00:00:38.580 But before we get to that, Senator, I want to get your reaction to some news that broke.
00:00:43.140 Special Counsel Jack Smith seems to be putting together an enemies list,
00:00:49.620 and quite a few listeners of this podcast may be on that list.
00:00:54.780 He has demanded that X, formerly known as Twitter,
00:00:58.800 is to give all information on all Americans who interacted with Donald J. Trump
00:01:05.760 on Twitter between October of 2020,
00:01:10.520 while he was the President of the United States of America,
00:01:14.000 to January of 2021.
00:01:16.620 One, this would include people that did something as simple as liking a tweet
00:01:22.760 of the President of the United States of America,
00:01:25.540 your reaction to this heavily redacted search warrant requesting everyone's intel
00:01:32.380 that interacted with Trump.
00:01:34.000 It's completely outrageous.
00:01:36.040 The Biden Justice Department wants information about you.
00:01:40.080 And you mentioned an enemies list.
00:01:41.900 That's exactly what they're compiling.
00:01:43.500 They have literally served on Twitter a search warrant that demands every single person
00:01:52.800 who liked a tweet from Trump or who retweeted a tweet from Trump
00:01:58.080 between October 2020 and January 2021.
00:02:02.280 I am quite certain I liked or retweeted multiple tweets.
00:02:05.940 I'm quite certain you liked or retweeted multiple tweets.
00:02:08.680 So you and I are both on the enemies list.
00:02:11.040 And so is anybody else that they're basically trying to compile a list of the social media
00:02:16.700 of every Trump voter.
00:02:18.600 And it's not even voter.
00:02:19.960 It's just if you had something positive to say about the president.
00:02:24.200 The Biden DOJ wants to know it.
00:02:26.680 And they're also asking for, quote,
00:02:29.720 all associated logs and metadata,
00:02:32.200 which could could cover location data as well.
00:02:37.340 And so understand that they're asking for the physical location
00:02:42.600 of every person who said something positive about Donald Trump on Twitter
00:02:47.720 between October of 2020 and January of 2021.
00:02:51.980 That is wildly overbroad.
00:02:54.640 It is not related to anything remotely within the scope of of the indictment
00:03:01.380 and what they're trying to prosecute Trump for.
00:03:04.100 And the prosecution itself, as we've discussed at great length, is bogus.
00:03:08.140 But this is an example.
00:03:09.280 Look, this is a political fishing expedition.
00:03:13.040 They want to know every American, every American citizen,
00:03:17.480 every American voter who dares say something positive about Trump.
00:03:21.880 The Biden DOJ wants to know your name.
00:03:24.940 This is something that you see in other countries like China, for example,
00:03:29.380 and Russia, for example, and other nations where you have dictators and tyrants,
00:03:34.360 where they will they will 100 percent constantly be tracking, following and looking at every word
00:03:41.820 that the citizens are saying.
00:03:44.240 And what we also know is that Twitter initially delayed complying with this request,
00:03:48.940 per The New York Post, resulting in a three hundred and fifty thousand dollar fine
00:03:54.060 levied against the company.
00:03:55.780 What's also shocking about this warrant who comes in and I do think we need to remind people
00:04:01.640 of exactly how radical and who this special counsel Jack Smith is,
00:04:07.620 because the Warrant Center also requests, quote, all IP addresses associated with the president.
00:04:14.860 He was the president at the time.
00:04:16.920 His account, as well as a list of all devices used to log into it.
00:04:22.480 This means that any staffer, any aide who logged into the account would have the information
00:04:28.460 divulged to the special prosecutor.
00:04:31.180 And this isn't after Donald Trump left office.
00:04:34.880 This is spying on the president and his staff while he was the president of the United States of America.
00:04:41.820 Well, look, and this is very much consistent with the abuse of power we've seen from the Biden DOJ
00:04:48.060 and from Democrats, the four indictments against Donald Trump are all about weaponizing the Department of Justice,
00:04:54.280 weaponizing local Democrat DAs to go after and attack the leading candidate for president on the Republican side right now.
00:05:03.040 And, you know, this is very much also in the spirit of the abusive Fulton County indictment where the prosecutor there alleges that
00:05:17.280 they've indicted a number of people on RICO counts.
00:05:21.520 And the basis for that or one of the significant bases they rely upon it are individual tweets that Trump sent.
00:05:28.380 And the theory is that the president of the United States sending a tweet was somehow racketeering,
00:05:37.040 that it was violated the RICO laws.
00:05:39.220 I mean, this is wacky stuff.
00:05:42.000 This is not, oh, that's a reasonable argument.
00:05:45.120 I mean, saying that the president of the United States by sending a tweet is committing a felony
00:05:51.980 is utterly bizarre, and it demonstrates a contempt for free speech.
00:05:57.860 Look, the president of the United States has a free speech right to send tweets.
00:06:01.440 You may not like his tweets.
00:06:02.480 You don't have to read his tweets if you don't like them.
00:06:04.960 But Democrats have, number one, when it comes to Trump, just their brains are broken.
00:06:13.260 They hate him so much that they now believe, apparently, that his sending a tweet is a criminal act.
00:06:18.980 And they also want to know, if you sent a tweet, and by the way, on the same theory,
00:06:23.540 I don't know if maybe retweeting Trump in their twisted world is a criminal act,
00:06:29.500 what it demonstrates is a political obsession,
00:06:34.600 a willingness to abuse power,
00:06:37.700 a grotesque overbreadth,
00:06:40.480 and a complete contempt for free speech and the First Amendment.
00:06:45.260 There's also another aspect of this, and that is, look, you've done this, I've done this.
00:06:50.040 I've retweeted people that I disagree with to bring light to something that they've said
00:06:55.740 that I think is egregious or just incompetent or maybe even just laughable.
00:07:02.460 I shouldn't be dragged into a special counsel's obsession over that individual
00:07:10.080 just because I, on a public forum, retweeted someone that I disagree with.
00:07:15.060 I've retweeted AOC and Nancy Pelosi and Barack Obama and Joe Biden countless times
00:07:21.380 with things that they've said and other liberals in the media that I've retweeted before.
00:07:26.240 That shouldn't give them the right to then come look at what I've been doing
00:07:30.760 because somehow it's connected to that individual.
00:07:33.720 Or am I wrong?
00:07:34.860 Well, you're not wrong, but this is, it's an enemy's list.
00:07:40.280 It is an abuse of power from DOJ,
00:07:44.120 and Jack Smith is, he is Captain Ahab,
00:07:46.800 and he is going after his white whale,
00:07:49.060 and he is going to try to plunge a harpoon into Donald Trump,
00:07:54.260 and he wants to kill him no matter what.
00:07:57.340 It is his obsession.
00:07:58.620 And, by the way, that's why Merrick Garland appointed Jack Smith to that position,
00:08:03.800 because they want, they want to frustrate democracy.
00:08:09.580 And this is where, you know, Ben, it's actually amazing.
00:08:13.720 The radical left has an almost Freudian projection.
00:08:18.100 Whatever they accuse you of doing is, in fact, what they are doing.
00:08:23.520 So the standard Democrat talking point nowadays is they're defending democracy.
00:08:29.640 They're defenders of democracy.
00:08:31.260 That's what this election is about.
00:08:33.040 Joe Biden loves saying that.
00:08:34.680 The reason for these indictments are because the Democrats are terrified of democracy.
00:08:41.780 The reason for these indictments is the Democrats are terrified that the voters,
00:08:46.840 come November, will go in and vote for Donald Trump.
00:08:49.860 And so they're trying to use the justice system to destroy the leading Republican candidate.
00:08:57.200 Why?
00:08:58.060 Because they want to interfere with the election.
00:09:01.220 They want to stop democracy from operating.
00:09:05.140 There's also an invasion of privacy aspect of this.
00:09:08.260 I'm going to talk about something else that's in this warrant in just a moment that deals with that.

00:10:53.840 Senator, there was also something else in this warrant as we were getting some of this information that was coming in
00:10:58.600 that was very alarming to me, and it's a free speech, but also an invasion of privacy aspect,
00:11:05.560 especially when you're talking about them wanting to get this information on who was the then-sitting President of the United States of America,
00:11:11.620 and that was this.
00:11:12.500 Quote,
00:11:12.760 All information, and this is what the warrant had in it, on Trump's, quote,
00:11:18.000 connect and notification tabs within the Twitter app was requested, as well as his entire search history,
00:11:27.760 all of the people that he blocked on Twitter, anyone that he didn't block but you can mute so you don't see their tweets,
00:11:35.020 and the most shocking part was this, even drafted tweets that he never sent out.
00:11:43.240 How can they justify that type of invasion of his privacy?
00:11:47.660 Well, they're engaged in a phishing expedition.
00:11:51.220 I will say, given that there is an active indictment against Trump,
00:11:57.080 that electronic information, they can probably get.
00:12:01.020 And that's, you know, if you've been indicted and have a criminal prosecution against you
00:12:07.800 and you have electronic records that are arguably relevant to the case,
00:12:13.720 the prosecution can get those.
00:12:15.580 And where the warrant goes wildly overboard is extending not just to Trump,
00:12:23.540 who is now a criminal defendant and has to defend himself,
00:12:28.380 but it's extending to 80 million Americans.
00:12:32.520 It's extending to every American who'd hit retweet or like for a period of three months on any Trump tweet.
00:12:41.260 I mean, that's insanely overbroad.
00:12:44.200 I will note also that the warrant instructed Twitter not to notify Trump of the search order.
00:12:50.380 Is that a normal way of a warrant reading, or is that also egregious in the way that they describe it?
00:13:00.200 You know, it depends.
00:13:04.160 So Twitter went and argued and tried to fight this,
00:13:08.740 and Jack Smith in court argued,
00:13:11.720 There is reason to believe notification to the former president,
00:13:14.980 a sophisticated actor with an expansive platform,
00:13:18.780 would result in a statutorily cognizable harm.
00:13:22.100 The nondisclosure order was granted based on facts showing that notifying the former president
00:13:27.800 would result in destruction of or tampering with evidence,
00:13:31.500 intimidation of potential witnesses,
00:13:33.640 or other serious jeopardy to an investigation or delaying of trial.
00:13:38.720 Look, if you're seeking someone's electronic records,
00:13:42.460 that's not that unusual to say don't.
00:13:44.740 Like if someone goes after your bank records,
00:13:47.720 it's not that unusual that they would not notify you of it.
00:13:51.900 What is unusual is going after every other person
00:13:56.180 who is not involved in the case in any way at all
00:13:58.700 and getting the record of every time Ben Ferguson liked Donald Trump.
00:14:04.920 That is completely overbroad.
00:14:08.720 I have to say, I want to give some credit here to X slash Twitter.
00:14:14.320 Not only did they initially delay complying with this request,
00:14:16.860 that resulted in a $350,000 fine,
00:14:19.200 but they also went to court trying to stop this abuse of power,
00:14:24.680 and I think that's something that should not be overlooked in this story,
00:14:27.460 that they were trying to protect the users,
00:14:30.880 and they realized, I think, how egregious this was,
00:14:33.720 and they deserve to, I think, give a lot of us,
00:14:36.740 a lot of us should appreciate the fact that Elon Musk didn't just say,
00:14:40.220 come on in, here's the books, grab whatever you want,
00:14:42.660 and said, no, no, no, we're going to fight you.
00:14:46.040 This is not okay.
00:14:47.260 Yep, fully agree.
00:14:48.680 And I think Twitter or X, they handled it exactly right.
00:14:53.780 But this Biden DOJ, this is a political department of justice,
00:14:57.480 and it's doing enormous and ongoing damage to the integrity of DOJ
00:15:03.320 and to the rule of law.
00:15:06.220 Politicized prosecutions and weaponizing criminal prosecutions,
00:15:10.720 that does big, big damage.
00:15:12.740 I want to move on also to some other news,
00:15:15.360 and it is not really hit outside of what happened
00:15:18.820 within the Senate Judiciary Committee,
00:15:21.200 and there was a lot of fireworks that happened
00:15:24.040 in the Senate Judiciary Committee this morning.
00:15:26.240 We're taping this late, obviously, on Thursday evening.
00:15:30.620 But explain what was going on in the Senate Judiciary Committee
00:15:34.360 and what was happening there,
00:15:37.120 as the Hill's headline was,
00:15:38.880 Senate GOP stage his hearing walkout to protest Supreme Court-related subpoenas.
00:15:44.520 Lindsey Graham slammed Democrats.
00:15:46.480 John Cornyn blasting Democrat Senator Dick Durbin.
00:15:49.800 You were blasting and defending your colleague, Senator John Kennedy,
00:15:54.480 and ripping apart the Senate Democrats
00:15:56.600 for consistently serving a rubber stamp, as you described it.
00:16:01.460 So tell us how this all happened, and kind of out of nowhere.
00:16:05.140 Well, we began the day with a markup in the Senate Judiciary.
00:16:08.880 And it began by the Senate Judiciary Committee voting on two judges
00:16:14.400 that actually Democrats had voted out of committee before,
00:16:18.120 but one of the Democrats was not physically present in the room,
00:16:21.120 and so we didn't have a quorum.
00:16:23.220 And so they screwed it up last time.
00:16:25.140 They had to go back and do it again.
00:16:27.040 And then there were also other judges that were up for being voted on.
00:16:31.300 And on top of that, the Democrats were seeking to issue subpoenas
00:16:37.180 to go after Leonard Leo, who was a long time with the Federalist Society,
00:16:42.500 very active in judicial matters and judicial selection,
00:16:46.360 a very long-time friend of mine,
00:16:48.680 and to go after Harlan Crowe, a very successful Texas businessman
00:16:52.900 who is very close friends with Clarence Thomas.
00:16:55.640 And so we had over two hours of fireworks.
00:17:00.380 I mean, judiciary is always vigorous.
00:17:06.480 It's a little bit like the Roman Coliseum,
00:17:08.820 where you get strong partisan warriors on both sides of the aisle.
00:17:14.860 They go at it a lot.
00:17:16.460 That being said, what happened today was really extraordinary.
00:17:19.540 So we started off that Dick Durbin, the chairman of the committee,
00:17:23.780 wanted to vote on the two nominees that he screwed up last time
00:17:27.180 and didn't have a quorum for.
00:17:29.740 And a number of Republican senators wanted to speak.
00:17:32.960 John Corden wanted to speak.
00:17:34.420 John Kennedy wanted to speak.
00:17:35.640 Marsha Blackburn wanted to speak.
00:17:37.380 And Durbin just plowed right over them, just said,
00:17:39.540 shut up, no, you can't speak.
00:17:40.860 You can't speak on these judges.
00:17:42.220 We're just voting.
00:17:42.960 And it was a remarkable thing.
00:17:48.040 It's something...
00:17:49.480 That's not the normal course of business.
00:17:51.000 That doesn't happen, correct?

00:17:53.520 Normally, that's abnormal, right?
00:17:55.500 It is wildly abnormal.

00:17:59.780 John Cornyn, who usually does not get all that excited or worked up,
00:18:04.180 here's what he said to Durbin.
00:18:05.340 He said, quote,
00:18:06.340 You just destroyed one of the most important committees
00:18:09.020 in the United States Senate.
00:18:10.160 Congratulations on destroying the United States Senate Judiciary Committee.
00:18:15.700 To try to silence your opponents,
00:18:19.060 well, it reflects the arbitrary abuse of power
00:18:24.680 that characterizes the Biden DOJ
00:18:27.500 and characterizes the Senate Democrats.
00:18:29.200 We also saw Senate Democrats once again just rubber stamp nominees.
00:18:40.920 And, you know, I was unloading in particular on a nominee out of Connecticut
00:18:46.760 who has a really radical record.
00:18:49.200 She signed a letter during COVID
00:18:52.140 urging the governor of Connecticut
00:18:55.180 to release as many prisoners as possible from jail.
00:19:00.600 And, by the way, with no distinction to whether they're violent,
00:19:04.300 and the letter, among other things,
00:19:06.100 called on the governor to release 100%
00:19:09.480 all of the prisoners in pretrial detention.
00:19:14.060 So if you've been arrested, say, for murder,
00:19:17.240 this nominee was saying, well, we should just let you go.
00:19:20.500 If you're arrested for rape or child molesting, all of them.
00:19:23.940 And that's really a radical, radical position.
00:19:27.880 And so I unloaded on the Democrats for being so extreme, so out of step.
00:19:33.160 And, in fact, I suggested to them, I said, look,
00:19:37.980 just because you're Democrats doesn't mean that you have to just roll over
00:19:42.040 and rubber stamp whatever it is the Biden White House wants.
00:19:47.000 And I pointed out, as Republicans, we didn't do that to Donald Trump.
00:19:51.060 And in particular, you know, I invoked the well-known bracelets
00:19:55.140 that some people wear, WWJD, what would Jesus do?
00:19:59.460 And I said, look, in the Senate Judiciary Committee,
00:20:01.800 let me suggest a modification on that,
00:20:04.000 which is y'all ought to wear a bracelet that says WWJKD,
00:20:08.660 which is what would John Kennedy do?
00:20:10.580 And the reason I use that analogy is that John Kennedy,
00:20:16.440 multiple times with Trump judges,
00:20:19.560 had withering cross-examinations,
00:20:22.560 and for judges who were not qualified,
00:20:24.600 those cross-examinations resulted in those nominees being defeated.
00:20:31.480 And I was telling the Democrats, you know,
00:20:33.900 you actually can behave like a senator.
00:20:35.760 You don't just have to be puppets of the White House,
00:20:39.440 but not one of them.
00:20:41.780 Let's play a few of these clips because they're important,
00:20:44.080 and I want people to be able to hear what was happening
00:20:45.960 because this is a room filled with a lot of tense moments,
00:20:49.160 and here's a few of those.
00:20:50.980 Constitution gives this body the power of advice and consent.
00:20:55.260 But it only works if people have the backbone to use it.
00:20:59.560 If you view your job as I'm a rubber stamp for the Biden White House,
00:21:03.020 whoever they send us,
00:21:04.200 look, the Democrats on this committee have already signed off
00:21:07.820 on three nominees in the Department of Justice
00:21:09.620 who want to abolish the police.
00:21:10.840 You've already signed off on a radical judge
00:21:15.040 who describes himself in his own words as a, quote,
00:21:19.180 wild-eyed liberal, says he wakes up every morning
00:21:21.380 motivated by hatred for conservatives.
00:21:23.460 He's a federal judge in New York.
00:21:25.500 God help you, if you're a conservative and you're in his court,
00:21:28.420 you go sit there, your honor,
00:21:30.680 you realize your honor woke up that morning
00:21:32.620 motivated by hatred of you.
00:21:35.080 But every Democrat thought that was fine.
00:21:37.040 That looks like a good judge to us.
00:21:38.640 That was one of your best moments,
00:21:40.920 and then, as you mentioned,
00:21:42.060 you were talking about John Kennedy
00:21:43.420 and reminding that Republicans
00:21:45.680 have held their own to a higher standard as well.
00:21:48.760 Because John Kennedy actually respects
00:21:51.580 what it means to be a judge.
00:21:52.780 He spent too much time in too many courtrooms
00:21:55.700 to know if you have a jackass
00:21:57.880 who doesn't know what he's doing
00:21:59.000 or an ideologue on the bench,
00:22:02.200 it's bad for the rule of law.
00:22:05.120 And y'all remember,
00:22:06.220 John Kennedy torpedoed Trump judge after Trump judge.
00:22:08.780 We had a lot of great judges,
00:22:10.180 but we had some that weren't great.
00:22:13.340 And the ones that weren't great,
00:22:14.740 the Republicans on this committee,
00:22:16.040 said, no, go back and do it again.
00:22:20.220 Is there even a single Democrat
00:22:22.540 who could look at that bracelet,
00:22:25.620 what would John Kennedy do,
00:22:27.020 and say, you know what?
00:22:30.020 A judge who calls for releasing
00:22:31.960 every violent criminal in the state of Connecticut
00:22:34.800 who's on pretrial containment,
00:22:39.920 that shouldn't be a judge.
00:22:44.260 Did it change the demeanor of the room
00:22:46.280 when you were talking that bluntly
00:22:47.600 and reminding them of the facts
00:22:48.880 that, hey, we've gotten rid of
00:22:50.780 some of our own bad nominees,
00:22:52.580 or was it just, nope, we're Democrats
00:22:54.300 and we're going to just keep doing
00:22:55.580 exactly what we do
00:22:56.540 and you guys need to shut up?
00:22:58.260 So the amazing thing is
00:22:59.780 the Democrats don't engage at all.
