00:00:46.760 circumstances that unfolded in Georgia with Lake and Riley.

00:03:59.500 As the audio from this trial came out, I was sitting in New York City on set.
00:04:05.940 It outnumbered right when they went live.
00:04:09.120 And the 911 call, as well as the body cam audio from the officer, was stunning.
00:04:18.260 It was shocking.
00:04:19.280 It made me angry.
00:04:20.840 It made everybody on set just furious and so sad that Lake and Riley fought for 18 minutes
00:04:28.400 to try to save her life.
00:04:29.740 This is a situation that never should have happened because this person should have never
00:04:34.220 been in the United States of America.
00:04:35.520 And it was because of the Biden-Harris policies that this monster was able to take her life.
00:04:41.260 Well, that's exactly right.
00:04:45.040 And it was heartbreaking as Lake and Riley's mom wept in court, listening to the 911 call.
00:04:52.680 18 minutes, 18 minutes that Lake and Riley fought.
00:04:55.860 She fought to avoid being raped.

00:04:59.720 And tragically, at the end, this monster, this murderer, bashed her head in with a rock.

00:05:22.360 of the trial that really laid out the tragedy of what unfolded.
00:05:27.120 Dana, it was really hard to listen to that opening statement from the prosecutor, the
00:05:32.800 condition that Lake and Riley's body was found in the fact that her Garmin watch tracked the
00:05:37.600 very moment her heart stopped.
00:05:40.040 I can only imagine being her family.
00:05:41.960 I think this just shows why we as a network made it such a priority to cover the border
00:05:48.280 so much these last few years.
00:05:50.040 These mass catch and release policies, they have consequences, real world consequences
00:05:55.580 that affect real people, particularly when it comes to the mass catch and release of Venezuelan

00:06:02.900 I mean, how many live shots were we doing together in 2022, 2023, hundreds of them in Eagle
00:06:08.280 Pass, in El Paso, watching these lines of hundreds of upon hundreds of Venezuelan men just
00:06:14.500 walking into the country single file every day, not running, not hiding, very nonchalant
00:06:21.960 because they knew they were going to be released into the country with a court date potentially
00:06:25.860 years away.
00:06:27.200 And the problem with that is you can't vet Venezuelan men.
00:06:31.660 Venezuela does not cooperate with the U.S.
00:06:33.720 We have no database, no records to run their names against.
00:06:37.220 So what you're listening to right now with this horrible case with Lake and Riley, unfortunately,
00:06:41.960 it's not even an isolated incident.
00:06:43.720 What happened just a few months later, Jocelyn Nungary was murdered in Houston, a 12-year-old
00:06:49.060 girl allegedly sexually assaulted and murdered at the hands of two Venezuelan illegal aliens
00:06:55.220 who had been caught and released at the Texas border just weeks prior.
00:06:59.640 Sound familiar?
00:07:00.940 Unfortunately, it's been happening all over the country, whether it's Trende Aragua setting
00:07:05.840 up footholds across the country, migrant crime happening in different cities across the country.
00:07:10.620 The idea that what happens at the border stays at the border ended a long time ago.
00:07:15.960 You look at Rachel Morin, she was murdered in Maryland.
00:07:21.300 You look at Lake and Riley, that happened in Georgia.
00:07:24.300 Jocelyn Nungary was in Houston.
00:07:26.400 These catch and release policies affect the entire country.
00:07:29.660 And say what you want about Donald Trump and the way he campaigns, but at his rallies, he
00:07:34.300 wasn't bringing celebrities up on stage.
00:07:36.060 Who was he bringing up?
00:07:37.300 Jocelyn Nungary's mom, Rachel Morin's mom.
00:07:40.100 Real people who suffered horrible, horrible, horrible consequences as a result of these catch

00:08:06.840 The question that so many people have after hearing that, Senator, is how much longer is
00:08:11.620 this going to happen?
00:08:12.240 Because we're even hearing reports of surges of illegal immigrants that may be trying to
00:08:16.940 get across before Donald Trump takes office, and this is because they still refuse to act
00:08:23.200 at the White House.
00:08:24.520 Well, Joe Biden, Kamala Harris, they want every illegal alien possible to come into this country
00:08:29.060 between now and January 20th, because they look at every one of them as a future Democrat
00:08:34.160 voter.
00:08:34.560 And, you know, the trial of Lakin Riley's murderer, where they played the 911 call, they
00:08:42.460 went through the timeline.
00:08:43.540 And one of the things, Lakin Riley, she wasn't killed at 2 in the morning.
00:08:48.180 She was killed just after 9 a.m.
00:08:50.760 She left her home jogging on the University of Georgia campus at 9.03 a.m.
00:08:57.500 She was seen at 9.05 a.m. jogging with her cell phone in her hand.
00:09:01.600 And then at 9.11 a.m., she called 911 while running.
00:09:07.260 And there was a minute-long recording where you can hear a male voice.
00:09:15.720 And the jury heard the operator repeating herself, saying, Clark County 911, hello, Clark
00:09:21.500 County 911, can anyone hear me?
00:09:24.580 The call ended at 9.12 a.m.
00:09:26.800 And if you can imagine, Riley's mom listened to that in court.
00:09:35.100 The suspect didn't even, his face didn't move.
00:09:39.820 He had no reaction.
00:09:41.700 As he listened to what happened, and the prosecution laid out that this murderer was, quote, hunting
00:09:50.100 for females on the campus when he came upon Riley.
00:09:54.680 And here's what the prosecutor said to the jury.
00:09:58.300 She said, quote,
00:09:59.500 When Lakin Riley refused to be his rape victim, he bashed her skull in with a rock repeatedly.
00:10:08.120 The evidence will show that Lakin fought.
00:10:11.160 She fought for her life.
00:10:13.260 She fought for her dignity.
00:10:15.160 And in that fight, she caused this defendant to leave forensic evidence behind.
00:10:20.180 She also marked her killer for the entire world to see.
00:10:26.520 I've got to say, the tragedy of what happened to Lakin Riley, the tragedy of what happened
00:10:33.220 to Jocelyn Nungary, the tragedy of what happened to Rachel Moran, the tragedy of what has happened
00:10:37.840 over and over and over again, all of this was preventable.
00:10:42.140 But we can at least take solace that we will see crimes like this begin to be prevented on
00:10:52.800 January 20th.
00:10:54.140 You mentioned January the 20th, and obviously that's coming soon, not soon enough.
00:11:00.300 But is there no change of your colleagues that realize what this election was about in D.C.,
00:11:08.880 where they say, hey, guys, maybe we want to get ahead of this.
00:11:12.020 Maybe we really, really misread this with the American people.
00:11:17.200 Maybe we should start now and not just allow for these open borders.
00:11:22.160 Or is this just the official policy of the Democratic Party that we are always open borders

00:11:52.400 one of the very first bills that we vote on be the Justice for Jocelyn Act, the law
00:11:57.760 that I've introduced that mandates that when illegal immigrants are detained, that they
00:12:02.740 be kept in detention, that they not be released as long as there are detention facilities there
00:12:07.660 for them.
00:12:08.020 I'd like to see that vote early on and put every Democrat on record, and we'll see.
00:12:13.240 Maybe they look at these election results and say, okay, we've got to change.
00:12:18.300 Or maybe they don't.
00:12:19.140 Maybe they dig in and say, we don't care, and we're going to keep doing the same thing

00:13:18.160 entered the country illegally back in 2022.
00:13:22.620 There's a timeline.
00:13:24.400 And we knew that this person was in the country illegally, and yet we kept allowing him to

00:13:32.060 Shannon, I want to just remind everybody, how did Jose Eberra get here, and how did we
00:13:35.680 get to this point?
00:13:36.340 So, in September of 2022, he crossed illegally on the west side of Texas in El Paso.
00:13:42.280 He makes his way all the way to New York, and that was in September of 2023.
00:13:47.660 As we've seen, a pattern, arrested in New York City then, but let go.
00:13:53.700 Makes his way down to Georgia.
00:13:55.660 And in October 2023, he was cited for shoplifting.
00:13:59.080 Okay, that's crime, but he's let go again.
00:14:01.560 And in February of 2024, this is the date where he is charged with the killing of Laken Riley.
00:14:08.880 So, I was just looking at the bigger picture, Shannon.
00:14:10.740 Well, under President Trump, these are the types of numbers you're looking at for ICE removals
00:14:15.340 of illegal immigrants who, for whatever reason, were in the country illegally, but also criminals
00:14:21.860 that were in the country illegally.
00:14:22.940 Then you look at the Biden administration, and those are the numbers, and that's one
00:14:26.840 of the reasons you see this number, Shannon, which I think is amazing.
00:14:30.120 Immigration being the most important issue, either overall, and in Georgia, 20%, 18%.

00:14:36.900 In 2020, it was 3%, 4%.
00:14:39.480 And so, something happened, I think we all know what it was, which is the change from

00:15:18.900 The first time he was apprehended was in 2022 in El Paso, Texas, and Joe Biden and Kamala

00:15:57.140 And the good news, you know, people wonder, well, how does this change so quickly?

00:16:03.860 Well, look, on January 20th, we're not going to build any new wall on January 20th.
00:16:10.820 We're not going to likely hire any new Border Patrol agents.
00:16:13.760 So you wonder what can change so quickly.
00:16:16.720 And what can change so quickly is a simple policy decision.
00:16:21.080 On January 20th, I am absolutely certain that Donald Trump will instruct the Border Patrol,
00:16:25.960 catch and release ends now.
00:16:29.500 If you apprehend someone, you detain them and we deport them.
00:16:34.120 And the thing to understand, not only does that mean the first step in the timeline of the Lake and Riley murderer ends,
00:16:41.160 because they never let him go in 2022, but it also means the numbers plummet because everyone who comes,

00:16:51.640 So on January 20th, and by the way, people are going to know this on January 10th.

00:19:29.460 As this race has tightened, and there are a lot of people that are just straight up saying now,
00:19:36.240 at this point, the Democrats are trying to steal an election in Pennsylvania.
00:19:40.200 They're looking at the Democrats trying to violate the rule of law and undermine the electoral process
00:19:47.560 as the new accusation.
00:19:49.400 Because of the ballots, they're now allowing to, in essence, be counted.
00:19:53.160 This seems very confusing, but also the game plan that you would expect from the Democrats right now.
00:19:59.620 Well, understand right now that Democrats are actively trying to steal an election in Pennsylvania.

00:20:09.420 The AP has called the race.
00:20:10.760 Bob Casey, the incumbent Democrat, has lost.
00:20:13.580 Bob Casey doesn't want to concede.
00:20:15.060 Apparently, Bob Casey and Chuck Schumer are election deniers.
00:20:18.580 They don't like the results.
00:20:19.640 They brought in a guy named Mark Elias.
00:20:21.200 Mark Elias is the top Democrat litigation attorney for elections in the country.
00:20:27.400 Mark Elias' job is to try to steal elections, to try to get illegal votes in, to try to get Democrats to win, no matter what.
00:20:36.160 I'm going to do something that I rarely will do on verdict.
00:20:40.260 I'm just going to read from the New York Times.
00:20:43.480 The New York Times is not a paper that I respect.
00:20:46.780 It often is profoundly dishonest.
00:20:49.000 But when the Democrats are too extreme for the New York Times, that tells you something.

00:20:57.400 In Pennsylvania, the election litigation continues with a twist.
00:21:02.320 As a Senate recount plays out, at least four counties are ignoring an order from the state Supreme Court that undated or misdated mail ballots cannot be counted.
00:21:14.260 And the article begins.
00:21:15.900 In an election defined in part by a tsunami of litigation before the polls even opened,
00:21:20.100 few states saw as much legal haggling over which ballots should count as Pennsylvania.
00:21:24.160 The polls have long since closed, yet a new round of litigation is flooding the recount battle between Senator Bob Casey, a Democrat,
00:21:31.220 and Dave McCormick, his Republican challenger, who currently leads by around 21,000 votes, a margin rarely overtaken by a simple recount.
00:21:40.300 The landscape, however, in at least four counties, Bucks, Philadelphia, Center, and Montgomery, local election officials are acting in open defiance of a ruling from the Pennsylvania Supreme Court that arrived weeks before the election.
00:21:57.900 The court found that mail ballots that are missing the date on the outer envelope or that have the wrong date cannot be counted for this election.
00:22:06.320 The Bucks County Election Commission felt differently.
00:22:08.780 Quote,
00:22:09.920 It's a pretty stupid thing to not count someone's vote simply because they didn't date an envelope for a ballot, said Robert Harvey Jr., the chairman of the board and a Democrat who's desperately trying to steal the election.
00:22:21.220 That last part is me editorializing.
00:22:24.000 During a meeting on Tuesday where the board voted two to one to count 405 ballots with date errors on the envelope,
00:22:31.260 He added that election officials know when ballots were printed for voters, making the outer envelope date requirement meaningless.
00:22:38.500 The law needs to be changed, Mr. Harvey said.
00:22:41.640 The commissioners were advised that they were likely to be sued no matter how they ruled.
00:22:45.440 So we're going to get sued either way.
00:22:47.140 I'd rather be on the side of counting ballots than not counting them, Mr. Harvey said.
00:22:51.760 So you have four counties that are battling the state Supreme Court,
00:22:58.580 that are refusing to follow the state Supreme Court.
