00:00:33.560 This seems to be a major change in the White House's position.
00:00:40.160 Despite, we now know, they were briefed back in June of 2022
00:00:45.020 that apparently, and this is coming from the CIA,
00:00:49.000 that Ukraine was planning and even practicing to blow up the Nord Stream pipeline.
00:00:56.240 Biden, if you fast forward from June to September of 2022,
00:01:02.060 he came out and said this after that pipeline was exploded.
00:01:06.340 Quote, let me say this.
00:01:07.680 It was a deliberate act of sabotage,
00:01:09.520 and now the Russians are pumping out disinformation and lies.
00:01:14.100 The President went on to say,
00:01:15.300 we'll work with our allies to get to the bottom of exactly what happened,
00:01:18.620 precisely what happened.
00:01:20.520 At my direction, I've already begun to help our allies enhance the protection
00:01:24.380 of this critical infrastructure.
00:01:27.200 And then, Senator, he said this.

00:01:30.200 And at the appropriate moment when things calm down,
00:01:32.860 we're going to send the divers down to find out exactly what happened.

00:01:39.000 We don't know exactly, but just don't listen to what Putin's saying

00:01:48.580 Now, I think he was trying to say because what he was saying we know is not true.

00:01:54.140 and if you look at the headline coming from the liberal Washington Post,
00:01:58.240 Biden blamed Russia for the Nord Stream pipeline attack
00:02:00.860 despite the CIA being briefed earlier on a Ukrainian plot
00:02:05.120 to do exactly that, blow it up.

00:02:07.440 Well, today's story in the Washington Post is a big deal.
00:02:11.500 And let's step back for a minute.
00:02:13.220 On this podcast, we've walked through at great length
00:02:15.580 what caused the war in Ukraine.
00:02:18.800 There are many things that are frustrating about this war,
00:02:21.480 but the most fundamental is that it was utterly preventable.
00:02:25.120 This war did not have to happen,
00:02:27.280 and it was caused by Biden's weakness
00:02:30.760 and his complete capitulation to Russia.
00:02:34.560 And to retread a little bit,
00:02:38.020 but this is important to understand why this story in the Post is significant.
00:02:43.840 Putin has long wanted to invade Ukraine.
00:02:47.620 He wants to reassemble the old Soviet Union.
00:02:51.020 He longs for the days of what he perceives as Soviet greatness.
00:02:55.120 If you're going to reassemble the old Soviet Union, Ukraine is the most important piece of it.
00:03:00.420 And Putin previously invaded Ukraine.
00:03:03.880 In 2014, he invaded Ukraine, invaded Crimea, which is the southern portion of Ukraine.
00:03:09.640 But he stopped because Russia's primary source of revenue is selling oil and natural gas,
00:03:17.580 and the natural gas pipelines run right through the middle of Ukraine.
00:03:21.220 And if he invaded the whole country, he risked damaging or destroying those pipelines.
00:03:27.020 So the next year, in 2015, he launched the Nord Stream 2 pipeline.
00:03:31.280 Nord Stream 2 is an undersea pipeline underneath the Baltic Sea
00:03:35.100 that runs directly from Russia to Germany.
00:03:39.420 The entire purpose of it was to circumvent Ukraine
00:03:42.620 so that when the pipeline became complete and active,
00:03:47.240 Russia could invade Ukraine and not worry about the pipelines
00:03:50.380 because it could get its natural gas to market.
00:03:53.980 As you know, in 2019, I authored sanctions legislation that shut the Nord Stream 2 pipeline down.
00:04:00.380 Putin halted construction of the pipeline literally the day
00:04:04.940 Donald Trump signed my sanctions legislation into law.
00:04:09.160 For over a year, from December 2019 to January of 2021,
00:04:15.140 the pipeline was dead and dormant and nothing happened
00:04:19.080 because the sanctions legislation that I authored and Trump signed had stopped it.
00:04:24.660 Joe Biden became president on January 20th, 2021.
00:04:28.080 Four days later, January 24th, Putin resumed deep-sea construction of Nord Stream 2
00:04:35.260 because Biden had foreshadowed incredible weakness that he was going to give into Russia.
00:04:42.620 That foreshadowing proved accurate.
00:04:45.080 Several months later, Biden formally waived sanctions on Nord Stream 2,
00:04:49.820 gave Putin a multi-billion-dollar gift.
00:04:53.680 Fast forward to January of 2022, I force a vote on the Senate floor to reimpose sanctions
00:05:00.940 on Nord Stream 2.
00:05:03.180 Every Democrat had voted with me twice to impose those sanctions.
00:05:07.680 On the day of the vote, Biden, for the first time in his presidency, came to Capitol Hill
00:05:13.440 and personally lobbied Democrat senators to vote against my sanctions legislation,
00:05:20.960 to vote in favor of Russia, in favor of Putin, and 44 Democrats flipped their votes.
00:05:27.560 They'd voted with me twice, but at Biden's behest, they put partisan politics
00:05:33.300 above U.S. national security, above standing with our allies.
00:05:37.760 Now, when that vote was pending, President Zelensky of Ukraine publicly begged the Senate,
00:05:43.500 pass Cruz's sanctions legislation.
00:05:46.900 It's the only way to stop Russia from invading Ukraine.
00:05:50.260 The government of Poland put out a formal statement, said,
00:05:54.020 pass Cruz's sanctions legislation.
00:05:56.820 Without it, Russia will invade Ukraine.
00:05:59.240 The Democrats flipped.
00:06:01.280 The legislation failed.
00:06:03.000 And just a few weeks later, Russia invaded Ukraine.
00:06:06.260 Fast forward.
00:06:09.260 We've now had the biggest land war in Europe since World War II, waging for over a year.
00:06:14.720 Biden was so weak to Russia, he capitulated to Russia.
00:06:18.160 He allowed Putin to complete Nord Stream 2.
00:06:21.480 And the result was exactly what Zelensky predicted, exactly what Poland predicted,
00:06:25.980 exactly what I predicted on the Senate floor.
00:06:28.620 Russia invaded Ukraine.
00:06:30.580 Now, several months ago, as we know,
00:06:33.920 the Nord Stream 2 pipeline was blown up.
00:06:37.820 That was a big deal.
00:06:38.960 This was a pipeline Biden had allowed Putin to complete.
00:06:42.140 And when it exploded with undersea munitions,
00:06:45.480 the Biden White House had a spin and their foreign policy talkers had a spin.
00:06:51.020 They said, Russia blew it up.
00:06:54.060 Now, I got to admit, Ben,
00:06:55.200 I always found that a weird talking point.
00:06:59.760 Sure.
00:07:00.980 Look, Putin's number one priority was to build the damn pipeline
00:07:04.140 in order to enable him to invade Ukraine.
00:07:08.040 Why would Putin blow up his own pipeline,
00:07:11.660 which is what gave him the ability to engage in the war
00:07:16.280 to reestablish and recreate the Soviet Union?
00:07:19.540 I always found that crap.
00:07:20.960 So, the alternative hypothesis was that the United States blew it up.
00:07:29.600 Seymour Hersh, who is a journalist who has done some good work,
00:07:34.440 but he engages in a lot of fantastical work
00:07:36.960 that has very questionable moorings to reality.
00:07:43.140 He wrote a long article arguing the United States blew it up.
00:07:46.260 I have to admit, I read Hersh's article,
00:07:48.380 and I was pretty skeptical of it.
00:07:50.460 And I was skeptical of it mostly because the Biden administration
00:07:54.000 lacks the spinal fortitude to do it.
00:07:57.700 It may well be in the United States' interest to blow the damn thing up,
00:08:01.880 but I didn't believe Joe Biden had the guts to give that order.
00:08:06.900 So, the Biden administration was saying Russia did it.
00:08:11.220 That always struck me as baloney.
00:08:13.360 Other people were saying maybe the United States did it.
00:08:16.160 That actually struck me as baloney as well.
00:08:18.380 I just don't believe Biden would be willing to do that.
00:08:22.260 My view from the day it happened is I said,
00:08:25.500 look, who benefits from this?
00:08:27.860 This is always a good analysis on foreign policy to ask who benefits.
00:08:32.120 The obvious player that benefits is Ukraine.
00:08:36.660 And so, my view on the day this happened is
00:08:38.920 the obvious player to have done this is Ukraine,
00:08:42.660 if, if, if, and this is a big if,
00:08:44.460 if they have the technological capability to do it.
00:08:48.580 And what I didn't know, and I don't know today,
00:08:51.140 is whether Ukraine had the ability to go nearly 300 feet underwater
00:08:57.520 and blow up that pipeline.
00:08:58.760 If they did,
00:08:59.840 it's a no-brainer that blowing up Nord Stream 2 benefits Ukraine
00:09:03.880 and hurts Russia.
00:09:05.340 This story in the Washington Post yesterday asserts that the CIA,
00:09:11.720 the Biden CIA had credible intelligence,
00:09:14.020 that Ukraine blew up the pipeline.
00:09:17.220 I don't know if that's true.
00:09:18.700 And I'm going to readily say I've had lots and lots of classified briefings
00:09:22.600 on lots and lots of topics.
00:09:23.840 I have had zero classified briefings with information on this question.
00:09:28.200 So, I don't have any specialized information on who blew it up,
00:09:33.720 whether it was Russia, whether it was Ukraine,
00:09:36.120 whether it was the United States, or whether it was someone else.
00:09:38.040 I don't know.
00:09:39.500 But I've read this Washington Post article,
00:09:41.680 and I know the incentives and who benefits.
00:09:46.120 And it strikes me as utterly plausible that Ukraine did this with the caveat
00:09:52.740 that I don't know if they had the technological sophistication to do it.
00:09:56.180 But if they did it, if they did have that capability,
00:09:59.580 I absolutely believe Ukraine would do it and would benefit from doing it.
00:10:04.140 And if that is true,
00:10:06.420 it means Joe Biden and the Biden White House lied to America over and over again
00:10:11.760 from the moment this happened.
00:10:13.280 Yeah, I want to ask you about the lies,
00:10:15.460 because the article, and this is the Washington Post,
00:10:18.180 that's implying that basically the President of the United States of America
00:10:21.220 willfully lied to the American people,
00:10:23.400 may have helped spur this war to get even bigger
00:10:27.040 while we were backing Ukraine.

00:12:03.480 They said, based on Pentagon documents, allegedly leaked onto Discord,
00:12:08.140 a European nation briefed the Biden administration that the Ukrainian military
00:12:12.120 had planned a covert attack on the undersea network using a small team of divers
00:12:16.660 who reported directly to the commander-in-chief of the Ukrainian Armed Forces.
00:12:21.520 Yet the president, knowing this, being briefed on this, told the American people,
00:12:26.360 Russia did this, he blamed Russia for this, and you talked about the lie here.
00:12:31.540 Why would he lie to us?
00:12:33.160 And why would he mislead the American people this way,
00:12:36.800 while also at the same time sending countless American tax dollars to Ukraine?
00:12:43.980 Well, listen, let me be clear.
00:12:45.620 I don't know for a fact that Biden was lying.
00:12:49.000 What I do know is their story never made sense.
00:12:51.500 Why would Putin blow up the pipeline that was integral to the Russian economies
00:12:59.740 being able to sell natural gas to Europe?
00:13:02.260 Why would Putin blow up the pipeline that enabled the invasion of Ukraine?
00:13:09.640 Why would Putin blow up the pipeline that Joe Biden had wrapped in gift wrap
00:13:15.120 and given him as a giant multi-billion dollar present?
00:13:19.260 And that capitulation is what caused the invasion of Ukraine.
00:13:23.700 It never made sense to me.
00:13:25.500 So, you know, I guess you could have some sort of sophisticated psyops
00:13:29.900 that he blows it and blows it up and maybe he figures it
00:13:33.520 weakens Europe's commitment to Ukraine.
00:13:37.740 I just, that seems so attenuated to me.
00:13:41.520 It sounds like baloney.
00:13:42.880 The Post also said that this was, they had a lot of details about the plan,
00:13:48.680 which had not been previously reported until now.
00:13:51.360 They were apparently collected by a European intelligence service.
00:13:54.420 They were shared with the CIA in June of 2022.
00:13:57.020 And they provided some of the most specific evidence to date,
00:13:59.820 linking the government of Ukraine to the eventual attack in the Baltic Sea.
00:14:04.460 Now, if that's true, Senator, and is there new questions that must be asked
00:14:10.100 about American aid going to Ukraine, or does that really have no bearing on that,
00:14:16.000 even if, in fact, they may have done this?
00:14:18.400 Look, I don't think it has bearing at all.
00:14:20.320 And, in fact, if Ukraine blew up the pipeline, I say good on Ukraine.
00:14:23.980 It's unquestionably in their national security interest it was the right thing to do.
00:14:29.660 To be honest, if Donald Trump were still president,
00:14:32.260 I think he may well have blown up the pipeline.
00:14:35.460 But I don't think the pipeline would have been built,
00:14:38.220 so I don't think he would have had to blow it up.
00:14:40.000 And I don't think there would have been a war on Ukraine.
00:14:41.960 Why?
00:14:43.080 Because, look, rewind to 2017-2018.
00:14:47.320 2017-2018, everyone in Washington said,
00:14:49.760 we can't stop this pipeline.
00:14:51.100 We're hopeless.
00:14:51.900 There's nothing we can do.
00:14:53.160 When I wrote the legislation, it was targeted sanctions legislation.
00:14:56.760 There was a specific company, the All Seas Company,
00:14:59.060 that was building the pipeline.
00:15:00.520 And I wrote the legislation that would bankrupt the company
00:15:05.420 if it continued building the pipeline even for a minute.
00:15:09.560 Now, amazingly enough, we passed this legislation December of 2019.
00:15:14.780 If you remember what else was happening in December of 2019,
00:15:17.360 the House of Representatives under Nancy Pelosi
00:15:20.320 was impeaching Donald Trump.
00:15:23.620 And not just impeaching Donald Trump,
00:15:25.700 impeaching him for conduct concerning Ukraine.
00:15:30.900 So I'm trying to pass legislation that is integral to Ukraine
00:15:35.260 in the middle of the House impeaching Trump
00:15:38.560 for Ukraine.
00:15:40.400 And I need bipartisan support.
00:15:42.260 To get this passed,
00:15:43.740 I had to get support from the chairman and ranking member,
00:15:47.720 so from the Democrat and Republican,
00:15:49.960 in the Senate Armed Services Committee,
00:15:51.820 in the Senate Foreign Relations Committee,
00:15:53.400 in the Senate Banking Committee,
00:15:54.580 and from Chuck Schumer and Mitch McConnell.
00:15:56.360 That's eight players in the Senate.
00:15:58.060 And I had to get support from the same eight players in the House
00:16:01.940 in the middle of this political bloodbath
00:16:05.780 over the first Trump impeachment on Ukraine.
00:16:08.860 And so, in hindsight,
00:16:11.080 it remains a friggin' miracle we got it done.
00:16:14.140 To be honest, part of the way I got it done
00:16:16.300 is I didn't mention the word Ukraine at all.
00:16:17.900 I'm like, Ukraine, never heard of it.

00:16:49.360 that, first of all, wanted the Treasury—

00:16:59.840 that would gut the sanctions.
00:17:01.680 And I ended up picking up the phone
00:17:03.600 and calling Trump's national security advisor,
00:17:06.120 Robert O'Brien, who was a good friend of mine.
00:17:08.520 Robert was in the NSC Christmas party at the time.
00:17:12.340 This is December 2019.
00:17:14.440 And I called over.
00:17:15.620 I said, pull Robert out of the Christmas party.
00:17:17.720 I need to talk to him right now.
00:17:19.680 And I told Robert, I said,
00:17:21.080 listen, this legislation is incredibly important.
00:17:24.340 There are forces that are not positive and beneficial
00:17:27.760 that are trying to get the White House
00:17:29.180 to give a signing statement
00:17:31.080 undercutting these sanctions.
00:17:32.260 I said, if y'all do this,
00:17:34.360 I'm going to go to the Senate floor
00:17:36.380 and light you up.

00:18:17.000 There was a big interagency battle.
00:18:20.200 Long and short of it is,
00:18:21.500 we won the interagency battle
00:18:23.060 and the people that were trying to get Treasury
00:18:24.720 to gut the sanctions lost.
00:18:27.400 I sent a letter
00:18:28.440 to the CEO of All Seas Corporation,
00:18:31.560 which was the company
00:18:32.220 that was building the pipeline.
00:18:34.120 And as you know, Ben,
00:18:34.940 I spent a lot of years practicing law.

00:18:37.720 Whether as Solicitor General of Texas
00:18:40.360 or in private practice,
00:18:41.460 I've represented a lot of clients.
00:18:42.800 I wrote a letter
00:18:44.560 that was designed,
00:18:46.700 and I'm going to give a technical legal term,
00:18:48.740 to make the CEO's sphincter
00:18:51.740 tighten so tight
00:18:54.200 that he could form coal into diamonds.
00:18:57.920 The letter said,

00:19:01.400 that this legislation,
00:19:02.920 which I drafted,
00:19:04.320 creates sanctions that are immediate,
00:19:07.200 that are non-waivable,
00:19:08.880 and that are fatal,
00:19:11.260 that are designed to destroy your company.
00:19:14.560 And if you care about shareholder value,
00:19:18.240 if you care about your executives,
00:19:19.820 if you care about your employees,
00:19:22.020 you will not continue to build this pipeline
00:19:25.500 for even 60 seconds
00:19:28.240 after the president signs this bill.
