00:09:56.000 At this hour, unfortunately, at least 28 bodies have been pulled out of the Potomac River after an American Airlines jet carrying 60 passengers and four crew members collided with an Army Blackhawk helicopter while landing at Ronald Reagan National Airport at around 9 p.m.

00:10:15.000 Crews were still searching for other casualties, but did not believe there were any survivors, which would make it the deadliest U.S. crash in nearly 24 years, I believe since 9-11.
00:10:26.000 There's an ongoing investigation inside the FAA and NTSB.
00:10:31.000 And while there's no official cause at this point, there is growing sentiment that the helicopter pilots may have confirmed visual on the wrong aircraft and may have not even seen the aircraft they crashed into.
00:10:46.000 Passengers on the flight include a group of figure skaters, their coaches and family members who are returning from a development camp following the U.S. figure skating championships in Wichita.
00:10:58.000 It's just a terrible event, a terrible day.

00:11:33.000 It matters intellect, talent, the word talent.

00:12:23.000 It does routine things on the regular basis.
00:12:25.000 Tragically, last night, a mistake was made.
00:12:28.000 I think the President is right.
00:12:30.000 There was some sort of an elevation issue that we have immediately begun investigating at the DoD and Army level.
00:12:38.000 Army CID is on the ground investigating.
00:12:41.000 Top tier aviation assets inside the DoD are investigating, sir, to get to the bottom of it so that it does not happen again because it's absolutely...
00:12:50.000 This is really an unfathomable tragedy.
00:12:52.000 It's been 15 years since we've seen any sort of crash like it in American airspace.
00:12:58.000 And honestly, we can't talk about this without talking about what Biden's FAA has been focused on these last four years.
00:13:07.000 DEI, or as I call it, DIE. Now, I'm not saying that's even the cause of it, but it certainly doesn't help.
00:13:14.000 When they call out perhaps the top performers in a test because they don't check enough boxes, whatever it may be, these are the things that we've been doing as a country.
00:13:24.000 We will, of course, wait until all the facts come out, but there's no doubt that DEI insanity has made our skies less safe.
00:13:33.000 For example, did you know that under Democrat left-wing leadership, 3,000 top-performing applicants for air traffic controller positions were rejected by the FAA because of their race?
00:13:48.000 Now, I don't know about you.
00:13:50.000 I don't care if my air traffic controller is yellow, green, blue, purple, pink.
00:13:55.000 It doesn't really matter.
00:13:55.000 I want them to be competent.
00:13:56.000 But 3,000 top-performing applicants were just totally rejected, just culled.
00:14:02.000 Because apparently they didn't check other boxes and we need to somehow diversify.

00:14:09.000 The state's legal foundation is part of a class action on behalf of 900-plus would-be air traffic controllers.
00:14:16.000 And so we brought this suit based on the FAA's change in its hiring practices.
00:14:21.000 So it used to be that they would score a pre-employment test, and it would be based on merit.
00:14:27.000 And all of our clients passed with flying colors.
00:14:29.000 Many of them passed with 100% on this test.
00:14:32.000 and the FAA decided that the pool of air traffic controller applicants was too white.
00:14:39.000 And so they flushed that initial test and they adopted a biographical assessment, which you can already hear is an ominous term for a air traffic controller test.
00:14:48.000 And unfortunately, our clients didn't pass that.
00:14:50.000 And we allege that the air traffic, that the FAA changed the test in order to gerrymander the racial.
00:14:57.000 And remember, we had Darren Beattie on the show a while back who laid out all of this.
00:15:02.000 So it's been going on a long time.
00:15:04.000 People are aware of it and doesn't seem to matter.
00:15:06.000 It's unfortunate that it perhaps takes tragedies like this, even if it's not the cause to have people talking about the risks that should not be.
00:15:15.000 And another report tonight claims that staffing was, quote, not normal at rate.
00:15:21.000 We'll wait for more findings on what exactly that means, but it's why we need...
00:15:28.000 It's why we need actual transparency.
00:15:32.000 It's why we need to start hiring based on merit and not checkboxes, because this stuff will continue to happen until we do that.

00:15:49.000 But important business continued on Capitol Hill today as Kash Patel, Tulsi Gabbard, And RFK Jr. all appeared in front of the respective committees for their confirmation hearings.

00:16:12.000 Kash Patel was subjected to bizarre smear attacks from Democrats who are even claiming they're worried about the weaponization of justice.

00:25:40.000 And lastly, a very disturbing story out of Washington where reporters say that a transgender individual inspired by charged CEO assassin Luigi Mangione was arrested at the Capitol on Monday with Molotov cocktails, knives, and explosives trying to assassinate Pete Hexeth, Treasury Secretary Scott Besant, and others.

00:26:07.000 It does seem that the radical trans movement is by far the most violent per capita group in the country.

00:26:17.000 By the way, Scott Besant, I think he's the highest serving ever openly gay treasury secretary, highest member of the cabinet who's gay, and yet I guess that's not going to stop the trans movement from trying to take them out because they're working for Trump.

00:27:06.000 First off, you know, just the latest that you can perhaps tell us about this crash.
00:27:11.000 I know you served in the 82nd Airborne in the Army, so you're quite familiar with Blackhawks.
00:27:17.000 You've been on them a lot.
00:27:19.000 What happened last night, it does seem unfathomable.
00:27:23.000 I mean, you know, especially that kind of airspace, right?
00:27:26.000 I'm a pilot myself, and I mean...
00:27:28.000 If you're, you know, on there with commercial airlines, I mean, they're on, you know, IFR approaches.
00:27:33.000 I mean, how does this happen, you know, in that kind of airspace on a really clear night?
00:27:39.000 Yeah, that's a great question.
00:27:41.000 I think that's where the NTSB investigation is going to be so important to determine whether or not the ADSB was turned on, the transponders were actually doing what they're supposed to do to ensure that you're getting everything up and running.
00:27:54.000 But also, I'm surprised that the TAUS, the train awareness system that's utilized on a lot of these fixed-wing aircraft, was not actually going off and letting them know at what level something was actually coming in and where.
00:28:05.000 And so ATC also, I'd love to hear some of their communication platforms or where they were communicating with both aircraft and which individual spaces, whether someone actually overshot the runway or overshot the turn.
00:28:18.000 There's so much to look at.
00:28:20.000 But look, before we get into the investigation, look, our hearts, our thoughts, our prayers to every single one of the souls that was lost in this horrific incident.
00:28:29.000 And I know that they're starting to release some of the names.
00:28:31.000 They're starting to release some of the families.
00:28:33.000 And it's just horrific what's what's taking place.
00:28:36.000 And hopefully we can do an investigation to prevent this in the future.
00:28:39.000 Yeah.
00:28:40.000 So, I mean, obviously, you know, a plan on final approach is descending.
00:28:44.000 But usually if you're in a traffic pattern and you're going in opposing directions, they usually have you at different altitudes, odd, even depending on which which you're doing.
00:28:52.000 So, I mean, it does still strike me as a little bit odd that they'd be flying at exactly the same level.
00:28:58.000 Well, it strikes me as a bit odd, but again, it also is just strange that none of the early detection systems, from the little bit of ATC traffic that I've heard, I didn't hear anything from the American Airlines that was indicating that they were actually on a collision pattern.
00:29:11.000 I heard nothing from the actual Blackhawk himself on whether or not they had detected or had eyes on.
00:29:17.000 A lot of times when we're in the air, the ATC will actually say, look, you've got an aircraft, you know, traveling at this, you know, altitude.
00:29:24.000 Do you get eyes on?
00:29:25.000 And, you know, you'll tell them, hey, look, I'll look for that.
00:29:27.000 And then you'll go ahead and indicate that you have eyes on that traffic.
00:29:30.000 I didn't really hear a whole lot of that.
00:29:32.000 And so I'm really curious to just get the full NTSB investigation and determine.
00:29:37.000 And look, this is why it's great to have Secretary Sean Duffy and Secretary Pete Hegseth, who will both be involved in this investigation to be able to get the truth out to the American people and what truly took place.
00:29:48.000 Yeah, I'm not even saying that, you know, this is part of it yet.
00:29:51.000 But, you know, I've been talking about on the show.
00:29:53.000 I think we've maybe even spoken about it in person.
00:29:56.000 You know, the sort of disqualification of 3,000 of the most qualified people, meaning people who scored the highest on the various aptitude tests, were just left out because, you know, I guess they didn't check some sort of, you know, racial, socioeconomic or otherwise box.
00:30:14.000 You know, it may not have anything to do with this one, but it certainly doesn't make me feel safer getting on a plane these days.
00:30:20.000 Well, that's exactly right.
00:30:21.000 Look, we know for a fact that the DEI platform has basically led to meritocracy being marginalized, and I think that's had a big play in things.
00:30:29.000 But also in going to the airports around the country, you know, one of the things that I've discussed is the fact that we've got a shortage in air traffic control operators.
00:30:36.000 One of the gaps that we can actually utilize to try and get that shortage down is to actually have the military ATC operators be able to transition straight in.
00:30:46.000 Currently, that doesn't exist, which is bizarre to me that you've got...
00:30:50.000 Some of the most qualified individuals who are operating, you know, military, ATC, you know, aircraft in and out who have to take additional exams and additional transition courses in order to do a job in the civilian world that they're already doing in the military at a much higher and much more stressful rate.
00:31:04.000 So I think getting that, you know, I sit on the Armed Services Committee.
00:31:07.000 I sit on three different subcommittees, military readiness, the intelligence special operation, and military personnel.
00:31:13.000 Getting that transition to allow our military ATC operators to transition to the civilian world should not only get the high qualified operators that we need, but it'll also help with the short failings that we have with regards to ATC operators across the country.
00:31:26.000 Yeah, I mean, I remember reading, I guess it was the Obama regs initially about this.
00:31:30.000 They want to make sure that people, you know, who are mentally unstable can get, I mean, like, it's really like when you read the list, it was almost like You know, watching an episode of South Park, like they really wait.
00:31:41.000 They want someone who has mental issues.
00:31:42.000 I mean, this is some of the most stressful things.
00:31:44.000 Again, as a pilot myself, you know, the hardest thing is actually not flying a plane.
00:31:48.000 It's doing all of these things, communicating.
00:31:50.000 And when you're balancing that kind of airspace, you know, that many planes in that tight of proximity, I mean, that is a serious, you know, high stress job.
00:31:59.000 You need high functioning people, not just people, you know.
00:32:04.000 Certainly not who have mental issues.
00:32:06.000 So I know there's ongoing investigations at the FAA, at the NTSB. What's Congress's role going to be in this investigations, if any?
00:32:13.000 Because I do feel, you know, hey, as someone who flies 300,000 miles a year, probably, on commercial aircraft, this does not exactly strike confidence, you know, when I get on those planes.
00:32:26.000 Well, you know, as a pilot, you know, our main thing is to aviate, navigate and communicate.
00:32:31.000 And it's exactly in that order.
00:32:32.000 And we have to continue to understand that this is a Bravo airspace.
00:32:35.000 A lot of people who don't understand what a Bravo airspace is, this is your big commercial airspace, which is one of the most controlled, one of the most highly utilized.
00:32:42.000 And so there's a lot that needs to be going.
00:32:44.000 I unfortunately don't sit on the actual transportation infrastructure committee, but I know that they'll be working hand in glove when it comes to what Secretary Duffy is doing as well as for we'll be looking into what's taking place with regards to what was a very experienced crew for this UH-60 Black Hawk crew who is, my understanding was, was just doing but I know that they'll be working hand in glove when it comes to what Secretary Duffy is doing as well as So I'm very intrigued to find out what the details of this is.

00:33:18.000 But hopefully it can prevent things in the future and we can look on whether or not ATC had properly communicated what was going on.

00:34:15.000 So, you know, they can continue to try and point at President Trump, who's been in office for all of a week, and try and say, oh, well, you're the responsibility of this.

00:34:25.000 I mean, it's the same thing that Pete's dealing with, for example, in the Department of Defense, where you got a 42,000 recruitment deficit.

00:34:34.000 Something I fought for for two years and got denied is actually going forward, which is the reinstatement of all of the 8,600 plus who are unconstitutionally purged for our military for a denial of their religious and medical exemptions in regards to the COVID vaccine.

00:34:49.000 So, you know, look, they can't keep putting the pressure on your father, who's actually done more in the first week than President Biden did in his entire four years.

00:35:52.000 One administration comes in, does 100, 150 different executive orders to do or undo the previous administration's kind of product, and then you have the exact same thing in the next administration.
00:36:01.000 What we need to be doing is not allowing the American people to continue to be the ping-pong between this political match.
00:36:07.000 We need to start codifying into law things that actually matter.
00:36:10.000 Things like the tax reform plan, things like eliminating DEI, you know, which is diversity, equity, inclusion, which does anything but bring inclusivity, cohesion, and meritocracy back into American, you know, workforce.
00:36:23.000 And we need to start making sure that that is codified to where it all across all federal governments, bureaus, and agencies, that that is no longer utilized.
00:36:31.000 And I'm not looking for where they just change the name from DEI to something else.
00:36:36.000 I'm looking for a complete elimination of funding and the implementation of this.

00:41:54.000 You questioned Kash Patel at the hearing.
00:41:56.000 You actually had some serious questions.
00:41:58.000 Your Democrat colleagues, however, Not so much.
00:42:02.000 What was your reaction to that, especially sort of through the lens of everything we've gone through for the last nine years, the weaponization of the DOJ, clearly the weaponization of the FBI and the incompetence that we've seen from there.
00:42:17.000 How do you keep a straight face in that meeting as they're doing their holier than thou nonsense?
00:42:23.000 Yes, their holier than thou nonsense, and they're trying to rehash things that- You know, are just of no use.

00:44:50.000 We saw yesterday how quickly Sean Duffy moved forward with his role as the DOT secretary with that horrific plane crash that happened last night.

00:45:08.000 We saw the day before how Secretary Noem went right into her role and was out with Tom Holman's crews as they were conducting these raids.
00:45:21.000 And you know, this is what the American people are wanting to see.

00:45:27.000 They have grown so fatigued and so frustrated with seeing two tiers of justice at the DOJ and the FBI, two tiers of access to government and government services.
00:45:40.000 We saw that with FEMA when they were very slow coming into Tennessee, coming into North Carolina.
00:45:47.000 We have seen how they have had two tiers of treatment.
00:45:54.000 Because the Biden administration preferenced those that were illegally entering the country and put the burden on people that are citizens of the United States.

00:47:22.000 And unfortunately, it's the only thing that's not that common in Washington, D.C. these days.

00:48:52.000 Again, I think there was a mandate clearly nationally, not just winning all the swing states, but also the popular vote.

00:49:03.000 What do you see as the timeframe on those remaining nominees?
00:49:06.000 Do you expect them all to be confirmed?
00:49:08.000 You know, I've seen, you know, a couple of your colleagues in the Senate on the, you know, let's call it Republican side, we'll use that very loosely or in air quotes, you know, not go along with that.
00:49:17.000 They're voting with the Democrats.
00:49:19.000 You know, what do you see here, especially as you get to some of the ones that are perhaps more controversial, whether that's cash, whether that's Bobby Kennedy, or perhaps the one that seems to be the most controversial, I can't actually figure out why, Tulsi Gabbard.
00:49:31.000 Yeah, and you know, Bobby Kennedy did a superb job yesterday when he came before us at the Finance Committee.
00:49:39.000 I thought he really did such a solid...
00:49:47.000 Presentation, representing himself, representing President Trump's opinion and approach.
00:49:54.000 And I believe we're going to get all of these nominees confirmed.
00:49:58.000 If we lose a couple of votes, we have a fantastic vice president who is there to break the tie.
00:50:05.000 What are some of your other top priorities now in the United States Senate?
00:50:10.000 Once you get through the confirmation process, what do you want to see happen?
00:50:14.000 You know, in the two years prior to midterms.
00:50:18.000 Yes.
00:50:19.000 And we do have to move quickly.
00:50:21.000 I have a package of bills that I've worked on for years.
00:50:25.000 And so we have pulled them together in a package.
00:50:28.000 They're called the Doge Acts.
00:50:30.000 And it freezes federal hiring and federal salaries.
00:50:33.000 And we were pleased to see the executive order on that.
00:50:37.000 You have to do that to cap.
00:50:39.000 Your federal workforce so you can begin to turn it down.
00:50:44.000 And I have one that moves a return to work policy and a merit-based promotion system.
00:50:52.000 Another of that package moves federal agencies outside of Washington, DC. And another that mandates having across the board spending cuts of either one, two or 5% across the board.
00:51:07.000 These are bills I have had.
00:51:09.000 We've had for years.
00:51:10.000 We also have bills that deal with children, with their safety online and in the virtual space, the Kids Online Safety Act.
00:51:19.000 We have an online consumer privacy bill, which you know, Don, AI is right around the corner.
00:51:26.000 So we have to make certain that we have online privacy for our citizens so that their information is not captured.
00:51:36.000 And these big tech companies Don't grab it and build a virtual you of each and every one of us.
00:51:43.000 We have a rural health agenda that deals with health care innovation, increasing access points, especially in rural areas, expanding telehealth, some incentives for a rural health care workforce.
00:51:58.000 And Senator Warner and I have worked in a bipartisan manner on the Area Wage Index.
00:52:07.000 I have a bill, again, I've worked on it for quite a while, and it would fix the Social Security issue so that we increase that threshold.
00:52:17.000 And then we take away the marriage penalty and individuals making less than $34,000 or married couples more than $68,000.
00:52:28.000 Everybody under that $34,000 and $68,000 would pay zero federal income tax on their Social Security.
00:52:37.000 And it exempts a little over 70% of all Social Security recipients from paying one penny of tax.
00:52:47.000 So, I mean, that all seems like total common sense.
00:52:50.000 And yet I imagine it's still, I mean, all of it.
00:52:53.000 I mean, that was a pretty extensive list.
00:52:54.000 I'd love to see all of that go through, obviously.
00:52:58.000 But how does that kind of common sense thinking policy clearly benefits the American people?
00:53:05.000 I imagine if they knew about it, they'd be all in for it.
00:53:08.000 How does that still face the kind of resistance that you and I both know it's going to face?
00:53:12.000 You've been talking about these bills for a long time.
00:53:14.000 Hasn't happened yet.
00:53:15.000 Hopefully we're in a brave new world.
00:53:17.000 Maybe people actually start acting brave and getting it done.
00:53:19.000 But how is that even remotely controversial at this point?
00:53:24.000 And you think how could it possibly be controversial?
00:53:29.000 Because these are things that everyone should be for.
00:53:32.000 You know, we should be thinking about the next generation.
00:53:35.000 What is our country going to look like for our kids and our grandkids?
00:53:39.000 How is it going to affect the opportunities that they are going to have?
00:53:44.000 How do we get government off our backs?
00:53:47.000 How do we reduce the size of the federal government and send power and authority back to the state?
00:53:53.000 Back to local communities so they don't have this enormous...
00:53:59.000 Tax burden of a government that is really going to limit their possibilities.
00:54:07.000 And that is what we should be talking about.
00:54:11.000 How do we repatriate manufacturing?
00:54:14.000 Everybody should agree.
00:54:16.000 That's a good thing.
00:54:17.000 And we need to have tax credits.
00:54:20.000 We need to have incentives for doing that.
00:54:23.000 When it comes to the border, Don, I've got some bills that are plain common sense.
00:54:27.000 When President Trump President Trump was president in his first term.
00:54:32.000 When a child came to the border with an adult that couldn't prove they were related to this child, they did DNA testing.
00:54:40.000 And we found that between 30 and 40 percent of all the children with those adults were not related to them and they were being trafficked.
00:54:48.000 Well, the Biden administration said doing DNA testing takes too much time.
00:54:55.000 So we're going to eliminate that.
00:54:57.000 You know how long it took to do a DNA test?
00:55:00.000 45 minutes.
00:55:02.000 Crazy.
00:55:03.000 And it is crazy.
00:55:05.000 And it saved the lives of a lot of children.
00:55:07.000 So we have legislation to put that back in federal code so that...
00:55:14.000 Future administrations have to DNA test when a child presents at one of our border crossings or tries to enter the country.
00:55:24.000 And also we have one that allows fingerprinting so that it would stop this child recycling that the cartels do.
00:55:31.000 These are all just common sense things.
00:55:34.000 We are hopeful that the Democrats will eventually realize that President Donald Trump was given a mandate in November, and it is up to us to enact that mandate.
00:55:46.000 And some of these Democrats that are in red states need to realize that their constituents voted for President Trump and gave that mandate, and they expect them to work with our president and to work with us to get this turned into law and get these laws on the books.
