.580 They will describe the countrywide threats to the security of Canada, the illegal blockades,

00:22:51.620 the disruption and intimidation experienced by Ottawa residents, the threats at our borders

00:22:58.040 and ports of entry, and the real impacts on Canada's trade, international reputation,

00:23:04.800 and the economic well-being of Canadians.

00:23:08.140 The government witnesses will outline the deliberate step-by-step process in which careful consideration was given to all the available options, which led to the declaration of a public order emergency as a matter of last resort.

00:24:47.120 to destroy or overthrow by violence the system of government of Canada. Are you going to hear

00:24:54.360 evidence about individuals trying to do that? The answer is no. Saskatchewan's position is

00:25:01.920 that the federal government had already determined that a nationwide emergency would be declared

00:25:08.000 before the first minister's call on February 14th. The call was not so much about consulting

00:25:16.780 as it was about telling. The third area, if you'll remember, Trudeau has to have dialogue

00:25:29.860 with all the premiers before he can invoke the Emergencies Act.

00:25:32.880 So this is the representatives of the government of Saskatchewan

00:25:35.660 talking about that call that Trudeau made to Scott Moe back in February.

00:25:39.960 And as this guy points out, it wasn't about asking, it was about telling.

00:25:47.020 Concerns whether the emergency measures were overbroad.

00:25:51.640 The financial measures, for example,

00:25:55.760 imposed broad responsibilities on financial institutions.

00:26:00.260 with little guidance and they created offenses for not complying with those new responsibilities.

00:26:35.460 Coutts, Alberta prior to the invocation of the Federal Emergencies Act. Alberta's evidence will

00:26:41.620 show that the existing law enforcement tools that were already in place were completely sufficient

00:26:48.020 and they were successfully used to peacefully restore the flow of traffic at the Coutts border

00:26:53.220 crossing and to disperse the protest to a legal protest site none of the powers that were created

00:27:00.820 under the federal emergencies act were necessary nor were any of them used in alberta to resolve

00:27:06.820 the coots blockade the first convoy participants arrived in ottawa not far at all actually from

00:27:12.820 where we sit today on january 28th this is going to be in our city for approximately three weeks

00:27:20.100 i expect you will hear from witnesses about the significant impacts on the city's residents and

00:27:25.620 businesses and you will also hear about the city's efforts to support the police-led response to the

00:27:31.940 convoy and to mitigate impacts on city services the impact on ottawa for those three weeks of

00:27:39.940 harassment street blockages ear splitting air and train horns and general lawlessness

00:27:48.580 was unprecedented many people in ottawa felt like they were prisoners in their own home

00:27:55.540 and they felt abandoned and they felt unsafe by the police and by all levels of government

00:28:03.300 the auto coalition is not going to take a position we don't anticipate on the emergencies act

00:28:08.020 but make no mistake it was a crisis in downtown ottawa there was disorder there was chaos

00:28:15.140 there were propane tanks, there were gasoline jerry cans everywhere, there

00:28:21.320 were fireworks going off at all hours of the night, pinging off buildings, pinging

00:28:25.940 off windows, people could not get, there was no public services, paramedics,

00:28:31.660 ambulances, no buses, no taxis, grocery stores were closed, businesses, several

00:28:39.920 hundreds of businesses are closed, the Rideau Centre, the major mall in Ottawa

00:28:44.640 was closed for the first time in its history for a prolonged period of time.

00:28:51.640 The people in Ottawa are still traumatized, Commissioner.

00:28:54.820 There is a well-established process, you will hear,

00:28:57.880 that the Ottawa Police Service follows when protests occur.

00:29:02.680 The police must respect the charter right to peaceful process

00:29:06.040 while at the same time protect the community and uphold public order.

00:29:11.640 The Ottawa police, you will hear, followed that well-established process that had always worked with protesters, this time as well, and were prepared for an event, but not for the event that occurred.

00:29:27.600 Why? What you will hear is that this protest was unique in Canadian history.

00:29:33.280 The police had little time to prepare.

00:29:36.740 The genesis of the protest had only begun a couple of weeks before it arrived in town and it gained momentum with time.

00:29:45.720 What none of the intelligence predicted in the very brief period of time prior to the convoy's arrival was the level of community violence and social trauma that was inflicted upon the city and its residents.

00:30:00.540 The city of Ottawa was ground zero for the protests that occurred in February 2022.

00:30:46.500 For 34 years, the Emergencies Act was never used. The Public Order Emergency of 2022 was a historic

00:30:56.200 first. But now that the glass has been broken on the Act, it can be used again. The Act was used

00:31:05.980 by this government against individuals protesting vaccine mandates. But a future government of a

00:31:12.980 different political stripe could use the act in response to protests against pipelines or climate

00:31:18.680 change. When the commission asks hard questions about the act's use in 2022, the commission must

00:31:27.640 also focus on the act's potential misuse in the future and protect the right to protest,

00:31:35.260 parliamentary democracy, and federalism. What the commission says matters not just to Canada,

00:31:42.340 but globally, where the use of emergency powers is on the rise. The world will be watching our

00:31:49.620 work. There are many issues that the Commission will be examining which are central to CCLA's work,

00:31:55.940 including the lawful scope of the right to protest, the role of police in facilitating

00:32:01.060 protests while protecting public safety, the relationship between policing authorities,

00:32:06.820 civilian oversight bodies, and government actors, and the surveillance of those involved in

00:32:11.740 dissenting social movements. More broadly, the CCLA's interest in the commission's work goes

00:32:17.460 to the core of the organization's mandate, protecting the rights and freedoms of Canadians

00:32:22.140 and demanding transparency and accountability from our governments. The CCLA views the commission as

00:32:27.900 an instrumental part of achieving the goals of transparency and accountability, and our

00:32:32.920 participation in the commission's proceedings will be aimed at supporting those goals.
