00:00:52.360 and with the shocking and dynamic endorsements by independent presidential candidate Robert F. Kennedy Jr.
00:01:02.380 and Congresswoman Tulsi Gabbard, a former four-term Democrat congresswoman, Democrat candidate for president in 2020,
00:01:11.700 and the forward momentum by the Trump campaign,
00:01:17.740 you have, of course, now a return to lawfare.
00:01:21.340 Out of the blue, Special Counsel Jack Smith has filed a superseding indictment in the District of Columbia.
00:01:29.740 Now, you'll recall that in the so-called documents case in Florida, Judge Eileen Cannon dismissed that case
00:01:39.180 on the basis that she ruled that Jack Smith had been unconstitutionally appointed to the special counsel's position.
00:01:49.800 There is no provision in law for such a position, and he was never confirmed by the Senate,
00:01:57.340 meaning he was being given broad prosecutorial powers without ever having been confirmed by the Senate.
00:02:05.220 Had he been a U.S. attorney, this would not perhaps have been an issue.
00:02:09.280 The left has tried to write that off as a fringe case, certain to be overturned in the 11th Circuit
00:02:16.820 and ultimately in the Supreme Court.
00:02:19.900 I'm not so sure, but I'm going to ask our next guest about that.
00:02:24.040 But now you have these new indictments because the D.C. court is not bound by that ruling in the 11th Circuit in Florida.
00:02:33.060 To break this down for us, one of my favorite lawyers, Mike Davis,
00:02:37.160 who was the former chief counsel for nominations to the Senate Judiciary Committee,
00:02:42.120 where he worked with the legendary Chuck Grassley, one of the great men of the U.S. Senate
00:02:48.420 and who has been a stalwart conservative for decades.
00:02:53.420 He now is with the A3P convention, the Article III Project convention, I should say.
00:03:01.360 There is no more outspoken legal advocate for President Trump and the America First movement

00:03:17.940 All right, there's a lot to break down there.
00:03:20.400 Let's start in D.C.
00:03:22.060 The shocking interference charges filed against President Trump yesterday,
00:03:29.240 which are, it seems to me, in themselves, interference.
00:03:33.320 What's going on here?
00:03:34.220 Jack Smith is the Freddy Krueger of this lawfare against President Trump.
00:03:41.280 I think he's been smacked down like five different times.
00:03:44.080 He's been legally killed five different times, and he keeps coming back from the dead.
00:03:49.280 We had the Supreme Court in the Fisher case, this recent monumental decision out of the Supreme Court,
00:03:56.620 hold that the Biden-Kamala Justice Department essentially has politicized, weaponized, contorted,
00:04:04.200 a post-Enron obstruction of justice statute intended to go after corporate fraud that Biden and Kamala
00:04:11.480 and their Justice Department have deployed against President Trump and his January 6th supporters.
00:04:17.960 Political persecution is essentially the holding from the Supreme Court.
00:04:22.180 Those are two of the four charges that Jack Smith has against President Trump in D.C.
00:04:28.680 under the January 6th case, these two 18 U.S.C., 15-12 cases.
00:04:33.960 And so even after the Fisher decision that said that the Biden-Kamala Justice Department can't use this law
00:04:40.440 like they've been using this law to go after political enemies,
00:04:43.500 Jack Smith superseded his indictment and included the two 15-12 charges.
00:04:50.460 He also did not address another monumental decision by the Supreme Court, which is presidential immunity.
00:04:58.600 You cannot charge a president criminally for performing his official duties or the outer perimeter of his official duties,
00:05:07.480 which extends a 40-year-old precedent in the Nixon case in the civil context.
00:05:13.940 And so Jack Smith just ignored that as well.
00:05:18.900 Jack Smith made cosmetic changes to his January 6th indictment in D.C.
00:05:25.420 He pretended, I guess, kind of pretended like he adjusted it.
00:05:30.820 He took out, for example, Jeff Clark as a co-conspirator, unindicted co-conspirator in his January 6th case.
00:05:38.460 But other than that, he largely kept his indictment the same, including Trump's discussions with his vice president
00:05:46.720 that the Supreme Court held were presumptively immune under the presidential immunity decision.
00:05:52.080 And it's a stupid indictment.
00:05:54.820 It's desperation by Biden and Kamala and Merrick Garland and Jack Smith.
00:05:59.360 There's no question that Merrick Garland, Biden and Kamala's attorney general,
00:06:04.300 had to personally sign off on this new indictment by Jack Smith.
00:06:09.400 And I presume that President Trump was given a heads up and probably Vice President Kamala Harris.
00:06:15.480 And so this begs the question, if you're not going to follow the Supreme Court precedence
00:06:20.640 and you're going to rush to file this superseding indictment right now before the presidential election,
00:06:27.420 why are you doing this?
00:06:28.500 Why is it the polling?
00:06:30.040 Is it Kamala's polling?
00:06:31.340 Is it the fact that Kamala didn't get a post-convention bounce like most candidates do?
00:06:39.420 Is it the fact that RFK Jr. and Tulsi Gabbard, as you said in your opening, Roger, endorsed President Trump
00:06:45.760 and Trump is the uniter and Kamala is the divider?
00:06:49.140 Why are they moving forward with this case?
00:06:51.580 It's not going to go anywhere.
00:06:52.900 This case is not going to get tried before the election because President Trump presumably
00:06:57.620 is going to raise the issue again of presidential immunity.
00:07:01.580 D.C. Obama Judge Tanya Shutkin is going to have to decide that issue.
00:07:05.040 However, she decides that issue, that will get appealed to the D.C. Circuit.
00:07:08.760 That will take many months.
00:07:10.440 The D.C. Circuit will rule.
00:07:12.420 And then, however, the D.C. Circuit rules, whoever loses will almost certainly seek relief
00:07:19.300 in the Supreme Court of the United States.
00:07:21.120 This is not going to get resolved for many, many, many months, maybe even more than a year.
00:07:26.260 So why are they moving forward with this indictment right now, like 75 days, within 75 days of
00:07:33.840 the election when voting starts in several weeks and in some of these early voting states?
00:07:40.060 Why are they moving forward now other than the fact that this is desperation?
00:07:44.980 This is Biden and Kamala's last ditch effort.
00:07:48.360 They're Hail Mary to try to interfere in this election and try to defeat Trump through the
00:07:53.380 legal system because they know that Trump's going to beat Kamala like a drum through the
00:07:57.260 political system.
00:07:59.060 Let me play a devil's advocate here.
00:08:01.840 So what if it is Jack Smith's argument, which I presume it is, haven't read the filings,
00:08:07.080 that the president's actions, whatever they may have been on January 6th, were outside the
00:08:12.320 parameter of his official duties, that he was acting in his own personal interest, not personal,
00:08:17.560 but political personal interest rather than within the scope of his responsibilities as
00:08:24.300 president?
00:08:25.520 Yeah, and that could, he could make that argument.
00:08:28.000 The issue is that's not going to get resolved before the election.
00:08:31.340 So why did he bring this superseding indictment now before the election, within 75 days of the
00:08:37.140 election, within several weeks of voting, early voting starting?
00:08:41.180 Why didn't, look, they waited three years to bring these charges against Trump.
00:08:44.680 Why is it so urgent that they have to make a public spectacle of this case before the election
00:08:51.660 when the Supreme Court of the United States just reprimanded the D.C. Circuit and D.C.
00:08:57.380 Obama judge, Tanya Shuck and this Biden-Kamala special counsel, Jack Smith, for rushing this
00:09:03.700 case, right?
00:09:04.380 The Supreme Court said there's no rush here.
00:09:06.500 Why are you trying to rush a case on presidential immunity, this case of first impression that
00:09:11.900 is so important to the president?
00:09:13.260 Look, this is so much bigger than Donald Trump.
00:09:16.520 Joe Biden is not going to be president after January 20th.
00:09:20.620 And there's a pretty strong likelihood that President Trump will be back in office if you
00:09:25.460 do not have immunity from criminal prosecution for your official acts.
00:09:29.820 And if that is not viewed very broadly, you could see the Trump 47 Justice Department prosecuting
00:09:36.500 President Obama for his illegal extrajudicial drone strike on two American citizens, including
00:09:44.280 a minor.
00:09:44.780 You could see now Judge David Barron on the First Circuit in Boston, who was Obama's legal
00:09:50.820 advisor at the time in the Obama Justice Department, also charged with this conspiracy for capital
00:09:57.400 murder.
00:09:57.740 If we go down this path, you can see Biden charged for his illegal mass parole of over 10 million
00:10:05.400 illegal immigrants, unvetted and unvettable fighting age men in our country in the resulting
00:10:11.380 rapes and murders and robberies and other migrant crime.
00:10:15.220 Kamala could be charged.
00:10:16.180 He's the border's hard.
00:10:16.980 George W. Bush, you know, you could make the case that he lied about weapons of mass destruction
00:10:22.900 and we went to war in Iraq based upon that lie.

00:11:08.880 They want to destroy the Supreme Courts that got in their way by packing the Supreme Courts
00:11:15.060 and by putting unconstitutional term limits and an unconstitutional ethics regime on the

00:11:21.740 And then look, they underfunded Trump's Secret Service detail.
00:11:26.540 They said Trump was an existential threat to democracy who must be stopped at all costs.
00:11:31.700 And then Biden told his biggest donors, then it became public, that we need to put a bullseye

00:11:39.260 What the hell did Joe Biden and Kamala Harris think was going to happen when you underfund
00:11:44.240 Trump's Secret Service detail?
00:11:45.640 You deny several requests from his Secret Service detail to beef up security.
00:11:50.980 You have the Biden and Kamala DHS telling the Trump Secret Service not to ask for more funding.
00:11:57.080 We're going to fund President Zelensky's security in Ukraine, but we're not going to fund President

00:12:04.500 What did they think was going to happen after they tried to bankrupt him, throw him in prison

00:12:12.180 And then we're not going to fund his Secret Service.

00:12:16.560 No, look, we know that Congressman Dan Goldman of Manhattan said that Trump needed to be
00:12:23.040 terminated, that Rick Wilson of the Lincoln Project said someone has to put a bullet in

00:12:30.340 They're the ones that have created this atmosphere of hate.
00:12:33.780 They're the ones who are infected with Trump derangement syndrome.
00:12:38.520 There's a new syndrome, Mike, you may not have noticed.
00:12:41.620 It's called assassination deniers.
00:12:44.760 The assassination deniers who actually believe that that entire horrific event in which a courageous
00:12:52.420 firefighter, Corey Comparatori, died because he took a bullet shot to the head, shielding
00:12:58.780 his daughter and his wife, two other people very seriously injured, and the president coming
00:13:05.180 within a milli inch of having a bullet in the head, raising his ear.
00:13:12.920 Yet there are thousands of people on social media who, by the way, are not censored, probably
00:13:19.340 should not be, insisting that all of this was a hoax, that the president bit some kind
00:13:25.700 of capsule that created that impression of blood.
00:13:29.460 It is sick.
00:13:31.140 It's really, really sick.
00:13:34.100 Somebody tell that to the family of Corey Comparatori.
00:13:38.040 Let's go to this other legal question, Mike.
00:13:40.400 And that is, as I said in my opening, Judge Cannon, who is vilified because she doesn't
00:13:47.760 rule the way the left wants her to.
00:13:50.160 You see, when a federal judge is appointed by Obama or Clinton and they rule the way the
00:13:58.160 talking heads at MSNBC want them to, they're great impartial jurists.
00:14:03.880 They're living up to the rule of law.
00:14:06.500 But when a judge appointed by a Republican president, who is a federal judge, makes a
00:14:13.620 ruling, they're incompetent, they're unqualified, they're corrupt, this double standard is outrageous.
00:14:21.780 I love this little rhetorical device when they try to describe Roe and they say, Donald
00:14:28.120 Trump handpicked these Supreme Court justices.
00:14:32.740 And they've been planning this for years, as if it's a plot.
00:14:36.960 Yes, presidents appoint Supreme Court justices, usually of their own judicial philosophy.
00:14:43.920 And yes, conservatives, lawyers, and thinkers have been talking about strategies to protect
00:14:50.180 our constitutional rights or take them back for years.
00:14:54.000 That's called the process of politics.
00:14:57.820 But the left makes this sound like it's some insidious plot.
00:15:02.520 Beyond that, there's the constant lie, Trump will end legal abortion in the United States.
00:15:08.900 No.
00:15:09.640 The Supreme Court justices appointed by Trump voted to return that decision to the states.
00:15:15.600 And every state is different.
00:15:17.320 And some states are putting reasonable restrictions on abortions.
00:15:20.240 And other states are not.
00:15:22.160 Donald Trump's not going to enact a federal ban on abortion.
00:15:25.860 He has rejected that.
00:15:27.220 But they keep saying it.
00:15:28.500 They said it from their platform.
00:15:30.660 Kamala Harris said it in her acceptance remarks.
00:15:35.360 It's an amazing disconnect.
00:15:38.360 Let's go to that Florida case.
00:15:40.140 Judge Cannon vilified for ruling that Jack Smith was unconstitutionally appointed.
00:15:48.140 Run through for us why that is the case.
00:15:51.160 Well, I mean, she's citing a concurring opinion by Justice Clarence Thomas on the Supreme Court.
00:15:59.240 And she's exactly right, that the Office of Special Counsel is unconstitutional because it was not created by Congress.
00:16:08.080 We used to have a congressionally created Office of the Independent Counsel.
00:16:13.020 We had Ken Starr as the Independent Counsel.
00:16:15.840 And he ran the investigation against Bill Clinton.
00:16:19.200 And the Democrats who pushed for the Office of Independent Counsel didn't like it so much after that boomeranged on them through Bill Clinton.
00:16:27.160 So they let the Office of the Independent Counsel statute lapse.
00:16:32.080 And Congress never created a new Office of the Independent Counsel.
00:16:35.920 Congress didn't create the Office of Special Counsel.
00:16:38.160 It was the Justice Department by fiat where the Attorney General just said,
00:16:43.780 I'm just going to create this office by fiat, the Office of Special Counsel.
00:16:49.100 And by fiat, I'm going to give it essentially unlimited jurisdiction across the entire country,
00:16:55.500 unlimited power to investigate any crime, unlimited budget, essentially, right?
00:17:00.940 The problem with that is that office violates the Constitution in several ways.
00:17:06.620 In order to have an officer of the United States, it needs to be created by Congress.
00:17:12.700 Like the Attorney General is an officer of the United States, so is the Deputy Attorney General.
00:17:18.640 So are Assistant Attorney, Attorneys General, so are U.S. Attorneys.
00:17:23.680 And there are like, I think it's 93 or 94 U.S. Attorneys around the country.
00:17:28.140 Those are offices created by Congress.
00:17:30.980 You have the President nominating people to fill those offices.
00:17:34.320 The Senate confirms those officers, and then the President appoints those officers.
00:17:40.000 And then you can have, like U.S. Attorneys' Offices, you have Assistant United States Attorneys, right?
00:17:46.260 The difference between Jack Smith and these Assistant United States Attorneys is
00:17:50.920 the Assistant United States Attorneys are managed on a day-to-day basis by the United States Attorney.
00:17:58.700 They are managed on a day-to-day basis by a constitutional officer.
00:18:04.020 The special counsel, in sharp contrast, intentionally is insulated by these Justice Department regulations,
00:18:11.720 by fiats, that he is not managed on a day-to-day basis by the Attorney General or the Deputy Attorney General
00:18:18.480 or an Assistant Attorney General or a U.S. Attorney.
00:18:21.340 And that's the problem.
00:18:22.420 That's why what he does is unconstitutional, because he's not accountable on a day-to-day basis
00:18:28.760 to a constitutional officer who's accountable to Congress and the President.
00:18:34.940 And that's the problem, part one.
00:18:36.900 Part two, as Judge Cannon correctly ruled, not only does the Office of Special Counsel
00:18:43.520 violate the Appointments Clause in the Constitution,
00:18:46.780 that also violates the Appropriations Clause because he gets an unlimited budget, essentially, by fiat.
00:18:53.700 Congress never agreed to that.
00:18:55.240 Congress controls the power of the purse, not the executive branch,
00:19:00.040 and certainly not by fiat by an Attorney General.
00:19:03.960 So reading the appeal in the 11th Circuit, and maybe you can explain this because I was confused,
00:19:11.580 he argues that he's an inferior officer and therefore doesn't require the confirmation of Congress.
00:19:21.500 Yet in other places, I recall with Mueller, he declared himself to be an inferior, a superior officer.
00:19:29.500 Can you explain this distinction?
00:19:32.360 Well, here's the problem.
00:19:33.460 Whether he's a superior officer or an inferior officer, he's not confirmed by the Senate.
00:19:39.160 That's number one.
00:19:39.800 And so if he's an inferior officer, he has to report on a day-to-day basis to an officer of the United States.
00:19:48.280 He has to report on a day-to-day basis on an officer who was nominated by the President,
00:19:54.520 confirmed by the Senate, and appointed by the President to an office.
00:19:58.360 And Jack Smith is not.
00:20:00.440 He reports to the Attorney General, but the problem is that the Attorney General's, the Justice Department's regulations insulate the Office of Special Counsel from day-to-day management from the Attorney General to whom the Special Counsel is supposed to report.
00:20:18.840 That makes it unconstitutional.
00:20:20.660 Look, do they really want to play this game?
00:20:24.820 Do they want presidents or their attorneys general to have the unilateral power to create these all-powerful offices with unlimited power and jurisdiction of budget?
00:20:35.160 Right now we have the Office of Special Counsel.
00:20:37.920 Do they really want Trump to create the Office of Viceroy and appoint crazy Mike Davis as the Viceroy and give me unlimited power and unlimited jurisdiction and unlimited budget?
00:20:48.680 Because I promise you I will not be merciful and I will be relentless in pursuing Trump's political enemies, just like Jack Smith has done as the Special Counsel.
00:20:59.760 We don't want that.
00:21:00.940 That's not a good thing for our country to have Jack Smith as the Special Counsel or Mike Davis as the Viceroy, because we're both partisan hacks and it violates the Constitution to create offices to give us this unlimited budget and power and jurisdiction.
00:21:17.840 We have a sentencing coming up for President Donald Trump.
00:21:24.120 He was convicted in this travesty of a trial in Manhattan where somehow, without ever proving or even asserting a definite underlying crime, they took business transactions, business records, which even if accurate would be a non-criminal offense.
00:21:47.280 For which the Trump organization would pay a fine, they've conjured this into a federal criminal investigation and the president just, I didn't know this because I'm not an attorney, but he can't appeal until he's sentenced and he has sentencing coming up September 18th.
00:22:04.280 Now, there are some people who think that the judge is going to give him a sentence but suspend it until his appeals are exhausted.
00:22:14.620 Others believe that he will be incarcerated immediately.
00:22:17.860 What is your view?
00:22:19.120 So, this Democrat Manhattan judge, Juan Mershon, is a partisan operative.
00:22:26.640 He illegally donated to Biden and Kamala.
00:22:30.520 That violates New York law.
00:22:33.040 His daughter, Lauren Mershon, is raising tens of millions of dollars off of this criminal case, and she gets a percentage of that.
00:22:41.840 So, she has a financial stake in this case.
00:22:45.480 That is, it is illegal under New York law for Judge Mershon to be on this case where his daughter has a financial stake.
00:22:54.060 Under New York statute, it goes out six degrees of separation for conflicts of interest.
00:23:00.420 The daughter is within the first degree of separation.
00:23:03.380 He clearly should have recused from this case.
00:23:06.040 That's not just me saying this.
00:23:07.620 On April 5th, a former Clinton federal judge went on Caitlin Collins' show on CNN and made this very same point, right?
00:23:16.720 And then, of course, Caitlin quickly got her off air.
00:23:19.600 But it's very clear under New York statute that Judge Juan Mershon has a conflict of interest that required him to be taken off this case.
00:23:27.860 When President Trump raised this issue of his conflict of interest, his clear conflict of interest under New York statute, how did this Judge Mershon respond?
00:23:37.820 He imposed an illegal, unconstitutional gag order on Trump and his team and said that if they ever mention Lauren Mershon's name again, Trump's going to go to jail.
00:23:48.700 I mean, that tells you what we're dealing with with this judge.
00:23:51.500 This is the judge who has been assigned supposedly randomly, but it's clearly not random to all of these Trump cases.
00:23:58.600 He was on the Trump Organization case where the CFO got sent to Rikers Island.
00:24:04.580 He's on this Trump case.
00:24:06.000 He was even on the Bannon case.
00:24:07.440 I think Mershon took so much heat for being so corrupt and being so-called randomly assigned to these cases that he just took himself off the Steve Bannon case.
