00:03:08.180 Good Tuesday morning. It's so nice to have you with us on the 47 Morning Update.
00:03:11.460 And we've got a big story for you.
00:03:13.260 A D.C. judge signed off on a search warrant of a member of Congress.
00:03:17.740 You know, the woman who's a member of the squad, Ilham Omar.
00:03:20.900 A federal judge thinks it's more likely than not that evidence of a federal crime sits inside that home.
00:03:28.260 Omar is not only a member of Congress, but she's also one of those that is now fighting back,
00:03:33.600 saying that this is Donald Trump just coming after her.
00:03:36.880 We have all the details of that search warrant and exactly what they're investigating.
00:03:40.820 And I have that for you in just a moment.
00:03:43.400 But before we get to that, let me talk to you about the midterm elections.
00:03:46.380 They're heating up, congressional control, and President Trump's agenda.
00:03:50.180 They're hanging in the balance.
00:03:51.300 Every headline has the potential to shift the odds.
00:03:54.380 And on Calshi, you can trade major primaries, election outcomes, and the biggest political storylines as they happen.
00:04:02.200 Let me give an example.
00:04:03.340 If you go to the Calshi election hub, it is the primary hub, midterm hub, whatever you want to call it.
00:04:08.540 there are different things like this which party will win the u.s senate right now democrats are
00:04:14.360 the odds 90 republicans at 10 now let's say you decide all right i'm going to go with the
00:04:19.880 republicans i think everybody's wrong well a hundred dollars it would give you back eight
00:04:24.520 hundred and fifty five dollars and change right now if you're right you can also get on to the
00:04:30.420 other big issues like who will win the los angeles mayor's race that's a big one or the
00:04:35.680 2028 presidential election winner who will it be all of these are up there right now on calci and
00:04:42.380 then there's that big big big race will kim paxton defeat talarico right now paxton is currently
00:04:48.440 trading at 50 percent meaning a hundred dollar trade would pay out 93 if he beats talarico now
00:04:55.280 on calci you're trading against peers in a live market meaning there's no house and as the

00:05:29.980 Story number one. Many of you woke up to the breaking news the same way that I did.
00:05:36.080 This is what it sounded like on Fox News.
00:05:41.500 Back with the Fox News alert, we're learning that the Washington, D.C. home of Minnesota
00:05:45.960 Congresswoman Ilhan Omar was raided early this morning by Homeland Security investigations. Fox
00:05:52.580 is told by multiple law enforcement sources this began early this morning around 6 a.m.
00:05:58.300 Eastern. Homeland Security and the DOJ are both working on the investigation. A DOJ spokesperson
00:06:04.320 telling Fox this, quote, today in the Washington, D.C. area, Homeland Security Investigations
00:06:09.780 executed a judicially authorized search warrant secured by the Department of Justice. This
00:06:15.260 enforcement action is part of an ongoing federal investigation. Now, that's all we learned at that
00:06:22.880 moment. But we know a lot more about the background now of federal agents and why they
00:06:28.040 raided the Democratic Representative Olam Omar's Washington, D.C. home early Monday morning as part
00:06:33.900 of this ongoing, as they described it, federal criminal investigation. Now, this isn't just any
00:06:39.720 member of Congress. We're talking about one of the most controversial Democrats in D.C.
00:06:44.420 The Minnesota Congresswoman is one that, well, doesn't back America very often, if ever. Instead, 1.00
00:06:49.940 she actually seems to hate this country. And what makes this story, I think, even more extraordinary
00:06:55.200 is the fact that this federal investigation reportedly involves all of the different
00:07:00.340 allegations that we've been hearing about. They've been following Omar, by the way, for nearly a
00:07:05.840 decade. Now, let me go through these allegations so you understand for context here. There was
00:07:11.100 allegations involving basic immigration fraud. There were questions about her family's original
00:07:17.380 entry into the United States as well. And then the explosive long disputed accusations that she
00:07:23.500 actually married her own brother as part of an immigration scheme. Now, I want to be very clear.
00:07:31.020 Of course, Omar denies all of this. Now, this raid, however, changes things. The raid is confirmed.
00:07:36.740 The criminal investigation is confirmed. And that is an important distinction here, because for
00:07:42.800 about a decade, she's been saying nothing is there. Nothing is there. Nothing is there.
00:07:47.380 Now, according to multiple reports that include Fox News, CBS and Reuters, the AP, federal agents all executed a search warrant at Omar's D.C. resident.
00:07:58.060 And while the headlines have referred to an FBI raid, the operation, we're now being told, was actually conducted by Homeland Security Investigations and the investigative arm of ICE working with the Justice Department.
00:08:11.060 Now, this is not simply somebody filing a complaint.
00:08:14.820 All right.
00:08:15.040 This is not another politician demanding answers.
00:08:19.160 Federal investigators had to obtain a search warrant.
00:08:22.920 They had to obtain it from a judge and entered the home of a sitting congresswoman.
00:08:28.880 Now, the Justice Department confirmed that the operation is part of their ongoing federal criminal investigation.
00:08:34.800 Keyword is federal criminal investigation.
00:08:37.280 And even according now to Reuters and CBS News,
00:08:40.200 sources familiar with the investigation say federal authorities are examining quote immigration
00:08:47.480 documents connected to omar's family including paperwork completed by her late father when she
00:08:54.180 was a child and then that brings us to the question everybody is asking how the heck do we even get to
00:09:00.080 this point all right so let's go back to the beginning okay omar was born in somalia in 1982
00:09:07.700 Her family fled the country's civil war, eventually spending time in a refugee camp in Kenya
00:09:13.180 before coming to the United States of America.
00:09:15.680 Now, this is from public reporting, so who knows where the story could actually not be
00:09:19.860 true, but we'll go with what we at least believe the facts to be.
00:09:23.920 Now, Omar has described arriving in America as a child, becoming a, quote, naturalized
00:09:28.740 American citizen in 2000 and then entering politics in Minnesota.
00:09:33.360 in 2018 that is when omar was elected to congress she became one of the first two muslim women
00:09:40.620 elected to the house of representatives and a prominent member of that radical progressive
00:09:45.300 group known as the squad but even before she reached congress questions about her personal
00:09:51.960 history and marriage records had already been circulating with massive question marks around it
00:09:58.220 And those questions would become the foundation of a controversy that's followed her entire political career.
00:10:05.120 Now, that first issue involved her marital history.
00:10:08.960 According to Omar's own accounts, all right, she entered a religious marriage with a guy by the name of Ahmed Harsey in 2002,
00:10:20.380 although they did not legally marry at that time.
00:10:24.420 They had children together.
00:10:26.160 The relationship later ended in 2009.
00:10:30.620 That is when Omar legally married another man by the name of Ahmed Noor Sed Elim.
00:10:36.360 That marriage is at the center of this controversy.
00:10:40.220 Now, critics allege that Elmi was actually Omar's biological brother
00:10:46.560 and that the marriage was intended to facilitate immigration benefits.
00:10:52.060 Now, that is an allegation, all right, which now they're clearly looking into.
00:10:56.880 Now, Amar has repeatedly denied that Elmi is her brother and rejected the accusations that the marriage was fraudulent.
00:11:03.400 But those questions have never actually been answered with real paperwork.
00:11:08.040 Then you go to the third part of this, the marriage controversy and the documents question.
00:11:13.220 This is how we're getting closer to where we are today.
00:11:15.840 And this is the timeline.
00:11:17.640 All right.
00:11:17.980 Amar marries Elmi legally in 09.
00:11:20.120 she has said that the relationship ended in 2011 through a religious divorce as she described it
00:11:25.800 the legal marriage remained in place for several more years however and then during that period
00:11:31.920 Omar she says she reconciled with Ahmed the father of her children now she eventually obtained a
00:11:39.240 legal divorce they say from from Elmi in 2017 and then right away she legally married her original
00:11:46.100 husband yet again in 2018. Now consider what reporters have uncovered. In 19 the Minnesota
00:11:54.100 Star Tribune conducted an extensive investigation into Omar's marriage history. Reporters examined
00:12:00.700 public records, addresses, social media activity and questions surrounding her tax filings. They
00:12:06.540 found that Omar had filed joint tax returns with Hirsi in 14 and 15 even though she was still
00:12:13.120 legally married to elmy that was a legitimate issue now involving her tax filings and omar
00:12:20.180 acknowledged the filings were improper and said they had been quote unquote corrected now the
00:12:25.260 newspaper also identified overlapping addresses involving the individuals in her marital history
00:12:31.980 as well all right i go back to what i just said the same addresses were used folks that's not
00:12:38.260 normal when you're married to two different people but somehow oh they just have the same exact
00:12:44.180 like you know records here the same exact tax filings the same addresses well then investigators
00:12:51.500 examined the public records and encountered major gaps and unanswered questions on top of all of
00:12:57.320 that and that is where the critical point comes in the star tribune did not establish that elmi
00:13:05.740 was omar's brother now its investigation can neither conclusively confirm nor disprove that
00:13:12.720 allegation other fact-checking organizations likewise found insufficient evidence to establish
00:13:20.240 the claim so now you've got two separate issues one involves documented irregularities under tax
00:13:27.680 filings and an unusual marital timeline and the other involves a much more serious allegation of
00:13:33.380 a fraudulent marriage involving a sibling her brother we'll take a quick break we'll come back
00:13:39.780 more on this coming up in the ben ferguson show right after this all of these questions are
00:13:44.140 legitimate but the question is why would you do this right why would you try to commit this type
00:13:49.260 of fraud if you're doing it what's the payoff what is the advantage of marrying your brother
00:13:53.680 and getting rid of your ex and then remarrying your ex uh and then divorcing what it sounds to
00:13:58.820 be like your brother in the allegations all right well let's go through that according to reuters
00:14:04.000 and cbs news investigators are now examining immigration paperwork connected to omar's not
00:14:10.240 only original entry into the united states and that paperwork reportedly includes documents
00:14:15.380 compiled by her late father when she was a child now you have to think about like the significance
00:14:20.800 of that this potentially takes the investigation beyond her adult marriage history and back to the
00:14:27.660 original immigration process that brought her family to america federal authorities are reportedly
00:14:34.220 looking into whether immigration documents also contain false information what has not been
00:14:40.940 publicly established is whether any such false information exists but they're looking into it
00:14:46.160 based on all the data that we now know and the other question would be this would omar be held
00:14:52.680 responsible for those documentation issues if there are some even if she knew about it or didn't 0.92
00:14:58.700 know about it that's the other thing how would you prove it this far along she came again she's
00:15:02.720 born 1982 this is a long time ago uh she was naturalized by the way in 2000 years before her
00:15:10.260 09 marriage to elmy so the allegations that are 09 marriage by the way and this is the second part
00:15:16.180 of this was somehow used to obtain her own original american citizenship well that doesn't fit the
00:15:21.740 timeline so we don't think that's actually the issue the separate allegation has been that the
00:15:27.560 marriage could have been intended to benefit elmy's immigration status that may be why the
00:15:34.080 investigation is looking into her past and her marriage history now if investigators establish
00:15:40.800 that a material fraud occurred during a naturalization process federal law provides
00:15:50.020 mechanisms for seeking denaturalization under specific circumstances i want to be clear this
00:15:55.860 is not automatic the government would face significant legal requirements and any attempt
00:16:01.640 to revoke citizenship require appropriate legal proceedings to go along with it now the search
00:16:06.740 warrant alone does not establish by the way that omar did get her citizenship unlawfully or not
00:16:13.260 and then there's the president who's now weighing in on this as well it was very short it was very
00:16:19.900 sweet and he was asked about alam omar and here's what the president had to say well i understand
00:16:25.540 they're looking at her very carefully uh i've always found her to be totally crooked personally
00:16:31.080 but that has nothing to do with me i think she's a terrible person just a complainer she comes from 0.88
00:16:37.600 a country that is a non-country and then she comes over here and she complains about our
00:16:43.800 constitution i think she's a terrible person but that's really up to the dj i have nothing to do
00:16:49.900 That's really up to the DOJ.
00:16:51.980 I have nothing to do with it.
00:16:53.620 And that's exactly where we are now.
00:16:55.140 By the way, in May, J.D. Vance said,
00:16:57.420 it certainly seems like something fishy is there,
00:17:00.580 but everybody's entitled to equal justice under the law.
00:17:04.640 He said investigators would examine the allegations
00:17:06.760 and determine whether there was evidence of a crime.
00:17:09.920 And then came statements from the Homeland Security Secretary, Mark Wayne Mullen.
00:17:13.420 In September, Mullen publicly acknowledged an ongoing investigation
00:17:17.420 investigation involving omar's family's immigration history and he suggested investigators were
00:17:24.120 examining whether the family's original entry into the united states of america involved illegal
00:17:29.320 activity and mohan made an especially significant statement saying this at the time quote if we can
00:17:35.640 prove that you shouldn't have been here in the first place we'll deport you quote unquote that
00:17:42.540 by the way is a extraordinary statement from the secretary of the homeland security about a
00:17:47.280 sitting member of Congress. But you got to remember the statement was conditional. Mullen
00:17:51.900 did not publicly present any evidence establishing immigration fraud. And the White House borders are
00:17:57.060 Tom Homan also confirmed that a criminal investigation was underway. And now, less than
00:18:01.920 a month later, federal agents have searched Omar's home. Now, this is the moment the story moves from
00:18:09.600 public accusations and political controversy to now what can only be described as a major
00:18:15.200 federal investigative action so what happened during the raid is the final part of this like
00:18:22.140 what were they doing all right let's talk about what happened on monday morning according the
00:18:26.440 associated press homeland security investigations agents searched omar's washington residence now
00:18:34.600 the street around the property was blocked off agents were seen removing boxes containing seized
00:18:39.400 evidence the justice department confirmed that investigators executed a judicially
00:18:43.920 authorized search warrant but officials have not publicly disclosed the complete scope of the
00:18:49.920 warrant or the specific evidence investigators were seeking now CBS News said the investigation
00:18:56.380 centers on immigration paperwork again involving Omar's family Reuters also reported that at least
00:19:03.020 part of the investigation concerns documents prepared by her father those details matter
00:19:09.480 because that suggests clearly that investigators are examining the historical records
00:19:14.560 rather than simply responding to the recent political statements.
00:19:18.180 But again, there are still major unanswered questions, all right?
00:19:23.880 So the judge is going to have to look at this, right?
00:19:26.540 What evidence was presented to the judge is a question we should all be asking
00:19:29.680 just for the search warrant.
00:19:30.980 And then what documents were actually seized?
00:19:33.180 And then what criminal violations are the investigators examining?
00:19:37.360 And perhaps most importantly, does the government have evidence connecting Omar personally to any deliberate fraud?
00:19:46.480 All of those answers have not yet been made public.
00:19:50.260 And by the way, we're also being told that there is no public announcement of any criminal charges against Omar, as I am saying this to you right now.
00:19:58.780 Now, Omar has also come out, and I think it's important that you know this.
00:20:02.160 She's fired back, all right? 0.56
00:20:03.920 She's accusing President Trump and his administration of targeting her because of her politics.
00:20:09.360 Following the raid, she said, for 10 years, Trump has targeted me with baseless lies and smear campaigns.
00:20:14.660 She called the search an escalation in political intimidation, declared, I will not be silenced.
00:20:20.540 Democratic leadership, by the way, also coming to her defense as well.
00:20:23.600 House Minority Leader Hakeem Jeffries and other senior Democrats condemned the operation,
00:20:29.180 accusing the administration of weaponizing federal law enforcement against their political opponents.
00:20:34.940 By the way, can we just go back to what actually happened when they raided Mar-a-Lago?
00:20:39.180 Let me just take you to a guy at CBS.
