00:08:59.260 will describe i'm not here in a vendetta my goal is to help you understand how this happened

00:09:13.700 You should also know that a few of the senior level DHS officials who harassed and abused
00:09:18.860 our unit for committing the sin of trying to expose a huge amount of fraud in the CCAP
00:09:25.160 program are still working at DHS today.
00:09:29.440 From 2014 to early 2017, our unit received tremendous support from the original Inspector
00:09:35.980 General and Deputy Inspector General.
00:09:39.380 These folks, along with the great staff at the DHS Child Care Licensing Unit, were the
00:09:45.400 first ones to discover very strange and unusual activity at certain Minnesota child care centers
00:09:51.960 as well as suspicious behavior by their owners.
00:09:55.440 This led them to believe that significant CCAP fraud may be taking place.
00:10:00.680 The DHS childcare licensing staff spent a great deal of time after we were hired teaching
00:10:06.560 us what would be normal activity at a childcare center and what would be abnormal or suspicious.
00:10:14.500 Just so you're aware, our investigators were all retired police officers.
00:10:18.820 They averaged 20 years of experience with extensive experience investigating everything
00:10:24.000 from fraud to narcotics trafficking to homicide.
00:10:28.960 These were veteran cops, but they knew nothing about child care centers, but the DHS licensing
00:10:33.540 folks took care of us.
00:10:35.720 From the beginning, our unit began receiving information, tips or complaints from a wide
00:10:41.660 variety of sources that we believed were likely indicators of fraud.
00:10:46.360 As an example, one day we received a call from a CCAT mother who called to complain
00:10:51.800 that her child care center owner had stopped paying her the monthly cash kickback they had
00:10:57.380 agreed upon another day a former co-owner of a center called to say that he had been cheated
00:11:04.000 out of his share of the fraud proceeds yet another day a fire department called asking if a child
00:11:10.880 care center was still operating let me just pause and i want you to think about this call center
00:11:16.440 These are people that are calling in and they're like, where's my stuff?
00:11:21.220 Where's my kickback?
00:11:23.100 Where's my cut?
00:11:24.500 This is normal business that's being described.
00:11:28.240 And this has been happening again, as he's describing it for years and years and years

00:11:32.620 And there were people that were telling them this was happening.

00:12:18.900 because they had been trying to conduct a fire safety inspection and had made multiple trips
00:12:25.080 there on different days at different times but there were never any children or staff at the
00:12:31.340 center i checked and found that in the last 12 months we had paid the center approximately one
00:12:36.320 million dollars and that they were billing for the care of approximately 90 children at a time
00:12:41.720 during two shifts from 6 a.m. to 10 p.m. seven days a week. I wish I could tell you that these
00:12:48.580 types of incidents were rare, but they weren't. This is what our team dealt with on a weekly basis.
00:12:55.380 Once our unit received information we believed was an indicator of CCAP fraud, we would prioritize
00:13:01.460 these tips primarily based on the amount of ccap funding the center received frankly we were so
00:13:08.380 inundated with tips on centers receiving 700 000 to over a million dollars that we didn't have time
00:13:15.580 to focus on centers receiving less funding did you hear that they had so many tips so many tips
00:13:24.580 that were coming in of major massive fraud that if you were under 700 000 like yeah like we we
00:13:30.160 we can't there's nothing we can do like that i mean we're doing the best we can we don't have
00:13:35.140 enough manpower to stop this type of fraud by the way i don't know what this guy makes but let's
00:13:39.220 just say it's under 100 grand you're telling me that you can't spend 100 grand to stop millions
00:13:46.000 in fraud you understand my point here right like this is insanity and they're explaining it because
00:13:52.880 this is how bad it actually got and it had been this way for years and no one in the democratic
00:14:02.000 party did anything to stop it they said double down keep going look the other way and just give
00:14:06.800 us our kickbacks the same kickbacks they're getting the phone calls like hey where's my payment
00:14:11.120 cases were assigned to investigators who would then conduct research on the center
00:14:15.680 and owner and would then initiate physical and electronic surveillance of the center
00:14:21.780 The surveillance would determine how many adults and children entered the center
00:14:25.860 and the times that they did so. This would later be compared with building records the
00:14:30.900 center submitted for CCAP payment. If the investigation to this point indicated significant
00:14:36.500 fraud, the information was shared with the BCA agent who then continued the investigation.
00:14:42.580 If warranted, the agent would eventually obtain a search warrant for the center,
00:14:46.180 at which time computers and phones belonging to the owner and business were seized.
00:14:52.280 At the time of the search warrant, we ordered all payments to the center to be stopped.
00:14:57.300 The DHS Forensics Lab would then perform forensic examinations on the electronic devices.
00:15:04.080 These exams often resulted in us obtaining our most powerful evidence against those committing fraud.

00:16:26.360 aid who are and this goes back to brook rawlings yesterday and and if you missed that go back and

00:16:37.860 of the number of people on government aid that were driving lamborghinis and ferraris and bentley's
00:16:44.060 and maseratis like this is they came in and they knew that they could commit massive fraud at a
00:16:52.360 massive level and that no one was going to stop them and they could then get government aid and
00:16:58.400 benefits as well it gets worse keep listening up to this point which was early 2017 in the roughly
00:17:06.680 two and a half years of our existence our unit had directed ccap payments to be stopped to 11
00:17:12.640 child care centers that we could prove had fraudulently billed dhs these stop payment
00:17:18.600 orders always resulted in the immediate closure of the center because the centers we investigated
00:17:24.660 never had any private paying clients only publicly funded c-cap clients okay so here's your fraud
00:17:32.320 if these are all fake centers right with with no real people that they're helping as soon as the
00:17:40.300 government dollars disappeared the centers would immediately close why because the government
00:17:45.260 dollars was the scheme and there wasn't even kids tied to the scheme that would show up and actually
00:17:50.060 do anything we also learn that right well the leering center is a great example of this many
00:17:54.640 of these centers were just that they were they were paper shops they were fictitious right it
00:17:59.420 was like it's like having a business at a p.o box it doesn't you know it doesn't exist that's why
00:18:04.560 you'd have so many of these learning centers in these areas and no kids present no playgrounds
00:18:10.860 nothing that screams kids and when you go there and try to enroll a kid they're like we don't do
00:18:15.040 that right like we're full we don't need you we don't want you like because it wasn't about the
00:18:19.300 kids it was about committing a fraud they didn't even try to like have normal kids by the way

00:18:52.760 crimes. I regularly joined with various investigators and agents as we interviewed
00:18:58.940 the owners and employees of the child care centers being investigated. More than once,
00:19:04.780 I heard an owner or employee respond when we asked where they first learned about the daycare scam.
00:19:11.680 they would say they had first heard about it while in the refugee camp in kenya
00:19:17.080 these individuals told us hold on wait i want you to just understand they found out about the scheme
00:19:24.440 in a refugee camp in kenya that this fraud is now like that's it's worldwide fraud folks

00:20:17.460 Additionally, at about this same time, the DHS investigators and BCA agents initiated an investigation of another child care center and found a high amount of billing fraud.

00:20:36.560 and human services office inspector general were invited to join in the investigation due to some
00:20:42.960 of the unusual activity and suspected crimes that we believe we saw this investigation resulted in
00:20:50.320 the federal indictment in 2017 of the owner of salama child care center that owner eventually
00:20:56.720 pled guilty and was sentenced in 2018 to two years in prison and was ordered to pay restitution of
00:21:03.540 over 1.4 million dollars. The Salama Child Care Center was located at 1411 Nicola Avenue in
00:21:10.960 Minneapolis. That address might ring a bell for some of you because of a YouTube video taken last
00:21:17.780 December at the Quality Leering Center which was being operated at the same address. Okay so
00:21:26.280 So what he's describing to you is multiple people that had already been brought down
00:21:32.080 who then the other people would just keep using the same address.
00:21:36.380 How hard is it to figure that out?
00:21:38.460 Now, luckily, the federal government, the feds are raiding these places.

00:22:30.560 some publicity and the legislature then directed the office of legislative auditor to conduct a
00:22:37.120 special review of the CCAP program. In August of 2018 as I was preparing answers to questions posed
00:22:43.860 to me by the OLA in an email I was told by a DHS official to submit my answers to them instead of
00:22:51.700 sending them directly to the OLA. When I forwarded my answer regarding what fraud trends we were
00:22:58.120 seeing in CCAP, as I had been directed, I soon had a senior DHS official in my office, angry,
00:23:05.900 red-faced, and almost yelling. The senior DHS official told me to delete a number of paragraphs
00:23:11.780 of the document that I had sent. I then advised this official that I believed what they were
00:23:17.580 telling me to do was illegal. I advised them that Minnesota law requires state employees
00:23:23.640 to cooperate with the OLA and to turn over information as requested. A few days later,
00:23:29.540 the same official told me, I just came from the commissioner's office and they're sending your
00:23:34.760 document to the OLA. You better be ready for the blank storm that's coming your way.
00:23:42.120 so you're now being threatened that if you do your job and actually expose fraud that you better be
00:23:50.340 ready for what comes at you from the government you're supposed to be supposed to be telling the
00:23:55.300 fraud to so that they can do their jobs and get rid of the fraud and now you understand how many
00:24:00.840 democrats out there all right in minnesota that we're getting the kickbacks including the governor
00:24:09.040 so this was all done by design and they knew it and if you did your job as law enforcement you
00:24:18.080 were threatened good luck keeping your job because if you go there we're that somebody's
00:24:25.420 going to come for you who the political machine in the following months members of our unit were
00:24:31.300 harassed and bullied by DHS officials in the following manner. First, DHS paid $90,000 to a
00:24:39.740 consultant with no experience in public benefit program integrity or financial fraud investigations
00:24:46.820 to label the CCAP fraud allegations in my email as unreliable and unable to be proven. During an
00:24:55.460 interview with the consultants, which became heated, I told them that I really didn't care
00:25:01.500 what they put in their report, but if they said there was no fraud or that our investigators were
00:25:06.940 making this up, that when this became public, their company would lose all credibility.
00:25:12.980 I told them that the fraud was so huge that sooner or later, it would come to light.
00:25:18.320 Secondly, false derogatory information was placed on a supervisor's performance review by DHS officials.
00:25:28.500 Third, DHS implemented a continuous improvement program with the Fraud Investigation Unit.
00:25:36.540 This process started with the senior continuous improvement official berating our group for approximately 30 minutes,
00:25:45.360 telling us, in essence, we were incompetent and terrible employees.
00:25:50.680 I had never heard of something like this happening to any group of state employees
00:25:55.720 in my 40 years in state government.
00:25:59.080 A DHS assistant commissioner was in the room watching this.
00:26:03.700 Over the next approximately six months,
00:26:06.160 we were directed to attend many group meetings
00:26:09.020 to discuss the investigative process at length,
00:26:12.180 and we were giving homework assignments to work on between the meetings.
00:26:17.140 These meetings were led by the same DHS official who had berated us so badly in that first meeting.
00:26:23.880 The huge amount of time our team spent in those meetings and on our assignments
00:26:29.000 resulted in investigators and supervisors being unable to conduct hardly any investigative activity
00:26:35.900 over the roughly six months of this program.
00:26:38.740 As a result of this program, significant changes were dictated to our unit by the lead official and this process, the changes to the process included A, myself and the unit supervisor, keep in mind together between the two of us, we had 70 years of criminal investigative experience.
