The StoneZONE with Roger Stone - Mike Davis ｜ 03-24-25

00:00:00.000 Joining me now is Mike Davis. He is the former chief counsel to the Senate Judiciary Committee.

00:00:06.120 He's also the founder and president of the Article 3 project. As chief counsel for nominations for

00:00:13.240 the committee, he advised Chairman Chuck Grassley and other senators on the confirmation of federal

00:00:18.660 judges and other senior executive branch appointees. Actually, Mike Davis has served in all three

00:00:24.140 branches of the federal government, including working for President George W. Bush in the

00:00:28.780 Justice Department, working for House Speaker Newt Gingrich, and also working for current Supreme

00:00:34.640 Court Justice Neil Gorsuch. We are pleased to have Mike Davis with us today. Mike, I have to ask you

00:00:41.180 about this spasm of what appears to me to be coordinated violence against Tesla, against Tesla

00:00:48.680 dealerships, against Tesla charging stations, against Tesla drivers and their vehicles. We're talking

00:00:56.720 about Molotov cocktails, shootings, bombings, vandalism, arson. And listen to Congresswoman

00:01:05.260 Jasmine Crockett talk about this. So I'll make sure that I keep it short, but I am truly here

00:01:10.700 for very selfish reasons. Starting with, on March 29th, it's my birthday. And all I want to see happen

00:01:16.620 on my birthday is for Elon to be taken down. Yes. And then here's the even more troubling comment,

00:01:23.860 where she calls for a physical attack on Senator Ted Cruz.

00:01:28.300 I think that you punch. I think you punch. I think you're okay with punching. You know, I think,

00:01:34.860 and I love Colin. And I think towards the end, he started to punch a little harder.

00:01:40.380 But like, it's Ted Cruz. I mean, like this dude has to be knocked over the head, like hard, right? 0.75

00:01:46.720 Like, there is no niceties with him. Like, at all. Like, you go clean off on him, right? 0.94

00:01:53.500 Mike, welcome to the Stone Zone. Your reaction?

00:01:57.780 I would say this to these terrorists and those who are inciting these terrorists. There are new

00:02:04.840 sheriffs in town. And those sheriffs are Attorney General Pam Bondi and FBI Director Cash Patel.

00:02:11.720 And they've already made it very clear publicly that they're not going to tolerate this. So if people

00:02:19.560 want to make political violence the norm in America, they're going to end up in prison.

00:02:24.900 And we have seen that these are coordinated attacks, that they're central funding.

00:02:31.500 Just as we found recently that in this massive rally that AOC and Senator Bernie Sanders,

00:02:39.000 as the millionaire senator from Vermont held, that there was mostly astroturf. This is, I think,

00:02:46.140 agate prop. This is a psyop to create the misimpression that the American people don't support

00:02:52.980 the drastic reforms that President Donald Trump has embarked on. I have to ask, off the top,

00:03:00.480 the ruling by Judge Bosberg in the District of Columbia, in that district, that the president

00:03:06.760 doesn't have the authority to deport terrorists and other illegals, including criminals.

00:03:14.720 Is he not vastly overreaching, going well beyond his authority?

00:03:22.220 Yes. D.C. Obama Judge Jeb Bosberg, his orders are both lawless and dangerous. They're lawless

00:03:31.380 because, separate from statute, the president, as the commander-in-chief under Article II of our

00:03:37.980 Constitution, has the absolute constitutional power, in fact, duty, to repel invasion of our

00:03:45.280 country. And that's exactly what's going on with these foreign terrorists, Trende Aragua from 0.59

00:03:51.560 Venezuela or MS-13 from El Salvador. These are the most vicious terrorists and criminals in the 0.98

00:03:58.960 Western Hemisphere. They are invading our country. They are kidnapping, robbing, raping, torturing, 1.00

00:04:06.920 murdering. And the president is fulfilling his constitutional duty and his campaign promise

00:04:12.620 to get these monsters the hell out of America. And this Judge Bosberg does not have the power to order

00:04:19.980 what he's ordering. At best, this would be a habeas petition from these terrorists in El Salvador 0.90

00:04:28.040 and Texas, not these activist lawyers running to these activist judges in D.C. and getting these

00:04:35.800 illegal, unlawful TROs and other injunctions. And it's dangerous because this judge held this hearing

00:04:44.000 two Saturdays ago during the middle of the ongoing military intelligence and law enforcement operation

00:04:50.900 that exposed the operation, putting American and online lives in grave danger. This Judge Bosberg ordered

00:04:58.100 the planes turn around with terrorists, which is insane. We saw the security footprint in El Salvador with

00:05:04.740 hundreds of officials ready to receive these terrorists. We probably did not have the same

00:05:13.200 footprint in America because no one would ever imagine that a judge would open up a hearing during

00:05:19.080 the middle of the operation and order planes turn around. He didn't know the fuel levels when it was

00:05:24.240 flying over the Gulf of America. It's just absolutely insane that this judge ordered this, and it's dangerous

00:05:32.040 because why would a foreign leader trust that a secret operation with the president will remain

00:05:38.320 secret? Why would a foreign leader want to put his neck on the line to do a foreign operation with the

00:05:43.700 president of the United States if an activist judge is going to expose it and sabotage it? In the meantime,

00:05:48.840 you have other federal judges with other rulings. You have a judge in California ruling that the

00:05:56.620 president cannot fire some 16,000 probationary, pardon me, he cannot fire federal employees at will and has

00:06:06.060 ordered him to rehire some 1,600 probationary employees. Yet another judge has ruled that he cannot ban

00:06:16.580 transgender people in our military. This is judicial tyranny, but for those who say,

00:06:26.480 oh, those judges need to be impeached, impeaching a federal judge is an extraordinarily high bar. First

00:06:32.420 of all, you need grounds. I'll let you address that. But it's also secondarily, it's much like the

00:06:38.500 impeachment of a president. The impeachment in the House is merely an indictment. It would go to a trial

00:06:43.640 in the Senate, and you would need a two-thirds vote to remove a federal judge. Very difficult, no?

00:06:50.340 Yes, but I think it serves as an important attorney. Look, I've never called for a judge to be impeached.

00:06:55.440 I have never called for anyone to ignore a judge's order until now, because what Boesburg did

00:07:01.000 is not only so lawless, it is very dangerous. It put American and allied lives in jeopardy,

00:07:07.740 and it hindered the president's ability to conduct foreign affairs then and in the future if you can't

00:07:14.180 trust the president, right, if you're a foreign leader. And so I have called for both the president

00:07:19.160 to ignore this lawless order. This judge is doubling down, trying to get operational details

00:07:24.660 about the military mission to which this judge is absolutely not entitled. He says he has a security

00:07:31.180 clearance. Well, guess what? You may have a security clearance, but you don't have the need to know.

00:07:35.000 So you don't get this information, judge. It's not your job to meddle in military affairs. And I

00:07:40.640 think impeachment, you're right, it's a high bar. It's unlikely to succeed in the Senate,

00:07:45.920 but I want to make the process the punishment. I want this to serve as a deterrent. I was the

00:07:51.540 chief counsel for nominations on the Senate Judiciary Committee with the oversight portfolio

00:07:56.620 for the federal judiciary. I know that calling for impeachments will get the chief justice's

00:08:02.880 attention. And the point of this is to the chief justice, he needs to get his judicial house in

00:08:09.760 order. And if he refuses to do it, Congress is going to do it for him, whether it's impeachment,

00:08:15.100 whether it's stripping jurisdiction from these judges, whether it's taking away funding,

00:08:21.460 there needs to be serious reforms to these activist judges courts. So this so they stop

00:08:27.860 sabotaging the president. When we come back, we're going to talk to Mike Davis about these other

00:08:34.240 illegal actions and whether President Trump's appeal to the Supreme Court can be successful.

00:08:40.120 Whatever you do, you're in the stone zone. Don't touch that dial. We'll be right back with Mike Davis,

00:08:44.840 former counsel to the Senate Judiciary Committee on the latest judicial tyranny. We're talking with Mike

00:08:51.640 Davis, the former chief counsel for nominations to the U.S. Senate Judiciary Committee. He's also the

00:08:57.040 founder and president of the Article III Project. That's A-3-P. The Article III Project defends 1.00

00:09:04.380 constitutionalist judges and the rule of law. Mike, tell folks where they can go to get more

00:09:09.000 information on your great organization. I appreciate that, Roger. Article3project.org,

00:09:16.500 Article3project.org. It is a very worthy nonprofit. Mike is a fighter for the Constitution,

00:09:26.060 for the America First agenda. Mike, the Justice Department has filed a motion to disqualify

00:09:32.980 U.S. District Judge Beryl Howell from overseeing a lawsuit brought by the hard-left Democrat activist

00:09:40.660 law firm Perkins Coy. Perkins Coy, of course, is the law firm that commissioned the Steele dossier.

00:09:48.640 I'm very familiar with Judge Howell. First of all, remember that she ordered President Trump's

00:09:54.200 own lawyers to testify against him in the so-called documents case, clear violation of the Sixth

00:10:01.440 Amendment of the U.S. Constitution. She also essentially upheld the unconstitutional gag order 0.95

00:10:08.440 on me when I went to trial in the Russian collusion hoax frame job in Washington, D.C.

00:10:15.520 Nowhere does it say that if you were charged with a crime, you lose your First Amendment free speech

00:10:20.700 rights. I filed a writ of mandamus, and she sat on it for eight months while I was savaged by CNN and 1.00

00:10:31.400 the Washington Post, and then ruled just before trial that my motion was not yet ripe for a decision

00:10:38.220 because I had not asked Judge Amy Berman Jackson, who placed the unconstitutional gag order on me,

00:10:44.440 to remove it. So tell us about your views on this case. What are Judge Howell's conflicts of interest

00:10:51.120 in the Perkins Coy matter? Well, what the Trump Justice Department has raised in its motion to

00:10:58.220 disqualify Judge Beryl Howell is that she's just demonstrated repeated hostility to President Trump,

00:11:07.780 and they've documented multiple instances where she's been publicly hostile. For example, she appeared 0.66

00:11:15.820 at a women's white-collar defense association gala back in March of 20, or actually, I'm sorry,

00:11:25.640 it had been November of 2023, and she delivered a speech there, and she talked about essentially

00:11:31.740 how we're at a crossroads as a country, and essentially Trump was a dictator who was going

00:11:38.900 to destroy America, is her thesis for her speech back in 2023. Well, obviously, if you think a party

00:11:49.340 before you is a dictator, and you've got out there and said that he's a dictator, essentially,

00:11:55.460 you're probably not going to give that party a fair shake before your courts.

00:12:18.600 You know, I had that same experience in D.C. The judge, in my case, Amy Berman Jackson, praised

00:12:23.200 the jury when they came back with a guilty verdict, and then when we learned that the jury forewoman,

00:12:27.960 who had said during jury selection and throughout my trial, she was unfamiliar with me, she wasn't

00:12:34.420 familiar with my case, had been attacking me and Donald Trump by name regarding the very case in

00:12:41.400 which she had been selected as a juror. Thanks to the journalist Mike Cernovich, we learned this.

00:12:46.920 The judge insisted that that was not evidence of bias, and she refused to give me a new trial.

00:12:55.300 She also said in my sentencing that I had been convicted of covering up for Donald Trump. That

00:13:02.980 was not a charge, and there was nothing to cover up. It was only later, after I was fully pardoned,

00:13:08.660 and BuzzFeed sued the U.S. Justice Department to get the long-redacted, long-hidden final report from

00:13:16.460 Robert Mueller, removing all the black marks that covered the sections about me, that Mueller himself

00:13:22.560 admitted that he had found no evidence of Russian collusion, WikiLeaks collaboration, or any other

00:13:28.460 crime, and that the problem with prosecuting me for any of those things was that there was no factual

00:13:35.540 basis for the charge. Nonetheless, I have experienced the D.C. swap firsthand. Do you think now that the

00:13:44.140 president has a good chance of getting the Supreme Court to step in in all of these federal actions,

00:13:50.120 where you have politically motivated judges exceeding their authority and essentially

00:13:57.980 challenging the executive authority given to the president of the United States in the Constitution?

00:14:04.560 Well, I would say this to the chief justice of the United States, John Roberts. The legitimacy of the

00:14:09.880 federal judiciary is on the line, and when the federal judiciary loses its legitimacy, with the

00:14:15.720 American people, it loses everything. It does not have an army to enforce its orders. It relies on 0.97

00:14:22.280 the executive branch. And you have President Trump campaigned. He campaigned on the fact that he's

00:14:29.260 going to hire Elon Musk, set up the Department of Government Efficiency, or DOGE, root out waste,

00:14:35.920 fraud, and abuse, secure our border, and deport these illegal immigrants, particularly foreign terrorists, 1.00

00:14:43.400 Trendy Aragua and international gangbangers, MS-13. And President Trump is doing the unthinkable. He's

00:14:49.520 actually doing what he promised American voters he would do, and he's doing it fast. President Trump

00:14:55.520 is not stealing legislative power from Congress under Article I. He's not stealing judicial power from the

00:15:03.780 Supreme Court under Article III. He is exercising core article to executive power. And you have these

00:15:09.720 activist judges who are serving as the last line of defense for the Trump resistance, because Trump

00:15:16.560 won a broad electoral mandate, 312 electoral votes, all seven swing states, the popular votes. He kept

00:15:23.960 the House. He won a comfortable margin in the Senate. The American people gave President Trump and his

00:15:31.160 allies a mandate to do what he promised he would do. These activist judges are not exercising judicial

00:15:38.340 under Article III. They are exercising judicial sabotage of the President's Article II powers. And if the

00:15:45.820 Supreme Court does not stop this, if the Supreme Court does not stop these lawless, temporary restraining

00:15:53.960 orders in name only, when they're actually legislation from the bench, and executive orders from the bench,

00:16:00.460 if the Supreme Court does not get its judicial house in order, if the Chief Justice does not

00:16:05.900 stop these activist judges from sabotaging the presidency, then it's going to be, this is going to end very

00:16:14.120 badly for the judiciary. Because if the Chief Justice won't get its house in order, Congress will, through

00:16:20.600 impeachment, through appropriations, through oversight, through jurisdiction stripping. This is

00:16:26.380 unacceptable what these activist radical judges are doing. And it's only gotten worse because the Chief

00:16:32.360 Justice Justice and Justice Barrett failed to do their job three weeks ago and stopped Judge Ali from

00:16:39.860 sabotaging the President on foreign foreign aid. And that only had boldened. And now we have judges trying to

00:16:47.520 sabotage military operations. It's unacceptable.

00:16:50.700 It's extraordinary to watch the left insisting that Elon Musk has no authority, that he can't possibly dig

00:17:01.560 into not millions, not billions, but trillions of dollars of waste, fraud, and corruption, when of

00:17:08.080 course, his authority flows from the Chief Executive. The Chief Executive has the power to grant him that

00:17:15.900 authority. The same people say that he wasn't elected. Well, Dr. Fauci was not elected. The

00:17:22.520 difference is that Elon Musk's public service is probably costing him money, whereas Dr. Fauci and

00:17:28.920 his wife, both federal bureaucrats, made millions and millions of dollars on the vaccinations that they 0.55

00:17:35.740 were pushing and trying to mandate. Who could be in favor of waste, fraud, and corruption? It is a sure bet

00:17:44.320 that those who are yelling the most have the most to hide. And USAID, which was, I think, nobly caused by

00:17:53.340 President John F. Kennedy, as a way to fund Central and South American countries who are fighting communism, has

00:18:00.840 morphed into a slush fund for the radical left. It is essential, the Supreme Act. I'm not much of a vote counterer. I've been

00:18:12.280 disappointed in Judge Barrett, and I don't know at the end of the day whether this court will stand up and

00:18:19.460 support what the American people overwhelmingly voted for in the last election. I think we have to pray for

00:18:26.860 that. Again, Mike Davis joining us. Mike, tell us one more time where people can go to the Article 3

00:18:33.240 Project that you so ably run. I appreciate that, Roger. It's article3project.org, article3project.org.

00:18:42.160 You can follow us on social media, donate, and the most important thing your listeners can do is take

00:18:47.100 action. All right. Many thanks to our guest, Mike Davis, and for all of our listeners here in the

00:18:52.800 Zone. Until we meet again, God bless you, and Godspeed.
