00:09:27.600 did in the bc legislature yesterday well yesterday was april 17th and it was april 17th 1982
00:09:36.300 that we got our charter so you know there is an anniversary um and it really does seem to be a
00:09:46.620 rubbing salt into the wound of doubling down and affirming that legislature's view that they're
00:09:57.580 supreme to the Charter. And of course, the unique thing about our Charter of Rights and Freedoms is
00:10:01.880 Section 53 that makes it the supreme law of Canada and overrides the legislative powers of
00:10:07.800 both the federal parliament and the provisional legislature. So I guess it was a symbolic
00:10:13.160 uh raising of one particular finger on one's hand
00:10:17.420 i know you've become rather close with former premier brian peckford of newfoundland and labrador
00:10:25.480 these past uh few months actually the last year probably more so than uh the last couple of months
00:10:32.280 but does the charter really i mean after everything that's happened in the last three
00:10:38.420 years, does the Charter really represent true freedom to Canadians in your legal opinion?
00:10:44.880 Well, I've joked before that I was going to sue my law school where I took constitutional
00:10:50.940 law, Osgoode Hall, because they had led me to believe through taking that course many
00:10:56.260 decades ago that the Charter actually meant something.
00:10:58.500 And it certainly seems to all of us, lawyers and non-lawyers alike, looking at the level
00:11:04.580 of overreach from government that the Charter doesn't seem to mean anything.
00:11:09.140 And I think we don't know.
00:11:11.800 And that's partly why I was willing to run some of these charter challenges is we got to test this thing to see if it really works.
00:11:20.020 And so far, it appears not to.
00:11:24.140 What does Mr. Peckford think of all this?
00:11:26.220 I mean, does he think that the language in the charter is strong enough?
00:11:29.060 And, you know, he told he was on the show about a year ago and he told a great story about what it was like in that room with Pierre Elliott Trudeau and Reddy Levesque and all of the premiers of the day.
00:11:38.420 uh was he disappointed in himself that this has happened and i know you've got a great story about
00:11:44.320 the day the emergency act was uh was invoked on us regarding no he doesn't from my many discussions
00:11:51.800 with him and and and you know he's been very vocal and done many interviews and given many
00:11:57.360 speeches and and i'm and lectures and i'm very glad that he he's done that and continues to do it
00:12:01.880 um i think he believes like i do that the charter is a sound document but it's being misapplied
00:12:10.140 that the courts have been unwilling to make the difficult calls you know i you know there's this
00:12:18.060 image of lady justice and she has a blindfold and i've said covid the judges pulled the blindfold
00:12:25.260 down. And they looked to see whose team you were on and made decisions in that manner. You just
00:12:32.400 cannot read some of these decisions from our courts on the various COVID restrictions, whether
00:12:38.160 it was restricting people from working, from traveling, from assembly, from religion, and so
00:12:46.120 on, and conclude that they actually looked at the evidence. Because the evidence showing that COVID
00:12:54.900 was not as serious as was portrayed by the public health authorities the vaccine was not effective 0.62
00:12:59.660 and had adverse effects and so on that these lockdowns weren't warded was pretty compelling
00:13:04.000 but no judge with limited exception was willing to make that bold decision but that's the essence of
00:13:12.440 justice and our justice process is that the the judge is supposed to make a decision however
00:13:18.520 ever unpopular. It's actually interesting. When I arrived in Ottawa during the convoy
00:13:24.120 and got served on the Friday, February 3rd, I think that would be, or 4th, around there,
00:13:31.000 with the emergency horn injunction. And the next day, I found myself appearing before one of their
00:13:36.120 senior judges, a grumpy Judge Justice McLean. And there was over 400 media in the Zoom from
00:13:45.680 around the world new york times you name it and he could see how many people were in and he made
00:13:52.100 this statement that he wasn't in a popularity contest and that he was going to make whatever
00:13:57.840 decision the facts and the law and the evidence led him to however unpopular that might be
00:14:03.700 and that's what our courts are supposed to do and and i really don't feel they've been doing that
00:14:09.240 i hope they get back to it soon they have been the courts have provincial courts been giving
00:14:14.740 government great reverence in regards to judicial notice and that means you know well i should let
00:14:20.080 you explain judicial notice to the people first of all because you'll do it better than i will
00:14:23.840 you know and judicial notice is a heavy heavy concept in law okay this is not something to
00:14:29.560 be taken lightly and i can illustrate it quite easily um if you've got a personal injury motor
00:14:35.160 vehicle case or something and um the person was driving at sunset towards the west you don't need
00:14:42.980 to bring evidence to prove that the sun sets in the West. If somebody is walking down a downtown
00:14:47.640 street and there's a highway construction going on and some worker knocks something off and it
00:14:53.300 falls and hits someone in the head, you don't need to bring in a physicist to establish that
00:14:57.740 gravity exists. Okay. So it's that kind of thing that's so fundamental, um, that they will restrict
00:15:04.600 judicial notice to. There's not a lot of things that the courts have ever taken judicial notice
00:15:08.760 of judicial notice means you need to bring no evidence to prove it the courts already accepted
00:15:13.440 it as a given fact given piece of evidence and it's established so the courts began starting
00:15:18.940 taking judicial notice that covid was the worst thing since the plague um or as bad as the plague
00:15:25.300 that the vaccine was effective and prevented transmission and that um you know that the
00:15:32.220 public health officials were filled with divine goodness truth beauty and nothing bad it was
00:15:37.660 really bizarre when you look at some of the things the courts took judicial notice of.
00:15:42.800 So as a lawyer trying to fight against that, like, how is it even possible?
00:15:47.520 Well, the approach I took when I initially got involved in the fall of 2021,
00:15:57.580 the approach I took was that, you know, I'd seen some of the other cases that had gone to the
00:16:03.380 courts and I was like, ah, you shouldn't have done a statement of claim. You should have done
00:16:06.620 an originating application. This is a judicial review. It's not a negligence action. And I was
00:16:10.820 like, oh no, that one's going to get knocked. That one's going to get punted. So I worked with other
00:16:15.620 lawyers, some very, very esteemed lawyers across the country. And I said, we've got to put together
00:16:20.520 a properly formulated case procedurally, legally, factually, so that we can see if the system's
00:16:31.140 going to work and if the system is going to work then great the system being the institution of
00:16:37.320 our courts and the institution of our laws and our charter um and if it's not going to work and
00:16:43.000 that system's become corrupted then we need to do it so everybody can see it because it's only
00:16:47.860 through understanding that your institutions have been corrupted that you can reform them and
00:16:51.540 improve them so that was my motivation because i did have a number of lawyers say to me why are
00:16:56.940 you doing this? Cause you know, I am on, I think you're right. And I'm as concerned as you are,
00:17:00.640 but I think the courts are, are not on our side right now. Are they corrupted Keith? And I know
00:17:07.020 it's a difficult question to answer as a member of the bar. Well, I think I've answered it, which
00:17:12.760 is, I think lady justice's blindfold has been pulled down. And, um, uh, we've seen number of
00:17:20.660 instances it, uh, an example is judicial notice completely outside the norms of when a court
00:17:26.600 would normally take judicial notice complete absence of evidence you know they have no
00:17:31.260 evidence before them about the effect the effectiveness and the harms and the risks
00:17:35.480 associated with the vaccine um and they just take judicial notice that it's safe and effective
00:17:41.860 like that that's just not the way our system uh is is has ever been intended to work so who
00:17:49.840 imposes this judicial notice is it the chief justice of each province no it's the judge
00:17:55.460 sitting on any given case. They have the ability to take judicial notice of anything that's before
00:18:00.060 them. And so every single one of them nearly has said, yes, okay, we're going to give complete
00:18:05.100 reverence to the government. Everything they've said is right. And you have to prove they're
00:18:08.840 wrong before you can even prove your case. Wow. Well, you don't, it's worse than that. So first
00:18:17.100 of all, in not every instance, did they take judicial notice, but they would put in their
00:18:21.200 ruling that the vaccine was safe and effective and therefore it's okay for the divorcing couple
00:18:26.140 the one parent that wants the child to get vaccinated to order the child vaccinated that
00:18:31.180 kind of stuff but um if they're taking judicial notice of it it's not even rebuttable it's you're
00:18:37.620 done they've ruled okay so before we even get into your personal journey which is what i want to do
00:18:45.540 tonight and i know you've been on many shows like this and and you've talked about this and how you
00:18:50.520 got involved because of your wife actually she said for you to get out and do something about
00:18:56.060 this and i want you to tell that story later on was voluntold here's the big one where the money
00:19:02.160 go keith where's the money where is it shadow didn't we split it you and me dude if we split
00:19:10.980 this money i'd be a rumor by now i wouldn't be up here in winnipeg expecting a blizzard in the
00:19:17.320 next couple of days i would be somewhere down south earning 20 on a beach uh yeah so let's deal
00:19:25.220 with it it's easy uh the truth is easy so the fascinating thing about the money so what are we
00:19:30.900 talking about the money well first of all there was the gofundme and it raised 10 million and
00:19:36.280 remember how quickly it went up i mean i donated before i had any idea that i was gonna be hired
00:19:41.840 by these guys and find myself in downtown Ottawa and in the various operation centers and war
00:19:47.420 rooms. But that raised 10 million. And before it got shut, completely shut down, they moved 1 million
00:19:57.080 into a TD bank account that was in the name of Tamara Leach and Chris Barber. One of the first
00:20:03.000 things Tamara did when I got to Ottawa was she took her phone, I didn't even ask, she went into
00:20:07.520 her online app and went see and i'm looking oh yeah one million okay i see that um uh none of
00:20:13.840 that one million ever got spent on anything but give send go or sorry go fund me decided to refund
00:20:21.900 everything remember initially they weren't even going to refund it they were going to give it to
00:20:24.700 some other like organization like blm or something and then the pressure was so great and there were
00:20:28.680 some other things that happened they said okay we'll refund it all so they actually refunded 10
00:20:34.020 million and so it cost them a million because that one million that was in the td account td
00:20:41.120 immediately froze it so it got frozen on the saturday i arrived on the wednesday so they they
00:20:48.020 shut the they announced the end of the that they were gofundme announced they're ending the gofundme
00:20:52.600 on the friday td froze the million on the on the saturday and then gofundme refunded all the money
00:20:58.440 so anybody who donated to go fund me all got their money back okay wait a minute why did td
00:21:05.060 freeze that million dollars this was before the emergencies act right because uh justin trudeau
00:21:13.040 and kristen freeland have some friends in the banking industry when they say jump they jump
00:21:19.420 as we've seen with the freezing of the bank accounts and everything else so where did the
00:21:24.000 10 million go back to every single person who donated it so then we immediately started give
00:21:31.000 send go because we knew from the events and i've testified to this and it's been written up on that
00:21:35.360 that things were suspicious with how fair um uh gofundme was going to be so we start this give
00:21:43.480 send go and it accumulates about 12 because it was in u.s dollars but it converted to about 12.7
00:21:49.160 million and and um so um of that 3.4 million went from the us up uh was being held in stripe which
00:22:06.060 is a merchant processor you know in between person that is normal when you buy something online it's
00:22:11.960 not necessarily visa there's someone in between and it's a stripe or a square the companies are
00:22:16.960 called that so it ended up in canada this 3.4 million we got served with a restraint order
00:22:25.060 under section 490 of the criminal code from the attorney general of ontario that they obtained
00:22:29.060 without notice even though they had my cell phone number my email address they went to court without
00:22:33.180 notice and got this and were claiming that this money that um uh 113 000 people donated to there
00:22:41.040 was 113 000 donors to give send go uh that that was proceeds of crime that it was terrorist
00:22:48.640 activity and all this absolute nonsense so um that restraint order applies in canada it doesn't apply
00:22:57.200 in the u.s and that's not in dispute everybody realized that all the lawyers and the courts and
00:23:01.840 the police and everybody else so the 3.4 gets frozen at stripe uh in canada through their
00:23:09.820 vancouver office and then give send go gives the rest the money back okay so now where's all the
00:23:17.600 money shadow yeah but for the 1 million at td and the 3.4 at stripe it's back with the donors so who
00:23:25.580 got the most of the money the donors which is awesome that's what the leadership wanted is if
00:23:31.100 it wasn't going to get to the truckers to help the truckers and the freedom convoy it needed to go to
00:23:36.320 the donors right that was their position okay and they were successful in that but there was also
00:23:42.920 an adopt a trucker there was some e-transfer money there was um there was some bitcoin that
00:23:50.160 bj dichter was was working on on his own initiative and if you bunch all that together
00:23:55.340 it adds up to 5.5 million and it's sitting uh then we got served so the 5.5 million
00:24:03.520 we got served with a mariva injunction which is a nuclear type seizure tool in civil law
00:24:10.740 we had the section 490 criminal code attorney general um uh uh order the seizure order on that
00:24:19.480 and then we had an attorney general civil forfeiture order so the money the 5.5 million
00:24:25.980 is sitting inside a safe that of the attorney general and then the name on the safe the money
00:24:33.640 safe says attorney general forfeiture order application that's safe with the 5.5 million in
00:24:39.740 it because remember all the other money went back to the donors yeah didn't go to you didn't go to
00:24:45.360 me didn't go to have a chip not one single cent i've never asked for one single cent of that money
00:24:53.500 nor have i received it nor has eva and all these other ridiculous allegations out there
00:24:58.660 so the 5.5 is sitting in the safe that the attorney general forfeiture order controls
00:25:04.400 that safe is sitting in another safe i love this called the attorney general criminal code section
00:25:11.040 490 order uh the restraint order that those two safes are now sitting inside a third safe which
00:25:19.200 is the class action lawsuit so the original volunteers that sacrificed to help make the
00:25:25.760 convoy happen are being sued for over 400 million dollars and there's this mariva injunction that we
00:25:32.660 converted to an escrow so in order to get that 5.5 million out to anybody we first got to get rid of
00:25:40.340 the class action lawsuit which is being occurring works being done on that and defending it then
00:25:46.820 we've got to convince the court that the criminal proceeds section 490 order was issued improperly
00:25:52.860 and get that canceled then we've got to eliminate the civil forfeiture then we will have unlocked
00:25:58.880 all three safes the um the original when the convoy started each province divided itself into
00:26:09.420 regions and self-elected, as they were on the road, a road captain. So there's Sean Thiessen,
00:26:17.000 who's Tyson, who's the Southern British Columbia road captain. There's Miranda Gracer from Lloyd
00:26:22.040 Minster, who's the Northern Alberta road captain. There's Chris Barber, who is a road captain.
00:26:27.020 There's Dale Enns, who's a road captain. Ryan Mihilowicz, who's a road captain. These were
00:26:34.860 the original guys who led the sections of the convoy across the country day and night saw the
00:26:41.280 tens of thousands of supportive canadians worked on the ground in ottawa every day in the operations
00:26:47.420 center and dealing with all the different issues that's the board of directors of freedom corp
00:26:52.940 okay and it's still the board of directors there's some allegation has been taken over by foreigners
00:26:57.720 or something uh it's still those original group and they're all being sued for the 400 million
00:27:03.720 So the board back in February did a survey of like 10,000 people participated and said, what should we do with the money if we can get it out? Should we get it to cover the truck registered truckers costs and any surplus give to veterans?
00:27:19.700 or should we use the money should the money be used to pay for trucker expenses and money for
00:27:28.460 legal defenses for the various truckers and supporters who are facing criminal charges
00:27:33.440 civil charges and others to help them with their legal defenses and the overwhelming like 88 percent
00:27:39.920 of the respondents said uh get it to the truckers don't give it to the veterans unless the legal
00:27:46.600 stuff's looked after because these people fought for our rights and we want them not to suffer and
00:27:51.180 have to remortgage their house to hire a lawyer. So the monies to summarize has all either been
00:27:57.900 refunded to the donors. The money that hasn't been refunded to the donors is in these three
00:28:03.260 safes that we're trying to get out. And if it's ever gotten out and isn't scooped by the government
00:28:09.240 or the personal injury lawyer in Ottawa, then the goal is to use it to cover registered trucker
00:28:16.300 expenses and to help them get legal defenses. This civil lawsuit being launched or spearheaded
00:28:23.340 by Paul Champ in Ottawa, this is based upon the complaints of what, a couple of hundred or a
00:28:28.900 couple of dozen residents of downtown Ottawa? Well, he initiated on his own and he just needed
00:28:33.520 a notional plaintiff. So it's classic kind of personal injury class. Zexy Lee. Zexy Lee. Yeah.
00:28:40.340 and and happy goat coffee um it's based on the law of nuisance uh it's one of our older common
00:28:47.100 law torts which is a cause of action and it's uh if you unreasonably interfere with someone's use
00:28:52.420 and enjoyment of their property uh you can be sued uh we think the case is completely deficient
00:28:57.860 for many many reasons like he's created a donor class where he wants to sue potentially bring
00:29:04.340 into the lawsuit anybody who donated well there's a ton of problems with that first of all
00:29:08.600 how much of the money think about this this is a test class shadow and you're my i'm gonna i oh
00:29:15.120 you just put your hand up to answer this question uh shadow after the lesson i just gave how much
00:29:21.100 of the money actually got to the trucker sir how much zero yes zero right so none you uh star for
00:29:30.020 you um ding uh so um you see what i'm saying so just that fact alone it's based on this fiction
00:29:38.860 that didn't uh that didn't this falsehood rather that that didn't exist this paul champ didn't 0.90

00:30:10.800 before so i've um i've done a lot of work representing farmers and ranchers over over my
00:30:17.240 career um dealing particularly i'm kind of uh for if you look at the high profile cases i've had
00:30:25.220 contaminated water wells cattle being killed public health you know my clients getting sick
00:30:30.580 from emissions from heavy oil production and so on i'm kind of been the aaron brockovich of alberta
00:30:36.800 without the endowments and good looks i was about to say that yeah beat you um so that's the kind
00:30:44.760 of practice i've had so i've been used to you know when i go into a fight i'm representing
00:30:49.540 this farm family that doesn't have much against a multinational oil company that would a minimum
00:30:56.460 of five lawyers they always wolf pack me that's an expression in litigation when you're in a big
00:31:00.260 fight and the party's got lots of money they put wolf packs on them and a wolf pack's always a
00:31:04.300 minimum of five i had this one that was high profile it led to a public inquiry actually
00:31:08.260 you can look it up on my my website uh wilson law office that's here whatever it's called
00:31:12.380 and they had three wolf packs so I had 15 lawyers that I was trying to fight for compensation and
00:31:20.140 ultimately got compensation for these families and so on but so that's the kind of work that
00:31:25.280 I would do I also worked for industry associations like cattle and chicken and dairy and so on trying
00:31:32.120 to get reform to legislation I represented the cattle industry during the BSE crisis and I was
00:31:38.780 in the Government Emergency Operations Centre for that. I had a good interaction, a learning
00:31:44.740 experience with public health officials when I represented the H1N1 Zutonic transmission case
00:31:51.060 that was ground zero for the international outbreak, happened to be in Alberta, and I
00:31:55.140 represented the farm family where the transmission had occurred. So I was dealing with all the public
00:31:59.960 health officials, again, in our emergency operations centres. So I've sued governments.
00:32:06.100 Most lawyers will not sue governments. It's very unusual processes to sue governments. I've
00:32:10.780 successfully sued particularly provincial government and municipal governments. So that's
00:32:15.620 kind of my background. And it kind of made me maybe better suited than other lawyers for the
00:32:22.200 unusual challenges of representing the Freedom Convoy. How long had you been doing this prior
00:32:27.560 to the convoy? I'm going to say 30 years, maybe a little bit. Yeah, I'm 28 years at the bar. So I
00:32:32.440 would have been 27 years at the bar. And what a lot of people don't realize is the statistics are
00:32:37.900 consistent. So, um, five years after I graduated from law school, half the guys and ladies that
00:32:45.640 I graduated with quit practicing law. So that's the attrition rate. The stress, the burnout is so
00:32:52.220 high that it's five years, half the bar quits. They're out. They're like, they go do something
00:32:57.360 else. So you'll see, that's why people say, I'm a recovering lawyer. Right. Um, and then it keeps
00:33:01.520 going down so there's not a lot of lawyers when you start to get up to 20 years and 30 years of
00:33:08.440 experience we're a small group and I'm a very specialized litigator and I take on very complex
00:33:15.020 challenging cases so you're a guy who's been practicing for a lot of time with plenty of
00:33:21.060 success you have represented people well and I'm not going to get into your own personal finances
00:33:26.980 but let's just say that you're well off and you did not need any money from the Freedom Convoy
00:33:32.660 or anybody else during this whole nightmare the last year and a half. You were perfectly happy
00:33:38.140 and you didn't need to get involved in any of this for any reason, except for the fact that
00:33:44.040 you knew what was going on in this country. Yeah, I mean, it's funny when I go to meetings or
00:33:51.160 something years ago and somebody would hear me speak if I do a lot of public speaking and they'd
00:33:55.360 say, Oh, they come up to me after, can I get your business card? Cause I want to phone you about a
00:33:59.180 case. And I would go, I'd laugh at them and I'd say, my wife hasn't let me have business cards
00:34:04.560 for years. And she had, she'd actually checked my coats before I go to a meeting. If I snuck
00:34:09.260 some business cards in. Um, so, so my ratio is usually one to 10, one to 20. So for every 10
00:34:16.520 to 20 people that phone me, I'll say yes to one of those 10 or one of those 20, depending on the
00:34:23.320 flow in other words i didn't do this because i was looking for work you know like no way i had
00:34:28.860 to shut down a whole bunch of my files and my clients were so understanding it was just heart
00:34:33.200 touching that because they i had clients with serious litigation files and they flat out said
00:34:38.460 to me keith what you're doing in ottawa is more important than my case so they all knew they all
00:34:44.720 knew what was going on as well yeah i thought i was gonna get fired on a bunch of cases and i was
00:34:48.800 quite surprised that that i didn't um so you know and so how i came to be involved in this was
00:34:55.860 in the fall of 2021 is we're all living this dystopian nightmare driving by playgrounds with
00:35:04.220 like police tape on them and swimming pools emptied and kids can't go to hockeys and all
00:35:12.100 these social events we really learned through covid and lockdowns that these social events
00:35:17.340 These social markers are so important to our community, our social development, our well-being, our mental well-being, the development of our children.
00:35:25.920 And I was just beside myself, as was my wife.
00:35:29.040 But the difference is my wife's a retired RN, university degree nurse, and she's looking at the science and the public health stuff.
00:35:38.400 And she's going, this doesn't make any sense.

00:35:43.320 so for the first time ever in our 37 years of being together uh we have four kids she said to me
00:35:53.000 you got to go you got to get involved so i said you want to get involved like were you showing
00:36:00.340 well i did you wanted to get involved or or i did but i kind of knew it was gonna be a hell of a go
00:36:06.680 man. First guy through the wall always gets bruised. And I knew I was going to get bruised
00:36:15.820 and I'd gotten bruised, but that's okay. So I said, when she said that to me, I said the two
00:36:20.580 smartest words a man's ever said. I said, yes, dear. And that led to the Peckford case, which
00:36:27.580 the Justice Center, I mean, I'm my own boutique firm. I've been aware of the Justice Center.
00:36:31.860 They've been around for 15 years. They do great work. They've been fundraising throughout that
00:36:36.540 time for a variety of different things they didn't come into existence because of covid
00:36:40.400 or the freedom convoy like some of these trolls allege um and uh they said we really need some
00:36:47.560 senior counsel on some of these files you know most senior lawyers won't touch any of our stuff
00:36:52.380 would you be willing to take one that request combined with my wife saying you got to get
00:36:57.880 involved i said all right i'm in agreed to do peckford's charter challenge on behalf of six
00:37:02.900 million unvaccinated Canadians who are being deprived of the right to travel, to be at the
00:37:07.660 side of dying loved ones, to go to marriages, award ceremonies, births, help out a loved family
00:37:14.980 member who's recovering from surgery, has been discharged, has no one to care for them, you know,
00:37:19.020 things like that. And I'm like, yeah, let's do this. And that started in December of 2021. Then
00:37:25.280 the convoy started in january and on february 1st i was had a zoom meeting set up with my legal team
00:37:33.460 on the peckford case and i was administrator and i saw these people in the waiting room i didn't
00:37:38.760 recognize so i clicked eva and eva chipiak my wingman and she said i said what's going on who
00:37:43.780 are they she said let them in and i'm like okay i let them in and a group of lawyers who i hadn't
00:37:49.520 met before explained they'd been contacted that morning by dr christian from saskatchewan
00:37:54.440 and by Tamara Leach and others from Ottawa
00:37:58.620 that they really felt they needed some legal help,
00:38:01.280 that they were overwhelmed.
00:38:03.020 And the Justice Centre had agreed to fund a team of lawyers
00:38:06.740 and a team had been assembled
00:38:08.700 and they asked me if I would lead that team.
00:38:10.680 And I said, how can I say no?
00:38:12.960 You were the veteran on the team, I'm assuming.
00:38:16.260 That's why you're going to be the one in charge of it.

00:38:23.000 well on the ground we had five but we had a whole network behind like at at times the justice center
00:38:29.580 was literally funding 17 lawyers 17 wow right and and and no trucker was asked to pay for that and
00:38:39.960 and is not being asked to pay for that that was through their own fundraising initiative
00:38:43.920 and there's this thing out there that oh the justice center has five million dollars that
00:38:52.980 they got from truckers or something that's pure nonsense it's absolute fabrication the justice
00:38:59.840 center has always done fundraising just like the democracy fund just like the canadian civil
00:39:05.040 liberties association just like the canadian constitution foundation and so on and they're
00:39:09.100 all doing trucker cases they all fund raised on the idea that they would help protect people's
00:39:15.120 right of assembly fight covid restrictions and help freedom convoy truckers so um that's some
00:39:22.260 some context there and and uh i was on the ground for 19 days um before we get into the ottawa keith
00:39:29.840 i want to talk a little bit about brian peckford's uh case sure i believe he he uh he was using the
00:39:35.720 was it section six of the charter the freedom uh right to sorry not freedom freedom of movement
00:39:42.760 uh clause and we had go ahead we did a number we we we our pleadings were very comprehensive
00:39:50.340 and it's a fascinating and it was a team effort you know i've had so much compliments from
00:39:56.640 very experienced counsel lawyers and i've said wait a minute that was yeah i had a hand in it
00:40:02.940 But there's a lot of other people that deserve credit, lawyers that deserve credit for that.
00:40:07.900 But so we pled loss of mobility rights.
00:40:12.700 We pled in our charter challenge for the six million Canadians, violation of their right to security of the person, their freedom of religion.
00:40:25.220 We pled every aspect of the charter that we could think of.
00:40:30.760 We pled the Bill of Rights as well, because there was applicable arguments there. And we even pled, because it was perfectly proper and necessary to do so, we pled the Nuremberg Code. 0.60
00:40:43.320 so it was a very comprehensive legal challenge and it resulted in the government putting forward
00:40:50.180 16 witnesses uh five experts and 11 of the most senior government officials
00:40:57.680 responsible for vaccination and covid policies um including those that the prime minister and
00:41:06.500 ministers would trot out to their press conferences every day and saying we're keeping canadians safe
00:41:12.700 right and so we're depriving you of all your rights and liberties and freedoms and social
00:41:18.920 activities and economic activities because we're keeping you safe because all of our experts and
00:41:24.060 officials have said this is what we should do and then i'm cross-examining them along with my team
00:41:28.860 and i'm saying did you tell that to the prime minister and they're not me not me not me but
00:41:33.080 there was some spectacular admissions that came out of that case let me tell you one other thing
00:41:39.000 think about this for a minute what covet has done and the government's overreaction to it
00:41:44.620 has exposed corruption of institutions it exposed the corruption of of of the public health
00:41:52.680 officials the medical profession you know how the the search college of surgeons whatever
00:41:56.800 would punish a doctor for speaking out still are but it also and i could keep going through the
00:42:01.620 list right the police with all the stuff we've seen and and and and but it exposed the corruption
00:42:07.520 of the media. And I can give you one very simple, absolute conclusive piece of evidence.
00:42:15.800 We have an anomaly in Canada that one of our founding fathers of our modern constitution
00:42:23.360 and charter of rights and freedoms is still alive. Could you imagine if that was the case
00:42:28.580 in the United States with all their litigation? He's still alive. His name's the Honorable Brian
00:42:32.960 a peckford okay he is signature of this um and he sued i happen to be one of his lawyers in the
00:42:41.640 charter challenge the sitting prime minister the son of pierre elliott trudeau who he signed the
00:42:47.860 charter with how can that not be news and he did so on behalf of six million canadians who glaringly
00:42:56.980 had their charter rights fundamentally violated in a harmful manner how can that not be news
00:43:05.220 google it you will not find one single not one canadian news story on it you'll find it on fox
00:43:15.940 you'll find it on the new york post you'll find it on the bbc but you won't find it in canada
00:43:22.080 when i have done far low profile cases when i was in ottawa in september of 2022 with eva chipiak
00:43:30.940 at my side and we were arguing uh the mootness application that the federal government bring to
00:43:36.440 knock out the charter challenge for on on on behalf of our client six million canadians
00:43:42.780 normally when i come out of a court on even something not nearly as sensational as that
00:43:47.960 you're scrummed there's tv cameras there's media and everything else i came out and there wasn't
00:43:55.560 a soul and i wasn't surprised about i mean i was and i wasn't but like that shows the corruption
00:44:01.880 of the legacy media they did not want to cover this because they were worried they would upset
00:44:09.040 their paymaster uh justin trudeau uh using our tax dollars to disseminate misinformation and
00:44:15.980 control the media well even though you know it's interesting in the last couple of days twitter
00:44:20.860 has been wrapped with a government-funded media label on twitter which i think is hilarious but
00:44:25.540 only 69 percent right they've adapted it as of today and elon musk was happy to tell us all that
00:44:32.540 news but what about the other media organizations i mean i worked in media for over 35 years keith
00:44:37.760 And I have to tell you that I know that CTV and Global and Rogers are not directly government funded entities.
00:44:51.640 Now, publications are different publications which are owned by the same company.
00:44:56.460 So could an argument be made that Global News and I know that Global News has gone to the Senate begging for more taxpayer dollars?
00:45:05.140 I'm not sure if they've received any yet, but I know that Troy Reeb, who is one of the top VPs of Chorus Entertainment, was pleading for more money from the government in the last few months.
00:45:16.640 Could it be could an argument be made that these are, in fact, government funded entities based upon the subsidiaries of their companies?

00:45:32.500 I can't remember whether it's $169 million or $69 million, but it's a substantial amount.

00:46:06.200 70 percent government and then he said okay fine 69 because i think he was having fun with it you
00:46:10.420 know that's what he does if you look he replied to their complaint with a with a poop emoji so we
00:46:15.020 know where he stands on all of that do you know what his donation was to uh to go fund me by the
00:46:20.240 way elon musk for the freedom cowboy it was 42,069 did he get it all back no 420
00:46:30.980 marijuana and then 69 i just leave it at that so i think he was quite happy to change the 70 to 69
00:46:39.420 right um but the point that i make is that something's happened to the media
00:46:46.320 obviously as my example demonstrates and i think you know what is the magic percentage where they
00:46:54.440 feel they have to first look after their self-interest and i i don't you know there's
00:46:59.700 been a gutting of these newsrooms i've gone into ctv studio here you know 10 years ago 15 years ago
00:47:05.880 And then I went in there about four years ago and I felt like I was going into a morgue, man. Like the place was 80% empty. The energy level was awful. I felt for the people that were left. So I feel for them, but we've had a big disruption in how we get information, obviously.
00:47:25.440 Well, it's all been centralized and it all comes out of Toronto and that's it. I mean, even local newscasts to some degree, I think the late night ones in cities like Edmonton, Calgary, Winnipeg, Saskatoon, Regina, outside of Vancouver, Montreal and Toronto, the late night local newscasts that look like they're coming from the local station are actually coming from Toronto, which is interesting.

00:48:05.760 So what happened with the Peckford case?
00:48:07.580 And I want you to explain, please, mootness in regards to to what happened with your case and how that's been applied all across the country.
00:48:16.280 Because I've been hearing a lot of mootness in the last year or so.
00:48:19.720 So in our legal system, we have a concept of mootness. And what that means is, if there's no longer a live issue in dispute between the parties, some event has occurred to take away the grievance or the conflict or the point they're arguing about, then we shouldn't waste judicial resources and legal fees.
00:48:45.560 and a court should we should throw that case out on saying it's no longer something we need to rule
00:48:50.920 on it's moot um there's a very well established test from the supreme court of canada in the
00:48:57.480 burowski case i believe it is i just can't remember the name of the case but i know the test
00:49:01.340 and and there's a public interest exception and that's what we argued but the problem here is
00:49:08.140 and uh professor party talked about this the other day in his testimony to the national citizens
00:49:13.700 uh inquiry is that the order the order that restricted six million canadians from their
00:49:22.560 fundamental range of flying and also by the way uh we had one of our applicants because we had
00:49:27.540 and then we had uh several other people who were our notional plaintiffs or applicants
00:49:32.560 needed to get to england to look after a dying an ill relative and i got uh one of the senior
00:49:42.140 officials in Transport Canada in the case to admit under oath that the only way, because this person
00:49:48.960 wasn't allowed to fly and they weren't allowed to get on a ship, so I said, the only way that this
00:49:54.960 person can get to England to look after this loved one is to swim the Atlantic, right? And she said
00:50:02.280 that's correct. So that was the severity of it. That order was not an act of Parliament. Parliament
00:50:09.900 made amendments to the Aeronautics Act after the 9-11 terrorist attacks in the U.S. to give
00:50:16.740 emergency powers for emergency aviation safety and terrorist type issues to the minister and his
00:50:25.200 deputy. Not even the minister, the deputy can do it as well. But they're only allowed to put an
00:50:31.080 order in for two weeks. It automatically expires every two weeks. So every two weeks, they would
00:50:35.680 reissue the order when we sued we were on order number 52 and by the time we got to court i can't
00:50:41.200 remember what number we were on so the problem is that uh they can put this in so quickly without
00:50:48.300 going through the parliament without going through debate and public process because they've delegated
00:50:53.020 the the order making power to the minister or the deputy and they can suspend it so by the time you
00:51:01.100 do all the work to get to court they can say oh it's moot and then the court rules it's moot and
00:51:06.560 then they can bring it right back in so they can effectively evade the court and that was one of
00:51:10.240 our arguments but i also made an aggressive pitch to the court we had an associate chief justice of
00:51:15.540 the federal court that we were before that canadians need to know about the worthiness of
00:51:21.380 this institution and their charter and this is a fun this affected six million canadians and
00:51:28.240 actually we'd done the math because it was actually higher than that because of the rule on
00:51:35.560 what a current vaccine was right and we know that so few people have gotten boosters
00:51:41.060 so it was a disappointing journey but it was a necessary journey the evidence that came out
00:51:47.580 was spectacular um dr lorenko who is the senior official with health canada who approved the
00:51:53.900 vaccine. I effectively got her through cross-examination to admit that it was experimental,
00:52:00.160 which is remarkable because anybody who got vaccinated was not told that they were
00:52:07.500 participating in an experiment. They were not told that they are now the phase three human trial.
00:52:14.900 And that's where the Nuremberg Code comes in, informed consent. So what a journey.
00:52:20.760 and where's the media in all this i mean you actually got that doctor to admit that the
00:52:25.800 vaccine was experimental i mean in the old days keith that would have been front page news on
00:52:31.920 every network every publication everything uh that does news in the entire country and yet crickets
00:52:38.380 and better dr waddell who's the head epidemiologist she's four so dr tam another doctor and then one
00:52:45.820 more and then her so she's number four in the hierarchy at the public health agency of canada
00:52:49.460 and she's the head epidemiologist for Canada and I was looking through all the guidance and all the
00:52:56.720 documents and the binders of evidence that they had filed each one of them was a binder
00:53:00.980 a thick binder we had to work so hard on that file I can't believe I survived 2022 period but
00:53:07.500 with the inquiry coming in the fall but she she I said to her because I couldn't find anywhere in
00:53:16.160 their documents that they'd recommended to the prime minister in the cabinet that they restrict
00:53:20.040 Canadians right to fly if they're unvaccinated so I put it to her in cross-examination style you 0.97
00:53:27.120 know with no smile and no glint in my eye and I said you know I put it to you that the truth is
00:53:31.420 that the public health agency Canada did not recommend vaccination for air travelers right 0.81
00:53:40.220 and I was like oh boy what's her answer going to be and she said that's correct and then I waited

00:53:53.820 said because the scientific literature literature indicated it wouldn't be effective it wouldn't be
00:53:59.500 an effective mitigation strategy so not only did we we not have officials telling the prime minister
00:54:06.580 and the minister of transportation to restrict six million canadians rights to travel
00:54:10.020 we had the officials concluding it wouldn't have helped it wouldn't have done anything and I
00:54:16.660 remember also saying to all of them because at this point too Canadians don't realize
00:54:20.660 in the in like February and stuff all the other countries had opened up they didn't require
00:54:27.300 vaccination for air travel they didn't require vaccination Canada was this anomaly because we
00:54:31.380 didn't drop it till what June and um so I would say to them I'd say all right um you're aware that
00:54:39.720 um uh air travel occurs in other parts of the planet right yeah okay uh is there something
00:54:45.480 different about the aircraft that are used in europe and england um and south america from
00:54:51.960 the aircraft that are used in canada no all right is there something fundamentally different about
00:54:56.460 the human physiology of canadians in our dna from those people in europe yes or no no is there

00:57:26.900 about a vaccine related death and then he put this eerie smile on yeah but they you know like
00:57:35.220 that it was a good death because they did such good through having it was creepy man to answer

00:57:49.020 were all split up so we had so you have health canada that deals with the vaccine and its
00:57:54.500 approval and monitoring its effects and so on and the trials and the reviews then you have the
00:58:00.420 public health agency of canada that's dr tam and that's where the epidemiologists are the all the
00:58:05.940 people responsible for testing protocols and then they had the covid cross ministry covid response
00:58:11.340 team uh that had multiple different ministries involved at the federal level and then you had
00:58:16.780 uh transport canada and then they had different teams depending whether it was rail ship or
00:58:24.740 aircraft so we had experts all over the place do you know what theresa tam said the other day
00:58:30.140 what she said that uh capitalism drives poor health negative health and what was the other
00:58:37.720 think capitalism and white supremacy i saw that supremacy like how is this person even in the

00:59:32.600 morning in edmonton we didn't arrive till 10 30 at night in ottawa and then immediately went
00:59:37.700 downtown what yeah oh yeah yeah we had to stop in medicine hat to pick up uh some people describe
00:59:45.000 this as this luxury jet and i'm eating grapes and drinking martinis you know i'm like no you
00:59:50.480 were not on this plane man sitting there holding an air sickness bag yeah no i thought we're landing
00:59:55.860 again yeah yeah and the alarms are going off you know because you hear everything right

01:00:54.340 to see what am I going to see what was your first impression well my first impression was I was
01:01:00.560 thinking how how many blocks are we going to have to walk right before we encounter the outer
01:01:07.340 perimeter of this occupation right how many how many blocks or miles is it from downtown is the

01:04:02.320 I had Tamara and others, and I helped her with a statement about why they were in Ottawa, what they were fighting for, what they were doing with the money, all the safeguards that had been put in for the money, for the donations, and how the money was going to be allocated.

01:05:28.900 independent truckers and i've represented a lot of groups in alberta who were ranchers and i
01:05:35.760 immediately noticed the similarity of personality between the independent rancher and the independent
01:05:40.060 trucker and it's like you can't tell them to do much you got to let them do their thing but maybe
01:05:44.660 help them see things they wouldn't see otherwise right and then there was also these groups and
01:05:48.840 I've testified to this, and Tamara's testified to it, and Mirazo's testified to it, and Eva's
01:05:53.340 talked about it, that were coming in, some with great intentions, trying to help others with not
01:05:57.960 so much, and trying to sort of take it over. So there was really a protective type role of
01:06:04.900 trying to filter and let Tamara and Chris Barber and Bridget and others deal with the issues
01:06:13.200 while eva and i were trying to guard off these side attacks and keep things on the up and up
01:06:19.120 and manage issues so but at the end of the day this this really was you know who the leaders of
01:06:24.320 this this thing were the leaders were i'll tell you i know exactly who they were it was the tens
01:06:31.620 of thousands of canadians who lined the highways it was 113 000 people who donated to give send go

01:07:19.320 one who was speaking what about pat king and so i'll ask you right now what was the involvement
01:07:24.160 with pat king if any in your experience well of a all the people in ottawa but for a couple like
01:07:32.740 none the only guy i actually had any interaction with before ottawa was pat king ironically
01:07:37.880 and it was uh the year earlier where he was all over social media claiming that he had single-handedly
01:07:44.940 defeated all covid laws right and it was a decision out of red deer and i was like i don't
01:07:49.700 think so so i researched the decision and then he went after sheila gun reed at rebel and so i
01:07:56.900 jumped in with legal credentials and said look pat sorry i mean we appreciate your efforts but
01:08:01.880 you're that's not what the court ruled you haven't single-handedly struck down so i already had known
01:08:07.020 of him as as being a loud voice uh someone with strong views maybe overstates things at times
01:08:15.020 and um but he had made a number of comments that had caused tamara and others to have concerns
01:08:20.760 in route to the convoy she's testified to this as have others so they tried to distance themselves
01:08:26.440 he did come into one of the op centers when i was in there and i said he's got to go
01:08:30.600 we just didn't we just couldn't manage that additional distraction he was um but such a
01:08:38.020 popular figure was there any way that you could think of to maybe integrate him in into the
01:08:42.840 situation into the leadership group because what's happened is a polarization within the people
01:08:49.880 right i mean they were a lot of them were following pat and a lot of them still believe in pat i like
01:08:54.900 pat i know he's launched a lot of hyperbole in the last couple of years a lot of incorrect
01:09:00.260 direct accusations. I know he's tried different things with the media that haven't exactly played
01:09:05.240 out well. But, you know, even after all of that, here's a guy who did so much time in jail. And,
01:09:12.160 you know, he's still under such strict conditions as are Tamara and Chris, that wasn't there any
01:09:20.300 way that you could think of in that moment to maybe bring him in without actually having him
01:09:25.880 as part of the leadership just to appease
01:09:28.580 the thousands of Canadians who supported him?
01:09:31.640 The answer to that is a hard and definitive no.

01:13:41.120 uh so this is serious business and i've negotiated complex i've been in middle of
01:13:48.240 international crisis as before with bsc and h1n1 and uh i knew the tension levels were so high
01:13:55.000 and with the permission of tamara and others we started opening up back channel dialogue

01:14:04.580 they had reopened on the weekend of the 12th and 13th of february remember it was monday

01:15:00.240 lemedi my clients instructed me to waive solicitor client privilege and to tell the truth and fully
01:15:08.580 answer questions for everything for that relevant period of time and they confirmed it in writing
01:15:13.500 with written waivers that were filed in evidence.

01:16:09.860 the enemy just sweeps them out right so marazo was really concerned about how thin these blocks
01:16:15.180 were getting and also how thin wellington was and the major beef was with the federal government
01:16:20.240 for the federal mandates so we wanted to get vehicles up to wellington um and one thing led
01:16:26.660 to another we're also a lot of the people at coventry in other words they all felt we were
01:16:31.600 in this stalemate and the morale was dropping tensions were increasing people were feeling
01:16:36.780 the need to get home so we needed to do something to mix it up we need to do something to reset the
01:16:41.480 narrative and throw the legacy media off and really put the pressure on the prime minister
01:16:45.500 especially because the borders had reopened so that's where this deal with the mayor between
01:16:50.100 the trucker leadership and tamara went out and met with truckers chris barber was constantly out we
01:16:56.000 printed off 850 flyers to explain the deal to everybody to get buy-in from because no one
01:17:03.080 controlled them right in the same way no one controlled pat king right uh so remarkably uh
01:17:10.060 we had the mayor did a letter tamara did a letter that was uh on the saturday the the 12th there was
01:17:17.740 a logistics meeting at city hall with the superintendent drummond from the ottawa city
01:17:22.000 police uh uh head of emergency another guy head of emergency services steve k city manager a whole
01:17:28.640 bunch of the truckers have a chipiak um and um it's funny like the the trolls will focus on a
01:17:37.540 tweet of mine where i say we did a divide and conquer what that meant was i stayed at the
01:17:42.740 operations center with tamara and some others in case there was a flare up on some of the blocks
01:17:48.480 and we could go talk to them about the deal well eva went over with chris barber and others to the
01:17:53.680 meeting at city hall it's a simple expression of saying let's redeploy our own resources so we can
01:17:59.760 conquer the problem right and they've painted this oh here's proof of a conspiracy so anyhow
01:18:05.240 uh what we had was on the sunday evening we had a plan ready to move trucks and then bj dicter went
01:18:12.560 into tamara's twitter account and sent out a tweet from tamara at night saying there is no deal and
01:18:19.320 that's what the prime minister relied upon in his testimony as did freeland and others as to why they
01:18:25.100 invoked the emergencies act was because of mr dicter's tweeting from tamara's account without
01:18:31.800 her permission without her blessing and against her wishes because she did fully support the deal
01:18:36.360 and we issued a correction so here we are on the monday morning and we're getting chris's out there
01:18:42.680 eva's out on the ground there's lots of video footage of this the trucks are moving under police

01:19:36.840 up to the top floor into one of the boardrooms where ironically 40 years earlier premier peckford
01:19:45.780 had negotiated the charter with justin trudeau's father like the the convergence of history in that
01:19:52.860 moment and i went into the room uh skipped the hellos or if they were very curse and i i still
01:20:00.640 call him mr premier from my years of working advising premiers it's just a habit and i think
01:20:05.840 he's earned it. I said, Mr. Premier, I've got terrible news. The Prime Minister's just invoked
01:20:11.120 the Emergencies Act. And he paused and he kind of had his hands together at the head of the table

01:29:24.080 the a day or two before the raids they subbed those guys out and the guys that came in were the
