00:08:00.720 And I know that beyond the cartoons and the puppets, you're actually bringing this fight to Capitol Hill to try to put some teeth in it to stop these mandates for five- and six-year-olds to get the Fauci ouchie.

00:08:48.220 I think we ought to empower parents, and I'll tell you, the arrogance of the left, look, when it comes to parents, we saw that play out in Virginia, where the same people who were saying, we, the government, are going to force your kids to obey whatever you think.

00:09:21.780 You know, I will say one of the people who got mad at me about this was Seth McFarlane, you know, the comedian who's a family guy, and he's funny as all get out, and he sent a tweet saying that Big Bird is smarter than Cruz, and so is Elmo, and the Cookie Monster, and Oscar the Grouch, and Animal, and he listed a whole bunch of others.
00:09:43.100 And, you know, I had to respond, and I said, look, last I checked, every one of those you listed are puppets, usually with someone's hand stuck up their rear end.
00:09:53.520 And so, and I said, listen, you're a really funny guy, and I'm sad to see you shilling for authoritarian tyrants who want to force kids to obey and take away health care choices from parents.

00:10:33.080 So do you think there's any chance that you could get some Democrats in the Senate or in the House to come along, come over and say, you know, no mandates for kids?
00:10:42.460 Or is the party line so strictly enforced that doesn't matter what happens in Virginia, they can't back down from it?

00:10:52.240 You know, we had a vote on vaccine mandates on the Senate floor where we voted to stop government funding for vaccine mandates for your job, that you shouldn't be fired if you decline to get a vaccine.

00:11:04.860 I mean, it was a complete party line vote.

00:11:09.180 They believe in government power and they don't think you have individual rights.

00:11:23.140 I'm hearing from doctors and nurses because they're firing thousands upon thousands of doctors and nurses because they're declining to get the COVID vaccine for various reasons.

00:11:39.540 You know, we're seeing every week.
00:11:41.040 It seems there's a new story about thousands of flights being canceled.
00:11:45.320 Southwest Airlines, American Airlines, United, one after the other, cancellation after cancellation.
00:11:50.880 And the corporate media is desperate to say it has nothing, nothing, nothing.

00:11:57.000 Absolutely nothing to do with the vaccine mandates.

00:12:04.840 I'm now the ranking member on the aviation subcommittee, the Senate Commerce Committee.
00:12:07.900 So I talk to aviation people a lot because I'm the lead Republican on all aviation issues.

00:12:17.080 I can tell you there are a whole bunch of them who are really upset about these mandates.
00:12:22.720 And what I'm hearing is that we're seeing sick outs and walk outs.
00:12:26.460 Now, the unions don't want to acknowledge that publicly because there there are negative legal repercussions that come from doing that.
00:12:33.720 But I think that's what's happening. And the media is desperate to have nobody acknowledge it.
00:12:39.360 And, you know, I got I got to say this weekend I was up in Chicago and I was speaking at an event that was called Freedom Fest.
00:12:47.440 It's about seven, eight hundred people there and was talking to them.
00:12:50.160 So I flew up there. Now, as I flew up there, this happens almost every time I fly now where people stop me, airline pilots, flight attendants, mechanics on airplanes.
00:12:59.800 They come up to me that they grab me by the shoulder. They say, Ted, thank you.
00:13:04.500 Keep fighting. It has gotten to the point now I almost can't get on an airplane without somebody coming up and saying that because they're facing.
00:13:13.300 I'm hearing every time I fly, someone saying I've been with airlines such and such for 10, 20, 25 years.
00:13:19.340 I'm losing my job. When I arrived in Chicago, I was greeted by Chicago cops.
00:13:25.620 And look, normally there's a police officer to that that is there to escort you.
00:13:30.580 In this case, it was, you know, seven or eight cops who were there.
00:13:34.380 And the Chicago cops, I love the Chicago cops.
00:13:38.040 They gave me two of their patches, Chicago Police Department.
00:13:41.320 And I've been speaking out loudly for the Chicago cops because the Chicago Police Union is fighting their idiot mayor.
00:13:50.220 Lori Lightfoot has a vaccine mandate.
00:13:52.800 According to the Chicago Police Union, a third of the Chicago police have refused to file their vaccination status.
00:14:00.120 And they're facing being fired.
00:14:02.220 Joe Biden was asked in a national town hall, what should Chicago do?
00:14:07.660 Should we should they fire a third of their cops?
00:14:11.200 And Biden said, yeah, fire them, fire cops.
00:14:13.860 I got to tell you, the speech I gave in Chicago, I told that story and I pulled out the patch of the Chicago Police Department.
00:14:21.460 I held it up and said, I am proud to stand with the men and women of the Chicago Police Department.
00:14:28.360 Every person in the room stood to their feet.
00:14:31.460 A long, rousing, standing ovation for those Chicago cops.
00:14:35.400 I told the press who were there, I said, why don't you guys cover this, that every person at the Chicago gathering stands with the Chicago cops.

00:14:46.100 And it's not just the Chicago cops.
00:14:47.840 There is a story out now that more than a third, something closer, I think, to 37 percent of truck drivers in the United States could resign or be fired.
00:14:57.840 But would would end up off the job amid a supply chain crisis as we're approaching the holiday season could could be a massive disruption to the economy.
00:15:06.600 Little Johnny won't get won't get his Christmas presents in time and there will be more serious consequences.

00:15:36.180 So there was a court decision, I believe, from the Fifth Circuit Court of Appeals that that pushed for a stay on the Biden vaccine mandate, saying we're going to figure out if this is constitutional or not.
00:15:49.680 In the meantime, you you can't force your your employees to take the vaccine.
00:15:54.740 The Biden White House has just come out today and said, never mind.
00:15:58.400 Forget about that.
00:15:59.760 Force your your employees to get the vaccine anyway.
00:16:02.480 It seems utterly lawless and at the very least extremely confusing.
00:16:05.960 So what are the workers supposed to do?
00:16:08.180 Yeah, look, lawless is is the right word for it.
00:16:10.620 If you look at the Biden vaccine mandates, there's there's four levels to it.
00:16:15.720 There's a mandate that applies to federal civilian employees.
00:16:20.440 There's a mandate that applies to fellow federal military, active duty military.
00:16:27.080 There's a mandate that applies to government contractors, anyone that does business with the federal government.
00:16:31.960 And then there's a mandate through OSHA that's supposed to be a health and safety regulation that applies to any employer with 100 or more workers.
00:16:42.360 All of those mandates are being challenged in court.
00:16:46.180 I think all of them are legally dubious.
00:16:48.620 The ones focused on federal employees are the most likely to succeed just because the federal government has a fair amount of leeway there.
00:16:56.240 But what's interesting is the litigation is succeeding against all of those different components.
00:17:01.900 You know, I got to tell you, I'm I'm also hearing from a lot of active duty military, from soldiers, from sailors, from airmen and Marines.
00:17:09.200 I've talked to to to to Navy SEALs.
00:17:13.140 You know, I was in the the Detroit airport and and a guy pulled me aside, said, said, I am a 10 year Navy SEAL.
00:17:21.360 I've given over 10 years of my life to defending this nation.
00:17:25.100 They are forcing me to get this vaccine.
00:17:27.020 He said, I'm going to quit.
00:17:27.660 And he said a bunch of the other SEALs who have put in years and years and years.
00:17:33.340 He said some of them who are at 14, 15, 16 years and, you know, you get your retirement in the military at 20 years.
00:17:39.380 He said those guys are ready to quit.
00:17:41.220 And so that dynamic is massive.
00:17:44.380 Now, there's been different litigation.
00:17:45.880 So, for example, the United employees have sued trying to stop the vaccine mandate for the airlines where they're getting hit is the government contractor aspect of it.
00:17:56.240 So so, you know, Southwest Airlines, the United States government is their single biggest customer.
00:18:03.120 All of the other airlines are customers.
00:18:06.680 The government is a customer to them.
00:18:08.420 And so they're really they're between a rock and a hard place because the federal government is threatening to withhold millions of dollars if they don't comply.
00:18:17.300 The litigation, the last I checked, the United litigation, there was a stay in place so that the employees had won the initial round.
00:18:25.600 The Fifth Circuit case you're talking about is a lawsuit that was brought against the OSHA regulation targeting employees, employers that have 100 or more employees.
00:18:35.720 And the Fifth Circuit, the Federal Court of Appeals, concluded that they had stated a strong initial case that there was a likelihood of success on the merits and a strong case of statutory and or constitutional violations.
00:18:48.920 The Biden administration is litigating this.
00:18:51.140 I've said from the beginning, the OSHA rule is going to be struck down.
00:18:55.480 It's going to be struck down as contrary to law.
00:18:58.180 I believe that is by far the most likely litigation outcome.
00:19:02.060 I also think, Michael, Joe Biden's lawyers do, too, that they've told the Biden White House we're going to lose in court.
00:19:09.400 But they've also said, look, litigation takes months, sometimes years.
00:19:14.820 It's slow.
00:19:16.000 And in the meantime, most people will comply.
00:19:19.500 And so, you know, if you watch at the White House press conference, when asked, so the Biden administration lost in court.
00:19:27.540 The Federal Court of Appeals stayed the order.
00:19:30.160 In other words, issued an injunction saying this order has no effect.
00:19:34.600 And the Biden deputy press secretary said, well, people should comply nonetheless.
00:19:41.180 Just shut up and obey.
00:19:43.880 Never mind the law.
00:19:44.940 That's that's really disturbing.
00:19:46.940 You know, I had the same gut reaction when President Biden made the announcement.
00:19:51.780 I said, I think that they're on shaky legal ground here, but they're just going to hope that everyone takes the jab and then it won't be a big deal.
00:19:58.780 Well, today, when when the White House came out and said, well, while this is working its way through the courts, comply anyway, I thought there's the proof.
00:20:06.280 There's the proof that, you know, you're not going to win in court.
00:20:08.620 So you're going to try to get your desired outcome before that all happens.
00:20:12.000 There's a ton of hypocrisy here, by the way.
00:20:14.300 And we've seen this from the beginning on the left and Democratic politicians not following their own mandates and their own health requirements.
00:20:22.680 And before we get to the mailbag, I can't I can't let us move on without bringing this up.
00:20:27.640 There was a ton of hypocrisy from left wing politicians who have just been at their climate change a palooza all week, the United Nations Climate Summit.
00:20:36.540 And it seems to me a fair number of them flew private jets on the way to save the world and stop the emissions.
00:20:45.380 Well, look, hypocrisy is something Democrats do a lot.
00:20:48.500 I got to say, by the way, let me start off by saying, what did the Scots do to piss us off so much that we caused all these people to descend upon them like locusts?

00:22:54.220 One of my colleagues, a Republican senator who's female, described being in the Senate gym and accidentally the door opened and seeing Schumer in his tighty-whities.

00:23:13.840 But look, Schumer, dancing away, no mask.

00:26:03.460 So, this past week, I was doing a press conference with a bunch of Republican senators talking about the environment,

00:26:19.720 And I talked about Kerry's hypocrisy on the jet, and I said, you know, last I checked,
00:26:25.960 none of us up here on this stage have a private jet.
00:26:28.780 Now, John Kennedy was one of the senators there, and Kennedy is ridiculously funny.
00:26:35.720 And Kerry deadpans goes, Portman does.
00:26:39.380 So, Rob Portman was behind me.
00:26:41.200 And it was funny.
00:26:42.700 And here's the funnier thing.
00:26:45.600 The media all believed Kennedy.
00:26:48.660 Fact-checked me.
00:26:49.540 ABC News wrote stories about how Cruz was fact-checked because Rob Portman has a private jet.

00:27:01.020 Kennedy was being funny as hell and a smart aleck.
00:27:04.640 So, actually, Portman and I spent the next day, like, fighting back these fact-checks

00:27:19.260 Portman doesn't.
00:27:20.100 But even if Portman did, he's not running around trying to impose rules on you that he's not obeying.

00:27:28.340 I feel very confident that Barack Obama, when he went to Scotland for his speech, did not fly commercial.

00:28:57.860 But what Barack Obama said was that it was the fault of rising nationalism that we weren't taking on this problem of climate change and we need to come together.

00:32:57.020 McAuliffe wanted to make this all about Trump, and then he thought that he would handily defeat

00:33:03.400 Youngkin realized, I think, one, that he is not a personality-driven candidate, right?
00:33:09.900 He is not quite the reality TV star of Donald Trump.
00:33:13.660 He is a standard conservative Republican of the sort that can win in Virginia.
00:33:20.100 And so he picked his issue very well.
00:33:22.920 He wasn't just running on tax cuts.
00:33:24.800 He wasn't just running on kind of ordinary chamber of commerce type issues.
00:33:28.540 He ran on a big culture war issue, which is education and whether parents have the right
00:33:33.820 to raise their kids and keep radical racial and sexual ideologies out of the classroom.
00:33:40.200 So I think that worked very well in Virginia.
00:33:42.380 I think the lesson more broadly for the GOP is we do need to lean into these cultural issues.
00:33:47.860 But you've got to be smart about it.
00:33:50.040 You know, I think if Glenn Youngkin had run on the campaign of overturning Obergefell and
00:33:58.440 getting rid of gay marriage, I don't think that would have been a culture war issue, but
00:34:01.980 I don't think he would have won in Virginia.
00:34:03.700 If Glenn Youngkin had run on a hardline immigration campaign, that would be a culture war issue,
00:34:11.400 but I don't think it would have won in Virginia.
00:34:13.420 So there is a little bit of savvy here that's required.
00:34:16.320 You need to be wise as a serpent and innocent as a dove.
00:34:21.100 And so it depends on what district you're in.
00:34:25.300 I mean, there are certain districts, I think, in this country where if you, certain states
00:34:28.680 even, but certainly certain districts, where if you ran on your great friendship with Donald
00:34:32.440 Trump, that would probably serve you very well.
00:34:34.200 But it wouldn't serve you very well in northern Virginia.
00:34:36.540 And so there is just an element of running a good campaign that you need to have here.
00:34:41.980 And if we're going to retake the country, I mean, it's a very conservative principle.
00:34:45.020 There's just not going to be a one-size-fits-all strategy.
00:34:47.520 You're going to have to tailor your message to the different constituencies and to the different
00:34:52.160 states and districts that you will be representing and not pretend that some solution that's going
00:34:58.680 to work for a Republican in California is going to be the same sort of thing that a Republican
00:35:02.680 in the middle of Texas is going to want.
00:35:05.160 Senator Cruz, you have the cactus sitting behind you.
00:35:07.680 So same question to you.
00:35:08.920 You, by the way, also started a culture war this week when you hit Big Bird for engaging
00:35:13.500 in propaganda about the COVID vaccine.
00:35:16.140 Well, listen, let me say a couple of things on that.
00:35:18.640 Number one, what, you know, Michael's answer a minute ago, I think there are a lot of Republicans
00:35:26.520 that behave as if they're wise as doves and innocent as a serpent.
00:35:32.920 They get it backwards.
00:35:36.500 You know, when it comes to Donald Trump, right now the Democratic playbook is scream Trump,
00:35:42.180 Trump, Trump, Trump, Trump.
00:35:43.600 So when you had the California recall, they made Larry Elder into Donald Trump.
00:35:48.660 Terry McCullough's strategy in Virginia was to say Glenn Youngkin is Donald Trump.
00:35:52.680 Well, look, he's not.
00:35:53.780 They're very different people.
00:35:55.460 I think that playbook is a one-dimensional playbook, and it's not very tethered to reality.
00:36:03.140 The flip side, though, I don't think Republicans should be running away from Trump.
00:36:06.140 I think we accomplished an enormous amount when Trump was president, and he's going to continue
00:36:10.240 to have a significant platform and a significant voice, and so we can acknowledge all the good
00:36:17.040 we did working together without having every election.
00:36:21.340 If you're debating, is Glenn Youngkin Donald Trump, that's really dumb.
00:36:25.980 Secondly, on culture war, it's worth remembering, listen, we're not waging a culture war.
00:36:33.400 It is the left that is waging a culture war.
00:36:37.200 They are attacking every institution of our culture.
00:36:40.980 They're tearing them down.
00:36:42.580 They're tearing our communities down.
00:36:44.140 They're tearing our families down.
00:36:45.500 They're tearing our children down.
00:36:46.800 They're tearing our churches down.
00:36:48.660 They are engaged in cultural jihad, and all we're doing is defending the culture.
00:36:59.740 So Terry McAuliffe stood up and said, we should not teach critical race theory to our kids.
00:37:06.460 We shouldn't be telling them that America is inherently racist and that all white people
00:37:11.820 are racist, and America was built on racial oppression.
00:37:16.960 That's not waging a culture war.
00:37:19.280 That's defending our culture.
00:37:20.900 That's saying American culture has value.
00:37:25.060 You know, when Terry McAuliffe says parents have no business saying what's taught in our
00:37:30.860 schools, he's waging a culture war.
00:37:33.540 Now, Republicans have a choice.
00:37:36.520 We can roll over and surrender our culture, and by the way, if we surrender our culture,
00:37:41.720 we surrender our country, or we can actually defend the Declaration of Independence.
00:37:47.880 We can defend the Constitution.
00:37:49.180 We can defend the Bill of Rights.
00:37:50.540 We can defend the Founding Fathers, not pretending that they were perfect men, not lionizing them.
00:37:56.820 Yes, they had faults.
00:37:57.940 Thomas Jefferson was a slave owner.
00:37:59.940 Slave owning is horrific.
00:38:02.100 He also laid out a vision for America of equality that ultimately resulted in abolishing slavery and
00:38:11.240 transforming the world.
00:38:12.680 And so we can defend our culture with honesty and facts, but, you know, I get irritated at
00:38:21.160 the press when they say we're waging a culture war.
00:38:24.600 We're simply defending America against Marxists who are trying to destroy our culture.

00:38:31.160 So this next question is kind of a long question, but I think it's worth asking.
00:38:35.560 It's a little bit edgy, which is something that I really like.
00:38:38.080 I like to hear both of you answer these questions.

00:38:42.380 It is from T. Sals, who asks, Republicans, including Senator Cruz, seem to be carrying on
00:38:49.460 as if the 2020 election was like all other elections.
00:38:52.860 They're focusing on 2022 and expect to win back seats that they lost.
00:38:57.300 How do we know that all of the mailed out ballots, not the absentee ballots, connect with a real
00:39:03.120 live legal voter?
00:39:04.720 I want to be convinced that Biden and the Democrats won in the close elections, but I am not there.
00:39:09.500 The alternative that they beat the system is frightening.
00:39:12.140 And if true, should make election integrity the number one, if not only priority for Republicans
00:39:16.580 right now.
00:39:17.400 The fact that really bothers me is this.
00:39:19.220 If we counted all the votes as we have done it before in person and absentee ballots, Trump
00:39:24.200 wins.
00:39:24.640 If we add in the very abnormal mail-out ballots, then Biden wins.
00:39:29.900 I don't want to be a conspiracy theorist, but it seems like it would not be too hard to
00:39:33.400 manipulate that kind of vote.
00:39:35.160 Senator, you first.
00:39:37.100 So listen, those concerns are real and they're concerns I hear all across Texas and all across
00:39:42.800 the country.
00:39:44.580 When it comes to voter fraud, my view is that the two extremes, neither one of them is right.
00:39:49.980 There are right now those in the corporate media and Democrats who say there is no voter
00:39:56.140 fraud.
00:39:56.460 It doesn't exist.
00:39:57.300 It's the big lie.
00:39:58.860 Well, that's a load of crap.
00:40:00.400 That's simply not the case.
00:40:02.240 On the other hand, it's not the case that there is such widespread voter fraud that every
00:40:07.960 election is rigged and we can never have a real election.
00:40:11.200 That's not true either.
00:40:12.020 The reality is democracy is messy.
00:40:15.300 Voter fraud has been part of elections.
00:40:19.040 As long as people have been voting, there have been people stealing votes.
00:40:23.040 Should we fight against it?
00:40:24.460 Absolutely, yes.
00:40:25.580 I've spent 30 years fighting against voter fraud and we need to fight for strong election
00:40:32.280 integrity legislation.
00:40:33.960 Now, what do we do in 22 and 24?
00:40:38.740 There's a shift and it's a shift that has happened in the last couple of years.
00:40:42.580 It used to be a few years back that you would get some modicum of bipartisan agreement that
00:40:49.020 we want safe and secure elections and we should have reasonable ballot integrity provisions.
00:40:54.780 That used to be possible that you could work together, Republicans and Democrats.
00:40:59.000 That has changed and it's changed because Democrats have decided, I believe, that voter fraud benefits
00:41:07.320 them, that it's good for them politically.
00:41:09.400 And so right now today, in the United States Congress, you get zero, not a single Democrat
00:41:14.400 willing to work in any way on any positive element of election integrity.
00:41:19.240 That's true in the Senate.
00:41:20.400 There are zero Senate Democrats and I think it's true in the House.
00:41:23.080 I don't know of any House Democrats.
00:41:25.800 What does that mean for 22 and 24?
00:41:28.020 Well, it means in red states like Texas or Georgia or Florida, you're going to see the
00:41:33.820 legislatures there passing reasonable common sense voter integrity laws.
00:41:37.640 That's good.
00:41:38.320 I support that.
00:41:39.200 I salute them for doing the right thing.
00:41:41.960 In blue states, you're not.
00:41:44.100 In states that have Democratic governors or Democratic legislatures, they're not going to pass good
00:41:49.500 legislation in the next two years or four years.
00:41:51.880 On the federal level, as long as Pelosi and Schumer are running the two houses, the chances that
00:41:56.800 Congress passes good voter integrity law are zero.
00:42:00.940 The Democrats don't want it.
00:42:02.940 So what's our answer?
00:42:05.000 The answer, the good news is election fraud historically only matters when it's close,
00:42:11.400 when it's on the margins.
00:42:13.240 If it's a close election, absolutely election fraud can take and switch the results.
00:42:20.060 The answer is what we saw last week in Virginia, which is in 22 and 24.
00:42:26.200 We've got to win by a big enough margin.
00:42:28.360 They can't steal it.
00:42:29.440 Was there voter fraud in Virginia?
00:42:30.900 Sure.
00:42:31.600 Was there voter fraud in New Jersey?
00:42:33.080 I'm sure there was.
00:42:34.260 But if we win by a big enough margin, you can overcome the fraud.
00:42:37.920 And that may not be fair.
00:42:39.060 But listen, we have two options.
00:42:42.380 We either win by a lot.
00:42:45.180 Or we give up on a country and I'm not willing to give up on the country.
00:42:49.480 But that's that's the reality.
00:42:51.740 If we're sitting there waiting for Democratic legislatures to change the laws to protect
00:42:56.760 ballot integrity, we will wait until hell freezes over.
00:43:00.080 So the only answer is go in and beat them.
00:43:03.280 And that's exactly what we did in Virginia.

00:43:10.780 It's also worth pointing out when people talk about should we go back and just constantly
00:43:15.340 focus on 2020?
00:43:16.540 I mean, there has been a lot of inquiry into 2020 and there has been the discovery of
00:43:20.740 shenanigans and fraud and and election practices that appear to be in violation of the state
00:43:26.760 constitution, at least up in Pennsylvania.
00:43:28.620 But then you look back and you think 1948, there's a young fella by the name of Lyndon Johnson
00:43:35.020 from Senator from your your state.
00:43:38.500 And that fellow, Lyndon Johnson, he stole a Senate seat.
00:43:42.620 He stole it and he stuffed a bunch of ballot boxes and he actually joked with top Democrat
00:43:47.800 officials.
00:43:48.420 FDR, this was on an earlier race.
00:43:50.220 They joked about sitting on the ballot box and it went up to the Supreme Court.
00:43:53.820 The Supreme Court wouldn't hear it sound familiar.
00:43:56.560 And Lyndon Johnson goes and he gets a Senate seat.
00:43:59.240 Then he gets picked to be vice president.
00:44:01.100 Then he becomes the president.
00:44:02.520 Then he leaves the presidency, does what he does.
00:44:05.480 Then he dies.
00:44:06.540 And then in 1990, a writer named Robert Caro laid out the strong case that he had stolen
00:44:11.660 that seat.
00:44:12.420 Well, what a great moral victor.
00:44:13.760 Are we going to are we going to go back and fight the 1948 Senate race?
00:44:17.460 No, you can't.
00:44:18.400 You can't do that.
00:44:19.320 He got away with it.
00:44:20.560 And sometimes these things happen.
00:44:22.180 And so, Senator, to your point, I just I think it's so pragmatic and realistic.
00:44:26.640 You've just got to deal with the realities on the ground and win and just win the next
00:44:33.420 election so that you can make the changes that you want.
00:44:36.380 And it's very encouraging to see in Virginia.
00:44:38.700 Apparently, at least, we can still win elections as conservatives and Republicans.
