00:01:26.320Here to view this latest lawfare attack on President Trump is one of the preeminent legal battlers for the truth and honesty in our judicial system.
00:01:40.860That is Mike Davis, head of the Article III project, and probably the second most hated conservative and right-thinking America first American in the country.
00:02:52.560You are, which is why I wanted to have you on to explain to the folks who watch The Stone Zone how outrageous this is.
00:03:00.760The release of a document, in many cases, I think in most cases, in which the president's accusers are actually still anonymous because their names are redacted, causing the media to do this huge guessing game of, well, Mark Meadows said this and this advisor said that.
00:03:36.260Remember, the Biden-Kamala Justice Department waited 30 months to bring these bogus charges against President Trump, and they brought charges in two different venues.
00:03:48.500They brought charges down in the Southern District of Florida for the non-crime of a former president having his presidential records in the office of former president, which is allowed by the Presidential Records Act.
00:04:01.840But the problem is that Jack Smith, Biden and Kamala's special counsel, didn't like the fact that he actually drew a fair judge for Trump, Judge Eileen Cannon.
00:04:11.960So Jack Smith did this unprecedented move of bringing a second charge against Trump in D.C. for the non-crime of objecting to a presidential election, which is allowed by the Electoral Count Act of 1887 and the First Amendment.
00:04:30.700Democrats objected to Republican wins in 1969, 2001, 2005, 2017.
00:04:38.840We don't see Al Gore and John Kerry and Hillary Clinton in prison, right?
00:04:43.940And Jack Smith brought four charges against Trump, including two charges that the Supreme Court in June in the Fisher decision said that the Justice Department could not bring related to a post-Enron obstruction of justice statute intended for corporate fraud that Biden and Kamala's Justice Department brought against their political enemies, including Trump.
00:05:08.680But Jack Smith ignored that and recharged Trump for those two charges the Supreme Court says he can't use.
00:05:16.060And then he also brought charges that are subject to presidential immunity that the Supreme Court ruled in June.
00:05:24.860You can't do it. You can't charge a president of the United States, any president of the United States, for his official acts, right?
00:05:32.920Not his personal acts, his official acts. And Jack Smith largely ignored that in this superseding indictment.
00:05:40.140And then they went to this D.C. Obama judge, Tanya Shutkin, this partisan hack in a robe.
00:05:46.340And they have this unprecedented, completely unfair procedure where Jack Smith lays out 165 pages of this one-sided political document, mere hearsay and other accusations against Trump in the October before the November 5th election, and Trump can't respond.
00:06:08.820This is a political drive-by shooting by Jack Smith, Joe Biden, Kamala Harris, Merrick Garland, and this judge, Tanya Shutkin, because, look, they know they can't beat Trump at the ballot box on November 5th.
00:06:24.740So they want to do everything they can to politicize and weaponize our justice system to try to rig the election.
00:06:32.260Very, very well put. In the Florida Documents case, in your legal career, have you ever heard of having a D.C. grand jury hear a case, taking the recordings of that, and playing it for a South Florida grand jury where they had no opportunity to question those testifying for the purposes of rendering an indictment? Have you ever heard of that?
00:06:55.440Well, no, and this is why Jack Smith did this, because he had another Obama judge in D.C., Beryl Howell, who is a partisan hack, who did not protect the procedural and substantive due process rights of criminal defendants in these proceedings.
00:07:13.100They steamrolled constitutional executive privilege going back 250 years to George Washington.
00:07:20.500Jack Smith knew that if he had a grand jury down in Florida, it actually may have had the proper constitutional and other legal safeguards that Beryl Howell ensured did not happen in D.C.
00:07:32.680So, no, look, they are out to get Trump. The only reason they're bringing these charges against Trump, again, they waited nearly three years, and then they bring these charges against Trump because they knew he was going to run for president again.
00:07:46.840This is all about taking out Trump through the legal process because they know Trump's going to beat Biden at the time, and now Kamala like a drum on November 5th.
00:07:56.740Yeah, it's kind of interesting. I noticed in the debate at that exchange, speaking about January 6th, when one of the moderators said basically challenging, pardon me, having alternative electors in an election dispute was both unconstitutional and illegal, when in fact it is neither.
00:08:17.280President John F. Kennedy, unfortunately for him, filed an alternative slate of delegates in Hawaii.
00:08:24.300Election night, it appeared that Vice President Nixon had won Hawaii.
00:08:29.160His electors were on the verge of being certified, and when the absentee ballots came in, JFK had won, but because he had formed an alternative elector slate, he was able to win the electoral votes of Hawaii.
00:08:46.280Also a huge amount of this in the famous election of this in the famous election of 1877.
00:08:53.860So fake electors is a word made up on MSNBC. There's no such thing as a fake elector.
00:09:00.440In Georgia, if you read the minutes of the meeting of the alternative electors, they said, we're filing a litigation, and in the event that we win that litigation, we would be required to have a slate of delegates, of electors.
00:09:14.480So we are forming this slate to preserve our legal rights, yet they were charged anyway.
00:09:20.180By the way, it had nothing to do with selecting or choosing illegal electors, but I had read about it, and I was aware of the Electoral College Act.
00:09:29.520So once again, they criminalized something that's not a crime.
00:09:32.880And when it comes to just questioning the election, which if you listen to the waltz's side of the debate, it's like one of the worst crimes in the world, you're right.
00:09:45.400Democrats for years insisted that they had been robbed when they hadn't.
00:09:50.000It's only when Donald Trump objected and they say, oh, it's an absurd conspiracy theory for you to think that there were irregularities or anomalies or outright fraud in the 2020 election.
00:10:03.920When we see the fraud unfolding in the Georgia courts before our very eyes, these aren't things that I'm saying.
00:10:11.100These are things that the courts have found.
00:10:13.020They also repeat that, the biggest lie of all, 62 judges considered their cases and they were denied on the evidence.
00:10:44.660Well, you know, there's a there's a lot of political impact as far as the the speculation that, oh, the elections are faking.
00:10:51.400And that's why I wanted to ask Mike here, because, you know, we're heading into an election where, strangely enough, Kamala Harris is going to be the one in the Mike Pence chair here going into the election day.
00:11:02.520And we've heard the Democrats might say over and over again, you know, Donald Trump can't be president.
00:11:06.820We have to do everything within our power to stop him.
00:11:09.260And my question to you is, you know, on that day when Kamala Harris said should Donald Trump win this election on that day where Kamala Harris is supposed to certify this election.
00:11:19.080Are we certain that she's not going to pull of Mike Pence in reverse and try to stop Donald Trump from getting elected in that fashion?
00:11:26.000So these Biden and Kamala Democrats have tried to bankrupt Trump for non-fraud.
00:11:33.520They've tried to throw him in prison for the rest of his life for non-crimes.
00:11:37.700They tried to take him off the ballot in Colorado and Maine and other states.
00:11:42.240And when the Supreme Court stepped up and stopped them, they're trying to destroy the Supreme Court that got in their way with court packing.
00:11:50.700They've underfunded Trump's Secret Service protection numerous times and almost got him killed twice.
00:11:58.540When all that failed and Trump was still beating Biden like a drum, what did the party of so-called democracy do?
00:12:06.400They gutted Joe Biden in a bloodless coup and backroom deal.
00:12:12.340They threw out 14 million Democrat primary voters and they installed Kamala Harris, who has not won one primary vote for president in her life, and they made her the nominee.
00:12:24.360And so you're already hearing rumblings that if and when President Trump wins on November 5th, on January 6th, 2025, these Democrats are going to try to deny Trump the presidency and they're going to try to use Section 3 of the 14th Amendment, their insurrection clause of the 14th Amendment, and have Trump not certified based upon that bogus theory.
00:12:50.620So this is the party who pretends like they're protecting democracy, who are doing everything they can to destroy democracy because they can't beat Trump fairly and squarely on November 5th.
00:13:01.620Yeah, I think that is abundantly clear.
00:13:06.740I mean, Jamie Raskin's been very, very open about the plan that they will simply refuse to certify his election, which, of course, they accuse Trump of committing a crime by objecting to the certification of the last election.
00:13:22.200So by their own admission, they say, yes, we're prepared to convict what we previously said were crimes to stop Trump from going to the White House.
00:13:30.880You have these executive orders that give the government broad powers, the president broad powers regarding, quote unquote, foreign interference in the election.
00:13:39.960In the shadow of what they tried with the Russia, Russia, Russia hoax, I think that they're capable of absolutely anything.
00:13:47.680Well, I had to wait until BuzzFeed sued Mueller to get the fully redacted final report in which he himself admitted that in my case, he'd found no evidence of Russian collusion, WikiLeaks collaboration.
00:14:01.160And he said if he had found such evidence, which he didn't, he concluded it wouldn't have been a crime that I was prosecuted.
00:14:06.960It's, these people are prepared to do anything, particularly when they have power.
00:14:19.480But between Democrats' skullduggery in the polling places, which has a documented history in many places, and these deep state operatives who are prepared to violate the Constitution to stop him from coming back,
00:14:35.120it did concern me that when the Supreme Court rejected the effort to keep him off the ballot in 50 states, they did say that the Congress would have the authority to prevent him from becoming president.
00:14:50.780I think what the Supreme Court meant is that Congress must pass legislation under Section 5 of the 14th Amendment, an insurrection criminal legislation to make, to disqualify under Section 3 through Section 5.
00:15:10.680If you want to disqualify an officeholder of the United States, you have to bring federal charges against that officeholder under Section 3, there's a crime for insurrection.
00:15:37.700And then only after that, only after a criminal conviction under that specific federal insurrection crime can you disqualify under Section 3 of the 14th Amendment.
00:15:49.120So, I mean, very, very clearly, the entire Democrat narrative is Trump is guilty of his insurrection because we say he is.
00:15:57.560Not that any court has ever found that, and that on that basis, he should be denied certification because we have the votes.
00:16:08.380I really think that they're brazen and they're talking about it.
00:16:12.260This whole operation out of Georgetown, it's the same exact players who thwarted the last election.
00:16:21.460And that's why I think we have to be very cognizant and not get cocky here.
00:16:26.620I keep meeting Trump supporters who tell me that this is going to be a landslide, the president's going to win by a mile.
00:16:33.120Yes, perhaps if we had a free, fair, honest, and entirely transparent election, that would be possible.
00:16:39.280But I think you always have to fight like you're two points down and recognize that every single vote here counts.
00:16:47.520It's going to be an incredibly close election, which I still believe Trump will win, but only by exposing this attack on him, which is just another in the latest of a series of politically motivated uses of the criminal justice system to blacken his name and try to put him in jail.
00:17:09.000But really, above all, to cost him the election.
00:17:13.500Mike, how do you feel about the election just less than a month away, a little more than a month away?
00:17:22.080I feel very confident that Trump is going to win and win comfortably so long as his supporters get out there and vote and vote as early as possible.
00:17:31.820Bank your vote. Do not wait until Election Day to vote, because if you think the BLM and Antifa riots were bad in 2020, wait till the Hamas riots come in 2024.
00:17:44.820And you don't want to be in line on Election Day and fear that, you know, fear for your life for voting.
00:17:53.680You don't want to have happen on Election Day what happened in Maricopa County in the last election, where they printed the wrong-sized ballots.
00:18:02.620Republicans showed up on Election Day.
00:18:09.480The ballots were not going through the machine, so they got sent to another polling place.
00:18:14.400When they went to the other polling place, they were told they couldn't vote there because they were checked in at the first place.
00:18:20.000And then the Democrats opposed the Republicans' efforts to have the courts extend hours by just a few hours to make sure that they can vote.
00:18:28.880And then you had thousands of Republicans disenfranchised in Maricopa County on Election Day.
00:20:24.080What the Article III project is doing is we want to say to these conservative lawyers, election workers, observers, judges, follow the law.
00:20:33.980If you follow the law, we're going to have your back at the Article III projects into these left-wing lawyers and election observers and workers and judges.
00:20:43.340If you try to rig and steal this election again, we're going to call you out very loudly and fearlessly.
00:20:48.760Yeah, it's very interesting that when the Detroit Account Center was closed down and they brought in ballots at 3 o'clock in the morning, first they had dispersed the Republican observers.
00:21:05.840The lawyers representing the Republicans didn't know how to contact a judge, even though they needed to file an emergency order to have access.
00:21:13.700So, interestingly, when I was at Mar-a-Lago and I was illegally taped by a couple of left-wing James O'Keefe wannabes, I said, you know, we have to have the phone numbers for the judges.
00:21:30.020Now, in every federal circuit, there is a duty judge who's designated at the end of the day when the court closes and until the court reopens, in the event of an emergency, which is usually medical or health-related, you can find a judge.
00:21:47.720Headline in The Guardian, Stone says Trump owns judges.
00:21:56.680I never said anything about owning a judge, but the attorneys representing the Republicans in every swing state, in every close county, need to be able to contact a judge in the evening if they need to file an emergency motion.
00:22:09.780It doesn't mean the motion won't even be granted.
00:22:13.080But it's how they distort, you know, they distort this.
00:22:16.760It's kind of like Kamala Harris saying to Donald Trump, you buddied up to Chairman Xi, President Xi, after he developed the virus in a Chinese lab, something that Xi and her friends were denying at the time it happened.
00:23:11.840Mike, some on the left, the Daily Beast, the Huffington Post, the usual suspects, they seem to be petrified that, well, you might be the next Attorney General of the United States.
00:23:22.520And this literally turns their knees to jelly, and they wet their pants at this prospect, because what if we had an Attorney General who actually followed the law, who actually treated everybody the same under the law?
00:24:08.260But I do want to be Trump's viceroy, right?
00:24:10.500I think that would be a great job, Roger, because the viceroy is not accountable to courts or Congress, and I can just rule by decree, kind of like what Jack Smith does as special counsel.
00:24:22.380Just make up a job like special counsel.
00:24:24.820You can call me the viceroy, give me unlimited power, unlimited budget, and just turn me loose like Biden and Kamala did with Jack Smith.
00:24:35.140So Judge Cannon, who I, from afar, have a high regard for, when a Republican judge or a Republican-appointed judge makes any ruling whatsoever that the left is unhappy with, they're incompetent, they're corrupted, they're stupid.
00:24:52.200But when a federal judge appointed by Obama or Clinton makes a ruling, they're non-political, non-partisan statesmen and stateswomen.
00:25:05.380Judge Cannon has ruled that Jack Smith's appointment is unconstitutional because he was not confirmed by the U.S. Senate, because no officer of the executive branch can be unfireable by the president.
00:25:18.320It's unconstitutional, and there is no funding or mechanism in law that even creates this position to which he was appointed, the special counsel law we did have having been allowed to expire.
00:25:35.040That will now go to the 11th Circuit because Jack Smith has challenged it, has appealed it.
00:25:42.020How do you think that decision will go?
00:25:43.700I think this will ultimately get resolved by the Supreme Court of the United States, and the Supreme Court's definitely going to side with Judge Cannon because she's right.
00:25:52.780If you want to create an office, a federal office, it has to be done through statute, through Congress.
00:25:59.780And not only does Congress have to create it by statute, it has to fund it every year through the appropriations process.
00:26:07.120And what happened, as you said, Roger, we had the Office of the Independent Counsel, an office created by statutes, right?
00:26:14.520And after Ken Starr's investigation of President Bill Clinton, when he got impeached by the House, the Democrats didn't like the Office of the Independent Counsel anymore.
00:26:23.660They usually had these independent counsels go after Republicans like Reagan and Bush and cause hell for them.
00:26:30.260But now that this actually boomeranged and hit a Democrat president, they let the Office of the Independent Counsel statute lapse.
00:26:38.380And so how did the Justice Department respond?
00:26:41.300They just made up the Office of Special Counsel through fiat, right?
00:26:49.760It's like I was saying, do Democrats really want the president to have the ability to create all-powerful officers on their own without Congress and fund them and have little accountability to Congress?
00:27:03.000If they want Special Counsel Jack Smith, do they want Viceroy Mike Davis?
00:27:08.340To give the broad prosecutorial power to any non-Justice Department unapproved by the U.S. Senate, never having been confirmed, I think is an additional flaw.
00:27:24.980Interesting enough, Hunter Biden's lawyers challenged some of the charges against him on the basis that that special counsel had that same flaw in their appointment.
00:27:34.280That was, interestingly, rejected because, in this case, the special counsel had been the U.S. attorney in Delaware, and therefore he had been confirmed with his prosecutorial powers by the Senate.
00:27:48.880I think the lawfare is just going to continue.
00:27:51.340How does the case in New York, the Alvin Bragg case, the case in which they take what, if Trump were guilty, which no one concedes, would have been at worst some kind of a business records misdemeanor in a civil case turned into a criminal case?
00:28:11.380And, of course, and, of course, with a rigged jury and an incredible prosecution in which the prosecutors could never prove how these transitions related to some larger underlying crime because they couldn't identify one, not a Federal Election Commission crime, not, therefore, a campaign finance crime, not a financial or a tax crime.
00:28:32.980Yet they still got a rigged jury to convict Donald Trump in a nanosecond.
00:28:42.960In 2017, President Trump settled a nuisance claim.
00:28:47.400And somehow that 2017 settlement of a nuisance claim somehow affected the 2016 election.
00:28:55.080And Trump put this private settlement in his private books as a legal expense.
00:28:59.980I've been a lawyer for nearly 20 years.
00:29:01.480I've settled many of these nuisance claims on behalf of clients.
00:29:05.640I don't know what the hell you would call it other than a legal expense, right?
00:29:09.160And so this legal expense in his private books as a legal expense somehow was election interference.
00:29:15.840And somehow these bookkeeping misdemeanors from seven years ago transformed into 34 felonies.
00:29:22.480And this is a legal theory that the prior Manhattan DA, Cy Vance, declined to prosecute.
00:29:29.360The Manhattan U.S. attorney declined to prosecute.
00:29:33.220The Federal Election Commission declined to pursue.
00:29:36.720And Alvin Bragg himself declined, even though he campaigned on getting Trump.
00:29:41.680It wasn't until Matthew Colangelo got deployed from the Biden-Kamala Justice Department, the number three office, a very senior political appointee, to resurrect the zombie case and bring these bogus charges against Trump.
00:29:55.460They were in front of Judge Juan Marchand, a corrupt judge whose daughter, Lauren Marchand, is raising millions of dollars off of this case requiring his recusal.
00:30:05.100Look, at the end of the day, the Supreme Court of the United States is going to step up and stop this.
00:30:10.940There's no way in hell the Supreme Court is going to let a former and likely future president of the United States go to prison under this bogus, politicized and weaponized justice system in Manhattan.
00:30:30.320The election is going to come down to this.
00:30:32.200Do you want President Trump to go back to the White House after November 5th, or do you want him to go to Rikers Island, even temporarily after November 5th, until the Supreme Court steps in?
00:30:43.840That's what this election is going to be about.
00:30:45.560It's interesting, as I recall, Hillary Clinton, in her descriptions in her Federal Election Commission reports, called the payments for the Steele dossier, the completely fraudulent document that was used to smear Donald Trump, legal expenses.
00:31:02.080She would ultimately even be fined by the Federal Election Commission for the inappropriate and inaccurate description of those expenditures.
00:31:10.680But I don't recall any criminal action to put her in prison, although she certainly deserves to be there, based on my book, The Clinton's War on Women, in which I lay out all their lifetime of crimes.
00:31:26.160But, again, it's the complete two-tiered justice system writ large.
00:31:33.440These people, I think, are prepared to do whatever it takes to stop Donald Trump from returning to the White House.
00:31:39.960That's why I'm glad to hear that the Article III project is going to begin your, or I should say continue your focus, on election integrity.
00:31:50.820It is essential that we have a free, fair, honest, transparent election.
00:32:01.320And even though when they tell you, don't believe what you see with your own eyes, believe what we tell you, the election was the cleanest in history, we know otherwise.

00:33:54.800They're going to do everything they can to stop President Trump from winning on November 5th.
00:34:00.020And that is why it is so critically important that his supporters fight legally, politically, financially.
00:34:08.200Make sure you show up and vote as early as possible.
00:34:12.280We have to make sure that President Trump wins this next election.
00:34:15.240Because if he doesn't, it's game over America.
00:34:18.440If you think 20 million illegal immigrants are bad, just imagine what Kamala would do over the next four years.
00:34:25.500And more problematically, she would have the chance to replace Clarence Thomas and Sam Alito on the Supreme Court.
00:34:33.760And if she does that, there goes our God-given rights to speak, to worship, to associate, to protect ourselves.

00:34:47.900I'd like to hear your reaction to the announcement by the Justice Department that they will postpone indefinitely the trial of Ryan Routh,

00:35:05.700Now, maybe the prosecutors should publish that new evidence, and they can redact it if they want, prior to the election.
00:35:11.840So we could see what kind of connections Mr. Routh may have had.
00:35:17.320It would be the same legal principle as Jack Smith putting forward this highly one-sided, biased, heavily redacted document of accusations, innuendo, hearsay.

00:36:18.940Biden and Kamala have said that Trump is an existential threat to democracy who must be stopped at all costs.
00:36:28.040And they underfunded Trump's Secret Service protection.
00:36:32.560They denied several requests from Trump's career Secret Service protective detail.

00:46:15.880But three women, Roger, have now come forward and allege that Kamala Harris's husband drunkenly assaulted his ex-girlfriend at this ritzy gala in 2012.
