00:00:07.940 We've got a lot to chat about today, including some breaking news with China and Iran,
00:00:12.100 plus an attack on judges coming from the Democrats, plus COVID vindication.
00:00:18.020 But first, we're going to start with China.
00:00:20.200 Senator, it is many are concerned now that we may be on the verge of this turning into
00:00:25.840 a really big war between Russia, Ukraine.
00:00:30.240 Some are referring to it as World War III.
00:00:32.640 The UK, we're being told, is going to supply Ukraine with long-range weapons.
00:00:38.020 China is also being accused of giving Russia lethal support.
00:00:45.080 You had that question asked this morning to Anthony Blinken on Face the Nation,
00:00:50.540 and I want everybody to hear what he had to say and then your reaction.
00:00:53.700 There is open source reporting that Chinese companies are providing surveillance equipment
00:00:59.820 to that mercenary group, the Wagner group, fighting in Ukraine.
00:01:04.720 Does the U.S. consider this to be providing military support to Russia?
00:01:10.580 We've been concerned from day one about that possibility.
00:01:13.840 In fact, if you go back to the very first conversations that President Biden and President Xi had
00:01:18.360 about Russia's war of aggression against Ukraine, just a couple of weeks into the war,
00:01:23.740 President Biden shared with President Xi our deep concern about the possibility China would
00:01:29.520 provide lethal support to Russia in this effort, as well as engage in the systematic evasion of sanctions.
00:01:37.500 And the reason for that concern was just weeks before the aggression.
00:01:40.880 You'll remember that President Xi and President Putin had a meeting in which they
00:01:43.620 just talked about a partnership with no limits.
00:01:45.700 I mean, Senator, a partnership with no limits, that obviously is something that would concern you.
00:01:50.220 But now seeing that apparently they're providing lethal aid to assist Russia's invasion of Ukraine,
00:01:56.580 your reaction?
00:01:58.320 Well, number one, China is the most serious geopolitical threat the United States faces for the next century.
00:02:06.600 And this administration is fundamentally weak on China.
00:02:10.200 They are soft on China.
00:02:11.440 They are unwilling to stand up to the Chinese communist government.
00:02:15.660 Number two, when it comes to the war in Ukraine, from the beginning, President Biden's policy has been utterly incoherent.
00:02:25.840 He has been weak on Russia, and he has been effectively funding both sides of the war,
00:02:32.080 providing aid, military aid to Ukraine, but also funding the people who in turn are funding Russia.
00:02:41.300 You talk about China right there.
00:02:43.960 As you know, I forced a vote on the Senate floor to enact a ban on the federal government purchasing electric vehicles or batteries
00:02:54.620 made using slave labor in concentration camps in China.
00:03:00.260 Every single Democrat but one, everyone but Joe Manchin voted no.
00:03:06.440 They all voted to keep importing electric cars, electric batteries made using slave labor.
00:03:13.100 John Kerry's response when asked about the concentration camps and slave labor said,
00:03:18.440 it's not my department, he's not concerned with it.
00:03:22.360 And so you have, in effect, this administration.
00:03:25.760 I would note also, and we've talked a lot about this on the podcast,
00:03:30.420 the Ukraine war started because Biden waived the sanctions on Nord Stream 2.
00:03:36.580 He waived the sanctions on Russia.
00:03:38.140 He waived the sanctions on Putin and allowed Nord Stream 2 to be built.
00:03:46.000 While Ukraine and Poland were begging him, don't let this pipeline be completed.
00:03:50.940 If you do, Russia will invade Ukraine.
00:03:53.880 Well, Biden ignored it.
00:03:55.440 He went soft on Russia like he'd gone soft on China.
00:03:58.760 And by the way, they're doing the exact same thing with Iran as well.
00:04:02.840 They are lifting and waiving sanctions on Iran.
00:04:05.440 And so the Russians are using those Iranian drones to kill Ukrainian citizens.
00:04:13.000 And the Biden administration is literally funding every side of the war.
00:04:17.220 They're funding the Ukrainians.
00:04:19.200 They're funding the Iranians by lifting sanctions on them.
00:04:23.800 They're funding the Chinese by buying electric cars and electric batteries from them.
00:04:29.120 And it is that weakness and incoherence that makes this so incredibly dangerous.
00:04:34.660 Anthony Blinken was asked, Senator, about the Iranian part of this.
00:04:39.920 And this was his response on Face the Nation themselves.
00:04:44.320 Iran is also accused of providing more weaponry to Russia here.
00:04:50.380 So they are building an alliance.
00:04:53.280 We've seen Iran provide drones that Russia is using in Ukraine to attack civilian infrastructure
00:05:01.040 to kill civilians.
00:05:03.400 This is something that's been going on for months.
00:05:05.680 We've been working to expose that, to take action against it, to sanction it.
00:05:10.400 There's an increasingly noxious relationship between Russia and Iran, and it's actually a
00:05:14.100 two-way street.
00:05:15.320 Not only is Iran providing this equipment to Russia, but Russia is also providing military
00:05:20.260 equipment to Iran, including, it looks like, sophisticated fighter planes.
00:05:26.460 That's something that looks like it may be happening, which would make Iran an even greater
00:05:31.420 threat if it acquires that technology.
00:05:33.760 So this is something that we've been talking about with allies and partners around the world.
00:05:38.740 That relationship is a growing concern.
00:05:40.520 Senator, this reminds me so much of the Axis of Evil after 9-11, when the president clearly
00:05:48.220 went to Congress and talked about that Axis of Evil.

00:07:08.640 China.
00:07:09.300 Is this a new axis?
00:07:11.520 Well, look, they have been our enemies for a long time.
00:07:14.740 The fact that they're working together, much of that has to do with the weakness and incoherence
00:07:20.140 coming from Joe Biden.
00:07:21.260 What Biden, what he'll do is he'll occasionally have some tough rhetoric, but he's got multiple
00:07:27.880 other domestic political priorities that he cares more about than actually following through
00:07:34.080 and defending our national security.
00:07:35.820 So let's take Iran, for example.
00:07:38.600 Biden came into the White House with his number one foreign policy objective being to reenter
00:07:44.740 the Obama-Iran nuclear deal.
00:07:48.100 And so from the very outset, he bent over backwards to give Iran everything it wanted, even as the
00:07:55.160 Iranian Ayatollah leads chants of death to America and death to Israel, even as the Iranian
00:08:03.020 government is funding terrorist activity.
00:08:07.640 They are the number one state sponsor of terrorism in the world.
00:08:11.000 Nevertheless, the Biden White House decided they had a political objective, and their political
00:08:16.440 objective was to have a new Iran nuclear deal.
00:08:20.160 And so they immediately began lifting sanctions on Iran.
00:08:23.860 The most potent sanction is the oil sanctions that we had in place, and actually under President
00:08:30.900 Trump, you'll recall, Trump pulled out of the Iran nuclear deal.
00:08:36.240 That was the right thing to do.
00:08:37.520 It was something I urged him to do.
00:08:39.200 Trump did so over the recommendations of both his own State Department and his own Defense
00:08:45.080 Department.
00:08:45.740 Both the Secretary of State and the Secretary of Defense advised staying in the Iran deal.
00:08:51.760 I made the case to him that a nuclear Iran was an existential threat to the United States
00:08:57.520 and to Israel.
00:08:58.820 Trump agreed with me.
00:08:59.920 He pulled out of the deal.
00:09:00.860 Even after he pulled out of the deal, however, a whole series of waivers remained in place
00:09:06.840 that still gave Iran meaningful relief.
00:09:09.740 And the biggest one was there was an oil waiver that allowed Iran to sell oil free of the sanctions.
00:09:17.240 And I made the case to the president that we needed to end the oil waiver.
00:09:22.820 In this case, the Secretary of State was Mike Pompeo, and Secretary Pompeo argued, do not end the oil
00:09:30.760 waiver, that it will cause global oil prices to go up.
00:09:34.320 Once again, Trump overrode his own State Department.
00:09:38.280 He agreed with me.
00:09:39.240 He ended the oil waiver.
00:09:40.480 Turned out energy was right.
00:09:42.840 State was wrong.
00:09:43.980 The global price of oil didn't move barely at all.
00:09:48.480 And the effect was we cut off a million barrels a day of oil sales to the Ayatollah.
00:09:57.520 What happened when Joe Biden came back in?
00:10:00.060 He stopped enforcing the sanctions on oil.
00:10:02.660 So the Ayatollah is selling a million barrels a day of oil.
00:10:06.320 So this, to show the incoherence, this is at the same time the Biden administration is waging war
00:10:14.220 on U.S. oil and gas production.
00:10:17.180 He's effectively waiving sanctions.
00:10:19.820 He's refusing to enforce sanctions on Iran, letting the Ayatollah sell a million barrels of oil a day.
00:10:26.660 That money is being used, among other things, to fund terrorism targeting Americans
00:10:31.500 and to fund drones that are being used in Russia to kill Ukrainian soldiers and Ukrainian civilians.
00:10:40.380 It's incoherent.
00:10:41.680 The answer is simple.
00:10:43.400 Enforce the sanctions on Iran.
00:10:45.940 Reimpose the oil sanctions.
00:10:49.640 End the so-called civilian nuclear waivers.
00:10:52.840 Use our economic force.
00:10:54.660 And we should do the same thing on China.
00:10:56.260 We should not be buying the products, the fruits of their slave labor.
00:11:01.560 But the Biden White House doesn't want to actually be strong and consistent.
00:11:06.040 Instead, it's trying to appease domestic political constituencies.
00:11:10.140 Last question on this.
00:11:11.160 At what point do you think this starts to hurt the president's approval rating,
00:11:16.220 refusing to come out, for example, and even say directly to China,
00:11:21.620 stop flying these spy balloons over the United States of America,
00:11:25.240 stop, you know, setting these things up, trying to come into our country, in our airspace?
00:11:31.060 If he won't do that, do you have any belief that he'll actually do any of these other things
00:11:35.140 like stand up to China if they're involved in this way with Russia?
00:11:38.780 For two years as president, Joe Biden has consistently shown us he will not be strong standing up to China.
00:11:46.120 The Democrat Party today, they're structurally pro-China.
00:11:49.900 The people who fund them, big business, big tech, big Hollywood, the big universities,
00:11:58.220 they're all in bed with China.
00:12:01.000 You look at the Penn Biden Center, funded by communist China.
00:12:06.260 The people writing the checks are communist China.
00:12:10.720 Where did Hunter Biden go to make millions of dollars selling access to daddy?
00:12:15.040 Communist China.
00:12:15.940 That is why the Democrat Party is unwilling to stand up.
00:12:21.380 And then you put on top of that, Joe Biden just structurally believes in appeasement.
00:12:28.060 He's unwilling to stand up to our enemies.
00:12:30.420 He began his presidency by giving Putin everything he wanted and giving China everything it wanted.
00:12:35.320 And you know what?

00:14:46.660 I want to move to another issue, Senator, that's a very important issue,
00:14:50.140 and this deals with intimidation of judges.
00:14:53.640 We saw this get to, I think, a new low when Democrats were doxing the home addresses of judges trying to stop the overturning of Roe v.
00:15:03.380 Wade, the releasing of those internal documents from the Supreme Court so that we knew the decision was coming so there could be pressure on the conservative justices.
00:15:13.460 And now there are two different opinion articles out there.
00:15:18.380 Well, let me say one opinion article and another one coming from one of your colleagues, Senator Wyden,
00:15:23.400 had a vile attack on the federal judiciary.
00:15:26.000 This, on top of the way the Washington Post put it, their opinion piece is, quote,
00:15:30.000 there is one way to rein in Republican judges.
00:15:33.000 Shame them.
00:15:35.100 Kavanaugh, by the way, was almost assassinated, and the DOJ has made zero arrests related to protests outside of the judges' homes,
00:15:42.500 outside this would-be assassin, basically.
00:15:45.500 They said, everybody else, you're good to go, and we still don't know who leaked this decision from the Supreme Court,
00:15:54.000 which is very shocking to me and everybody else, knowing what level of government was supposed to be involved in finding that leaker.
00:16:00.960 Well, it is dismaying because we seem to have reached a new chapter where the Democrats have escalated their attacks on the judiciary.
00:16:11.620 And, listen, for some time, the Democrats have been willing to use violence and threats of violence to try to intimidate people into giving in to their political agenda.
00:16:22.300 That was true in 2020 in the so-called Summer of Love, when you had Antifa and Black Lives Matter riots all over the city,
00:16:30.340 where you had the far left more than happy to use the threat of violence, of rioting, of firebombing, of looting, of murder,
00:16:40.260 to try to intimidate people into going along with their political agenda.
00:16:45.980 When it comes to the courts, we saw in particular with the Supreme Court decision overturning Roe,
00:16:51.840 that the left responded with violence.
00:16:54.980 They responded with angry and aggressive protests at the home of the justices.
00:16:59.820 These are justices sometimes who have children, even small children.
00:17:03.940 When you have angry protesters at a home with small children, there is a threat of violence in the air.
00:17:10.920 It's also a federal crime.
00:17:12.740 There is a federal statute that makes it a crime to go to a justice's home and protest at the home.
00:17:19.220 The Biden Department of Justice refuses to enforce that law.
00:17:22.600 They simply won't do anything about it.
00:17:25.660 Why?
00:17:26.220 Because they are quite happy.
00:17:27.780 They agree with the threats, the intimidation directed at the justices.
00:17:34.660 Chuck Schumer stood on the floor, or rather on the steps of the Supreme Court,
00:17:39.240 and threatened to unleash the whirlwind, to use his language,
00:17:44.220 in an effort to threaten the justices to rule how he wanted in the case concerning Roe.
00:17:51.380 So, now what we've seen in the past week is two things.
00:17:54.760 Number one, we saw on the Senate floor Senator Ron Wyden out of Oregon give a really vicious speech
00:18:02.340 attacking a federal district judge in Texas, Matthew Kazmarek.
00:18:06.860 Now, this speech was directed at Judge Kazmarek not for a ruling he's made,
00:18:12.480 but rather because the Democrats are afraid he's going to make a ruling they don't like.
00:18:17.640 And in particular, he has a case before it that deals with the legality of abortion drugs
00:18:24.500 and the legality of how the FDA allowed them.
00:18:28.040 And the left is concerned that he is going to rule against them.
00:18:31.300 And so, what they're trying to do is intimidate the judge and demonize the judge.
00:18:39.400 So, for example, Wyden on the floor said this about Judge Kazmarek,
00:18:45.000 quote,
00:18:45.840 This judge is not upholding the oath he took.
00:18:48.340 He is not adhering to the Constitution.
00:18:50.540 He is making a dangerous mockery of the rule of law.
00:18:54.280 Something needs to be done about it.
00:18:56.840 Now, that something needs to be done about it is an invitation.
00:19:00.960 It is an invitation to harassment.
00:19:02.860 It may even be an invitation to violence.
00:19:05.840 We know at least one leftist heard the invitation to violence
00:19:09.420 and traveled from California to Bethesda, Maryland in an effort to murder Justice Kavanaugh.
00:19:15.880 And he was apprehended with weapons late at night outside Justice Kavanaugh's house.
00:19:20.960 By the way, Wyden didn't direct his attack just to one judge.
00:19:24.360 A judge who hasn't even ruled in the case yet,
00:19:27.680 he also went ahead and impugned the integrity of the rest of the judicial system.
00:19:32.120 Here's what Wyden went on to say.
00:19:34.380 The Fifth Circuit, which is the Court of Appeals that covers, among other things, Texas,
00:19:38.900 the Fifth Circuit, which has little respect for precedent
00:19:41.440 or the authority of the other two branches of government,
00:19:44.360 will almost certainly uphold his ruling.
00:19:47.540 Then the Roberts Court will almost certainly leave the ruling in place
00:19:51.280 through the long and arduous appellate process.
00:19:54.360 So let's be clear.
00:19:55.940 This is now a calculated and direct attack on the judiciary,
00:20:01.560 on every level of the judiciary, on federal district judges,
00:20:04.460 on the courts of appeals, on the Supreme Court.
00:20:07.880 And it is coming in a concerted matter.
00:20:10.880 Wyden's speech occurred at the same time as a big op-ed in the Washington Post,
00:20:15.940 again, arguing for harassing and going after judges.
00:20:20.080 This is dangerous.
00:20:21.060 It's not only dangerous.
00:20:23.740 Is it fair to call it unprecedented to have someone do this type of attack from the Senate floor?
00:20:29.180 I mean, I understand if you're outside playing politics,
00:20:32.000 but on the Senate floor to do this, was this shocking to many members of that body?
00:20:37.600 Well, I don't know that much of anything shocks us anymore.
00:20:40.760 Look, it is not unusual for elected officials to disagree with a court's ruling
00:20:45.840 and to denounce a ruling after the fact.
00:20:47.820 That happens, and that happens on both sides.
00:20:50.960 It is unusual for politicians to do it before the court decides
00:20:56.840 in a manner that seems calculated to try to threaten and intimidate the judiciary.
00:21:02.100 You know, I mentioned what Chuck Schumer said on the steps of the Supreme Court.
00:21:08.320 He said, quote,
00:21:09.420 I want to tell you, Gorsuch, I want to tell you, Kavanaugh,
00:21:14.760 you have released the whirlwind, and you will pay the price.
00:21:19.920 You won't know what hit you if you go forward with these awful decisions.
00:21:25.200 And, Ben, look, one of the things that is unique about our nation
00:21:29.400 is that we have an independent judiciary that is, by design, not political,
00:21:36.500 that is supposed to follow the law, follow the Constitution.
00:21:40.760 Most countries, the judiciary is steeped in politics.
00:21:45.720 In many countries, the judiciary is political, it is corrupt,
00:21:49.540 and one of the most fundamental protectors of our liberty
00:21:55.640 is that we have a judiciary that doesn't respond to the passions of the moment,
00:22:01.140 doesn't respond to the mob, but instead is faithful to the law.
00:22:04.920 These Democrats, in a concerted way, are trying to intimidate
00:22:08.660 and tear down that judiciary.
00:22:11.280 Yeah, no doubt about it.
00:22:12.320 It's a great point, and they're not going to stop, I think, anytime soon,
00:22:15.380 which is also concerning.
00:22:16.800 It's why these elections are so important, so that we can make sure
00:22:19.740 they keep some of their radical judges off the court.
00:22:22.540 Lastly, Senator, I want to move into another important issue,
