00:25:10.020police presence that has shown up within the past few seconds. Seems like they're trying to show
00:25:16.580kind of some unification here in front of those barricades. I'm counting about, it looks like
00:25:23.080at least seven or eight uniforms separating this crowd to the entrance of the courthouse. Of course,
00:25:31.880the motion's running high as we get into now just past 2.05 p.m. when we know members of the media
00:25:38.500were going to be allowed back inside the courtroom to hear what that verdict is. You know, I can tell
00:25:43.820you when i first got here uh a few minutes ago when we heard that a verdict was going to be1.00

00:26:52.720joining us right now as to what is going on right now the jury started deliberating at 10 52 this
00:26:59.800morning and at 2 0 5 they have now reached a verdict we're waiting for that verdict to be
00:27:05.820announced 2 0 7 right now these things sometimes take some time and uh things have certainly
00:27:11.280escalated outside of the collin county courthouse you can see uh law enforcement out there um trying
00:27:17.020to you know keep everything calm trying to get people away it looks like from the steps of the
00:27:23.280courthouse but tensions are rising at one point we saw um two people really close to each other
00:27:29.500exchanging some words and we could hear um yelling uh earlier when when we were on the noon show
00:27:36.320alex boyer was outside of the courthouse and he was saying that you know he saw prayer circles
00:27:40.860at one point i think we were hearing someone chanting in the background um and and speaking
00:27:46.780and so things have certainly escalated even within the last i would say two hours that he's
00:27:52.240been out there and i'm sure once this verdict is announced it will only get worse uh but this as
00:27:58.240you mentioned sean this doesn't really help the situation here right the verdict is the verdict
00:28:02.700right it doesn't um you know and it could lead to even people having conflict with police out there
00:28:10.600and getting arrested out there because of their emotions these moments are very tense and very
00:28:16.460intent but you have to control your emotions in this moment so we have to watch that as well
00:28:22.780i think he actually kind of understands that back in it could very well be that
00:28:29.680asking another george yeah more than likely that'll be read by either the judge or the
00:28:38.080foreperson what that verdict is and and because this trial really has moved quickly i kind of
00:28:43.800want to get into some of the developments that took place this morning so the jury was able to
00:28:48.840consider manslaughter as a lesser charge to first degree murder give me a man slaughter is you know
00:28:55.600just reckless killing right he did not that that uh arguing that carmelo anthony did not intend to
00:29:01.300kill someone he just happened to kill someone meanwhile why do you have a gigantic knife in
00:29:05.100his bag then this was deliberate so the jury is having to decide between manslaughter as that
00:29:09.640lesser charge or first degree murder. Now, as we talked about this earlier, the difference really
00:29:15.020is the maximum sentence, right? So for manslaughter, the maximum sentence is 20 years
00:29:20.360for manslaughter, sorry, for murder, first degree murder, the maximum sentence is really
00:29:25.960life in prison. So Carmelo Anthony was facing between five years to 99 years in prison.
00:29:32.700During closing arguments, the state actually waived the right to open. So the defense went first.
00:29:38.280And so on Carmelo Anthony's side, his attorney, Mike Howard, argued that Anthony was invited into the tent by somebody he knew and that nobody had the right to use force to eject him in terms of, I mean, some of the witnesses have said he was pushed, he was shoved.
00:29:53.420They use different words to describe that physical altercation there.
00:29:57.700Attorney Howard also claimed that Anthony did not have the right to, did have rather the right to defend himself against somebody much bigger than him.
00:30:05.800And that was something else that was brought up was the difference in size between both of these 17 year old boys.
00:30:11.080But prosecutor Bill Worski, he argued that Anthony showed up with a mindset that, you know, which is why he had a knife with him.
00:30:20.360Prosecutors argued that self-defense is not a defense in this case because Anthony proved provoked rather Austin Metcalf into pushing him when he said, touch me and see what happened.
00:30:32.600So the question here is, was this self-defense or was this deliberate?
00:30:41.800That is what the jury is going to have to decide on.
00:30:44.220Or was this a case of manslaughter, as we just mentioned, the lesser charge that was presented this morning to the jury that they could also consider?
00:30:51.780And in a case like this, you talk about Bill Worski waiving his opening opportunity in closing arguments.
00:35:12.200I think they felt they were okay without that.
00:35:14.200And I think the defense felt the same thing, that they were okay without Carmelo Anthony taking this.
00:35:19.780And for people who are watching and may be wondering, too, the prosecution called 21 witnesses.
00:35:26.300Initially, I believe 35 witnesses were expected, and the defense called a handful of witnesses.
00:35:32.020I think I've heard from different legal experts that the defense really doesn't even have to call witnesses in this case.
00:35:37.600All of this falls on the prosecution side in terms of trying to prove that he is guilty.
00:35:42.680So that is why, you know, if you think, oh, there's a disparity, why were there 21 witnesses on one side and a handful of witnesses on the other side?
00:35:50.460That is probably why you see a higher number on the prosecutor's side.
00:36:41.260To some extent, you can hear about a case and not make conclusions about it and still be a great juror, and we pray that so, but they've been in this crucible.
00:37:05.860Um, I, as we've talked about this, I mean, this has gotten national attention, which is why so
00:37:12.260many people have come out, um, to, uh, protest, um, you know, on whichever side that they're on,
00:37:19.520um, to whether it's to defend Austin Metcalf or Carmelo Anthony. And so, um, it looks like
00:37:26.460things have certainly calmed down. That was not the case when we, uh, got on, uh, about 20 minutes
00:37:31.800ago or so. So I guess that's good news there that things are starting to calm down, but we're going
00:37:36.460to see, you know, how all of this plays out. Um, and, and we'll go from there. I mean, this was a
00:37:42.82012 person jury, uh, 600 people were part of that initial jury selection there. They narrowed it
00:37:48.480down to 12 people. Um, and over the course of two and a half days, the prosecution called 21
00:37:54.720witnesses, the defense called a handful of witnesses. And so now it is this, this case is
00:37:59.600really in the hands of this jury. It is up to them. They have made their decision. And so we
00:38:04.840are patiently awaiting to find out what that decision is. What have they decided? It's done
00:38:10.460now. They've made their decision. They've come to a verdict. And we'll soon hear that. And then
00:38:15.560the punishment phase, sentencing phase will begin. And Austin Metcalfe's brother is in the courtroom
00:38:20.860next to his mom right now. And so this has been an emotional burden for all involved. I mean,
00:38:29.120all these kids are good kids. They all had good grades. They all had bright futures. And in a
00:38:34.800moment, whatever happened under that tent has derailed a number of lives here. I think it was
00:38:40.200also during the trial, people have talked about how emotional it was. I think you mentioned this
00:38:44.080too, Sean, that having to see the surveillance footage, having to see just what unfolded in
00:38:48.920the moments after this altercation, this interaction between these two 17-year-old
00:38:54.520moment. Yeah, this is probably, I would imagine, emotionally taxing for both sides, for both
00:39:03.340families. And to just consider that a lot of these friends who are part of the track team
00:39:08.960who went to school with both students, it's got to be very emotional for them as well to
00:39:13.640be a part of this and to witness all this play out. So we will see, you know, what the jury has
00:39:21.940decided momentarily um again we were expecting for that decision to be announced at 205 it is
00:39:27.380220 right now so uh they're a little bit late right we're a little bit uh 15 minutes behind
00:39:32.980schedule but i think you know that sometimes happens in these kinds of cases right and so
00:39:38.020we're really not late if we thought it would come at 205 it could come at any time now we know it's

00:42:40.120noticing the length of time we've been watching this is that slowly there has been more cops.
00:42:43.880What do you make of the fact that, I mean, the jury has been deliberating for,
00:42:47.080deliberated rather, for three hours. So they reached a decision just before two o'clock
00:42:52.380Just in your experience, I mean, what do you make of them coming to this decision fairly soon?
00:42:59.480You know, I think, yeah, it would be consistent with there not being much disagreement among the 12 jurors.

00:44:45.480But when you're sitting there through a trial and you hear testimony, it has to cause you to form an opinion or some thought one way or another.
00:44:55.420And so you're trying to keep your mind open as to things.
00:44:59.180And usually your mind is working your way through to one way or another regarding how you feel about the case.
00:45:10.000And the judge provides the law, and the law then either affirms what your thoughts are.
00:45:18.140And so I think that was probably what was happening here.
00:45:22.440again in the scope of issues that cases could have even though this is a you know nationally
00:45:30.820watched case the issues are kind of narrow right and you've talked to many of your jurors both as
00:45:37.860a prosecutor and defense attorney do you find they've retired to that jury room and Russell
00:45:43.440they kind of do a straw poll to see where they are on guilt or innocence and then they start
00:45:48.280really deliberating and look at facts or evidence or revisit testimony from that point forward if
00:45:53.460need be right yeah i think the first thing they do is select the four person um and then um they
00:46:01.400usually talk about that you know they may spend time going back over the jury instructions again
00:46:07.660um which wouldn't take very long and then if you take a straw poll or a vote and you see where
00:46:14.600people are at on issues and then you may ask a person why they felt this way or that way
00:46:21.640and then if their recollection of events is different or the reason that they feel one way or
00:46:27.880another um is different somebody may point out something in the law or something in the evidence
00:46:34.280that might cause the person to view it a different way i wonder how much whiskey this guy's had
00:46:39.080How deliberations proceed. There's usually a few folks that we would characterize as followers, meaning that they, based off of their disposition, are more likely to follow a person who's firm in their belief.
00:46:58.780And so that usually, you know, is how deliberations proceed. There's a person or persons that are firm.

00:55:14.520By lots of ammunition and guns, possibly higher armed security, build a wall around your house, probably a moat, put alligators in it.

01:04:59.200And we watched in real time as a woman was on the ground being consoled, visibly shaken by that verdict there.

01:05:19.420You know, from day one, when I was here last Monday at the beginning of the jury selection process, keep in mind that there were some 600 potential jurors that were brought here.
01:05:29.860That was a massive number, larger than most high-profile case, because the judge said from the beginning that he was going to get this right, and both sides ending up with the panel that they chose.
01:05:43.120Again, as we knew early on when the jury was sat, there were no African-Americans on this panel, but still several minorities on this panel that decided his fate.
01:05:52.780As you mentioned, though, Sean, certainly, of course, we have supporters for the Metcalf family, supporters for the Anthony family,
01:05:59.600and then just people in general who have really followed this case from the beginning since it was such a high-profile tragedy from the get-go
01:06:07.020happening here in North Texas involving these two young men, both 17 years old at the time, Carmelo Anthony, 19 now.
01:06:15.020So, of course, lots of focus, eyes, and attention leading up to when everything began last Monday.
01:06:22.780As the week progressed and as both sides started to present their case, it would ebb and flow with the groups that we would see here, some groups louder than others.
01:06:32.600But then at the same time, we were also seeing people here that were very neutral, people that just wanted to come and pray with others and be a list, someone that they could lend an ear to.
01:06:43.200I can tell you one day there was a pastor who was sitting out here, a non-denominational pastor who was here,
01:06:50.400and he was sitting down in a folding chair and offered three hugs and an ear.
01:06:54.620And I can tell you that certainly many people took him up on that.
01:06:57.360No doubt a lot of people are going to want to decompress and offload what they're learning today.
01:07:02.900Yeah, and you talk about the many people, the supporters, but then you talk about those who weren't in either camp,
01:07:08.540people who wanted to see what justice would look like uh in this particular trial and and so they
01:07:14.620now they've seen it they've seen it play out yeah all right so what i think i'm going to do here is
