00:01:55.000 Yesterday, we had mentioned this, but there were oral arguments in front of the Supreme Court yesterday,

00:02:01.580 and those oral arguments included a case that goes right to presidential power, presidential authority,

00:02:08.660 whether essentially the president can fire people who work for the executive branch,

00:02:13.500 or is there truly a forever state, a deep state, whatever you want to call it?

00:02:19.760 There are people who are the bureaucracy that are effectively a fourth branch of government

00:02:25.140 because they cannot be fired by the executive branch.

00:02:28.740 They are not employees of the legislative branch.

00:02:31.660 They're certainly not part of the judicial branch.

00:02:34.100 So what the heck is going on here?

00:02:36.240 It is a very interesting question.

00:02:37.580 I think, Clay, the outcome should be quite clear, and yet here is Ketanji Brown-Jackson,

00:02:45.960 whom I think you'd have to say is the most left-wing member of the court.

00:02:50.520 She also, and this is, I mean this, she talks the most by far of anybody on the court,

00:02:55.420 and that's just a question of timing on the transcript.

00:02:58.160 She talks the most by far, and unfortunately sometimes shows that she doesn't really understand

00:03:05.040 the very basics of our government, which for a Supreme Court justice I think is a problem.

00:03:09.500 Here she is yesterday, Clay, on the issue of presidential authority,

00:03:14.020 and can you fire these forever bureaucrats? 0.99

00:03:17.260 Some issues, some matters, some areas should be handled in this way by nonpartisan experts,

00:03:27.240 that Congress is saying that expertise matters with respect to aspects of the economy and transportation

00:03:37.960 So, having a president come in and fire all the scientists and the doctors and the economists and the PhDs

00:03:46.500 and replacing them with loyalists and people who don't know anything

00:03:51.300 is actually not in the best interest of the citizens of the United States.

00:03:55.340 These issues should not be in presidential control.

00:03:58.100 Whose control should they be in then, Clay?

00:04:02.520 That's the question that seems obvious, among others, that Ketanji Brown-Jackson,

00:04:07.020 I do not think, has a particularly erudite answer to.

00:04:11.260 I have never said this before.

00:04:13.200 I would be a better Supreme Court justice than Ketanji Brown-Jackson,

00:04:17.400 and I would not be a great Supreme Court justice.

00:04:19.720 I don't think she has the intellectual heft to do this job,

00:04:26.080 and the questions that she asks confirm that on a regular basis.

00:04:31.100 Look, what she's trying to grapple with inarticulately is the concept of

00:04:36.280 where do the powers of the presidency extend

00:04:39.200 and how do they implicate the powers of Congress.

00:04:43.540 So, essentially what we've got here,

00:04:45.440 and it is, I think, an actually intriguing and important position,

00:04:50.580 is how do you end up making choices on,

00:04:55.580 let me take a step back and explain,

00:04:56.980 because I think this has gotten confusing to a lot of people,

00:04:59.580 and I don't think it's overwhelmingly confusing.

00:05:01.820 So, let me just kind of lay out the issue here.

00:05:04.940 About 100 years ago,

00:05:07.020 Congress started to create these independent regulatory agencies

00:05:13.220 inside of government

00:05:15.800 that were basically neither executive nor congressional in nature.

00:05:21.400 They were kind of a hybrid.

00:05:23.500 And, effectively, the question is,

00:05:25.800 and most of the time the terms on these agencies rotate,

00:05:29.400 and they're supposed to be mixed Democrat-Republican,

00:05:32.000 and all of these things.

00:05:33.420 And the question really at essence here is,

00:05:36.100 where does that fall within separation of powers?

00:05:39.260 Because if you decide that these people are doing a bad job,

00:05:43.380 the president is saying,

00:05:44.760 I should have the authority to fire them

00:05:46.680 because they are acting in an executive capacity.

00:05:49.900 Ketanji Brown-Jackson is trying to argue

00:05:52.600 that they are independent of the entire political process,

00:05:56.720 but derive their power from congressional authorization,

00:06:00.080 and therefore should be able to serve in their office

00:06:03.500 without needing to be at the behest of anyone, right?

00:06:07.620 And I think for most of us out there,

00:06:10.220 we say, wait a minute.

00:06:11.380 In a government, people should be actionable,

00:06:14.960 and if you're acting in some form in an executive capacity,

00:06:18.740 the president should have the ability to decide

00:06:21.280 whether or not someone is on one of these agencies.

00:06:24.480 And Ketanji Brown-Jackson is trying to say,

00:06:26.920 well, we need experts from outside the world of politics.

00:06:30.480 Well, it's actually anti-democratic, right?

00:06:32.680 Because the entire process of our country is predicated on

00:06:36.300 there should be people who are able to be removed

00:06:40.480 if the will of the people is violated on some level.

00:06:43.620 And that's really what all this is about.

00:06:44.940 And look, it's getting tied up in Trump,

00:06:47.180 but I actually think that's a poor way of the media conveying it

00:06:51.160 because Trump's only going to be president for three more years.

00:06:54.780 And largely the question is,

00:06:56.640 what are the powers of the executive as it pertains to these agencies?

00:07:01.320 And I happen to think the executive should have the power to remove.

00:07:05.440 But Ketanji Brown-Jackson, let's go back to her for a minute, Buck,

00:07:08.760 because I actually think there's an argument

00:07:11.400 that her selection for the Supreme Court

00:07:16.140 quite clearly violated federal law 0.82

00:07:19.020 because Biden said, I'm only going to pick a black woman. 1.00

00:07:22.800 You could not do that in almost any job in America

00:10:49.980 because bureaucrats tend to be Democrats.

00:10:51.980 Also, it's Congress not doing its job
