00:02:43.260 The information was constantly changing about the Mar-a-Lago raid.
00:02:46.860 We were told initially it was over classified documents.
00:02:50.400 Then we were told it might be over nuclear secrets.
00:02:53.460 Then that kind of seemed to fall apart given the timing of the warrants and the raid
00:02:57.720 and the fact that we're already 18, 19 months into the Biden administration.
00:03:01.680 Now we've got the hindsight of one week.
00:03:04.580 Is there any justification for the raid?

00:03:09.040 What is really distressing, looking now at the warrant and what they were searching for,
00:03:16.000 this was a fishing expedition.
00:03:17.420 It was an old-fashioned fishing expedition.
00:03:19.920 I actually think it had little to nothing to do with classified documents.
00:03:24.520 What this was about was January 6th.
00:03:26.400 What this was about was the FBI and DOJ wanting to send in a team to say,
00:03:31.540 let's grab every piece of paper we can find, and maybe we'll get something incriminating.
00:03:35.560 And look, that's not a new thing for law enforcement to do.
00:03:38.840 Sometimes, you know, if you're going after Al Capone, you try to go after him on income tax evasion.
00:03:43.680 It's not new for law enforcement to try to find a hook.
00:03:48.080 And so the classified documents, the presidential records, they had a hook to say,
00:03:52.880 well, he may have brought a piece of paper or maybe multiple pieces of paper that we've asked for back.

00:04:03.080 I got to say, though, look, we have a long tradition in this country of a peaceful transfer of power.

00:04:32.420 When you send your troops in to raid the home of your predecessor, looking for evidence,

00:04:42.520 What I can tell you is in 200 plus years of our nation's history,
00:04:47.280 no president has ever done that to his predecessor.

00:04:52.340 Look, each of our presidents, when the party shifted,

00:05:03.420 But it's not like Jefferson said, all right, let's bust down the door of Adams' house and

00:05:11.840 Listen, it is certainly true that the laws apply to everyone, including former presidents.
00:05:18.020 And if they violate criminal laws, they should be held accountable.
00:05:24.580 That being said, when there's a specter of using the law enforcement machinery to target your enemies,
00:05:31.020 the threshold should be much, much higher.
00:05:33.280 It shouldn't be a ticky-tack crime.

00:05:37.260 It should be something that is exercised only when there is no alternative.

00:06:04.700 I think they're frustrated because their January 6th investigation is not getting anywhere.
00:06:09.780 And so they said, well, look, we got an excuse to go raid Trump.

00:06:18.880 That is an absolute abuse of power.
00:06:22.400 If they're going to say that Trump is Hitler, as they've been saying for years now,

00:06:31.120 And if that involves breaking some laws or if that involves abusing government power, well, who cares?

00:07:01.340 And I got to tell you, within the FBI, there are thousands and thousands of good and honorable law enforcement officers,
00:07:09.560 people who signed up to be cops, people who signed up to catch bad guys because they wanted to protect America and keep us safe.
00:07:15.180 And what is so infuriating is those FBI agents, their entire career and life is being cheapened,
00:07:26.740 is being undermined by these political hacks who are leading the Department of Justice and who are at the senior levels of the FBI.
00:07:34.500 I cannot think of anybody in modern times who's done more to damage the credibility of the FBI and the Department of Justice than Merrick Garland
00:07:45.980 because when he turns them into a nakedly political group of stormtroopers, it's not the agent's fault.
00:07:54.640 It's the politicized leadership's fault, and he is hurting the FBI and hurting the Department of Justice.
00:08:03.080 And it ought to scare the hell out of him.
00:08:05.300 Instead of lecturing people, how dare you say abolish the FBI?

00:08:16.680 And as you mentioned, they went in there with the charge to take pretty much everything they could.

00:08:24.980 They went in, they took Donald Trump's passports, for goodness sakes, two expired passports and his current diplomatic passport.
00:08:31.940 And then, of course, immediately CBS News denies this, says that Trump is lying about his passports.
00:08:37.400 And then five minutes later, the DOJ was caught with egg on its face.
00:08:40.880 They had to admit they did, in fact, take Trump's passports.
00:08:43.860 And then they returned them to him.
00:08:46.140 So now, of course, the line is the DOJ, the FBI never took Trump's passports, and don't worry, they gave them back.
00:08:52.540 All of this really, really reducing the credibility of the FBI and the DOJ.
00:08:57.960 And as you suggest, this isn't about classified documents.

00:09:04.460 This is about January 6th and the failure of the January 6th committee.
00:09:10.480 The Republican face, the nominally Republican face of the January 6th committee, Liz Cheney, is almost certainly going to go down in flames tonight.

00:09:20.600 All of the polls say she's going to be ousted from office.
00:09:24.120 So that's just not working.
00:09:26.100 There was also, Senator, I don't know if you saw a really interesting article in Revolver News about the pipe bombs on January 6th.
00:09:35.920 We've heard so much about the grannies that went into the Capitol.
00:09:38.680 We've heard so much about the Horn Hat guy.
00:09:40.500 We've heard so much from the J6 committee.
00:09:42.700 We haven't heard a whole lot about those pipe bombs.
00:09:44.840 And we don't really know who planted the pipe bombs.
00:09:46.960 And it seems like that would be pretty important when we're talking about that day.
00:09:51.080 This would be the nearest that you got to serious political violence on January 6th.
00:09:57.680 And yet we've heard nothing.
00:09:58.780 So there's a Revolver News report out that suggests that there are really more questions than answers when it comes to these pipe bombs.

00:10:07.420 Why the FBI isn't releasing footage of the people planting it to try to figure out who actually did it.

00:10:19.080 And then the strangest one of all you called out when you were grilling the FBI director, Christopher Wray,
00:10:25.040 which is that the former head of the Detroit office for the FBI, this guy, Stephen Dunn, I've got Dan Tuono is his name.
00:10:34.420 He was in charge of the operation to entrap people into trying to kidnap Gretchen Whitmer, the Democrat governor of Michigan.
00:10:43.100 And this was a complete cluster, didn't work.
00:10:46.940 The trial's going on right now.
00:10:48.180 It's just a complete mess for the FBI.
00:10:51.280 Shortly after that all fell apart, Stephen D'Antuono got a promotion.
00:10:55.560 He was brought over, this would be in the months before January 6th, to head up the Washington field office for the FBI.
00:11:01.700 This is one of the most prestigious posts you can have in the Bureau.
00:11:05.320 And so therefore, he's the guy that's overseeing the investigation into January 6th.
00:11:10.720 All of this has me scratching my head, Senator.
00:11:12.940 I know it had you scratching ears, which is why you grilled Christopher Wray.

00:11:18.620 And you got a lot of a lot of substance in that question.
00:11:20.980 So let me try to take it one piece at a time.
00:11:22.940 And let me say at the outset, it is interesting.

00:12:01.460 Look, the FBI and the Department of Justice should be focused on criminals.
00:12:07.520 It should be focused on people who commit crimes of violence.
00:12:11.100 We saw all during Antifa and Black Lives Matter riots where the federal government essentially turned a blind eye because many of the hyper-partisan senior leaders at the Department of Justice and the FBI,
00:12:25.520 even under Donald Trump, the burrowed-in career leaders who remained hard leftists, agreed with the politics of the rioters and the violent criminals and so gave them slaps on the wrist over and over again as they engaged in violent acts of terror,
00:12:42.880 firebombing police cars, looting stores, murdering officers because of the politics they disregarded violence.
00:12:52.680 On January 6th, Merrick Garland has claimed it is the largest and most significant investigation in the history of the FBI.
00:13:00.320 Like, holy crap, like, really?
00:13:03.240 Like, in the history of the FBI.
00:13:05.080 So more than 9-11, like planes flying into the World Trade Center, flying into the Pentagon, 3,000 people murdered.

00:13:13.840 And the reason it's more serious is because for them it's all about politics.
00:13:18.340 Who are they targeting?
00:13:19.180 They're targeting the little old ladies who were on the mall waving American flags, singing God Bless America.
00:13:25.100 They're targeting, ultimately, every American who voted for Donald Trump, who spoke out in favor of Donald Trump.

00:13:34.760 The White House sees it that way.
00:13:36.340 Just like the raid, the raid was a political persecution.

00:13:41.000 Now, you look at January 6th.
00:13:42.740 One action that on the face of it certainly appears to be a crime of violence and was an attempt at a serious terrorist attack are the two pipe bombs.
00:13:53.220 If pipe bombs had detonated on Capitol Hill, potentially killing dozens or more, that would have been a horrific act of violence.
00:14:02.900 Now, thankfully, neither pipe bomb detonated.
00:14:05.760 If you look at everything that transpired that day, you would think a multiple attempted bombing in the nation's capital
00:14:11.700 would be really high on the priority list of let's get someone that's trying to blow people up and murder people.
00:14:18.020 Like that, you know, between blow people up and murder people and little old lady waving a flag,
00:14:23.180 maybe blow people up and murder people would be a higher priority in any sane world.
00:14:27.920 We're now, you know, almost two years after the fact.
00:14:33.800 And we know nothing about the pipe bomber.

00:14:36.880 Apparently, the pipe bomber dropped the bombs off at 8 p.m. the night before.

00:15:34.220 The implication is that the pipe bombs were not actually planted by real criminals but were part of a fraud.

00:15:53.520 When law enforcement, A, doesn't make it a priority to target actual violent criminals and, B, answers no questions, has no transparency, and behaves as if they have no accountability, they shouldn't be surprised when they have no credibility and people don't trust them.
00:16:09.120 Well, and especially on this issue, Senator, of Stephen D'Antuono, I mean, to me, that's the craziest part of all.
00:16:15.280 Forget the fact that the timers on the bombs apparently were not functioning.
00:16:21.040 The timing wouldn't have made a whole lot of sense.

00:16:25.960 The very fact that a guy who we know led an entrapment campaign, a poorly orchestrated entrapment campaign, by the way, in Michigan, then becomes the head of the Washington field office.

00:18:20.540 And let's start out with what happened in Michigan.
00:18:22.720 So if you remember in the fall of 2020, right before a big election, the FBI breathlessly
00:18:30.460 announces that they've uncovered a plot to kidnap and murder the governor of Michigan, Gretchen
00:18:35.720 Whitmer.
00:18:36.420 Now, that's a big damn deal.
00:18:37.800 You're like, holy cow.
00:18:38.720 All right.
00:18:38.860 If you've got a plot to do that, like go prosecute those guys, throw them in jail a long
00:18:42.500 time.
00:18:43.200 Thank you, FBI, for like stopping criminals.
00:18:45.660 That's your job.
00:18:46.320 Now, I'll point out at the same time that that prosecution happened to perfectly align
00:18:54.460 with the political narrative of Joe Biden and the Democrats because these alleged criminals
00:19:00.040 were doing it because they were mad about Gretchen Whitmer's COVID lockdown policies.
00:19:04.980 And because Trump had criticized Whitmer, the whole narrative was, you know what?
00:19:09.360 It's Trump's fault.
00:19:10.500 See, any Trump supporter is a violent criminal.
00:19:14.140 Look, those guys are literally trying to kidnap and murder a Democratic governor.
00:19:18.580 So it fit the political narrative beautifully, which, by the way, the corrupt corporate media
00:19:22.640 got, ran with, danced, celebrated, said, see, unless you are a violent murderer, too, you
00:19:29.440 better vote for Joe Biden.
00:19:30.600 That was what it was all about.

00:19:32.540 Fast forward to the actual trial.
00:19:35.200 Four guys go on trial.
00:19:37.120 They're charged with various crimes all related to an alleged plot to kidnap and murder Gretchen
00:19:43.040 Whitmer.
00:19:44.140 At the end of the trial in federal court, the four defendants are convicted of zero counts,
00:19:51.660 nothing.
00:19:52.680 Two of them are acquitted across the board.
00:19:54.440 The jury comes back and says, not guilty, not guilty, not guilty, not guilty.
00:19:58.740 Two of them have hung juries.
00:20:01.240 So the juries can't agree.
00:20:02.940 And so they have mistrials declared.
00:20:04.240 So in the course of the trial, the prosecution gets zero convictions on anything.
00:20:11.560 Now, in any prosecution, that's a big deal.
00:20:16.280 That's a big, serious problem.
00:20:19.080 Prosecution wins almost every case they bring.
00:20:21.780 Typically, the prosecutors don't bring a case unless they can get you and they got the
00:20:25.200 evidence.
00:20:25.600 So it's unusual for the prosecution to lose.
00:20:28.820 But it's even worse than that.
00:20:30.280 Why did they lose?
00:20:31.580 Well, the principal defense.
00:20:34.500 From the defendants was entrapment.
00:20:38.640 It was that the FBI informants, people who are on the payroll of the FBI, who are working
00:20:43.640 for the federal government, that they were the ones that suggested the damn thing.
00:20:47.780 They were the ones that kept urging him to do that.
00:20:49.800 In fact, the defendants pressed back, said, hey, let's not do this.
00:20:53.880 This is a bad idea.
00:20:54.880 Let's let's not kidnap and murder the governor.
00:20:56.960 Gosh, your idea is interesting, but no, thank you.
00:21:00.300 And the FBI agents or the undercover informants kept saying, no, no, no, no, no, no, no.
00:21:04.960 We got to do this.
00:21:05.980 Really important, really important.
00:21:07.500 We kidnap her really important.
00:21:08.740 We murder her.
00:21:09.340 And that was the defendant's defense's arguments.
00:21:14.100 And apparently the jury agreed.

00:21:18.820 Now, for any law enforcement, look, there's a general line.
00:21:23.260 What are the rules governing undercover officers?
00:21:27.020 Law enforcement all the time has undercover officers.
00:21:29.740 You go in, you go into the mob, you go into a drug cartel, you have someone undercover
00:21:33.920 who pretends to be part of it, and you can gather evidence and that can be used in a
00:21:37.680 prosecution.
00:21:38.360 That's legitimate.
00:21:40.100 What is not legitimate, the line is you can't engage in entrapment.
00:21:44.700 You can't be the one who is the source, the genesis of the illegal conduct, that it is
00:21:52.740 an abuse of government power when they send an agent to you and say, hey, Michael, don't
00:21:58.780 you really want to steal that fancy watch from behind?
00:22:03.480 They can't go suggest to citizens they break the law.
00:22:07.820 The guy in charge.
00:22:11.280 So this was all run out of the Detroit field office, the guy in charge of it, Stephen D'Antuano.
00:22:17.520 This is one of the biggest scandals in the history of the FBI to lose a marquee front page, top
00:22:25.500 of the fold banner headline case because of misconduct by your office.
00:22:31.560 In any sane and ordinary and responsible law enforcement office, everyone involved would have been fired.
00:22:39.200 That's just like the level of scandal.
00:22:42.280 You didn't just screw it up.
00:22:43.480 It was your misconduct.
