00:07:10.000 bill C63. I personally don't think that it's got a chance of passing before Trudeau gets booted out,

00:07:21.220 an election. And also remember, this is something I think Leighton Gray maybe mentioned on the show
00:07:26.400 a couple of months back, that in law, Canadian governments have a five-year mandate, not
00:07:35.700 just a four-year mandate.
00:07:37.880 Harper introduced the Fixed Election Act, and that was, I'm going to say, 10 years ago.
00:07:44.500 But before that, governments had five-year mandates, unless, of course, they were minority
00:07:49.100 governments and they got toppled by the other parties, or if a majority government decided
00:07:54.260 they wanted to have a snap election.
00:07:56.400 But you could technically be in power legally in Canada for five years.
00:08:03.360 And if Justin Trudeau decides he wants to repeal the fixed election rule, sorry, law,
00:08:09.420 that Stephen Harper put into place all those years ago, he can.

00:08:41.020 I don't think he's got the time to pass this. And if he does, it's going to get in just before
00:08:46.980 the election gets called next year, and then it'll be repealed anyway by Pierre Polyev,
00:08:52.960 who says, says, that's what he's going to do.
00:08:56.040 So we'll see what happens.

00:22:52.960 A few days ago, my colleagues gave me a heads up that a Twitter account was calling me out as a
00:22:57.980 cacozotic Jew in charge of a Jew charity.
00:23:03.220 I take the word cacozotic to mean I'm a fair-skinned Jew.
00:23:06.740 The latter part is a bit more confusing because the charity I direct has no religious or ethnic affiliations.
00:23:12.460 I laughed and blocked the account, but the Liberals' newly proposed law suggests
00:23:16.540 that not acting on these kinds of tweets could leave Elon Musk on the hook for 6% of X's global revenues.
00:23:25.640 That's just one example of the absurdities that could result if Minister of Justice Arif Farhani's revamped Online Harms Act passes in Parliament.
00:23:34.640 It's Bill C-63. It's aimed at regulating a wide swath of undesirable online conduct from child sexual exploitation material, already criminalized, by the way, so this is redundant, to the more amorphous content that foments hatred, which is something we still can't figure out.
00:23:53.620 The Liberals' decision to deal with this range of conduct in one fell swoop
00:23:57.940 perhaps distracts from the reality that the Online Harms Act
00:24:02.160 is a profoundly anti-free expression bill that threatens draconian penalties for online speech,
00:24:09.460 chilling legitimate expression by the mere specter of a complaint to the Canadian Human Rights Commission
00:24:14.540 or the new Digital Safety Commission of Canada, which has yet to be formed.
00:24:20.900 The bill beefs up criminal penalties for instances of hate speech
00:24:24.840 and creates a new standalone offense motivated by hatred.
00:24:28.840 The hate crime of advocating genocide,
00:24:31.080 previously punishable by up to five years imprisonment,
00:24:33.580 now carries a possibility of life in jail,
00:24:39.840 which is 25 years in Canada.
00:24:42.440 Advocating genocide is evil,
00:24:44.480 but it's stunning to think someone in a free society
00:24:47.340 could spend life in prison for their words. Previously, a finding that a crime was motivated
00:24:54.140 by hate could be considered as an aggravating factor in sentencing. Now, an offense motivated
00:25:00.000 by hatred is a separate offense. Not yet, because it's just a bill. But she's claiming that if it
00:25:07.660 does become a law, then now an offense motivated by hatred is a separate offense, which can be
00:25:13.580 charged and prosecuted by police and prosecutors.
00:25:16.680 Verani proudly touted this new standalone offense as allowing offenses motivated by hate
00:25:21.560 to be charged on the front end, again, whatever that means, suggesting the government is signaling
00:25:28.360 to law enforcement to seek, charge, and prosecute more such crimes, and you can bet that if
00:25:34.220 this does pass, they'll be looking for somebody that same day.
00:25:39.460 Probably my money would be on Ezra Levant.
00:25:41.920 Even worse, the bill provides a preventative criminal restraint on suspected future speech.
00:25:47.640 Anyone with the Attorney General's consent can request that a judge order a 12-month
00:25:52.500 recognizance to keep the peace if they have reasonable grounds to suspect that someone
00:25:58.880 might commit hate speech in the future.
00:26:03.160 Yeah.

00:26:06.440 If they agree, they can be subject to major restrictions on liberty such as giving a
00:26:11.040 bodily sample, refraining from drugs and alcohol, and wearing an ankle monitor. If they refuse,
00:26:17.400 they can be imprisoned. The bill also brings back a civil remedy for communicating alleged
00:26:23.600 instances of hate speech in the form of reviving the dreaded Section 13 of the Canadian Human
00:26:28.760 Rights Act, specifying that such instances constitute discrimination and are liable to
00:26:33.780 be investigated by the CHRT. The tribunal will expand to as many as 20 government-appointed
00:26:42.320 bureaucrats tasked with policing allegations of harmful speech. Even if most alleged instances
00:26:48.740 are dismissed as not meeting the threshold of hate speech, the penalties for individuals found
00:26:54.240 liable up to $50,000 paid to the government plus $20,000 paid to the victim are severe enough that
00:27:01.260 we can infer the new regime will lead
00:27:03.360 to large amounts of backpedaling
00:27:05.480 and self-censorship by people
00:27:07.280 accused of crossing the line,
00:27:08.940 which is
00:27:09.940 what the bill is designed for.

00:27:15.460 to police yourself.
00:27:19.360 Just like you had to in society

00:27:31.260 We will also see more people punished for their speech, considering that S-13 creates
00:27:36.840 a civil defense that need only be proved on a balance of probabilities, which is much
00:27:42.500 easier than meeting the criminal law's more stringent threshold of beyond a reasonable
00:27:46.340 doubt.
00:27:47.200 The bill makes extensive use of what's been called jawboning.
00:27:51.800 Delegating to and pressuring social media platforms to themselves take steps to police
00:27:56.480 their users.
00:27:57.940 Platforms are tasked with a duty to act responsibly and minimize harms to users.
00:28:02.360 They must provide a mechanism for users to flag harmful content,

00:29:06.920 and tempting and all of that online but this bill even though it encompasses that
00:29:14.200 is not just that, but that's how the Liberals are touting it.
00:29:20.440 This woman's harrowing testimony foregrounded some of the bill's priorities,
00:29:24.320 which are obviously laudable.
00:29:26.280 That said, viewing or distributing child sex exploitation material
00:29:30.240 is already strictly criminalized.
00:29:32.220 It's also good news that the only harmful content
00:29:34.900 that must be removed within 24 hours
00:29:37.100 is child sexual exploitation material and revenge porn.
00:29:42.420 The earlier iteration of the bill that died on the order paper in 2021
00:29:46.740 also required alleged hate speech to be taken down within 24 hours.
