00:03:27.400 We have new breaking news,
00:03:28.820 and it deals with former President Joe Biden.
00:03:31.960 He ignored, we're now being told,
00:03:33.660 the Department of Justice's warnings
00:03:36.400 over legally flawed auto PIN pardons.
00:03:40.900 Senior Justice Department officials
00:03:44.000 were left scrambling to, quote,
00:03:46.360 interpret the sweeping clemency orders
00:03:49.120 former President Joe Biden approved
00:03:51.160 for thousands of federal convicts
00:03:53.700 in his final days and final hours in office.
00:03:57.440 And they chastised the White House
00:03:59.960 for falsely portraying the releases
00:04:03.000 as limited to, quote,
00:04:05.900 nonviolent offenders.
00:04:07.420 This, according to internal emails,
00:04:10.960 have now been revealed.
00:04:13.040 The records obtained by the Oversight Project
00:04:16.140 and reviewed by the Washington Examiner
00:04:18.680 now reveal that former Associate Deputy Attorney General,
00:04:23.740 the department's top career official at the time,
00:04:26.840 Bradley Weinsheimer,
00:04:28.420 raised alarms immediately after Biden issued
00:04:31.440 three auto PIN signed warrants.
00:04:34.520 On January the 17th,
00:04:37.240 covering nearly 2,500 inmates were now learning.
00:04:44.120 In a January 18th message
00:04:46.580 to the White House Counsel
00:04:48.120 and the Department of Justice Office
00:04:50.480 of the pardon attorney,
00:04:52.820 Weinsheimer wrote that one warrant granted clemency
00:04:56.480 for offenses described to the Department of Justice
00:04:59.820 was so vague it could not be lawfully
00:05:03.240 even carried out, quote, unquote.
00:05:07.080 He went on to say at the time,
00:05:09.380 I think the language is highly problematic,
00:05:13.000 adding that to interpret the document properly,
00:05:16.120 we will need a statement or direction
00:05:19.680 from President Biden.
00:05:21.380 He also suggested that Biden provide, quote,
00:05:24.980 a list as to each inmate listing the offenses
00:05:29.140 that are covered by the commutation,
00:05:31.900 which he described as the clearest
00:05:34.300 and least problematic alternative moving forward.
00:05:38.860 Weinsheimer and Biden needed to clarify
00:05:41.620 the meaning of the warrant language, quote, unquote,
00:05:45.820 so the DOJ could implement it in the manner intended,
00:05:49.560 they claimed, by President Joe Biden.
00:05:52.540 Here is an exact quote from the email.
00:05:55.740 It said this,
00:05:57.240 Given the above,
00:05:58.520 I think it is best that we receive a direct statement
00:06:01.420 on direction from President Biden
00:06:04.180 as to the meaning of the warrant language.
00:06:06.960 This will then allow us to give full effect
00:06:09.680 to the commutation warrant
00:06:11.000 in the manner intended by the president.
00:06:13.860 In the absence of such a statement or direction,
00:06:16.260 I am concerned option three above
00:06:18.980 will be the interpretation that is given to the warrant.
00:06:22.940 While that is a logical construction legally,
00:06:26.900 it can't possibly be what the president intended.
00:06:31.320 So I would like to avoid that outcome.
00:06:34.960 One other important note, the email says,
00:06:38.160 in communication about the commutations,
00:06:41.240 the White House has described
00:06:42.600 those who receive commutations
00:06:44.980 as people convicted
00:06:46.300 of nonviolent drug offenses.
00:06:48.720 I think you should stop saying that
00:06:51.000 because it is untrue
00:06:53.040 or at least misleading.
00:06:56.140 As you know,
00:06:57.240 even with the exceedingly limited review
00:06:59.780 we were permitted to do
00:07:01.600 of the individuals
00:07:02.560 we believe you might be considering
00:07:04.960 for commutation action,
00:07:06.480 we initially identified 19
00:07:09.100 that were, quote,
00:07:10.920 highly problematic.
00:07:13.600 That was based only upon running
00:07:15.700 our initial priority list
00:07:17.880 against the list of those
00:07:19.240 who had submitted clemency petitions,
00:07:22.360 a small percentage of the overall total
00:07:24.580 from the White House.
00:07:26.260 Even in that number,
00:07:28.220 we identified violent offenders,
00:07:31.580 including those who committed acts of violence
00:07:34.260 during the offense.
00:07:37.140 Now, this is a screenshot
00:07:38.480 of a much longer email exchange.
00:07:41.220 This email was directly warning
00:07:43.620 the Biden White House
00:07:45.000 that its language about clemency subjects
00:07:47.880 was, quote,
00:07:48.900 untrue or at least misleading.
00:07:52.280 Weinsheimer also warned
00:07:53.960 the ambiguous order
00:07:55.180 could unintentionally wipe away convictions
00:07:57.640 for many violent felons.
00:08:00.680 He pushed back
00:08:02.260 against the White House messaging
00:08:03.700 that the clemency recipients
00:08:05.600 were only nonviolent drug offenders.
00:08:09.080 That's not true.
00:08:10.600 Among them, for example,
00:08:11.920 was Russell McIntosh.
00:08:13.940 Now, this is not someone
00:08:15.540 you would ever describe
00:08:16.680 as a, quote,
00:08:17.620 nonviolent drug offender.
00:08:19.340 How do we know this?
00:08:20.840 Russell killed a woman
00:08:22.780 and her two-year-old child
00:08:25.720 to protect his drug business.
00:08:29.020 Stephen Fowler,
00:08:30.460 whose enforcer
00:08:31.940 tortured an informant
00:08:33.680 with a butane torch
00:08:35.460 and plays Anderson,
00:08:38.660 a gangster's disciple member,
00:08:41.100 was implicated
00:08:41.980 in multiple murders
00:08:43.580 and multiple kidnappings.
00:08:46.160 This according
00:08:47.180 to a commutations receipt page
00:08:49.960 from the Department of Justice.
00:08:52.320 Now, all of the people
00:08:53.480 I just named,
00:08:54.260 those are not
00:08:55.000 nonviolent drug offenders,
00:08:56.400 as the White House claimed.
00:08:57.720 And despite these warnings,
00:09:00.300 the White House released
00:09:01.180 a statement
00:09:01.760 in Biden's name
00:09:03.020 touting
00:09:03.640 the mass commutations
00:09:05.440 as relief
00:09:06.720 for, quote,
00:09:07.580 nonviolent drug offenses
00:09:09.560 and saying
00:09:11.080 it was the largest
00:09:12.860 clemency action
00:09:14.100 in U.S. history
00:09:15.420 that we apparently
00:09:16.400 were supposed to
00:09:17.260 celebrate it.
00:09:18.780 Well, in July,
00:09:20.420 in the interview
00:09:21.040 with the New York Times,
00:09:22.460 I want to remind you,
00:09:23.860 Biden insisted
00:09:24.700 he personally made
00:09:26.080 all clemency decisions
00:09:28.420 calling Republican claims
00:09:30.540 that aides misused
00:09:31.980 the auto pen
00:09:32.860 ridiculous
00:09:34.280 and, quote,
00:09:35.640 false.
00:09:36.800 Now, amid scrutiny
00:09:37.800 of his aides' use
00:09:39.800 of the automated
00:09:40.740 signature device
00:09:41.720 to place his name
00:09:42.660 on the pardon documents,
