00:00:37.520 from deep fakes that are targeting more and more kids.

00:01:50.460 where, say, you have a boyfriend and girlfriend,
00:01:52.320 and they take explicit pictures of each other,
00:01:54.500 they take explicit videos of each other,
00:01:56.400 and then they have an ugly breakup.
00:01:58.280 And one or the other is pissed off,
00:02:00.420 and they say,
00:02:00.960 all right, I'm going to stick it to you,
00:02:02.160 I'm going to put these pictures,
00:02:03.260 I'm going to put these videos out online,
00:02:05.540 and the whole world is going to see you.
00:02:07.200 And I've got to say,
00:02:08.020 that is wrong.
00:02:08.940 It is a grotesque violation of your rights,
00:02:12.080 of your privacy,
00:02:12.840 and it's a problem we're seeing growing more and more.
00:02:16.160 There's a new iteration of it
00:02:18.060 that is a product of technology,
00:02:21.500 which is now, with artificial intelligence,
00:02:24.300 you can create deepfakes,
00:02:26.880 where you can create images or videos of real people
00:02:30.480 that appear to be real,
00:02:32.140 and they're entirely fake.
00:02:33.400 And we are seeing the prevalence of deepfake,
00:02:37.700 non-consensual intimate images,
00:02:40.300 it has grown 3,000% last year.
00:02:44.120 Over 90% of the victims
00:02:45.520 are either women or teenage girls.
00:02:48.600 And I'll tell you how this issue
00:02:50.460 first came to my attention.
00:02:52.280 It came from a Texas girl
00:02:55.540 who was targeted by this,
00:02:56.880 a girl named Elliston Berry,
00:02:59.720 who last year, she's 15 now,
00:03:01.600 last year she was 14,
00:03:02.880 she was in ninth grade,
00:03:04.280 and she woke up one Monday morning,
00:03:06.240 and her phone started blowing up.
00:03:08.020 And all of her friends let her know
00:03:10.240 that a classmate of hers,
00:03:13.320 a boy in her class,
00:03:14.260 had taken what was a perfectly innocent picture of her
00:03:17.860 on social media,
00:03:19.200 and used an AI app online
00:03:22.800 to create deepfakes,
00:03:24.660 and he created what appeared to be
00:03:26.360 naked pictures of her.
00:03:27.840 Now they weren't,
00:03:28.660 but you couldn't tell from looking at them,
00:03:30.120 and then he sent them
00:03:31.520 to every one of her classmates.
00:03:33.060 So this poor girl,
00:03:33.940 look, it's hard to be a teenager,
00:03:36.000 it's hard to be a teenage girl,
00:03:37.540 but if you could imagine the nightmare
00:03:39.160 of every one of your classmates
00:03:40.480 thinking they're looking at naked pictures of you.
00:03:42.800 She woke up,
00:03:43.660 she was in tears,
00:03:44.580 it was horrifying.
00:03:46.560 And what happened,
00:03:48.440 she's a Texan,
00:03:50.040 so she and her mother,
00:03:51.540 Anna,
00:03:52.880 called my office
00:03:53.840 and complained to me.
00:03:54.760 They said,
00:03:55.160 look, can you help us?
00:03:56.320 You're our senator,
00:03:57.140 can you help us?
00:03:58.400 And I gotta say,
00:03:59.200 my team did a great job
00:04:00.400 that they elevated it to me
00:04:01.860 and put this in front of me
00:04:02.780 and said,
00:04:03.080 look, isn't this horrible
00:04:04.040 what happened to this girl?
00:04:05.900 And we actually drafted legislation
00:04:08.140 to address this problem
00:04:09.540 because as we looked at it,
00:04:10.820 it was becoming more and more common.
00:04:12.920 And the Take It Down Act that I wrote,
00:04:14.840 it does two things.
00:04:16.280 Number one,
00:04:16.880 it makes it a crime,
00:04:18.340 a federal felony
00:04:19.560 to post non-consensual intimate images,
00:04:22.360 either real images
00:04:23.440 or deepfakes
00:04:25.300 that made through AI.
00:04:27.240 And to be clear,
00:04:28.160 that's where this has real teeth.
00:04:30.900 You just said it is a felony.
00:04:32.660 Yes,
00:04:33.200 a felony with jail time.
00:04:35.160 And a number of states,
00:04:36.380 including Texas,
00:04:37.720 have criminalized revenge porn,
00:04:40.400 but a lot of those states,
00:04:43.440 they don't address deepfakes
00:04:45.200 because deepfakes are new
00:04:46.660 and so it's a hole in the law.
00:04:49.200 So part of what Elliston discovered
00:04:50.720 in Texas is there was nothing
00:04:51.960 she could do about it.
00:04:52.820 This kid could send out these pictures
00:04:54.640 and there was no consequence at all.
00:04:57.760 So number one,
00:04:58.760 it makes it a crime.
00:05:00.200 But number two,
00:05:01.500 there is a persistent problem
00:05:03.040 that the tech platforms
00:05:04.600 won't take this garbage down.
00:05:06.100 And in fact,
00:05:06.800 when I introduced the legislation,
00:05:09.060 Ellison or her mom came to D.C.
00:05:10.680 I sat down with them in my office.
00:05:13.000 And when they sat down with me,
00:05:14.680 I asked them,

00:05:30.900 and repeatedly tried
00:05:31.820 to get them taken down.

00:06:06.680 they have to take the pictures

00:06:09.640 immediately.

00:06:12.460 with Amy Klobuchar,
00:06:13.580 a Democrat in the Senate.
00:06:14.780 We passed it through the Senate
00:06:16.480 100 to nothing.
00:06:18.260 We did it in the last Congress,
00:06:19.900 but unfortunately,
00:06:20.720 the House didn't get it passed.
00:06:22.360 So this Congress,
00:06:23.320 we passed it again.
00:06:24.720 And then one thing
00:06:25.460 that was really terrific,
00:06:26.440 the First Lady,
00:06:27.100 Melania Trump,
00:06:28.240 got actively involved.

00:06:35.480 with other victims
00:06:36.960 of this growing problem.

00:07:18.580 in prison for offenses
